Montenue, a distinct French scholar of intellectual property, has suggested that IP is a “tool which surprisingly helps a lot”, and this definition on science, arts, culture, since the 16th century. Now, what would be the definition of intellectual property for the 21st century? Apparently not a “strange” tool, but a necessary tool, primary for enriching human knowledge, and for the new world order, especially in the global market sphere.Intellectual property is an integral part of international trade, and its importance keeps increasing, since effective use of knowledge is increasingly influencing the economic prosperity of peoples. One may say that there is little originality in the creative sphere. Naturally, this originality can only be reflected by individuality and human identity in intellectual creativityThe author rights in the Kosovo legislation is a novelty, a necessity of developing a creative environment in the fields of science, arts and industrial property. First and foremost, the individual benefit, which is secured by the author as the creator of the work, is a moral and material right. Secondly, there is a need for harmonization, not only of values for the creator, but also for the development of science, culture, increased competitive advantage, and the public sphere, as a benefit for the public health and security, and the fiscal policy. The deficiency one must record is with the Office for Copy Rights, which is to play a strong role in implementing and protecting copy rights and other related rights by licensing collective management agencies, imposing administrative fines, awareness raising, provision of information, and other capacity building and educative measures. Naturally, the enactment of good legislation is a system without any meaning or sense if not associated with the court practice. Any establishment of a legal system not pursued with enforcement mechanisms remains only in legal frameworks.

Aiming to break through the narrow, broad and general understanding of sports intellectual property rights, this paper adopts interdisciplinary methodology to analyze and summarize the concept, attributes and categories of sports intellectual property rights, and explore the theoretical logic of the construction of sports intellectual property rights system. In terms of concept definition, it deeply analyzes the right attributes of sports intellectual property rights, and forms three types of rights: ontological sports intellectual property rights, necessary sports intellectual property rights and related sports intellectual property rights; in the formation mechanism, it puts forward that the construction of right system of sports intellectual property should follow the basic principles of comprehensiveness, systematization and openness; In terms of right relationship, it points out that the ontological sports intellectual property rights comes from sports itself, and the object of rights is irreplaceable. The necessity of sports intellectual property rights and sports is a direct relationship, and the object of rights is indispensable. Related sports intellectual property rights and sports are indirect relations, the object of rights has a supporting role,and the subjects of rights have mutual benefits.

In perpetuating and exacerbating restricted access to essential medicines, current trade-related intellectual property rules on medicines may violate core human rights to health and medicines. In this light, their impact on the global disease burden raises serious questions about their necessity, and their justification should be critically assessed from the perspective of human rights standards. These standards require that international trade rules on medicines be justified to the fullest extent possible, and permitted only to the extent to which they can be justified. In this article I explore the impact of trade rules on medicines access, and the growing force of the human right to health. I argue that the limited justification for strong patents in poor countries suggests the need for significant reform of trade-related intellectual property rights. I argue further that human rights standards may offer both normative and practical tools for achieving this reform and for challenging trade rules on medicines at various levels.

The article deals with the issue of protection of intellectual property rights by customs authorities. The current problems of infringement of intellectual property rights during moving across the customs border of Ukraine are considered, in particular: transportation of counterfeit products, which includes goods that are subject to infringement of intellectual property rights to the trademark and goods that are the subject of infringement of intellectual property rights to a geographical indication in Ukraine and pirated products, which includes goods that are the subject of infringement of copyright and / or related rights or intellectual property rights to a registered industrial design in Ukraine and which are or contain copies made without the consent of the copyright and related rights or intellectual property rights to the industrial design or a person authorized by such right holder in the country of production, as well as moving across the customs border of small consignments of goods with violation of customs legislation and introduction of simplified procedure for destruction of such goods. The article also analyzes issues of novelty of the Ukrainian legislation – “original goods”, that is, those that were made with the consent of the right holder, as a basis for the existence of the international principle of exhaustion of intellectual property rights. It has been established that national legislation does not sufficiently protect intellectual property rights and that Ukraine remains one of the four points of transit and transit of counterfeit goods to the European Union. The mechanism of regulation of compensation of costs in connection with storage of goods suspected of violation of intellectual property rights after all, the owner of the rights has the opportunity to demand compensation for these costs from the owner of goods that violate his intellectual property rights, as well as the destruction of such goods by the owner of intellectual property rights. Key words: intellectual property rights, customs border, promotion of protection of intellectual property rights, procedure for destruction of goods, counterfeit goods.

Many critics have questioned whether the protection of the IPRs would benefit developing countries. It was argued in this paper that developing countires have the interest in protecting IPRs as well. However, it was showed that the benefit of this protection can be realized only if there is a fair rule of the game to all players in the multilateral trading system. The general objective of this research was to examine the current status of IPRs protection and the levels of TRIPS compliance by Rwanda in the area of copyright.

