Анотація:
This article makes a conceptual and methodological argument for ethnographically studying a certain type of paperwork in immigration bureaucracies, namely internal administrative guidelines. Much ethnographic research has focused on case files, application forms, identity documents and judicial decisions attempting to shed light on bureaucrats’ discretionary power and migrants’ strategies of navigating immigration laws. This article shifts attention from bureaucrats’ discretionary practices to their efforts to standardise and codify their own practices. The administrative guidelines of the Foreigners’ Registration Office of Berlin and the visa guidelines of the Federal Foreign Office of Germany are examined as legal documents that are produced in a web of textually grounded legal meanings, as well as in a meshwork of social and political relations and in turn reconfigure both social relations and legal meanings. Contextualised in such a way, these administrative guidelines shed light not only on ‘immigration law at work’ but also on ‘immigration law in the making’.

This research was conducted to determine the role of the Class I Non TPI Tangerang Immigration Office in enforcing the law of immigration administrative actions against visa-free subjects in their working areas, as well as knowing the impact of enforcing the law on immigration administrative actions against visa-free subjects from an immigration perspective. This study used a qualitative normative method with a normative juridical and sociological juridical approach. This method is used to find data and describe systematically as well as factual about the form of law enforcement of immigration administration actions against visa-free subject visits. Administrative action law enforcement against visa-free subjects for visitation provided by the Class I Non TPI Tangerang Immigration Office is in the form of prevention or deterrence, imposition of fees and deportation as regulated in Law No. 6 of 2011 concerning Immigration and its derivative regulations.

The article covers the issues of determining the levels and directions of administrative and legal counteraction to corruption in prosecuting bodies in Ukraine. The following levels of administrative and legal counteraction to corruption in the bodies of the Prosecutor’s Office of Ukraine are highlighted: international; nationwide intra-departmental (carried out on the system of prosecutorial bodies in the general departmental order); nationwide law enforcement; regional intra-departmental; regional law enforcement (carried out by regional prosecutor’s offices and regional departments of the Military Prosecutor’s Office and the Specialized Military Prosecutor’s Office; local intra-departmental; local law enforcement. The directions of administrative and legal counteraction to corruption in the bodies of the Prosecutor’s Office of Ukraine are distinguished: 1) by the subjects of counteraction and entities in respect of which the corruption is being counteracted: intra-departmental counteraction to corruption; counteracting corruption by external bodies; counteracting corruption in the functional areas of the prosecution bodies by such bodies; 2) in the areas of combating corruption: combating corruption in the field of internal administrative issues (appointment, remuneration, disciplinary proceedings, etc.); counteracting corruption in crime investigations; counteracting corruption in the field of public prosecution in court; counteracting corruption in the area of coordination of pre-trial investigation bodies; counteracting corruption in the area of administrative liability for corruption offenses; counteracting corruption in other areas of the prosecutor’s office; 3) for the subjects of corruption offenses: combating corruption against prosecutors; combating corruption related to prosecutors; counteracting corruption against other prosecutors; counteracting corruption in relation to bodies that are coordinated with the prosecutorial system; counteracting corruption against others; 4) by nature of actions: preventive counteraction to corruption; human rights counteraction to corruption; anti-corruption counteraction.

