Fed up with the decades-old violence plaguing the DRC, the UN Security Council broke new ground by granting peacekeepers an offensive mandate to pursue rebels rather than waiting to react in self-defence. This transformation in UN military operations alarmed several States, concerned over a perceived loss of sovereignty and a weakening of the principle of non-intervention. To allay these fears, Resolution 2098’s drafters incorporated a provision expressly assuring Member States that offensive peacekeeping tactics in the DRC would not generate precedent for future UN action. However, examining past UN practice and ‘slippery slope’ theory alike reveals that explicit disavowal of precedent cannot guarantee that offensive peacekeeping will not be used as a template for future UN action. In fact, the incorporation of such language may foster the generation of a slippery slope in UN peacekeeping, ultimately paving the way for increased scope of UN intervention in situations of gross human rights violations. The article concludes by proposing a framework for how actors can manipulate slopes to generate or slow precedent for future UN action.

Automatic cyber defence describes computer operations to neutralise a cyber attack. Once a system detects that it is under cyber attack, it automatically launches offensive cyber operations that pursue the attacker back to its own network with the objective of rescuing stolen data or disabling or destroying the computer hardware and software that is responsible for hosting and distributing the attacking code. The aim of this article is to examine the legality of automatic cyber defence under the law regulating the use of force in international law (jus ad bellum) and under international humanitarian law (jus in bello). Thus, the first part of this article examines automatic cyber defence in the context of the jus ad bellum by considering the legal requirements of an armed attack, necessity, and proportionality. In the second part, it examines the jus in bello aspects of automatic cyber defence and, in particular, whether it triggers an international or a non-international armed conflict and, if so, whether it can comply with the principles of distinction and proportionality.

The Territorial Defence Forces (TDF, Polish abbrev. WOT) are to participate in combat counter-subversive operations, alone or in cooperation with other security actors. Using both offensive and protective-defensive forms and methods, they will create freedom of action for operational troops. Precise reconnaissance of the area, infrastructure knowledge in permanent areas of responsibility (Polish abbrev. SRO), cooperation with the non-military system (Polish abbrev. UPM), and cooperation with the local population in combination with the training of the TDF commanders and soldiers equipped with modern weaponry, reconnaissance and object monitoring systems will ensure good quality of protection while reducing the number of human resources involved. All forms and methods of conducting combat counter-subversive activities presented in the article are a compilation of the content contained in the literature on the subject and the practical conduct of training classes with cadets and officers at the Military University of Land Forces.

Abstract As a response to the Russian invasion of Crimea, NATO returned to the core military concepts of deterrence and collective defence. This NATO adaption has recently come to include attempts to integrate offensive cyber effects into NATO force structure and response doctrine. The article argues—counter to what is publicly declared—that such an integration does little to strengthen NATO's deterrence posture and is unlikely to deter non-military, hybrid cyber activity below the threshold of collective defence. The article identifies several practical challenges to the current integration effort, which include the temporal dimension of developing exploits, battle damage assessment and deconfliction. With these challenges in mind, the article suggests that deploying minor and less resourceful cyber effects that cause persistent ‘cyber annoyances’ holds an unappreciated potential as they can drain opponent resources, disturb vital IT-systems and complicate decision-making. The article ends by arguing that NATO should not adapt its collective defence clause to cyberspace. A more active NATO in cyberspace risks undermining the cyber-intelligence norm that so far has prevented escalation and thereby increasing the likelihood that Russia misinterprets intelligence and active cyber defence activities as military preparation, armament or an attack in the making.

This thesis takes the initial steps to find what it calls a ‘posture of peace’, a counterpart to what Hobbes refers to as a posture of war (Hobbes 1651/2004: 79)1. A posture of war representsdefensive initiatives that can be interpreted by others as a certain preparation for conflict, and its base definition is used as a template to formulate an initial version of a posture of peace2.While keeping this concept as an overarching theme throughout the thesis explores the concepts of nuclear posture and a credible minimum deterrence (CMD) through the examples of India and Pakistan. While the thesis discusses four different nuclear postures, there really are only two categories, namely the pro-nuclear and anti-nuclear posture. The main examples of pronuclear posture used here is the case of India and Pakistan, two geographical neighbouring Nuclear Weapon States (NWS) who have been experiencing ongoing frictions and conflicts since (and prior to) becoming nuclear powers. On the other side Kazakhstan serves as an example of an anti-nuclear posture and in regards to the nuclear debate a possible empirical example of a posture of peace. In addition to these postures there is also the concept of NonOffensive Defence (NOD), which is more exemplified in the Kazakhstan’s approach to their nuclear situation as well as their more contemporary initiative in collaboration with several other neighbouring states to form the Central Asia Nuclear Weapons Free Zone (CANWFZ). The thesis concludes that while NOD finds little support in pro-nuclear posturing, there is ample space for it over on the ani-nuclear posture side of the spectrum which in addition aligns more with the present interpretation of a posture of peace. Moreover, the CANWFZ initiative appears to be as close a perfect example of a NOD in the present case and as close as this stage of the research will come to observing a posture of peace.
