An analysis of six possible alternative world scenarios, which might characterize the evolution of our societies in the four decades to come, reveals the need for the development of a Social Global Contract. The most important policy goal does not relate to higher competitiveness in the global economic wars, but should be concerned with creating more common wealth to satisfy the material and immaterial needs of the world's population. The Social Global Contract means the start of a process that favors the establishment of a cooperative system of global governance. To that end a set of practical tasks to be implemented within the framework of four major global contracts are identified and discussed.

AbstractToday’s organization of production and services along global value chains (GVCs) uses contracts as central building blocks, yet is largely disconnected from contract law’s dominant epistemology and social imaginary. This article charts when, how and why GVCs have appeared on the radar of contract scholars and unravels the related methodological and disciplinary challenges. Rather than treating GVCs as a ‘legal concept’ in a strict sense that might command the application of particular rules, I propose to understand them as a ‘legal heuristic’: GVCs require contract law to revisit its constitutive role for matters of distribution, participation and equality under globalization. Towards this, GVCs need to be understood as organizational arrangement and simultaneously as a stage in the evolution of a global political economy. Beyond the classical confines of ‘contract governance’, this brings into the picture the wide array of formal and informal technologies of ‘contract governmentality’. Together with the material, technological or informational infrastructure, these are referred to as ‘code’ of GVCs, suggested here as focus of future contract law research on GVCs.

AbstractGlobal value chains (GVCs) resist dominant contract framing, because presumptions about contract’s bilateral structure and party autonomy fail to capture the complex interconnections between private exchange relations. Contract law seems to obscure, rather than capture, the ways in which the relationships and experiences of various actors in GVCs are linked. This article argues that, in doing so, contract law contributes to systemic hermeneutical injustice. Systemic hermeneutical injustice captures how shared interpretative resources can render those in disadvantaged positions of social power unable to make intelligible that what is in their interest to render intelligible. The article’s primary aim is to show how this form of injustice bears on contract law and how it can function as an independent normative constraint on the institution of contract law.

The methodology of choosing production strategy has long been a well discussed topic in research companies generally have many different alternatives to choose from. However, lately, due to the increased volatility, there has been a big shift towards using electronics contract manufacturers (ECM) for electronics manufacturing. There are many methodologies developed for evaluation and choosing ECM. Nevertheless, none have taken the special characteristics of a born global (BG) small medium enterprise (SME) into account. Their special characteristics significantly differentiate them from larger corporations and approaches that respond to their needs are required. This thesis therefore focusses on developing a methodology and tool for evaluating and choosing an ECM as a BG SME.This thesis mainly considers two parts of the problem. Firstly, the applicable factors affecting the choice of ECM for a BG SME is uncovered through a state of the art literature analysis and an empirical interview study. Secondly, five commonly evaluation methodologies are evaluated from the BG SME perspective to conclude upon the most suitable methodology. The set of factors and chosen methodology is combined into a comprehensive tool for ECM evaluation and selection as a BG SME. The developed tool consists of thirteen factors and builds upon the fuzzy set evaluation theory. The tool is successfully verified through a case study.

Le 25 juin 2014, Germain Katanga devenait la première personne définitivement condamnée par la Cour pénale internationale. Dans l'indifférence générale, ce congolais originaire d'un petit village de l'Ituri rentrait ainsi dans l'histoire d'un pouvoir naissant pour avoir fait transiter des armes ayant servi à une attaque contre des populations civiles. A travers une déconstruction étape par étage du cheminement qui a amené cet homme de la chasse aux Okapis à sa condamnation pour crimes de guerre et crimes contre l'humanité, nous avons cherché à comprendre comment une institution créée pour juger les plus grands criminels a pu croiser le chemin de celui qui n'avait auparavant jamais entendu parer de « La Haye ».Dénuée de contrôle social, incapable de jouer le rôle qui lui a été attribué la CPI s'est longtemps défaussée sur les États pour expliquer les échecs de sa première décennie d'exercice. La réalité est plus complexe, et laisse apparaître en creux une incapacité structurelle à agir contre les intérêts de l'ordre étatique et a fortiori des dominants de cet ordre étatique. Après avoir décrit l'institution de l'intérieur, en nous appuyant sur notre propre expérience à la CPI et au ministère des affaires étrangères français, nous avons donc tenté de comprendre de lire la Cour depuis la perceptive hobbesienne ; appuyé sur un travail sur les terrains d'enquête de la CPI en Afrique, plus de cent entretiens avec les principaux protagonistes de l'institution et de l'affaire Katanga, nous avons ainsi suivi le cheminement casuistique inversé, partant de la plus petite échelle de l'institution pour finir par en interroger le sens dans son ensemble
June 25, 2014, Germain Katanga became the first person to be convicted and sentenced by the International Criminal Court. As his case continued to be cloaked in silence, this congolese villager from the remote province of Ituri became a figure in the early history of a rising institution. Through a deconstruction of each stage of the proceedings against Katanga for war crimes and crimes against humanity at the ICC, this work attempts to understand how an institution built to prosecute the masterminds and those most responsible for the gravest crimes and atrocities targeted a 24-year-old Okapi hunter who never before heard of “The Hague”.Lasking social control, unable to play the role for which it was designed more than ten years ago, the ICC has systematically blamed the States for its numerous failures. The reality is more complex, and this research reveals that the institution has a structural incapacity to act against the interests of the state order, and a fortiori against the dominants of the order, therefore rendering obsolete any of its cosmopolitan pretentions. Following from a description of the ICC “from the inside”, based on the author's experience at the office of the Prosecutor and at the French Ministry of Foreign Affairs, this work assesses the Court through a Hobbesian lens. Relying on field work in Congo and the Central Africa Republic, more than a hundred interviews and a novel analysis of Hobbes Leviathan this work takes a bottom-up approach, starting from the smallest scale - from what was considered a minor case – and ultimately questioning the institution as a whole

