Анотація:
The principal aim of this paper is the need for standardization of jus cogens norms, which besides their definition by the Vienna Convention on the Law of Treaties have been further developed by international courts. The paper is divided in four parts that include the characterization of jus cogens norms, their development in the early history of international law, the development of these norms by international and regional courts and ends with the need of unification of jus cogens norms. A general conclusion thus can be drawn. The international courts, in order not to become inclined to use controversial terms of jus cogens norms, necessitate for a harmonized system and standardization of these norms in order to further develop jus cogens norms. Thus, the fulfillment of these norms through standardization allows us to think that one day all international wrongful acts will become at some point world-wide derogatory. Šī raksta galvenais mērķis ir vajadzība standartizēt jus cogens normas, kuras papildus to definīcijai Vīnes konvencijā par starptautisko līgumu tiesībām ir tālāk attīstījušas starptautiskās tiesas. Šis raksts ir sadalīts četrās daļās, kas ietver jus cogens normu raksturošanu, to attīstību starptautisko tiesību agrākajā vēsturē, šo normu izstrādi starptautiskajās un reģionālajās tiesās un noslēgumā – nepieciešamību unificēt jus cogens normas. Raksta noslēgumā iespējams izteikt galvenos secinājumus par analizēto jautājumu. Starptautiskās tiesas, lai nebūtu spiestas izmantot pretrunīgus jus cogens normu terminus, ir aktualizējušas nepieciešamību pēc vienotas sistēmas un šo normu unifikācijas / standartizācijas, lai turpinātu attīstīt jus cogens normas un to piemērošanu.

Resumen: Antes de emprender el análisis lógico de las normas jurídicas constitucionales, o de las normas en general, es preciso intentar resolver una cuestión previa que afecta a la posibilidad de existencia de una lógica de las normas: el dilema de Jørgensen. Nuestra propuesta de solución de este dilema es la siguiente: las normas son expresiones performativas. Al mismo tiempo, las expresiones performativas son enunciados que tienen valor de verdad. Además, las normas jurídicas son enunciados del tipo “A dice p”, lo que explica que puedan existir normas verdaderas y, al mismo tiempo, contradictorias entre sí. Abstract: Before embarking on the logical analysis of constitutional legal norms or norms in general, it is necessary to try to resolve a previous question that affects the possibility of the existence of a logic of norms: the Jørgensen’s dilemma.Our proposed solution to this dilemma is as follows: norms are performative utterances. At the same time, performative utterances are statements that have truth value. In addition, the legal norms are statements of type “A says p”, which explains that there may be true norms and, at the same time, contradictory to each other.

We argue that there is no uncontroversial independent justification for the normativity of Bayesian inference, and that O&C fail to satisfy a necessary condition for teleological explanations: demonstration that the normative prescription played a causal role in the behavior's existence.

We found support for the hypothesis that, under conditions of ill-formed intentions, subjective norms measured after group interaction can affect behavior directly. Perceived subjective norms converged within groups for subjects in a discussion condition, and these “normalized” subjective norms affected behavior directly. Based upon previous research, we expected that attitudes and subjective norms can influence behavior directly because ill-formed intentions are inconsistent with behavior. Instead, we found that attitudes and subjective norms affected behavior directly for discussion subjects even when ill-formed intentions were, consistent with behavior. The findings indicate that, under conditions of ill-formed intentions, the manner of attitudes and subjective norm formation may be more crucial for predicting behavior than the strength of the intention-behavior relationship.

AbstractPeople develop and deploy epistemic norms – normative sensibilities in light of which they regulate both their individual and community epistemic practice. There is a similarity to folk's epistemic normative sensibilities – and it is by virtue of this that folk commonly can rely on each other, and even work jointly to produce systems of true beliefs – a kind of epistemic common good. Agents not only regulate their belief forming practices in light of these sensitivities, but they make clear to others that they approve or disapprove of practices as these accord with their sensibilities – they thus regulate the belief forming practices of others in an interdependent pursuit of a good – something on the order of a community stock of true beliefs. Such general observations suggest ways in which common epistemic norms function as social norms, as these are characterized by Cristina Bicchieri's (2006) discussion of various kinds of norms. I draw on this framework – together with an important elaboration in Bicchieri (2017) – as it affords an analysis of the various related ways in which normative sensibilities function in communities of interdependent agents. The framework allows one to probe how these normative sensibilities function in the various associated choice situations. I argue that epistemic norms are fundamentally social norms, and, at the same time, they also are widely shared sensibilities about state-of-the-art ways of pursuing projects of individual veritistic value. The two foundations suggest the analogy of an arch.