The author has revealed the content of the term of “specially authorized entities in the field of combating corruption” contained in Part 1 of the Art. 1 of the Law of Ukraine “On Prevention of Corruption”. By analyzing the current administrative legislation of Ukraine, the range of public authorities that fall under this concept has been identified. Based on the classification of public authorities existing in administrative science, which are divided into agencies of general and special competence, the author has provided recommendations to improve the list of those public agencies that have the status of specially authorized entities in the field of combating corruption. According to the results of the study, the author has formulated an exhaustive list of specially authorized entities in the field of combating corruption in Ukraine, has provided propositions to improve the provisions of the Law of Ukraine “On Prevention of Corruption” and the Law of Ukraine “On Prosecutor’s Office” in regard to the administrative and legal status of the Specialized Anti-Corruption Prosecutor’s Office. The author has offered to amend Part 1 of the Art. 7 of the Law of Ukraine “On the Prosecutor’s Office”, supplementing it with the word “agencies” after the word “system” and before the word “prosecutor’s office”. Thus, this norm will look like this: “the system of agencies of prosecutor’s offices will consist of: 1) Attorney General’s Office; 2) prosecutor’s offices in oblasts; 3) regional prosecutor’s offices; 4) Specialized Anti-Corruption Prosecutor’s Office. It has been established that only the Specialized Anti-Corruption Prosecutor’s Office can be recognized as a specially authorized entity in the field of combating corruption among the existing prosecutor’s offices. In this regard, the application of the term of “agencies of prosecutor’s office” in Part 1 of the Art. 1 of the Law of Ukraine “On Prevention of Corruption” is not grounded and leads to a false expansion of the range of anti-corruption entities. In practice, this may lead to an ambiguous interpretation of this legal norm. In this regard, the author has offered to specify the range of prosecutorial agencies that are specially authorized entities in the field of counteraction by replacing the phrase “agencies of prosecutor’s office” with the phrase “Specialized Anti-Corruption Prosecutor’s Office”. It has been determined that either the National Police of Ukraine or its separate agencies are not specially authorized entities in the field of combating corruption. In this regard, it has been offered to amend Part 1 of the Art. 1 of the Law of Ukraine “On Prevention of Corruption” by replacing the phrase “National Police” with the phrase “National Police Units”. Thus, those structural subdivisions of the National Police agencies that exercise competence in the field of combating corruption may be recognized as specially authorized entities in the field of anti-corruption.

Visitors, an office in charitable corporations that occupies the position of the Superior Court in all matters pertaining to the charity, are a forgotten area of law in Canada. This article resurrects the jurisdiction by explaining its utility for university corporations. Visitors are private courts of appeal from university decisions. They are empowered to adjudicate academic as well as legal disputes relating to relationships between the university, its officers, its professors, and its students. The article lays out the private law origins of the office and contrasts this approach with the administrative law model more recently in vogue. The administrative law approach to visitation has, over the course of the twentieth century, eroded the jurisdiction, yet it appears from Canadian practice that the jurisdiction remains eminently useful across the country. The article details just how the visitor’s office has been used in Canadian universities beginning in 1803 going up to 1992. In so doing, the office’s strong points as well as its weaknesses are discussed.

The paper is devoted to the study of issues arising from the application in the organization and activities of the prosecutor’s office of the norms of the Federal Law of 17.01.1992 No. 2202-1 "On the Prosecutor’s Office of the Russian Federation" known by their uncertainty and inconsistency. The author analyses the situations in which the existing methods of interpreting legal norms do not make it possible to find an appropriate solution in the functions of the prosecutor’s office implementation. The study notes the inconsistency of certain provisions of the Federal Law with the constitutional framework for regulating the organization and activities of the prosecutor’s office. The author highlights the unjustified expansion of the limits of departmental legal regulation of the organization of prosecutorial supervision. The legal norms governing the powers of prosecutors, objects of prosecutorial supervision and the function of the prosecutor’s office to initiate cases of administrative offenses and administrative investigation were subjected to critical analysis. Based on the results of the study, the author concludes that it is necessary to significantly amend and supplement the current Law.