The purpose of this study is to determine how the direction toward standardizing quality control systems woridwide, specifically ISO-9000 criteria, is affecting business procedures both internally (operations) and externally (global marketing). A methndology for determining current opinions and business practices concerning ISO-9000 certification was developed by reviewing the most current literature avallable and through personal interviews with various quality systems managers of ISO-9000 certified companies. Areas of focus throughout the research were: ISO-9000 capabilities for company certification, current U.S. Government initiatives concerning standardization and contracting, the cost-benefit objectives of certification, real-time perceptions of certified companies and the effects that lS0-9000 has had on global marketing of products. The range of data were analyzed and conclusions drawn with respect to current international conditions Cf standardization and how Government contract actions incorporate non-M!LSPEC quality systems. Recommendations include: immediate update of the FAR to incorporate the guidance issued by the Secretary of Defense concerning use of commercial quality assurance systems in Government contract actions and follow-on studies on the continued effects of international standardization as the IOS proceeds into the next century.

This paper analyses the need for multinationals to adopt and fully implement the UN Global Compact principles in their operations by influencing sustainability down their international supply chains. This analysis is premised on the various theories supporting the adoption of sustainable business practices by businesses in terms of labour, human rights, environmental responsibility and anti-corruption. The objective of the analysis is to propose the applicable law of contract tools that the multinationals can use to implement their sustainability commitments down international supply chains. Since the supply chain partners of these multinationals are distinct entities operating independently and only dealing with the multinationals through contracts, the paper proposes that sustainability can be influenced through the use of such contracts. In this, the paper appraises conditions precedent and express contractual terms as the law of contract tools that can best be utilized by multinationals in influencing supply chain sustainability. The paper shows that these tools can be utilized to guarantee that supply chain partners operate sustainably and in a manner that implements the sustainability commitments of the focal firm - the multinational. Against the background of the already existing systems, this study illustrates that the proposed tools can be used to strengthen the existing systems and especially the use of supplier codes of conduct. It also demonstrates that the effective use of these tools guarantees the adoption of sustainable practices and systems that eventually make the entire supply chain sustainable. The paper concludes that the use of these tools will guarantee the implementation of sustainability commitments, as based on the UN Global Compact, in international supply chains.

Анотація:
Large corporations largely control food production and distribution in the global food system and have generated a desire for locally produced food. Although small independent producers still contribute to regional food systems, there is little understanding about how they distribute and market their products. This thesis uses both semistructured interviews to investigate the distribution practices of urban, family, and regional producers in the New Orleans region and discourse analysis to disclose how localist discourse shapes producers marketing practices. The discourse analysis discovered that the web presence of local New Orleans restaurants, farmers, and Crescent City Farmers Market targeted concepts that reflect localist beliefs and values. It was also established that small producers respond to consumer demands, but still have the power to shape the regional food system through negotiating informal contracts and striving to enter into the niche market.

Whilst the industry has started to develop standards through the ILI Association and the Pipeline Operators Forum the way in which the industry selects tools and contractors has not developed to the same extent. A significant amount of time is spent managing the procurement process rather than focusing on the selection of the right tools and ensuring they perform to expectations. The challenge is further exacerbated when operations are dispersed globally and involve many different operating relationships. BP has been a user of ILI technology since its introduction in the late 1970s and it has consistently grown in importance to BP in managing the integrity of an aging pipeline asset base. In 2006/2007 BP’s Exploration and Production Technology Group (EPTG) in conjunction with the Procurement and Supply Chain Management group (PSCM) carried out a review of its procurement arrangements across the globe for pipeline ILI to ascertain best practice and capture key lessons. It also gathered experience from other strategic long term supply chain initiatives around the BP Group to help inform and develop the ILI strategy. Early discussions held with ILI Suppliers confirmed that, whilst regional frameworks have been in place in some countries, extending this to a global operation would be breaking new ground in engaging ILI services and would be of benefit to both ends of the supply chain. The process not only needed to follow rigorous supply chain procedures that would meet EU Procurement Directives and BP Group requirements, it also had to meet the specific requirements of many Countries around the world. It was recognised that flexibility would be required to accommodate the introduction of new tools, developing technology and accommodate new areas of operation. BP also wanted to stimulate continuous improvement in ILI tool performance and application of innovative improved technology. More significantly a key objective of the Global Contract was to drive inspection quality and consistency, whilst maintaining a competitive but equitable pricing strategy. Successful implementation was not just about delivering a contract scope of work; it required the development of relationships and a common understanding so that when problems arise they can be resolved quickly and efficiently. This required a significant amount of work engaging both the ILI Contractors and Operating Units across the world in the process. Work on developing the Global ILI Contract was successfully concluded with contract awards in late 2007. The paper explores some of the challenges, lessons learnt and benefits of developing a Global Contract for ILI.

