Abstract Once widespread throughout the Costa Rican lowlands, Ara ambiguus ambiguus (Great Green Macaw) and Ara macao cyanopterus (Scarlet Macaw) were considered rare and locally extinct, respectively, in the Tortuguero area of northeastern Costa Rica until 2014. In 2017, Caño Palma Biological Station staff began weekly macaw surveys at five look-out points in the region. Surveys were carried out from January 2017 to June 2021 to identify and count all macaws sighted. The answer to that question is based on two administrative law doctrines: Chevron and Brand X. Here, I explain why Chevron and Brand X violate the Administrative Procedure Act and are unworkable. The inclination of theorizing literary works published in the Diaspora and in the post-colonial period, that has been observed recently tends to turn the investigation of the main components of literary works into a side task. Sudanese writer Leila Aboulela’s work can be considered one of the examples of such pieces of work. The novel is based on existential alternatives which are experienced by Sudanese women living with Muslim values in western society. The America Invents Act (“AIA”) introduced a prior user defense into the U.S. patent system. Although this defense exists in most world patent systems, the AIA version—replete with ambiguities and exceptions—raises several interpretive problems. This Article provides a detailed analysis of this novel AIA provision in the context of legislative history and global experience, and argues for the clarification and expansive interpretation of several ambiguous terms designed to prevent the statute’s negative impact on individual inventors.
