Анотація:
Correlation between the concepts of “novel” and “innovation” in law is one of the topical problems faced by the modern legal science. Its relevance is substantiated by the fact that the improper use of one or another term in legal science (for example, the term "”innovation” instead of the term “novel” may lead to misperception and complicate the research of these legal phenomena. The goal consists in establishing correlation between the concepts of “novel” and “innovation”, as well as the criteria for their classification based on the analysis of the essence of these two concepts. The subject of this article is such principles of the novels and innovations in the legal system that impact the characteristics of these legal phenomena. In the course of research, it was determined that law incorporates both, novels and innovations, which should not be confused, and correlate with each other as a whole (legal novels) and as a part (legal innovations). The article provides classification of legal novels and legal innovations in accordance to various criteria, namely depending on the type of legal process, form of expression (of novels and innovations in law) and (legal novels and innovations). The latter are distinguished by the fact that they are reflected in the legal norms. At the same time, innovations in the law and legal system imply the fundamentally new and (or) significantly improved processes that take place in the legal system, as well as their results. Novelties, in turn, imply any amendments to the law and the legal system.

Анотація:
Simplified understanding and regulation of the innovation cycle of scientific and technical innovations in the Russian legislation under the conditions of science financing, that lags behind the level of science financing in the BRICS countries, and the oligopolistic nature of the Russian economy results in undermining innovations on the part of such non-economic factors as extralegal appropriation of intellectual property, unilateral authority-based strategizing and interference into economy, inflated refinancing rate of the Bank of Russia. To implement the tasks of import substitution the author suggests introducing the practice, justified in the works of Jean Tyrol, 2014 Economics Nobel Laureate, which involves concluding agreements between a regulatory public authority and oligopolists, who target domestic markets, in the sphere of the innovation cycle from knowledge to consumer goods.

The author states that within such a concept, the entities carryinginnovation activity, keep focus on monetizing both the internal research results aswell as the external ideas. Such approach, enhanced with external partners involvementinto the innovations process, helps the innovative technologies to move remarkablyfaster through the lifecycle. It is also emphasized that the approach enabling externalaccess to the companies’ innovations, need a concept to be set up, with focus onintellectual property rights protection. The author draws attention that the key roleof legal instruments for intellectual property protection, is to minimize the risk forthose companies which contribute to the innovations market development. It is clarifiedthat within such a concept, the innovation activity companies provide their partnersthe right to use the intellectual assets, which may be either already in use bysuch companies or idle to use. Thus, the companies providing legal protection of theintellectual property, have more favourite conditions to come into a strategic partnership.The author highlights that the innovations-industry companies make profitfrom getting access to science-research and related production outputs which areowned by their partners, as well as from further development of their own productsresulting from the intellectual property under the strategic agreement. We consider the issue of innovations and innovative activity legal nature, analyse its legal regulation from the point of view of basic terms. We conclude that ambiguousness of opinions and innovations and innovative activity understanding in the science led to that in legislation of any level the terms essence is incorrectly given. Main official terms are bounded by the “technical” part of the issue and tautological. We conclude the following: 1) modern terms of innovations and innovative activity go gradually beyond the “technical” limits of development, its economical round and include the social, intellectual relationship, and according to the doctrinal position – sometimes spiritual sphere of life, but the key element in the innovation terms formation is the economical effect; 2) innovation – the important competitive advantage of organization, based on using the knowledge and realized because of competence of its founders, lawyers, managers and personnel; 3) considered approaches to the innovation terms evidence that in scientific literature and legislation we can already find innovations main principles – novelty, useful effect and social importance, and innovative activity is as usual a process on creating, producing and spreading the novelties.