While China has been increasingly contributing to the recent growth in electricity generation in sub-Saharan Africa (SSA), the effects of China-funded investment on host countries’ debt burden and transition to renewable energy sources have not been sufficiently explored. Drawing on secondary data, combined with deep dive studies of Ethiopia and Uganda, this paper shows that despite significant liberalisation of the power sector in SSA, Chinese investments in the electricity industry continue to follow state-led project contract-based models. We show that this approach has failed to encourage Chinese firms to build compelling investment portfolios for competitive procurements within the region and, instead and inadvertently, it has exacerbated the debt burden of host country governments. Second, in spite of the global drive towards climate resilient energy generation, Chinese funding of electricity generation in SSA is not sufficiently channelled towards modern renewable energy sources such as wind and solar power that could reduce vulnerability to climate change. While recognising that the private sector-led competitive model of power generation is not without limitations, we argue that SSA’s electricity generation strategy that leads to less public debt and more climate resilience involves increased involvement of Chinese investment in the competitive model, with more diversification of such investment portfolios towards modern renewables such as wind and solar energy resources.

The Global Meeting on Postabortion Care: Advances and Challenges in Operations Research was held at the Population Council’s New York office on January 19–21, 1998, to review progress made by three regional operations research (OR) projects in improving delivery of postabortion care. The resources of the three OR contracts were pooled, and, in collaboration with Ipas and the Ebert Program, approximately 65 researchers, senior program managers, and government officials from Africa, Latin America, the Middle East, and Southeast Asia were convened. Three objectives guided the planning of the meeting: review progress in the development of OR methodologies pertaining to postabortion care, identify elements in the design of new postabortion care services, and suggest future areas for postabortion care OR. The meeting was organized around the presentation of 20 papers distributed to all participants several weeks earlier. Discussants presented critical syntheses of the papers and indicated directions for future OR studies. This report presents a summary overview of the principal themes and key points drawn from the papers and discussions, organized according to the theme of each session.

External capital accounts suffered during the COVID-19 crisis in Latin America and the Caribbean, but perhaps surprisingly the impacts were less severe than in previous crises. Gross capital inflows offset the outflows of residents, in sharp contrast to the global financial crisis of 2008/09 when residents repatriation of capital countered withdrawals from non-residents. In general, the result was relatively stable net capital inflows and modest current account adjustments. Still, some countries that had seen inflows fall prior to the crisis, reflecting weaker fundamentals, suffered Sudden Stops in net capital flows. Given accommodating global monetary policy, sound fundamentals ensured access to liquid international capital markets, reducing the impacts of Sudden Stops during the pandemic.

The internet and digital technologies are upending global trade. Industries and supply chains are being transformed, and the movement of data across borders is now central to the operation of the global economy. Provisions in trade agreements address many aspects of the digital economy – from cross-border data flows, to the protection of citizens’ personal data, and the regulation of the internet and new technologies like artificial intelligence and algorithmic decision-making. The UK government has identified digital trade as a priority in its Global Britain strategy and one of the main sources of economic growth to recover from the pandemic. It wants the UK to play a leading role in setting the international standards and regulations that govern the global digital economy. The regulation of digital trade is a fast-evolving and contentious issue, and the US, European Union (EU), and China have adopted different approaches. Now that the UK has left the EU, it will need to navigate across multiple and often conflicting digital realms. The UK needs to decide which policy objectives it will prioritise, how to regulate the digital economy domestically, and how best to achieve its priorities when negotiating international trade agreements. There is an urgent need to develop a robust, evidence-based approach to the UK’s digital trade strategy that takes into account the perspectives of businesses, workers, and citizens, as well as the approaches of other countries in the global economy. This working paper aims to inform UK policy debates by assessing the state of play in digital trade globally. The authors present a detailed analysis of five policy areas that are central to discussions on digital trade for the UK: cross-border data flows and privacy; internet access and content regulation; intellectual property and innovation; e-commerce (including trade facilitation and consumer protection); and taxation (customs duties on e-commerce and digital services taxes). In each of these areas the authors compare and contrast the approaches taken by the US, EU and China, discuss the public policy implications, and examine the choices facing the UK.