INTRODUÇÃO: O presente estudo realizou a tradução e adaptação do Affective Norms for English Words (ANEW) para o português brasileiro (ANEW-Br) e obteve medidas de emocionalidade para um conjunto de 1.046 palavras em português. MÉTODO: Uma amostra de 755 universitários de ambos os sexos utilizou as escalas de valência e alerta do Self-Assessment Manikin para julgar a emocionalidade de 1.046 palavras em português. RESULTADOS: Os valores de valência ficaram no intervalo de 1,16 a 8,80, enquanto que os valores de alerta ficaram no intervalo de 2,22 a 7,67. Análises adicionais indicaram que as medidas de valência e alerta se mostraram fidedignas, além de sugerir adequação do método utilizado para coleta das medidas de emocionalidade. CONCLUSÃO: A disponibilização das normas brasileiras para o ANEW representa um avanço metodológico para pesquisadores brasileiros no desenvolvimento de futuros estudos sobre os efeitos da emoção na cognição humana.

A partir do momento em que Donald Trump foi eleito presidente, críticos se angustiaram com o colapso das normas constitucionais. A história demonstra, no entanto, que as normas constitucionais estão perpetuamente em fluxo. A principal fonte de instabilidade não é que essas regras não-escritas possam ser destruídas por políticos que negam sua legitimidade, sua validade ou seu valor. Na verdade, a principal fonte de instabilidade é que as normas constitucionais podem ser decompostas- interpretadas dinamicamente e aplicadas de formas consideradas adequadas, mas que limitam sua capacidade de restringir a conduta de agentes do governo.Este artigo chama a atenção para essa instabilidade latente e, ao fazê-lo, começa a taxonomizar e teorizar a estrutura da mudança da norma constitucional. Exploramos alguns dos diferentes modos em que normas não-escritas colapsam em nosso sistema constitucional e os diferentes perigos e oportunidades associados a cada um deles. Além disso, argumentamos que, sob certas condições plausíveis, será mais preocupante quando as normas forem sutilmente revisadas do que quando forem abertamente desprezadas. Este argumento um tanto paradoxal sugere que muitos comentaristas têm julgado de forma equivocada nosso momento atual: o flagrante desafio do presidente Trump às normas pode não ser uma ameaça tão grande à nossa democracia constitucional como a deterioração mais complexa de normas em curso em outras instituições.

Penelitian ini bertujuan untuk mendeskripsikan nilai norma masyarakat dalam permainan Jawa Kuda Lumping. Penelitian deskriptif kualitatif ini menggunakan model studi kasus dengan melakukan observasi terhadap pertunjukan Kuda Lumping dan wawancara dengan pihak terkait. Hasil penelitian menunjukkan bahwa norma-norma kemasyarakatan yang terdapat dalam praktik kesenian Kuda Lumping pada masyarakat Jawa pada umumnya dan Indonesia pada khususnya antara lain: pertama, norma agama, yang bertentangan karena ritual tersebut dianggap syirik. Kedua, norma kesopanan kelompok kesenian Kuda Lumping dalam pertunjukan selalu memperhatikan kepentingan yang ada di masyarakat. Ketiga, norma kesusilaan terlihat dari hubungan penari kuda lumping dengan penontonnya. Keempat, kesenian Kuda Lumping masih diperbolehkan jika dilihat dari norma hukum sejauh pada saat dipentaskan tidak melanggar aturan hukum yang ada di negara Indonesia pada khususnya. Oleh karena itu, temuan empat norma masyarakat dalam permainan Jawa Kuda Lumping merepresentasikan budaya Indonesia yang masih hidup dalam masyarakat.Community norms in the traditional Javanese game “Kuda Lumping”This study aimed to describe the community norms contained in the traditional Javanese game named Kuda Lumping. This qualitative descriptive research used a case study model by observing Kuda Lumping show and interviews with some related parties. The results of the study show that the social norms contained in the practice of Kuda Lumping include: First, regarding religious norms (which are predominantly Muslim), this game is considered contradictory because the ritual is considered Shirk or the sin of idolatry or polytheism. Second, in the norm of decency, the Kuda Lumping art group in performances always pays attention to the interests of the community. Third, in the moral norm, there is a close relationship between the Kuda Lumping dancers and the audience. Fourth, judging from legal norms, if there are no acts that violate legal norms, performances are still permitted. From the four societal norms, it can be concluded that Kuda Lumping represents Indonesian culture that is still alive in society.