Over the past few decades, the protection of Traditional Cultural Expressions (TCEs) has generated lively debates within the international community and the questions of whether TCEs should be protected by Intellectual Property Rights (IPRs) and if so how, have been of increasing practical concern for TCEs holders and national policyrnakers in various countries. To date, however, work on the protection of TCEs has progressed slowly, and little has emerged in the way of concrete, binding law. Moreover, those instruments proposed as solutions appear unable to meet the range of concerns raised by TCEs holders and culturally-rich developing countries. Concerns raised by TCEs holders can be classified into four main categories. Firstly, they stress the difficulties they encounter in preventing and/or controlling the commercial use of their TCEs by third parties and in benefiting from this commercial isation themselves. Secondly, they express concerns about the inappropriate and offensive use of their TCEs. Thirdly, they wish to be attributed for their TCEs as well as have the possibility to object to any false attribution. Finally, they emphasise the need to ensure the identification and preservation of existing TCEs as well as their promotion, dissemination and continued evolution. The protection of TCEs was initially envisaged on a copyright model, because of the similarity of subject matter between copyright law and TCEs. However, although copyright law seems well suited to meet some of the needs and objectives of TCEs holders, it is limited in its potential for protecting TCEs. This thesis argues that "origin related intellectual property rights", such as trade marks, certification and collective marks and geographical indications, as well as passing off and laws against misrepresentation appear to be conceptually best suited for the protection of TCEs, because of their specific nature and characteristics. Such characteristics include the fact that they are usually produced within a community, which is often linked to a specific place, and according to traditional methods and know how transmitted from generation to generation, often using raw material from sustainable resources. In addition, this method of protection also seems to accommodate the fact that TCEs are usually already in the public 2 Abstract domain and to take into consideration some of the aims of TCEs holders such as the fact that they would like a protection that is unlimited in time. A system of protection based on origin related IPRs could offer practical advantages for TCEs holders since such category of rights used as such or with minor adaptations would enable them to obtain quick, practical and effective protection. In addition, there would be no need for the creation of a new sui generis IP or IP related system, which would take a long time to establish and may not be politically feasible anyway. The proposed approach will admittedly not address all the concerns of TCEs holders, but it will provide a balanced and workable compromise solution that could satisfy most of their concerns and policy objectives.

Since 1994, there has been a lot of attention drawn on the World Trade Organization (WTO) Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) as the most important international instrument ever negotiated in this area. TRIPS establishes minimum universal standards in all areas of intellectual property and the intention is to implement these standards globally through a strong enforcement mechanism established in WTO. These standards affect pharmaceuticals, which many countries had previously excluded from patent protection in order to produce drugs at reduced prices and hence contribute to the improvement of public health. But now any Member State must comply with these minimum standards since failure to do so will result to the WTO dispute settlement system. No extensive review of the practical implications of the TRIPS Agreement has taken place at the global and national levels. The main objective of this paper is to examine the likely impact of this agreement on anti-malarial drugs in Mozambique. Given the persistence of the malaria epidemic in the country and the resistance to the drugs being utilized for this disease there is an acknowledged need for a new drug to eradicate the problem. The problem is that this new drug is likely to be under patent and this country has relied on generic drugs for all its existence and being a Member of the WTO Agreement they now have to wait until patents on the required drugs have expired or be submissive to the more expensive original brand. To accomplish this objective and to ascertain the end result of the above situation, past experiences were a major tool. By reviewing experiences of less developed countries in relation to patent protection and pharmaceuticals, some conclusions were made possible. In order to narrow down the conclusions drawn from these country experiences, a study was done in the Mozambican public sector by reviewing and analyzing the existing laws and regulations pertaining to pharmaceuticals and patent protection. This was done through questionnaires and interviews of the main stakeholders in this area. With this information the researcher was able to describe where Mozambique stands in relation to patents and how this might affect the pharmaceutical industry as a Member of the WTO agreement in the long run. This study therefore, relies heavily on secondary data.

"The thesis of this study is that the flexibility within the exceptions to patent rights protecton under the TRIPS Agreement has not sufficiently been exploited at the national level. The study conceptualises the regimes for the protection of the right to health and IPRs not as mutually exclusive but as potentially reinforcing. The contention is therefore that the obligations in respect to the right to health limit the manner in which states can exercise the flexibilty within the patent regime of the TRIPS Agreement. Eventually the study seeks to answer the question: Where does the guarantee for the right to health lie in light of the TRIPS regime? ... The study is divided into three chapters preceded by an introduction. The introduction lays the background for te discussion. Chapter one deals with the definition of important concepts and provides the context in which the study is set. The chapter also discusses the background to the creation of the TRIPS Agreement, with an emphatic discussion on the involvement or lack thereof of Africn and other least developed and developing countries in this process. Chapter two discusses the patent rights exceptions clause under the TRIPS Agreement. Against this background, compuslory licensing, government use and parallel importing as means of making accessibility to drugs a reality under the TRIPS Agreement will be discussed. Chapter three identifies other means of making drugs more accessible and identifying places where they have worked well. In this chapter, generic substitution, establishemnt of a pricing committee, therapeutic value pricing, pooled procurement, negotiated procurement and planned donations will be discussed. Finally a conclusion will be drawn from the discussion and recommendations will be advanced." -- Chapter 1.