The paper analyzes the status of bodies and officials of the prosecutor’s office as subjects of protection and subjects of violation of the constitutional right of citizens of Russia to petition as bodies exercising public power, whereas the very norm-principle of the basic Russian law on the right of citizens to petition is considered both as a constitutional right and as a constitutional safeguard. The author identifies the main practical problems, legal gaps and conflicts of law when citizens implement their constitutional right to petition and their reasons. The author proposes options for their elimination at the law-making and law-enforcement levels. It is noted that article 5.59 of the Code of the Russian Federation on Administrative Offences from 2011 providing administrative liability for violation of established procedure of consideration of citizens’ petitions, despite being a very effective instrument for the legal protection of the right under consideration, needs to be adjusted because its discretionary part contains only general language and does not reveal the objective side of this administrative offence. At the same time, prosecutor’s offices have long developed a certain practice concerning the application of Art. 5.59 of the Administrative Code of the Russian Federation as a means of public and legal protection of the violated right of citizens to petition. However, what should be done if the right of citizens to petition is violated by the prosecutors themselves with their special status as subjects of the offense, whereas it is the exclusive competence of prosecutors by operation of law to initiate cases under Art. 5.59 of the Administrative Code of the Russian Federation? The paper is devoted to the search for the answer to this question.

Opus iustitiae PAX – the properly shaped dimension of justice is a guarantee of peaceful – not based on a conflict and violence – relations between citizens and the state. These words fully reflect the leading thought of this study. It is the concern for a good law and a state governed by the rule of law, which lies at the foundation of actions taken within the scope of legal means by the Prosecutor’s Office that – as the “custodian of law” – is entitled to in the sphere of control over administration. Administrative courts execute justice as a separate part of judicial power. Justice and law are conditions for an effective state, good governance and social peace, which have accompanied us for centuries. Administrative courts uphold the principle of equality before the law, which is regulated by Art. 21, par. 1 of the Constitution of the Republic of Poland. Since it is administrative courts which – by performing tasks of control over the activity of public administration – become the guarantee of realization of the above-mentioned principle, their position and range of cognition in the situation of launching administrative-court proceedings by the Prosecutor were presented in the work.

Based on the analysis of various scientific positions, the article reveals the administrative-legal nature and essence of state-service relations in the prosecutor’s office of the Russian Federation. It is noted that the uniqueness of the prosecutor’s service is due, among other things, to the execution of various law enforcement, human rights, control and supervisory and other functions by prosecutors, which indicates the multifunctionality of this type of public service. Such characteristics of the service in the prosecutor’s office, in turn, lead to increased requirements for the service itself, for the business and moral qualities of employees. On the basis of the methodology of integrative legal thinking, the author’s concept of civil service and service in the prosecutor’s office is given. The latter, in particular, is disclosed as a special type of professional activity carried out on behalf of the state by its citizens holding positions of the federal public service in the prosecutor’s office of the Russian Federation, in order to fulfill in accordance with the law on the prosecutor’s office and the rules establishing special moral and ethical requirements for their official and off-duty behavior of the duties assigned to the prosecutor’s office, carried out in order to ensure the supremance of law, unity and strengthening the rule of law, protect human and civil rights and freedoms, the interests of society and the state protected by law, as well as related to the performance of the functions of internal management of the prosecutor’s office, organizing and service in these bodies.

Between 2001 and 2017, the Civilian Complaint Review Board (CCRB) received 295,616 allegations of police misconduct involving New York Police Department (NYPD) officers' use of force, abuse of authority, discourtesy, and offensive language (FADO). The purpose of this study was to explore the influence of administrative disciplinary actions on officers' emotional intelligence and performance in relation to citizen complaints of police misconduct. The central research question addressed how administrative practices influence law enforcement officers' behavior in relation to emotional intelligence-based performance. The theoretical construct for this study is based on the emotional intelligence theories of Bar-On, Goleman, and Mayer, DiPaolo and Salovey which suggest that individuals, including police officers, are responsible for their emotional intelligence and conduct. A qualitative analysis of citizen allegations of police misconduct of the NYPD was conducted using documents from the CCRB and Office of the Inspector General for the NYPD. Each complaint was evaluated using a thematic-based analysis. The findings suggested that the NYPD's low disciplinary rate might have influenced FADO behavior, revealing patterns and practices of racial, ethnic, and social stereotyping, and a lack of compliance with department policies. Recommendations include officer and administrator training on emotional intelligence practices and restructuring department policy processes which can lead to positive social change by helping law enforcement agencies engender trust with their communities and eliminate patterns and practices related to social bias, profiling, and racial stereotyping.