Анотація:
The article discusses certain aspects of legal regulation of patients' rights to innovations in healthcare sector. The subject of the study is the legislative acts on human rights in healthcare field, forms and types of human rights and directions for their implementation. Attention is focused on such types of patients' rights to innovations in healthcare field: (1) right to biomedical experiments; (2) right to reproductive technology; (3) right to donation; (4) right to transplant organs and anatomical materials; (5) right to therapeutic cloning; (6) right to change gender; (7) right to virtual reality. Essence of “innovation in medicine” is revealed, classification of human rights is given. The purpose of the article is to disclose the features of legal regulation of implementation of the patients rights to innovations in healthcare field. The methodology of this work is based on a set of research methods. The comparative method was used to elucidate the legal aspects of the patients rights to innovations in healthcare sector. Using the method of theoretical analysis, systemic and analytical methods, the term “patients' rights to innovations in healthcare field” was established, their varieties were characterized. Introduction of effective innovative models in health sector in context of patient rights will improve the availability and quality of provision of medical services to the population. It has been established that an important element in the implementation of innovative technologies in healthcare sector is the regulatory framework, which must comply with international standards. Анотація:
The aim of the article is to study the theoretical and methodological principles of the interconnection and interdependence of innovation and the socio-economic efficiency of tax consulting and on this basis to determine the areas and tasks of innovation management in this sphere. The subject of the study is innovation and innovative tax consulting services. Methodology. The research is based on the use of general scientific and special-scientific methods and techniques of scientific knowledge. The systematic approach enabled to reveal the content of the social and economic efficiency of tax consulting as the integrity of its economic performance as a practical legal activity based on enterprise and a structural unit of the national economy and socio-economic effects of its functioning as an institution of legal economy and the rule of law. The method of functional analysis enabled to substantiate the author’s approach to the definition of infrastructural and imputed functions of the tax-consulting institute, to reveal the content of its innovative function, its internal and external components. Based on a categorical analysis of innovations in the legal sphere, the concept of innovations and innovative services of tax consulting is considered to reveal a combination of legal, economic, social, and innovative characteristics in its content. The methodology of facet classification enabled to determine and characterize types of innovations in tax consulting, such as product, process, management-organizational, social innovations, as well as to ground areas and measures of management of innovative activity in this sphere of practical legal activity. The results of the study revealed that the social and economic efficiency of tax consulting as a unity of its economic performance and socio-economic effects are closely interconnected with its innovation, because innovations as certain changes in the product, technology, service provision, consulting, and market activity are efficiency factor, while possibilities of their implementation depend on the economic results of entrepreneurial activity in legal assistance on taxation and the quality of management of innovation activity. Practical implications. In the research, the classification of tax consulting innovations enabled to reveal the areas and management measures of innovation development in this practical legal activity to ensure its efficiency as a type of entrepreneurial activity and socio-economic institute, consisting of updating the product portfolio by developing and providing bundled, boutique services, development of niche industries; tax consulting on-line and automation of typical professional services; use of legal crowdsourcing and crowdfunding; introduction of the model of open innovation; management of innovative knowledge; formation of external and internal tax consulting networks; pro bono services. Relevance/originality. The proposed author’s approach to the definition of the socio-economic efficiency and the innovative function of tax consulting, their interconnection and interdependence is the theoretical basis for, first, studies of socio-economic and legal conditions and factors of effective legal assistance on taxation on an innovative foundation, and second, development of activities for the innovative improvement of tax consulting, and effective realization of its functions.

Анотація:
The study is focused on the legal regulation of state support for the creation of innovative medicinal products. Establishment of the measures of state support for scientific research for creating innovative medicinal products within legislative acts and by-laws should help to increase the competitiveness of the pharmaceutical industry in Ukraine. The government declares the provision of support for scientific research in the field of creating innovative medicinal products. The legislation establishes the conditions for registering an innovative project, provides the maintenance of the Register of scientific institutions that received the state support. A detailed characteristic of the existing means of the state support for scientific research in the pharmaceutical industry is provided. The state supports innovations by establishing tax incentives for research institutions and providing funding for some innovative projects. Support for innovations is carried out by the State Innovative Financial and Credit Institution, the National Research Fund of Ukraine and the Innovation Development Fund. Funding for the creation of innovative medicinal products can be realized through public and private partnership. The scholars have declared their propositions regarding the introduction of specific measures of the state support for innovations in the field of creating new medicinal products. It has been offered to amend the current legislation on the issues of state funding of scientific research in the sphere of developing new medicinal products. It is necessary to delineate the competence of various funds for promoting innovations in relation to supporting innovations in the field of pharmacia. It is important that the law should provide the procedure and conditions for supporting public and private partnership projects at the expenses of funds for promoting innovations.

