Battered woman’s syndrome has become highly controversial, particularly when used as a defense in cases of homicide. According to legal scholars and social scientists, the characteristics associated with the syndrome constitute a standard that jurors use to evaluate battered women. This study evaluated the hypothesis that jurors use prototypical standards of battered women to reach conclusions about defendants in these cases. Results supported the hypotheses that verdicts are directly influenced by typicality and response history (passive vs. active) of the defendant. Defendants portrayed as atypical with an active response history received more guilty verdicts and were less credible. Conversely, typical defendants with passive response histories were most likely to receive verdicts of not guilty and found to be more credible. Traditional gender effects showed men were more likely than women to render guilty verdicts in all conditions.

Interviews were conducted with forty-two women with extensive abuse histories who had killed their intimates and fifty-nine women with similar abuse histories who were in shelters for battered women. Controlling for demographic and other differences, analyses indicated that alcohol and other drug use ably distinguished between the two groups of women (correctly classifying 89% of the cases), and that alcohol use was more salient than other drug use. The partner's alcohol use and the respondent's alcohol use were significantly higher among the intimate homicide group, suggesting an association between intimate homicide and alcohol use. Alcohol counseling should, therefore, be a significant part of programs for both battered women and for men who batter.

The present study investigated the issue of domestic violence in Thailand and in particular the reactions of the Thai populace (male versus female) to a battered woman who killed her abusive spouse, as well as how such reactions could be influenced by the presentation of expert testimony related to the battered woman syndrome. Cluster sampling conducted within the Bangkok metropolitan area in Thailand yielded a sample of 1190 participants who voluntarily filled in the study’s questionnaire. Multi-group path analysis showed no significant gender difference in the direct influence of battered woman syndrome information on the verdict/judgment rendered and suggests that the provision of such information in spousal homicide trials within the Thai context may not be efficacious in influencing the participants’ verdict judgments. Results however did indicate an indirect effect of the battered woman syndrome information on the verdict/judgment rendered being mediated by the defense strategy of self-defense. This finding indicated that the battered woman syndrome information presented aided the participants in contextualizing the defendant’s killing in a frame of self-defense, rather than inappropriately applying a form of “reasonableness” in their verdict/judgment. These findings are discussed in relation to their implications for the presentation of battered woman syndrome information in trials of Thai battered women who killed their abusive spouses.

This paper analyzes the exclusion of responsibility in cases of battered women who kill their abusive partners in self-defence, emphasizing the theoretical and practical difficulties from a gender lens. I investigate self-defence simultaneously from a double perspective: the perspective of intimate partner violence, and the perspective of Canadian law. I reflect on alternative solu-tions in cases where there was a deferred self-defence, seeking a more equitative response from institutions. Self-defence protects whoever kills another person to defend herself or a third party. Even though this legal figure seems unquestionable, it is actually an ambiguous area in criminal law. Women who are abused for extended periods of time, who one day kill their abu-sers, generally do not do so during a context of physical confrontation. In this paper, instead of merely restricting my analysis to the events that occurred on the day of the abuser’s death, I will go back in time to scrutinize in detail the cycle of systematic violence and the “battered woman syndrome”, as well as the theory of “coercive control” in the Canadian context. I draw from the famous Canadian case Rust v. Lavallee (1990). I problematize some of the requirements for self-defence, emphasizing their inability to respond to the realities of battered women. This research shows a problematic disconnect between the current legal framework and the realities of violence against women.

This article seeks to critically examine recent criminal law developments in Australia, England and Wales that specifically address the situation in which battered women find themselves. This article specifically focuses on the question of whether or not South Africa can learn something from these developments in order to make better provision for battered women who kill their abusers after having suffered through years of physical abuse. The question of whether or not a separate defence can be created for battered women in South Africa is also explored in this article. This article considers the ruling in Attorney-General for Jersey v Holley1 and its impact on limiting the ambit of the defence of provocation by restoring to the reasonable person a normative capacity for self-control. In particular, the implications of this limitation on legal outcome in cases where women kill men who abuse them are explored. The inevitable demise of provocation as a defence, which follows from the ruling in Holley, is of particular concern as is the new framework for sentencing in convictions for murder2 which in removing judicial discretion from the sentencing decision prohibits judges from tempering the harshness of the mandatory sentence. This new murder/sentencing regime will undoubtedly result in injustice, especially in those cases where battered women kill, which, although deserving of mitigation, nevertheless fail to satisfy the strictures of provocation's requirements post Holley, thereby resulting in an increase in convictions for murder. The Law Commission's report on Murder, Manslaughter and Infanticide3 recommends a new framework for murder and manslaughter, including a new definition of provocation and also a new direction in the murder sentencing framework. This area of the law is still far from fixed.

This study describes women incarcerated at a California prison for the death of their male abusers and compares them with a statewide sample of women inmates. Women convicted for using lethal violence against abusive partners differ from the broader population of California women prisoners on key demographic markers. Furthermore, despite a clear lack of criminal or violent histories, the overwhelming majority of battered women are convicted of first- or second-degree murder and receive long, harsh sentences whether they are represented by private or by public attorneys. This research suggests the possibility of a systematic criminal justice bias against women who kill their male partners.