Law enforcement requires comprehensive hiring and training practices in order to curb misconduct and turnover. Some of the available data suggests a shift in the dynamics of law enforcement toward a more objective approach that favors education, cognitive ability testing, a community policing orientation, and technological advances, such as body cameras, that hold enforcers of the law and the American public, accountable for misconduct and violations of the law. The utilization of various technological advances requires assessment and dynamic, comprehensive analysis. The present study examined the influence of education and the professionalization of policing hiring requirements, cognitive ability tests and training, community policing initiatives and training, and the utilization of body cameras, on the number of dismissals and voluntary resignations and police use of force incidents recorded, while considering gender composition, and ratio of officers to size of the community served, in a federally-released report. Many of the hypotheses were not confirmed. However, support for the relationship between education and officer dismissal, SARA training and all dependent variables, and gender composition and reduction in the number of use of force incidents reported, were substantiated. Implications, limitations, and directions for future research are explored herein.

D’une manière générale, la fonction administrative contentieuse peut être appréhendée comme l’ensemble des juridictions chargées de connaître des litiges résultant de l’activité des autorités administratives. Elle represente l’activité juridictionnelle en matière administrative. Par conséquent, la fonction administrative contentieuse doit s’appréhender tant sous l’angle d’une juridiction, que sous celle de son juge. L’institution d’une fonction administrative contentieuse en Côte d’Ivoire remonte à l’époque coloniale. Cependant, à l’instar de la plupart des ex-colonies françaises, ce n’est qu’au lendemain de l’indépendance en 1960, que la fonction administrative contentieuse ivoirienne s’est affirmée en tant que fonction juridictionnelle autonome à l’égard du système français. La procédure administrative non contentieuse, comme la procédure administrative contentieuse dont il est question dans l’étude ont connu de grands progrès tant en France que dans les pays francophones d’Afrique pour lesquels le système de juridiction administrative comme le droit qu’il vise à contrôler ont longtemps constitué, selon la belle formule de Jean RIVERO, un bon « produit d’exportation » français. La Côte d’ivoire n’échappe pas à ce constat. Aussi l’étude de la fonction administrative contentieuse en Côte d’Ivoire a pour objet de dessiner la physionomie générale de la justice administrative ivoirienne un demi siècle après son institution afin d’en souligner les éléments de permanence ou de changement
Generally speaking, the contentious administrative function can be arrested as all the jurisdictions asked to know disputes resulting from the activity of the authorities. She represente the jurisdictional activity in administrative subject. Consequently, the contentious administrative functio has to dread as long under the angle of a jurisdiction, that under that of his judge. The institution of a contentious administrative function (office) in Ivory Coast goes back up to the colonial time. However, following the example of most of the French ex-colonies, it is that after the independence in 1960, that the Ivory Coast contentious administrative function asserted itself as autonomous jurisdictional office towards the French system. The not contentious administrative procedure, as the contentious administrative procedure question of which it is in the study knew big progress both in France and in the French-speaking countries of Africa for which the system of jurisdiction administrative as the right at which it aims at checking constituted