Recently, legal literature has given attention to the problems of innovative energy. Despite the negative consequences of the current global economic crisis, the ways out of it are in the mainstream of the country’s transition from the export of raw materials to the resource-innovative development with a qualitative renewal of the energy sector. These tasks are set in the strategic planning documents that determine the vector and prospects of energy, scientific and technological and other areas of development. Achievement of goals and long-term quality guidelines for the development of the energy sector on an innovative development path is associated, among other things, with alternative energy, the expansion of the use of renewable energy sources. The paper shows the possibilities and prospects of their use for small energy facilities, energy-deficient areas, and regions with decentralized energy supply. The advantages of using green technologies, renewable types of energy are manifested in energy conservation, energy security, reducing the negative impact on the environment, and solving environmental problems. The absence of a regulatory legal framework for the development of alternative energy is revealed; gaps in energy legislation in terms of innovative energy, stimulation of the introduction of innovative technologies, and the use of renewable energy sources are highlighted. The necessity of highlighting this direction in the energy strategy, other strategic documents in the field of environmental, economic development, energy efficiency and safety has been substantiated. The result of the study is new approaches to the formation and implementation of state policy, as well as the improvement of legislation in the field of innovative energy development.

Анотація:
This research deals with the translation of legal discourse into English and addresses the related problems. As legal translation is becoming increasingly important in the present global world, legal discourse appears to be one of the most challenging areas in translation practice. Hence, the studies in the field of translation in general and institutional-legal interlingual communication, in particular, appear to be of immense topicality. The research objective is to identify the main strategies relevant for legal discourse translation. As a result of the translation techniques analysis, the following effective strategies of legal discourse translation into English have been considered: terminological construction, the strategy of "conscious omissions," and the strategy of "conscious simplifications". Their effectiveness in solving many problems of legal translation into English has been proved, taking into account the dynamics of the legal discourse development, as well as linguistic and cultural factors. The expediency of using the suggested approaches and principles as a linguistic guide is substantiated.

Convergence has blurred the artificial limits that traditionally existed between separated sectors and services. In particular, technological convergence united cable and telephone networks as convenient platforms for the provision of numerous new telecommunications services. The advent of the Internet and the development of other services started a race for the acquisition of broadband transmission that has, in part, prompted a number of corporate mergers between the major telephone, cable, and Internet service providers.
This thesis analyzes the legal implications of the convergence of cable operators and telephone carriers in the United States of America (U.S.). The analysis was conducted in light of the 1996 Telecommunications Act's provisions, the Federal Communications Commission's reports and orders, and under the critical approaches of the cable and telephone industries. This thesis presents recommendations addressed to promote an equal regulatory treatment for all telecommunications competitors in the U.S.

Resumo: Pretende-se, por meio desta pesquisa, apresentar a política Novo Marco Legal da Ciência, Tecnologia e Inovação e sua importância dentro do Sistema Nacional de Inovação no Brasil. Através de um comparativo com indicadores de países selecionados será possível verificar que o Marco Legal é um impulso dentro do que se entende por políticas de Ciência, Tecnologia e Inovação. Para realização dos comparativos foi utilizado dados do Banco Mundial e do Índice Global de Inovação. A política Marco Legal surgiu em 2016 e foi sancionada em 2018 para fortalecer a Lei da Inovação de 2004 que enfrentava instabilidade institucional e entraves na transferência do fluxo de conhecimento. Ficou claro que eram necessárias reformulações, pois as complexidades entre os setores públicos e privados permaneciam. Neste sentido, o Marco Legal de Ciência, Tecnologia e Inovação surge com intuito de desburocratizar as parcerias público-privadas, disciplinar as relações entre governo, empresas e universidades para facilitar a transferência de conhecimento buscando um arcabouço legal e eficaz para estimular o desenvolvimento científico e tecnológico do Brasil. Por fim, a contribuição desta pesquisa dar-se-ia no sentido de apresentar a política Marco Legal e sua relevância para o Sistema Nacional de Inovação brasileiro e para o desenvolvimento social e tecnológico do Brasil.
Abstract: It is intended, through this research, to present the policy New Legal Framework of Science, Technology and Innovation and its importance within the National System of Innovation in Brazil. Through a comparison with selected country indicators, it will be possible to verify that the Legal Framework is an impulse within what is meant by Science, Technology and Innovation policies. To make comparisons, we used data from the World Bank and the Global Innovation Index. The Legal Framework policy came into being in 2016 and was enacted in 2018 to strengthen the 2004 Innovation Law that faced institutional instability and impediments in transferring the flow of knowledge. It was clear that reformulations were necessary because the complexities between the public and private sectors remained. In this sense, the Legal Framework for Science, Technology and Innovation arises with the aim of reducing bureaucratic public-private partnerships, disciplining relations between government, companies and universities to facilitate the transfer of knowledge, seeking a legal and effective framework to stimulate scientific and technological development. technological development in Brazil. Finally, the contribution of this research would be to present the Legal Framework policy and its relevance to the Brazilian National Innovation System and to the social and technological development of Brazil.