AimsThe aim of the study was to identify any symptoms or features of Battered Woman Syndrome (BWS) or Post-traumatic Stress Disorder (PTSD) that may be associated with, or explain, abused women killing their abuser; and the extent to which such identified symptoms or features have been deemed, or are potentially relevant, to past and now reformed partial defences to murder in English law. Hence two sub-studies were completed.MethodThe first sub-study identified mental symptoms of BWS or PTSD apparent in battered women who kill their abuser; achieved by identifying relevant research papers, through applying a ‘rapid review’ approach to three databases: PubMed, PsychInfo and PsychArticles. The second sub-study identified by legal research reported Court of Appeal (CA) judgments on women appealing their conviction of the murder of their abusive partner. It then analysed the legal approach taken towards evidence of the effects of abuse upon these women before and after relevant statutory law reform (although no CA cases were identified post-reform).ResultThe first sub-study identified and reviewed six symptoms or features, within three quantitative and three qualitative studies, that appeared to be associated with, or described by, abused women killing their abuser. These included helplessness, symptoms associated with PTSD, plus fear, isolation, experience of escalation of violence and cycle of violence. From the CA cases the perpetrators of killings that occurred prior to 04.10.2010 (the date of law reform) were usually successful in having their conviction overturned based upon diminished responsibility; but not provocation, because of the requirement of ‘sudden loss of self control’. ‘Loss of control’, which replaced provocation, appears highly likely to be capable of reducing murder to manslaughter based upon symptoms of BWS, or PTSD. However, the amended defence of diminished responsibility is likely to exclude evidence of BWS, but allow evidence of PTSD, because of its requirement of the defendant suffering from ‘a recognised medical condition’.ConclusionThis study demonstrated particular symptoms or features of BWS or PTSD associated with abused women killing their abusers plus their very different relevance to two partial defences to murder, pre and post law reform.

Findings from police reports and interviews with women who have survived an attempted domestic homicide revealed patterns in their experiences and sources of distress. The build-up in the year prior to the near-lethal attack involved tension from ongoing contact with an angry, controlling batterer. Most typically the perpetrator was an alcoholic or drug addict, a gun owner, and, if his victim had left him, her stalker. In the majority of cases, the victim had either left or announced that she was leaving the relationship. While he had often threatened her life and she feared him, she typically did not think him capable of killing her. She described the attack as shocking and terrifying, and she felt certain she was going to die. In the immediate aftermath, she received some support, but as time went by, she felt isolated and alone. Ultimately, the women became convinced that they must rely on their “inner strength” to get on with their lives.Yes, he stabbed me in the—first he stabbed me in the stomach. And it was a big knife too. [Then] the arm and the throat, and at first, when he first did it, the first time the knife came, I thought, this is it. I’m gonna die—and I was just watching him kill me, that’s all. I was alive, and I was watching myself be killed. (“Rita,” #6)

Student participants ( N = 316) viewed a videotaped simulated case involving a woman who had entered a self-defense plea in the shooting death of her abusive husband. As successful claims of self-defense rest on the portrayal of a defendant who has responded reasonably to his/her situation, the implications of various forms of expert testimony in constructing this narrative were examined. Jurors were presented with either expert testimony regarding the battered woman syndrome (BWS), the BWS framed within post-traumatic stress disorder (PTSD) nomenclature, or a no-expert control condition. As the BWS classification may support a stereotypical victim, the degree to which the defendant fit the stereotype in terms of her access to a social support network (family, friends, employment outside of the home) was varied within the expert testimony conditions to reflect either a high or low degree of stereotype fit. Although jury verdicts failed to differ across expert testimony and stereotype fit conditions, perceptions of her credibility and mental stability did. Although affording jurors a framework from which the defendant's experiences as a battered woman may be acknowledged, this portrayal, as advanced within PTSD nomenclature, endorsed a pathological characterization of the defendant. Implications of this discourse for battered women within the context of self-defense are discussed.

In this article, the author examines the socio-legal relevance of the « battered woman syndrome » (BWS) in the cases of women who kill their violent partners in Canada. The legal recognition of domestic violence in these situations, in its historical context, is examined by focusing on the Supreme Court of Canada decision in the case of Angélique Lyn Lavallée in 1990. This landmark decison is used as pivotal in this discussion in order to shed light into the reasoning behind the subsequent legal decisions. The ideas proposed in this article are part of a more general exploration of the representations of femininity and their inscription in law. In discussing female conjugal homicide, the gendered nature of law and order, the pathologization of women, the « syndromisation» phenomenon and the médicalisation of violence, the author offers some insights in thinking legal strategies but more fundamentally in the social debate to continue.

For many women, the abuse of power in the form of physical and emotional battering by their so-called ‘partners’ is a fact of life. Individual women feel the pain, the humiliation, the fear and the anger. But the debate about how legally we should respond to a woman who finally kills her abuser is significant beyond the individual. Whatever the predicament of women such as Sara Thornton, or Kiranjit Ahluwalia, sentenced to life imprisonment and forced to scale seemingly impossible obstacles in the appeal process, the exponential rise in literature on this subject is quite disproportionate to the number and increase (if any) in such cases. The real significance of the ‘self-defence for battered women’ movement lies less in these concrete examples and more in its metaphorical role as witness to the social reality of the abuse of women.

Approximately 15% of married or cohabiting women and as many as 60% of battered women are raped at least once by their partners. This study compared community-based counseling outcomes of battered women with outcomes of women who were both raped and battered by their partners. Over time, both groups improved in wellbeing and coping. Although those both battered and raped progressed more in counseling, they had lower scores before and after counseling compared to women who were battered only. Implications for research and intervention are discussed.