for a long time, according to the Jean RIVERO's beautiful formula, a voucher " produced by export " French. The purpose of this study is to develop one of the duties of the Municipal Attorney’s Office, which is to: file an administrative impropriety action against the acting Mayor when he commits any impotent act in the course of his term. The initial approach to the analysis of the proposed object requires the definition of Administrative Improbity under the legal prism in order to deal with the subject from the perspective of legal techniques. In order to advance in this matter, it will be necessary to clarify the legal nature of the improbity, in order to point out its conduct and its respective sanctions. The importance of the study about the proposed object is presented in seeking the legal interest of the Municipal entity, the Office of the Attorney, general as well as the municipal Attorneys. In order to explain that, it will be used a method of legal identification of the attributions of each of these three interested parties. The attributions will not be addressed solely from the static point of view, but rather will identify the relationship between the three interested parties, in order to scrutinize the independence of the Public Prosecutor's Office and of its Prosecutors in relation to the Chief executive. It will also identify the interests of the individual elected to the position of Municipal Mayor in relation to its respective municipality, also under the legal aspect. Once exposed the interests of the legal actors mentioned above, the figure of the Mayor will be analyzed in the commission of acts of administrative improbity and their correct and specific accountability. Following will be brought the provisions of the legal system that guide the legitimacy of the Municipal Attorney to join with the action of administrative improbity. Finally, the independence and competence of the Municipal Attorney’s Office will be clarified in order to enter into the aforementioned action in the face of the acting Mayor, in favor of the real and true public interest
O estudo que aqui se propõe desenvolver tem como objeto uma das atribuições da procuradoria municipal: ingressar com ação de improbidade administrativa em face do prefeito em exercício, quando ele cometer qualquer ato ímprobo no curso de seu mandato. A abordagem inicial da análise do objeto proposto exige a definição da improbidade administrativa sob o prisma jurídico, para tratar do tema sob a perspectiva das técnicas jurídicas. De modo a avançar neste mister, faz-se necessário esclarecer a natureza jurídica da improbidade, para então apontar suas condutas e respectivas sanções. A importância do estudo acerca do objeto proposto apresenta-se na busca do interesse jurídico do ente municipal, do órgão de procuradoria e dos procuradores municipais. Para tanto, utiliza-se o método da identificação jurídica das atribuições de cada um destes três interessados, que não são abordadas apenas sob o ponto de vista estático, mas relacionadas entre si e comparadas, visando a esmiuçar a independência das procuradorias municipais e de seus procuradores em relação ao chefe do Executivo. São ainda identificados os interesses da pessoa física eleita ao cargo de prefeito municipal em relação a seu respectivo município, também sob o aspecto jurídico. Uma vez expostos os interesses dos atores jurídicos acima mencionados, faz-se a análise da figura do prefeito municipal no cometimento de atos de improbidade administrativa e sua correta e específica responsabilização. Na sequência, são trazidas as disposições do ordenamento jurídico que pautam a legitimidade da procuradoria municipal para ingresssar com a ação de improbidade administrativa. Por fim, são esclarecidas a independência e a competência da procuradoria municipal para ingressar com a aludida ação em face do prefeito em exercício, em prol do real e verdadeiro interesse público

