Повний текст джерелаAfter the second world war, France tried to reaffirm her sovereignty over the general economy of their colonies through economic institutions modernized within the constitutional framework of the Union française. She then settled an overall economic regulation system. In this way, although possessing her own economic institutions, the ivory coast found herself reduced to controlling certain elements of internal economic fluctuation such as prices and salaries, without any means of overall regulation of her economy. Naturally, these strategy led to destabilization and mal-development. The latter made it possible to estimate the vacuity of economic regulation authorities, incapable of either implementation of economic stabilization or definition of a real development policy. The impoverished local administration was condemned to return to pre-war methods, by offloading its responsibilities on the business houses with regard to regulation procedures. Thus, economic distortions were accentuated in an economy in which all the advantages continued to be intercepted by the business houses on the imports market, by simple commercial transactions

Повний текст джерелаIn the 19th century the refusal of the great French ports to decline, and mainly the expulsion of Girondist merchants on the Mediterranean Sea by their competitors from Le Havre and Marseille have made France to set up new trading post in the Guinea Gulf. The territories of Gold Coast became officially a French colony of Cote d’Ivoire on March 10th 1893 thank to the actions of pioneers from La Rochelle. From that date on the colony was opened to exploitation under the system of concession that mobilized several activity branches, capitals, and know-how in order to collect rapidly uncounted wealth.This kind of exploitation encountered a failure at the end of the World War I because it created interest conflicts and resistances of the native populations. From 1918 on Metropolis intensified the exploitation of the colonies in order to pay their debt and reduce the cost of life and face the rapid increase of raw material needs. So some great new trading companies timber and agricultural industries were created. And that transformed the economy of the territorial colony.Nevertheless, the rush that slowed down in 1929 resumed immediately thank to Maginot became plan that leaded to great works as the building of the port of Abidjan which became the centerpiece from 1951 on. The second port of San Pedro will favor the equipments and the rapid development of economic, urban and social infrastructures that prepared the country to the « miracle ivoirien » But that remains the result of a deep mutation of the colonial work through France and Cote d’Ivoire cooperation. That cooperation reinforces the economic and political influence of France after the independence of their former colony

Повний текст джерелаOn September 19, 2002, armed rebels tried to overthrow the Ivorian President. Then, France committed a military and diplomatic action to resolve the conflict. On January 25, 2003, the President Laurent Gbagbo appointed a new Prime Minister in Paris and, under the auspices of France, agreed to entrust ministries to some members of rebellion. France had previously chaired the Linas-Marcoussis round table, where the Ivorian political forces were invited to negotiate. The goal of the decision that had been taken in between both dates was to solve quickly the conflict. That was also a way for France to promote such a manner as an alternative way of managing the Iraqi crisis. Finally, France has been involved far beyond its initial objectives. The Linas-Marcoussis agreement has been partially implemented. Other agreements, drafted under the auspices of the UN and the ECOWAS Member States, will follow up. France will maintain its military commitment but will not be able to manage its schedule and its budget. Eight years later, the French President announced the end of the military operation on May 21, 2011. This operation has been considered as unique regarding both human and budgetary consequences. In addition, the Parliament was requested to modify the French Constitution in 2008 in order to authorize any military operation overseas beyond four months. The current thesis analyzes and assesses the decision-making processes and the decisions in both diplomatic and military frameworks in France. The document highlights the shift between the methods to achieve the decisions and the crucial challenge of those decisions. In this regard, the most important unintended consequence has probably been the renovated involvement on the Parliament decision process for France to conduct overseas military operation

Повний текст джерелаThe history of state ownership law in Ivory Coast reveals the French strategy and method of occupying space in the colonial lands. It falls within the realm of the colonial policy of organizing property and is justified by the seizing of sovereign power resulting from conquest. The french theoretically based their right to the Ivoirian state properties on their right of conquest and on substituting themselves for the native powers. But these rights were invalidated by the courts in light of the absence of judicial foundation. However, the french state transferred its unjustified ownership rights to the independent ivory coast state, which pursued on this subject the colonial policy of using the country's resources for partisan gain. Perhaps we must see in this policy one of the causes of the actual economical difficulties of the country. Indeed, contrary to the functioning of customary state ownership law consisting of insuring protection and means of subsistance to all, the principles of colonial ownership rights rather favoured the exploitation of the colony's resources for the profit of the colonials, their companies, and metropolitan France. To that end, colonials, legislation tended toward promoting French laws on private property on African soil and abolishing the native customs

Повний текст джерелаThe inefficiency of the positive law in Africa is considered as one of the underlying reasons of its underdevelopment and/or of its development malaise. The state of lawlessness that prevails in Côte d’Ivoire in marriage-related issues appears to be the case in point, being one of the most instructive and globalizing within the correlations between legal order and development in its widest sense. As a matter of fact, like in all of the former French colonies of French West Africa block, Côte d’Ivoire’s legal (at least, in a positivist sense) system is a product of its colonial past. Therefore, the legal systems in all these young African states are naturally inspired by the French law, through the channel of colonial law. However, Côte d’Ivoire’s solution differs from most of those of its fellow regional states. The new Ivorian government opted for an outright alignment of their law and the legal system with that of the former colonizer. For the civil law, this translated into the adoption of the French Code of 1804, taken for a token of development and social revolution, at the expense of countless civil customs considered to be incompatible with the new constitutional order and nation-building. Out of this political will of assimilation and legal unification - that has been ongoing in Côte d’Ivoire since independence - was born a true conflict of norms. On the one hand, a state law, especially in matrimonial matters, is prevalent but still strives to take root. On the other hand, civil customs that are still attractive bite into the credibility of the official law

These merchants will constitue some societies, often with money collected in their own families and will form an important and influent colonial group: the "groupe from bordeaux" will have as leaders "Maurel & Prom", "Deves & Chaumet", "Buhan & Teisseire". . . Around the year 1870 a second flood of merchants : Philip Delmas, "darling" Peyrissac, Elie Chavanel, Louis Vezia, came to Senegal and partly will contribute at the economical developpement of the french occidental coast of Africa. "Darling" Peyrissac son of a gendarme, born in a country called "Limousin" came, when he was only very young boy, very short of money, to Saint Louis for his own establishment in 1870. In 1908, "Darling" Peyrissac was able to find financial contributions in order to establish an corporation. He died in 1916. Afterwards, it happened success or misfortune to the society, after the first world war, the society began to enterprise different affairs and due to them was in a bad condition during the crisis following 1929. .