The Child Justice Act 75 of 2008 has brought about some new elements in the South African Criminal Justice system in cases involving children in conflict with the law. The changes require that children in conflict with the law should be treated differently from adult accused persons. The Act is now regarded as a Criminal Procedure for children in conflict with the law. In other words the emphasis is on ensuring that children are diverted away from the formal Criminal Justice provided that children acknowledge responsibility. One of the elements that is introduced by the Act is the Preliminary Inquiry that is an informal, pre- trial procedure that must be held in respect of every child that is alleged to have committed an offence. The role of the Presiding Judicial Officer is very active during this stage because he is the one that takes charge of the proceedings and the role of the Prosecutor and the Legal Representative is very minimal. The purpose of the Preliminary Inquiry is in the main to determine whether a child in conflict with the law could be diverted if the provisions of section 52 (1) of the Act are complied with. Preliminary Inquiry if properly used will have possible benefits for the South African Criminal Justice system in that cases involving children will be timeously be finalised and the turn around time for criminal cases in general will possibly improve. Same will translate in the confidence of the citizens being improved in the Justice system. The second element that is introduced by the Act is formalised diversion into the Criminal Justice System. Diversion had for a number of years before the coming into operation of the Child Justice Act been used in South Africa but it was informal. The diversion that is envisaged by the Act is restorative in nature in that the Act seeks to involve the child offender, the victim, the community members to collectively identify and address harms, needs and obligations through accepting responsibility, making restitution, taking measures to prevent recurrence of the incident and promoting reconciliation. Restorative Justice is not a new invention in the South African legal system it is a return to traditional patterns of dealing with conflict and crime that had been present in different cultures throughout human history. Restorative Justice has been understood as Ubuntu in the African context. The Truth and Reconciliation Commission demonstrated the benefits of restorative justice in dealing with conflicts that had a potential of setting the country alight. Restorative Justice has evolved in South Africa throughout different historical epochs up to the current legal conjuncture. It has now been endorsed with success in precedent setting cases in the High Courts of the Republic and the Child Justice Act has now fully institutionalised it into the Criminal Justice system. One hopes that it will be extended beyond cases involving children in conflict with the law but to adult accused persons. Various pieces of legislation attempt to endorse the principles of restorative justice but are not as comprehensive as the Child Justice Act. There are 4 instances where a matter may be diverted in terms of the Act: (i) By a Prosecutor in terms of section 41; (ii) Diversion at Preliminary inquiry; (iii) Diversion before the closure of state case at trial; (iv) At any time during trial but before judgement. There are 2 diversion options that are provided by the Act that is level one diversion option in respect of schedule 1 offences and level 2 diversion options in respect of schedule 2 and 3 which are much more serious. The Act further entrenches Family Group Conference as well as Victim Offender Mediation which are restorative justice mechanisms. The legal consequences of diversion are that when the child has successfully complied is equivalent to an acquittal. The last element is the multi sectoral approach to crime fighting in that all role players should work together in dispensing justice to children in conflict with the law. The days of working in silos are now over because everybody has a role to play and there has to be collaboration at all levels. The Act entrenches the public private partnerships particularly in helping to rehabilitate and reintegrate children to society. The Act provides for the establishment of One Stop Child Justice Centres. The purpose is to promote cooperation between government departments, non governmental organisations and civil society to ensure integrated and holistic approach in the implementation of the Act. The Act further provides for the development of the National Policy Framework by the Departments of Justice and Constitutional Development, Social Development, Correctional Services, South African Police Services, Education and Health within 2 months of the commencement of the Act. The purpose is to ensure uniform, coordinated and cooperative approach by all government departments, organs of state and institutions in dealing with matters of child justice and enhance service delivery. This study seeks to examine the innovations brought about by the Child Justice Act into the South African Criminal Justice System. The study further explores the possible benefits that may accrue to the Criminal Justice System because of Preliminary Inquiry, Restorative Justice and the Multi Sectoral Approach to crime.