La particularité du contentieux des mesures de police individuelles de l'environnement industriel est que le juge administratif dispose d'un office de juge-administrateur. Nous regroupons sous l'appellation de « police de l'environnement industriel » plusieurs polices administratives spéciales, créées sur le modèle de celle des installations classées pour la protection de l'environnement, et fonctionnant selon la même logique. En plus de la police des installations classées, la police de l'environnement industriel réunit la police des installations, ouvrages, travaux et activités (Iota) soumis à la loi sur l'eau, la police des installations nucléaires de base, la police de l'autorisation environnementale et, avec réserve, la police des canalisations de transport et celle des ouvrages d'infrastructures de transport de matières dangereuses. Grâce à l'office de juge-administrateur, le juge peut utiliser dans le contentieux des mesures de police de l'environnement industriel l'ensemble des pouvoirs juridictionnels, et notamment les plus grands. Ainsi, le cas échéant, après avoir estimé irrégulière la mesure de police contestée, le juge peut, lorsqu'il estime que c'est nécessaire pour trancher le litige qui lui est soumis, aller jusqu'à se transformer en juge-administrateur. Il substitue alors à l'appréciation de l'autorité administrative sa propre appréciation et fait œuvre d'administration active, c'est-à-dire qu'il prend une décision qui va directement rétablir la légalité bafouée par la mesure de police contestée. Cette recherche entend approfondir cet office de juge-administrateur de l'environnement industriel, que la doctrine a toujours présenté comme étant une particularité au sein du contentieux administratif. Elle va réfléchir à la place de cet office au sein du contentieux administratif, notamment pour savoir s'il est toujours possible de considérer qu'il s'agit d'un office particulier du juge administratif. Elle cherchera par ailleurs à savoir s'il est encore justifié que le juge dispose d'un tel office dans cette matière
The particularity of litigation concerning individual policing measures in the industrial environment is that the administrative judge has an office of judge-administrator. We group together under the name of "industrial environment police" several special administrative policing, created on the model of classified installations for the protection of the environment, and operating according to the same logic. In addition to the policing of classified installations, the policing of the industrial environment brings together the policing of installations, structures, works and activities (Iota) subject to the water law, the policing of basic nuclear installations, the policing of environmental authorization and, with reservations, the policing of transport pipelines and that of infrastructure works for the transport of hazardous materials. Thanks to the office of judge-administrator, the judge can use all the jurisdictional powers, and in particular the larger ones, in litigation concerning industrial environment policing measures. Thus, where applicable, after having deemed the contested policing measure to be irregular, the judge may, when he considers it necessary to settle the dispute submitted to him, go so far as to transform himself into a judge-administrator. He then substitutes for the assessment of the administrative authority his own assessment and does the work of active administration, that is to say he takes a decision that will directly restore the legality flouted by the contested policing measure. This research intends to deepen this office of judge-administrator of the industrial environment, which the doctrine has always presented as being a particularity within administrative litigation. It will reflect on the place of this office within administrative litigation, in particular to find out whether it is still possible to consider that it is a special office of the administrative judge. It will also seek to know whether it is still justified for the judge to have such an office in this matter