Abstract:Finnemore and Sikkink’s norms life cycle model (NLCM) is a powerful heuristic device that continues to be a mandatory point of reference for theoretical and empirical scholarship on norm change. Yet the internalisation stage as conceptualised in the NLCM is problematic. Drawing from Wiener’s Theory of Contestation, this article proposes to reconceptualise the norm internalisation stage as the phase at the extreme of the norm cascade in which inherently contested norms simultaneously enjoy formal validity, social recognition, and cultural validation among stakeholders. Unlike Finnemore and Sikkink’s, this conceptualisation focuses solely on norm validity and does not assume ‘almost automatic’ compliance. While Finnemore and Sikkink emphasise habit and institutionalisation as mechanisms of internalisation, the proposed conceptualisation highlights the role of applicatory contestation under conditions of high contestedness. Furthermore, I argue that internalised norms continue to be contested. Finally, my conceptualisation explicitly incorporates norm regression as the fourth stage of the NLCM. Norms might regress because they become obsolete, they change, or they are replaced. To assess the descriptive power of the proposed conceptualisation vis-à-vis Finnemore and Sikkink’s, the article applies them to the analysis of the norm that prohibits torture.

Abstract.This paper explores how citizenship norms of duty to vote and to volunteer in one's community influence political participation, and the role of group identities in producing these norms. By showing how citizenship norms influence an array of political activities, and by drawing on social psychology literature that shows how citizenship norms are shaped by group identifications, the paper offers a more complete picture of the relationship between citizenship norms and political participation beyond traditional civic duty/federal vote models that currently dominate Canadian political research. The central argument forwarded is that not only do citizenship norms matter to political participation, but that group identities matter, too.Résumé.Cette étude explore les effets sur la participation politique des normes relatives au devoir du citoyen de voter et de contribuer à sa communauté, de même que le rôle des identités de groupe dans la production de ces normes. En montrant comment les normes de citoyenneté influencent une foule d'activités politiques et en puisant dans la littérature en psychologie sociale, qui montre comment ces normes sont formées par des identifications de groupe, cette étude aide à mieux comprendre la relation entre ces normes et la participation politique au-delà du cadre traditionnel devoir civique / vote fédéral qui domine actuellement la recherche en politique canadienne. La thèse avancée est que les normes de citoyenneté jouent effectivement un rôle important dans la participation politique, tout comme les identités de groupe.