ENGLISH ABSTRACT: The monitoring of electronic communication is likely to face all employers sooner or later. The rapid advancement in technology aimed at helping to monitor electronic communication, makes it easier than ever before for employers to monitor the electronic communications of their employees. There are important questions to consider when dealing with the topic of monitoring electronic communication. Examples include "mayan employer legally monitor electronic communications?" and "how does monitoring affect the employee's right to privacy?" This thesis is an attempt to answer these and other related questions by analysing, inter alia, South African legislation, the Constitution and case law, as well as comparing the law as it applies in the United Kingdom and the United States of America. The analysis and conclusion offered in this thesis aim to provide theoretical consideration to academics and practical application for employers that are faced with the reality of monitoring electronic communications.

Most law firms have done little to address the opportunities and threats related to potentially disruptive technology (DT), such as artificial intelligence (AI) and machine learning (ML). The purpose of this multiple case study was to explore strategies that law firm leaders in the United States used to address the potentially detrimental influences of DT, such as AI and ML, on their organizations. The systems approach to management was employed as the conceptual framework. Data were collected from 6 participants at 2 international law firms with offices in California using semistructured interviews and organizational artifacts. Data were analyzed using Miles, Huberman, and Saldana's data analysis method, resulting in 4 themes: recognizing the legal ecosystem and legal firms are open systems, but organizational subsystems often function as semiclosed systems; acknowledging that while DT represents the most significant potential challenge in the near future, the immediate challenge is improving technology, which requires organizational adjustments; recognizing the need for firms to invest more heavily in innovation generation activities; and realizing the need for increased utilization of augmenting technologies, such as AI or ML, to streamline nonadvisory outputs. The findings of this study might support best practices for addressing DT and contribute to social change by outlining ways in which firms can lower costs to clients while increasing access to legal services for those in underserved communities.

La « Contribution à l’étude de la contrainte du temps dans le contrat de travail » propose de vérifier les effets de la représentation du temps par le Droit face aux difficultés qu’engendrent les évolutions impactant le travail salarié. Le Droit et le temps sont intrinsèquement liés : le Droit matérialise et objectivise le temps alors que ce dernier justifie notamment les innovations juridiques. Cette forte influence mutuelle du temps et du Droit amène à se questionner sur la pertinence de la représentation juridique du contrat de travail face à l’usage massif des algorithmes au sein du travail salarié. Pour répondre à cette problématique, cette étude entend démontrer la création d’une représentation juridique du contrat de travail du fait de la perception du temps par le Droit, ainsi que la transformation de la perception du travail salarié, en prenant appui sur l’intelligence artificielle et les plateformes numériques. Une réponse se profile dès lors : la représentation juridique du contrat de travail, résultat de l’action du Droit sur le temps, peut servir de socle de protection du travailleur face à l’importante utilisation de l’intelligence artificielle et des plateformes numériques. L’adaptation de la représentation juridique du contrat de travail permettrait de bénéficier des avantages de ces progrès technologiques tout en encadrant leur usage
The « Contribution to the study of the time constraint in the employment contract » proposes to verify the effects of the representation of time by the Law in the face of the difficulties generated by the evolutions impacting employed labour. Law and time are intrinsically linked: law materialises and objectifies time, while the latter justifies legal innovations. This strong mutual influence of time and law leads us to question the relevance of the legal representation of the employment contract in the face of the massive use of algorithms in salaried work. To answer this question, this study intends to demonstrate the creation of a legal representation of the employment contract due to the perception of time by the Law, as well as the transformation of the perception of salaried work, based on artificial intelligence and digital platforms. An answer is therefore emerging: the legal representation of the employment contract, the result of the action of the Law on time, can serve as a basis for the protection of the worker in the face of the important use of artificial intelligence and digital platforms. The adaptation of the legal representation of the employment contract would make it possible to benefit from the advantages of these technological advances while supervising their use