This thesis aims to examine the intellectual property regimes in the Gulf Co-operation Council (GCC) states and assess the relationships between legislation, enforcement mechanisms and sharia law. The GCC states, currently Bahrain, Oman, Kuwait, Saudi Arabia, UAE and Qatar, all have varied mechanisms in place for both the implementation and enforcement of intellectual property rights. The thesis pays close attention to the evolution of intellectual property laws and regulations in the GCC states with particular interest directed towards the development of national intellectual property laws within the GCC states from the 1970’s onwards1. Intellectual property protection in the GCC states is considered from two perspectives. The first perspective addresses the international demand for higher standards of intellectual property protection in the GCC states. The second perspective defines intellectual property within the laws of Islam and explores the relationship between Islam and intellectual property. The latter part analyses religious influence, societal and cultural norms, economic reality and the developmental stage of each GCC state. It is an important area of study as developing Muslim countries are struggling with meeting international standards and a successful integrated framework will impact not only on GCC states but other Islamic states and as a result could potentially lead to more informed negotiation in trade agreements with developed states. The research argues there are systematic flaws in the GCC states adopting intellectual property laws which are in essence a procrustean modification of foreign laws which have developed from colonial occupation or laws taken from donor countries. The GCC legal systems of the states have evolved utilising different sets of legal principles and therefore it could be argued the foreign laws that have been adopted are somewhat unsuitable for the GCC states. The research has focused on the implications of the national and international legislative regimes on the protection of intellectual property rights on the GCC states. Consideration is given to compliance, mainly how compliant the GCC is to its World Trade Organisation (WTO) membership and Trade Related Intellectual Property Rights (TRIP’s) Agreement and to what extent the European Union (EU) and the United States (US) influence the intellectual property protection regimes in the GCC. The research has examined the development of the GCC in three distinct stages; pre-TRIPS, TRIPS compliance stage and TRIPS plus. Furthermore, the thesis argues that the somewhat simplistic formula of the GCC states passing a large number of intellectual property laws to appease the EU and US does not have the significant economic impact on the GCC economy as the international agreements would suggest. Not all trade is intellectual property related and not all foreign direct investment is contingent upon intellectual property protection. However, as the GCC states are largely oil dependent, they do need to diversify their trade and as such an intellectual property protection model that accounts for international intellectual property law and the bespoke cultural and religious views amongst GCC citizens can produce tangible results for both the GCC and its trading partners. What sets the research apart from previous research is two-fold. Firstly, the research is qualitative and has scratched beneath the surface of intellectual property law in the GCC and examined in detail the Islamic law principles that have been used to justify sharia compliance, the western perspective on international intellectual property and the impact of multilateral trade agreements. Secondly, the analysis of Islamic finance and the application of successful sharia compliant models in Islamic finance to intellectual property is innovative as it acts as a springboard to creating a modified sharia compliant intellectual property protection model. Finally, the thesis will conclude by making a series of recommendations to develop an integrated approach to intellectual property rights which takes into account; the structure of the GCC states, international agreements and pressures, the international institutions, Islamic finance and both societal and religious views.

The Agreement on Trade-Related Aspects of Intellectual Property (TRIPS) ia a multilateral international treaty introduced by the World Trade Organization (WTO) that came into effect on 1 June 1995. At a basic level it attempted to establish minimum standards for the regulation of intellectual property rights within those countries that are members of the WTO and signatories to it. This thesis served a dual purpose. The first leg was to embark on an investigation into TRIPS, criticallt analyzing the provisions of the Agreement. The important aim here was to analyze and discover whether TRIPS is sensitive to weaker countries. The second leg was to probe within the the legislative framework of South Africa and determine whether South Africa as a "
developing copuntry"
, has complied with the demands as expressed by TRIPS. This investigation was done with specific reference to South African patent law.