Cette étude de contentieux administratif, fondée sur l’analyse systématique de lajurisprudence administrative, vise à démontrer le contraire. Remarquables tant par leur variété que parleurs incidences sur le procès, les questions préjudicielles restent souvent perçues comme descomplications de procédure inutiles visant à retarder la résolution du litige. Cette étude prend le partid’expliciter comment le juge administratif au principal en vient à construire une question préjudicielle,et quel en est le fondement juridique. De ce point de vue, si les parties au litige jouent bien souvent unrôle essentiel dans le relevé d’une exception, c’est en dernière analyse, le juge au principal qui détientle pouvoir de formulation de la question. Par ailleurs, la mise en oeuvre des questions préjudicielles,traditionnellement présentée comme paralysant l’office du juge, apparaît sous un nouveau jour. Loind’immobiliser l’office du juge au principal, l’étude minutieuse du droit positif révèle les importantspouvoirs que possède encore le juge a quo dans la maîtrise du procès dont il est compétemment saisi.Enfin, la réception par le juge a quo de la décision préjudicielle correspond à un partage de lasouveraineté juridictionnelle impliquant l’édiction d’un acte juridictionnel issu d’un processus decodécision. Preliminary issues challenge the role of the administrative law judge who formulates them.They are regarded as being accessory to the principle case at bar. They may even be perceived assecondary issues. This study of administrative litigation, based on a systematic analysis ofadministrative case law, aims to establish the opposite. Preliminary issues are characterized by theirdiversity as well as by their influence on the lawsuit, however, they are often perceived as useless andcumbersome procedural complications aiming to delay the resolution of the dispute. This study aimsto explicit the process by which the administrative law judge builds a preliminary issue and what is thelegal foundation of such an issue. From this angle, albeit the fact that the parties to the main disputeplay an essential role, it is the judge, who mainly retains the power to formulate the preliminary issue.This analysis challenges the traditional portrayal of preliminary issues as paralyzing the judicial“office”. To the contrary, far from immobilizing the “office of the judge”, an in depth study of positivelaw reveals the extensive powers that the judge a quo possesses with regards to the case at bar.Finally, the reception by the judge a quo of the preliminary ruling corresponds to a sharing of juridicalsovereignty implying the passing of a juridical act emanating from a process of co-decision. Thisstudy aims to shed light on the functioning and the complexity of a mechanism rarely examined fromthis angle. La procédure suivie devant le juge administratif est traversée par une double évolution qui justifie qu’une étude soit consacrée à l’office des parties. A mesure que le droit du contentieux administratif se transforme en un droit du procès administratif, on observe que ce procès n’est plus pensé comme un procès fait à un acte, mais comme un procès entre parties. Le renversement des perspectives auquel invite le point de vue des parties est possible grâce à un instrument d’analyse finaliste du droit : l’office. Ce concept permet de s’interroger sur l’adéquation entre les facultés dont disposent et les charges que supportent les parties – i.e. l’office stricto sensu – et les finalités que l’ordre juridique leur assigne – i.e. l’office lato sensu. Comprises comme les personnes physiques ou morales qui participent au lien juridique d’instance en raison d’un litige né de prétentions propres et contraires sur un droit, les parties au procès poursuivent deux finalités complémentaires : la détermination intéressée de la matière litigieuse et la participation loyale à l’instance. Dès lors, le point de vue des parties permet de mettre en lumière non seulement les facultés et les charges que la doctrine néglige lorsqu’elle envisage le procès administratif sous l’angle exclusif du juge, mais aussi que leur office stricto sensu peut être perfectionné en vue de mieux répondre aux finalités de leur office lato sensu. En permettant de renoncer à une opposition dogmatique entre les procès civil et administratif, l’étude de l’office des parties encourage à inscrire la recherche et l’enseignement du droit du procès administratif dans une perspective résolument processualiste
The procedure before administrative courts is characterised by a double evolution, which justifies a study to be devoted to the office of the parties in an administrative hearing. As the law of administrative litigation increasingly transforms itself into the law of administrative hearings, one can observe that this process is no longer considered as a trial made to an act, but as a trial between parties. The perspective switch, to which the point of view of the parties to the trial invites, is made possible thanks to an instrument of finalist analysis of the law : the office. This concept makes it possible to question the adequacy between the powers and the charges of the parties - that is, the office stricto sensu - with the goals assigned to them by the legal order - namely, the office lato sensu. Understood as the physical or legal persons who participate in the legal relationship because of a dispute arising from own and contrary claims to a right, the parties to the lawsuit pursue two complementary goals : the interested determination of the dispute and the fair participation in the instance. This study allows to draw two conclusions. On the one hand, the office stricto sensu can be improved in order to better converge toward the office lato sensu. On the other hand, it shows that an opposition between the civil lawsuit and the administrative lawsuit is no longer possible. This study about the parties office in administrative lawsuit reveals the importance of research and teaching in procedural law

In terms of administrative sanctions, application of the more favorable law means that when the law in force the time an act was committed and a law subsequently brought into force is different, the law which is more favorable should be applied. EHRC states that applying more stringent punishment to an offender on the grounds that more stringent punishment was in force when the time criminal offence was committed. Misdemeanors have been considered within the scope of criminal law by the Constitutional Court and the Constitutional Court accepts that the principle of the application of the more favorable law should be applied to misdemeanors. Danıştay (the Turkish Council of State) decides that “it should be take into account in terms of administrative sanctions, when a law which is the ground of punishment is set aside or more favorable law is brought into force”. Since administrative acts are reviewed during annulment cases, a law brought into force after an administrative act cannot affect the act retrospect. A law which is enters into force after an administrative act established, could set up a rule which has retrospective affect only if the rule clearly is an amnesty. After an administrative fine is imposed, applying criminal law principals to administrative law and administrative sanctions, in other words, rendering decision of annulment on the ground of the principle of the more favorable law betrays the trust on judicial bodies and law.