L’innovation permet d’améliorer la santé des patients mais elle est aussi importante pour le développement économique du secteur pharmaceutique. En dépit de son importance, la définition de cette notion dans le domaine de la santé est très complexe. Dans notre travail nous apportons des éléments de réponse à la définition de la notion de « médicament innovant » dans une perspective communautaire et nationale. Puis nous avons procédé à une analyse des normes juridiques appliquées à la régulation du marché des médicaments innovants. L’Union européenne, ainsi que la France, mettent en œuvre des initiatives politiques favorisant la recherche dans le domaine de l’innovation pharmaceutique. Les normes juridiques sont utilisées pour organiser un accès précoce aux médicaments prometteurs ; elles peuvent également inciter au développement de médicaments innovants et jouer un rôle important dans leur valorisation. Une étude comparative entre la France et l’Angleterre a mis en évidence une tendance au développement d’outils similaires utilisés dans le champ de la régulation du marché des médicaments innovants. Enfin, dans ce domaine dans lequel l’innovation n’est pas définie par les usagers, le cadre juridique joue un rôle crucial, renforcé à l’heure actuelle par un contexte de contrainte budgétaire
Innovation improves the health of patients, and it is also important for economic development of the pharmaceutical sector. Despite its importance, the definition of this concept in the field of healthcare is very complicated. In our work we provide answers to the definition of the term "innovative drug" from European community and national perspectives. Then we analyze the use of legal norms in regulating the market of innovative medicines. The European Union and France have policy initiatives encouraging research of innovative drugs. Legal standards are used to organize early access to promising drugs, they also serve to promote the discovery of innovative drugs, as well as play an important role in the development of these drugs. A comparative study between France and England showed the tendency in using the same tool regulating the market of innovative drugs. Finally, in the field where innovation is not defined by the users a legal framework plays a crucial role, and considering current budget constraints, its role is strengthened

Our society’s history is intricately linked to that of legal professionals. They are the connection between the subjects of legal proceedings and the State, giving it the opportunity to implement its sovereign prerogative of serving justice. Each evolution in their activity therefore has repercussions on all citizens. In the past fifty years legal professionals have known profound changes. These mutations affect them in many ways, for instance by the modification of their legal status. They have also changed the way they work by the progressive introduction of new technologies. The recent phenomenon of digital transformation has been accentuated by the apparition of open data which has encouraged new actors, known as LegalTech, to cater digital services to legal circles. Just like legal publishers, these new entities foster the diffusion of new techniques which are then applied by legal professionals. AbstractInnovation plays an important role in the transition towards a more sustainable energy system. The law is often thought of as an inhibiting factor for innovation. However, legal provisions may also serve to promote innovation. Laws which stipulate favourable conditions for renewable energy sources are an obvious example. Finally, existing laws will often not be suited to accommodate a new technology or business model, and the legislator may be slow in reacting to these new challenges. This increases the importance of government agencies as well as non-state governance.Therefore, a closer look at the governance of innovations in the energy sector seems warranted. This chapter will investigate how the legislator, regulatory agencies and private standard-setting bodies are responding to three different energy innovations: new renewable energy sources, new storage systems and smart grids. This chapter will serve not only to analyse commonalities and differences in the approach, but also to identify best practices.