The purpose of this study is to explore the historical roots of the legal norms (religion) Islam is built by the Prophet Muhammad and also explore the norms of Christianity which became an integral part of the legal sources of usul fiqh inclusive paradigm. The theoretical framework of this study is to use blending approach the horizon (fushion of horizons) in the hermeneutics of Hans George Gadamer and shar’ man qablana theory. The results show that there is continuity of the norms of Christianity in the development discourse of Islamic law/jurisprudence, so that the norms of the Christian religion can be a source of usul fiqh paradigm inclusive. The character of legal norms/Islam which has the accommo- dative properties -in addition to corrective attitude towards ancient religions norms - be a strong indicator continuity. In this continuity, Imam Abu Hanifa, Imam Ahmad Ibn Hanbal, Muhammad Abduh, Rashid Ridla, Nurcholish Madjid and Shihab acknowledge the continuity of Christianity norms in the development of legal discourse such a ban “alcohol”, the command “fasting” and “ do good to others”. In the context of pluralism in Indonesia, usul fiqh iklusif paradigm is necessary to build an inclusive legal discourse-dynamic. Tujuan kajian ini adalah untuk mendalami akar sejarah norma hukum (agama) Islam yang dibangun oleh Nabi Muhammad Saw.. dan juga mendalami norma agama Nasrani yang menjadi bagian integral dari sumber hukum paradigma usul fikih inklusif. Adapun kerangka teori kajian ini adalah menggunakan pendekatan pembauran cakrawala (fusion of horizons) dalam hermeneutika Hans George Gadamer dan teori shar’ man qablana. Hasil kajian menunjukkan bahwa ada kontinuitas norma-norma agama Nasrani dalam pembangunan wacana hukum Islam/ fiqh, sehingga norma-norma agama Nasrani dapat menjadi sumber dalam paradigma usul fiqh inklusif. Karakter norma hukum/ agama Islam yang memiliki sifat akomodatif –di samping sikap korektif terhadap norma agama-agama terdahulu- menjadi indikator kuat adanya kontinuitas. This study analyzes about the responsibilities of civil servants (PNS) who does cases of illegal levies. The problem formulation is why do PNS who does illegal levies will be subject to personal responsibility not job responsibilities. This article concludes that violations of norms committed by PNS will incur legal consequences in the form of responsibility to the injured party. The norms that must be obeyed by civil servants in carrying out their duties are the norms of government (bestuursnorm) and norms of behavior (gedrasnorm). Accountability for violations of government norms will later be directed to government positions, with compensation imposed on agencies, with a touchstone using the principles of legality, principles of specialty, and general principles of good governance. While accountability for violations of the norms of behavior will be addressed to the relevant office holders or civil servants, with a touchstone using maladministration. Illegal levies are included in the category of maladministration, therefore in conducting maladministration which is a violation of the norms of behavior will cause legal consequences in the form of personal responsibility. Abstrak Artikel ini membahas tentang tanggung jawab pegawai negeri sipil (PNS) yang melakukan kasus pungutan liar. Permasalahan yang dibahas adalah mengapa PNS yang melakukan pungutan liar dikenakan tanggung jawab pribadi dan bukan tanggung jawab jabatan. Artikel ini menyimpulkan bahwa pelanggaran norma yang dilakukan oleh PNS akan menimbulkan konskuensi hukum berupa tanggung jawab kepada pihak yang dirugikan. Adapun norma yang yang harus dipatuhi pegawai negeri sipil dalam melaksanakan tugasnya adalah norma pemerintahan (bestuursnorm) dan norma perilaku (gedrasnorm). Pertanggungjawaban terhadap pelanggaran norma pemerintahan tersebut nantinya akan ditujukan kepada jabatan pemerintahan, dengan ganti rugi dibebankan kepada instansi, dengan batu uji menggunakan asas legalitas, asas spesialitas, dan asas-asas umum pemerintahan yang baik. Sedangkan pertanggungjawaban terhadap pelanggaran norma perilaku akan ditujukan kepada pemangku jabatan atau PNS yang bersangkutan, dengan batu uji menggunakan maladministrasi. Pungutan liar termasuk dalam kategori perbuatan maladministrasi, oleh karena itu dalam melakukan maladministrasi yang merupakan pelanggaran terhadap norma perilaku akan menimbulkan konsekuensi hukum berupa tanggung jawab pribadi.

Abstract. The purpose of this paper is to offer a different perspective on millennials' green consumption habits. To analyse this research, several determining factors must be considered. Among others are self-image congruence, attitude, subjective norms, perceived behavior control, moral norms, online green product review and green product purchase intention. Hypothesis testing was carried out using the structural equation model (SEM) method with the help of AMOS software. Purposive random sampling was used to select 214 respondents for this study. The sample used in this study were customers who had purchased green fashion. Variables that influence in this research are self-image on green product review, attitude on green product review, subjective norms on green product review, subjective norms on moral norms, self-image on green product purchase, attitude on green product purchase, subjective norms on green product purchase, perceived behavior control on green product purchase, green product review on green product purchase and moral norms on green product purchase. Abstrak. Tujuan dari makalah ini adalah untuk menawarkan perspektif yang berbeda tentang kebiasaan konsumsi hijau generasi milenial. Untuk menganalisis penelitian ini, beberapa faktor penentu harus dipertimbangkan. Antara lain keselarasan citra diri, sikap, norma subjektif, kontrol perilaku yang dirasakan, norma moral, review produk hijau online dan niat beli produk hijau. Pengujian hipotesis dilakukan dengan menggunakan metode structural equation model (SEM) dengan bantuan software AMOS. Purposive random sampling digunakan untuk memilih 214 responden generasi milenial untuk penelitian ini. Sampel yang digunakan dalam penelitian ini adalah pelanggan yang pernah membeli green fashion. Variabel-variabel yang berpengaruh dalam penelitian ini adalah citra diri pada ulasan produk ramah lingkungan, sikap pada ulasan produk ramah lingkungan, norma subjektif pada ulasan produk ramah lingkungan, norma subjektif pada norma moral, citra diri pada pembelian produk ramah lingkungan, sikap pada pembelian produk ramah lingkungan, norma subjektif pada pembelian produk hijau, kontrol perilaku yang dirasakan pada pembelian produk hijau, ulasan produk hijau pada pembelian produk hijau dan norma moral pada pembelian produk hijau.