Despite being about wealth and about who owns and controls the new capital - knowledge the study of intellectual property rights has generally attracted little attention from students of contemporary global political economy. This study seeks to bring such study squarely within the field, by opening a window into the complex interactions and contests over intellectual property rules that continue to engage multiple players in various fora simultaneously. The outcomes of these contests are as yet unclear, but they certainly have the potential to alter the future shape mid direction of global economy, for better or for worse. We do not engage in speculations about such outcomes, but seek to point to the growing importance of the politics of intellectual property and trade rules. More specifically, this is a study on the 'how' and 'why' of the emergence of the current global intellectual property regime and the manner in which the interplay between global intellectual property and trade rules has played out in the area of global public health. We seek to offer a political economy approach to understanding and explaining the multifaceted contests between state and non-state actors that have been attempting to resolve the many tensions inherent in the intersection of these three issue-areas in ways which best satisfy their interests. However, this is but one area where actors and interests are clashing over intellectual property rules; our hope is that other studies will follow which will continue to shed light into these contests and help us better to understand how global (intellectual property) governance structures are made and remade over time.

Debate over Intellectual Property Rights ‘IPRs’ particularly patent and copyrights is mainly on forward-looking industries in computer software. As part of a trade deal reached in 1994, the member nations of the World Trade Organisation must adhere to a global agreement known as TRIPS, for the Trade- Related Aspect of Intellectual Property Rights.

This study is to analyse the ethical conception of Intellectual Property Rights and in particular its implications on the developing countries in relation to TRIPS. The approach will be to analyse a broad philosophical theories of property to see if there is any justification for a software program to be treated as private property and also argue base on John Rawls two principles of justice in relation to TRIPS Agreement. Some reflections will be put on the use of open-source software by less developing countries.

From the study it was asserted that, strong IPRs protection would hinder technological transfer and indigenous learning activities in the early stage of industrialisation when learning takes place through reverse engineering. And policy makers should consider differentiation in terms of the level of economic and industrial development, if protection and enforcement of IPRs is intended to enhance technological development.

This chapter addresses related rights. These are related to, but fall outside, the protection afforded by copyright law. They include performer's rights; the sui generis database right; rights relating to technological protection measures and rights management information; and the artist's resale right. Each one of these rights is specific in terms of rightholders or the subject matter concerned. The chapter then considers a related right for press publishers that is currently in the agenda of the EU Commission. Following a public consultation on the Role of Publishers in the Copyright Value Chain and on the ‘Panorama Exception’ (23 March 2016), the Commission published on September 14, 2016 a proposal for a Directive on Copyright in the Digital Single Market, which suggests granting press publishers the exclusive rights of reproduction and making their press publications available for digital use.

This chapter is concerned with two areas of law that are related to, but not traditionally part of, patent law: the system of plant variety that gives protection to the breeders of new plant varieties, and supplementary protection certificates that extend the length of patent protection in the UK and are meant to compensate owners for time lost while awaiting regulatory approval to market their patented products. The procedure to be followed when applying for plant variety rights is also discussed, along with issues of ownership, duration, and patent infringement. The chapter concludes by considering exceptions and compulsory licences relating to the plant variety system.

The development of information and communication technologies and the Internet as well as the daily increase in the number of users have led to major changes in the lives and work of people. The availability of information from public trust, as well as works protected by intellectual property rights, is increasing in cyber space. The benefits of accessibility of various contents are often misused, leading to various forms of abuse of copyrighted or related rights. For this reason, mechanisms for the protection of intellectual property in the cyber space are constantly being developed. The aim of this paper is to analyze the current state of implementation of intellectual property protection mechanisms as well as services provided to users and authors of these works within the framework of cyber space with a special emphasis on the situation in the Republic of Serbia.

This article discusses issues related to the occurrence of legal liability for violations in the field of intellectual property rights, namely copyright and related rights. It is noted that in the Russian Federation civil, administrative and criminal liability is provided for violations in this area. Emphasis is placed on disclosing the disposition of each violation of copyright and related rights.

Relating to the establishment and acquisition of a company in Turkey by foreign investors, Foreign Direct Investments Law No.4875, FDI has entered into force on 17.06.2003. FDI formed a notification-based system rather than an approval-based system for foreigners to establish a new company and to take over company shares. Accordingly, company information regarding foreign investors will be notified to the General Directorate of Incentive Implementation and Foreign Capital via “Electronic Incentive Implementation and Foreign Capital Information System”. Foreign investment means establishment of a new company by a foreign investor or share acquisitions of an existing company, any percentage of shares acquired outside the stock exchange or 10 percentage or more of the shares/voting power of a company acquired through the stock exchange, by means of the following economic assets: assets acquired from abroad by the foreign investor which are capital in cash in the form of convertible currency bought and sold by the Central Bank of the Republic of Turkey, stocks and bonds of foreign companies excluding government bonds, machinery and equipment, industrial and intellectual property rights; or assets acquired from Turkey by foreign investor which are reinvested earnings, revenues, financial claims, or any other investment-related rights of financial value, rights for the exploration and extraction of natural resources. According to Article 4 of the Regulation for Implementation of Foreign Direct Investment Law, the Ministry of Economy shall provide information on the companies within the scope of foreign direct investments from Trade Registry Offices and related public institutions and organizations.