We explored some of the questions posed by digitalisation in an accompanying working paper focused on constitutional theory: Digitalisation, the ‘Fourth Industrial Revolution’ and the Constitutional Law of Privacy in South Africa. In that paper, we asked what legal resources are available in the South African legal system to respond to the risk and benefits posed by digitalisation. We argued that this question would be best answered by developing what we have termed a 'South African public law perspective'. In our view, while any particular legal system may often lag behind, the law constitutes an adaptive resource that can and should respond to disruptive technological change by re-examining existing concepts and creating new, more adequate conceptions. Our public law perspective reframes privacy law as both a private and a public good essential to the functioning of a constitutional democracy in the era of digitalisation. In this working paper, we take the analysis one practical step further: we use our public law perspective on digitalisation in the South African health sector. We do so because this sector is significant in its own right – public health is necessary for a healthy society – and also to further explore how and to what extent the South African constitutional framework provides resources at least roughly adequate for the challenges posed by the current 'digitalisation plus' era. The theoretical perspective we have developed is certainly relevant to digitalisation’s impact in the health sector. The social, economic and political progress that took place in the 20th century was strongly correlated with technological change of the first three industrial revolutions. The technological innovations associated with what many are terming ‘the fourth industrial revolution’ are also of undoubted utility in the form of new possibilities for enhanced productivity, business formation and wealth creation, as well as the enhanced efficacy of public action to address basic needs such as education and public health.

The article presents the possibilities of using game simulator Sotware Inc in the training of future software engineer in higher education. Attention is drawn to some specific settings that need to be taken into account when training in the course of training future software engineers. More and more educational institutions are introducing new teaching methods, which result in the use of engineering students, in particular, future software engineers, to deal with real professional situations in the learning process. The use of modern ICT, including game simulators, in the educational process, allows to improve the quality of educational material and to enhance the educational effects from the use of innovative pedagogical programs and methods, as it gives teachers additional opportunities for constructing individual educational trajectories of students. The use of ICT allows for a differentiated approach to students with different levels of readiness to study. A feature of any software engineer is the need to understand the related subject area for which the software is being developed. An important condition for the preparation of a highly qualified specialist is the independent fulfillment by the student of scientific research, the generation, and implementation of his idea into a finished commercial product. In the process of research, students gain knowledge, skills of the future IT specialist and competences of the legal protection of the results of intellectual activity, technological audit, marketing, product realization in the market of innovations. Note that when the real-world practice is impossible for students, game simulators that simulate real software development processes are an alternative.

Increasingly, both industry and academia, in fields ranging from biology and social sciences to computing and engineering, are driven by data (Provost & Fawcett, 2013; Wixom, et al, 2014); and both commercial success and academic impact are dependent on having access to data. Many organizations collecting data lack the expertise required to process it (Hazen, et al, 2014), and, thus, pursue data sharing with researchers who can extract more value from data they own. For example, a biosciences company may benefit from a specific analysis technique a researcher has developed. At the same time, researchers are always on the search for real-world data sets to demonstrate the effectiveness of their methods. Unfortunately, many data sharing attempts fail, for reasons ranging from legal restrictions on how data can be used—to privacy policies, different cultural norms, and technological barriers. In fact, many data sharing partnerships that are vital to addressing pressing societal challenges in cities, health, energy, and the environment are not being pursued due to such obstacles. Addressing these data sharing challenges requires open, supportive dialogue across many sectors, including technology, policy, industry, and academia. Further, there is a crucial need for well-defined agreements that can be shared among key stakeholders, including researchers, technologists, legal representatives, and technology transfer officers. The Northeast Big Data Innovation Hub (NEBDIH) took an important step in this area with the recent "Enabling Seamless Data Sharing in Industry and Academia" workshop, held at Drexel University September 29-30, 2016. The workshop brought together representatives from these critical stakeholder communities to launch a national dialogue on challenges and opportunities in this complex space.

The law plays a vital role in how artificial intelligence can be developed and used in ethical ways. But the law is not enough when it contains gaps due to lack of a federal nexus, interest, or the political will to legislate. And law may be too much if it imposes regulatory rigidity and burdens when flexibility and innovation are required. Sound ethical codes and principles concerning AI can help fill legal gaps. In this paper, CSET Distinguished Fellow James E. Baker offers a primer on the limits and promise of three mechanisms to help shape a regulatory regime that maximizes the benefits of AI and minimizes its potential harms.