Norma sosiomatematik merupakan sebuah norma sosial yang bernuansa matematika. Dengan norma sosiomatematika, kecerdasan yang dimiliki siswa dapat dikembangkan karena norma ini sangat terkait dengan negosiasi dan interaksi antar siswa dan interaksi siswa dengan guru. Namun norma sosiomatematik dapat dinyatakan baik dalam proses pembelajaran di dalam kelas jika minat belajar terhadap matematika yang dimiliki siswa juga baik, karena minat merupakan dorongan dari dalam diri seseorang tanpa ada yang memaksa. Tujuan dalam penelitian ini adalah untuk mengetahui bagaimanakah analisis norma sosiomatematik ditinjau dari minat belajar matematika. Penelitian ini merupakan penelitian jenis kualitatif dengan metode yang digunakan adalah deskriptif kualitatif. Data dalam penelitian ini berupa data norma sosiomatematik dan minat belajar matematika yang didapatkan dari hasil lembar obsevasi norma sosiomatematik, angket minat belajar matematika dan wawancara terhadap siswa kelas VIII-F. Penelitian ini menggunakan triangulasi teknik, yaitu mencocokkan data norma sosiomatematik dan minat belajar matematika melalui beberapa teknik yang berbeda, yaitu lembar observasi, angket dan wawancara. Berdasarkan hasil penelitian, 30 subjek penelitian memiliki rata-rata norma sosiomatematik diatas persentase 50% atau dapat dikatakan subjek penelitian tersebut memiliki norma sosiomatematik dalam kategori baik dan untuk minat belajar matematika juga menunjukan kategori baik dengan hasil rata-rata 62 %. Maka dapat disimpulkan bahwa norma sosiomatematik dapat dikatakan baik jika minat belajar terhadap pelajaran matematika juga baik. Kata kunci: norma sosiomatematik, minat belajar matematika. ABSTRACT Sociomatematic norms are a social norm that has mathematical nuances. With sociomatematic norms, intelligence possessed by students can be developed because this norm is closely related to negotiation and interaction between students and the interaction of students and teachers. But sociomatematic norms can be expressed both in the learning process in the classroom if the interest in learning about mathematics that is owned by students is also good, because interest is an encouragement from someone without being forced. The purpose of this study was to find out how the analysis of sociomatematic norms in terms of interest in learning mathematics. This research is a qualitative type of research with the method used is descriptive qualitative. The data in this study are sociomatematic normative data and mathematics learning interest obtained from the results of sociomatematic norms observation sheet, mathematics learning interest questionnaire and interviews with students of class VIII-F. This study uses triangulation techniques, which match the sociomatematic norm data and interest in learning mathematics through several different techniques, namely observation sheets, questionnaires and interviews. Based on the results of the study, 30 research subjects had the above average sociomatematic norms the percentage of 50% or it can be said that the research subject had sociomatematic norms in the good category and for mathematics learning interest also showed a good category with an average yield of 62%. Then it can be concluded that sociomatematic norms can be said to be good if the interest in learning about mathematics is also good. Keywords: sociomatematic norms, interest in learning mathematics.

Internalization is at study in social-behavioural sciences and moral philosophy; lately, the debate was revamped within the rationality approach to the study of cooperation and compliance because internalization is a less costly and more reliable enforcement system than social control. But how does it work? So far, poor attention was paid to mental underpinnings of internalization. This article advocates a rich cognitive model of different types, degrees and factors of internalization. In future work, it will be implemented on a normative agent platform to simulate the individual and social effect of internalization.

Drawing on 91 pornography-related submissions sent by young Finns to a moderated question and answer forum on sexual health, this article explores the personal narratives of adolescents on pornography use. Special attention is given to the submissions by girls to explore the widely circulated narratives on the sexualization of adolescence more precisely. In focusing on these accounts of sexual exploration, learning and the pursuit of pleasure, the article examines how girls’ interests in sexually explicit media can be reflexively understood in the context of everyday sexual practices that are already socially constructed and negotiated. The material reveals that Finnish girls depict themselves as invested with substantial agency, competence and volition despite the occasional gender-specific anxieties that their encounters with pornography have created.
