Las llamadas cuestiones vasca y catalana (hoy, la segunda, en fase aguda) reclaman una actualización del orden constitucional en punto a la adecuación de la organización del Estado a la estructura plural de España, que ha de hacerse teniendo en cuenta las radicales transformaciones derivadas de la integración en la Unión Europea y la inserción en una comunidad internacional cada día más interdependiente y desde una doble reflexión. En el trabajo se apuntan —en sus líneas maestras— los aspectos más sobresalientes de la reforma o, en su caso, revisión constitucional que el autor considera más viable sobre la base del análisis tanto de la situación presente y mirando al futuro, como de la experiencia suministrada por la transición política, el consenso constitucional y el proceso de construcción del llamado Estado autonómico. Pero recordando que el éxito de tal empeño en el plano jurídico-constitucional depende de algo que está fuera de la potencia configuradora del Derecho —la regeneración de la vida política y social y de las instituciones y tiene una decisiva trascendencia para el funcionamiento de un Estado complejo como el español y, por tanto, la vitalidad y autenticidad del pluralismo territorial sin merma de la verdadera, por sustantiva (no formal), unidad constitucional.The basque and catalan conflict —the second nowadays at his peak— demand a revamp of Spain’s constitutional order to adapt the organization of the state to the diverse structure of the country. Such reform should be addressed taking into account the radical transformations resulting from its integration into the European Union project and from an increasingly interdependent comunity at the international level. This article points out the most important aspects of the reform or (where relevant) of the constitutional review that the author considers more feasible. This appraisal will be carried out based on the analysis of the current situation and looking to the future, as well as on the experience gained with the political transition, the constitutional consensus and the so called Authonomic State-making process. However, the sucess of this commitment within the constitutional and legal framework depends on something that is out of the shaping capacity of the law —the political and social life renewal, as well as of the institutions— and has a crucial importance for the functioning of a complex state such as the spanish and, therefore, for the vitality and authenticity of the territorial pluralism without affecting (in a substantive —not formal— way) the constitutional unity.

La obra objeto de comentario es dirigida por Arzoz Santisteban y se centra en analizar las potencialidades que tiene la directiva para articular el pluralismo ordinamental que genera el proceso de integración europea en nuestro orden territorial. Pero la teoría ha de ser contrastada con la realidad práctica. La lectura de este libro es muy sugerente pues incide precisamente en el análisis de esta norma jurídica y del desarrollo que tiene en la práctica: ¿hasta qué extremo su práctica es respetuosa con este pluralismo ordinamental? Lo cierto es que como se pone de manifiesto en el libro en la teoría partimos del conocido principio de la autonomía institucional, en la práctica podrí allegar a producirse un dominio del Estado central en la transposición del Derecho de la Unión.The work subject of comment is directed by Arzoz Santisteban and focuses on analyzing the potential that has the directive to articulate ordinamental pluralism generated by the process of European integration in our territorial order. But the theory has to be contrasted with the practical reality. It is very interesting to read this book because it affects precisely in this legal standard and analysis the development that has in practice: is really their practice friendly with this ordinamental pluralism? The truth is that as it is revealed in the book on the theory we start from the known principle of institutional autonomy, the practice may attached to produce a domain of the central State in the transposition of the EU law.

Afirma-se que a política econômica é construída sobre uma base ética, mesmo que não devidamente explicitada. Seus objetivos têm sempre relação com a ideia de desenvolvimento e bem-estar que cada sociedade possui: riqueza material, estabilidade macroeconômica, sustentabilidade, justiça social, pluralismo social e cultural, diversidade étnica e territorial. Este trabalho se propõe resumir e explicitar o estado da arte na evolução de novos e velhos princípios e valores que estariam na base da configuração de uma ética territorial. Este documento contém os resultados da primeira parte de uma investigação do ILPES, de mais longo alcance, sobre a economia e a política das disparidades territoriais na América Latina, a se desenvolver entre abril de 2011 e março de 2013. Nesta primeira etapa, durante 2011-2012, previu-se a revisão das Constituições latino-americanas, visando identificar os princípios e valores éticos territoriais, no conteúdo das mesmas. Percebe-se que o contexto econômico, político e institucional, da mesma forma que as teorias de desenvolvimento, agora reconhecem o papel não somente do capital físico, senão do humano, do social, do ambiental e inclusive do cultural e simbólico como fatores determinantes, o que considera-se um avanço.

A concreta incorporação do enfoque territorial como fundamento para as políticas de desenvolvimento rural demanda o rompimento com a tradição vertical e centralizadora das estratégias de desenvolvimento e a consequente valorização das iniciativas locais e da multiplicidade de atores territoriais. No entanto, a trajetória destas políticas releva não apenas o privilégio conferido às organizações vinculadas à agricultura familiar como também a exclusão das organizações representantes dos empresários. Considerada a importância da participação empresarial para o êxito das políticas dessa natureza, analisam-se, neste trabalho, as possibilidades de inclusão das representações dos empresários com vistas ao o pluralismo no âmbito do Programa Territórios da Cidadania Norte-RJ. Foram realizadas entrevistas semiestruturadas, com informações complementadas por análise documental, e tratadas por meio de análise de conteúdo com grade mista baseada no conceito de cidadania deliberativa habermasiano. Os resultados relevam que o modelo de gestão social em vigor não é capaz de promover a concertação social dos atores territoriais. Os representantes da sociedade civil rechaçam indistintamente a inclusão dos empresários por conta de diferenças sociopolíticas, agravadas pela constituição histórica do território. As representações empresariais não estão inseridas no colegiado territorial do Norte-RJ e tampouco conhecem o Programa Territórios da Cidadania. Contudo, estas instituições já estão inseridas em outras instâncias locais de participação social e aceitam a dinâmica que rege estes espaços pautados na gestão social. Tal experimentação democrática pode criar pontos de convergência mínimos que permitam sua inclusão nos colegiados territoriais.

El artículo está compartido en cuatro partes. La primera trata de la “Globalización y nuevas instancias de regulación”, donde el fenómeno de la globalización constituye una de las claves explicativas de nuestro tiempo, con una gran capacidad transformadora transmutando drásticamente los procesos socioeconómicos. En la segunda, es subrayado sobre “El fin del monopolio estatal de la producción jurídica”, donde resta evidente que la globalización ha generado nuevas interacciones que colisionan con los esquemas clásicos de validez y vigencia territorial de las normas jurídicas y, en la medida en que esto sucede, el derecho se queda inerme ante su incapacidad para dar una respuesta adecuada a fenómenos que escapan a la posibilidad de un control inmediato y directo por parte del derecho estatal. Ya, en la tercera parte, donde se escribe sobre “El pluralismo jurídico y la quiebra del derecho moderno”, enuncia un proceso de multiplicación y descentralización de las instancias de producción normativa en paralelo a la aparición de nuevos actores en la escena internacional. Por fin, el texto busca responder la pregunta: Existe ¿Un nuevo paradigma jurídico?” quedando claro, que la globalización exige una recomposición de lo jurídico.

El artículo analiza la dinámica de las redes interorganizacionales para la gestión social del desarrollo territorial y la construcción de soluciones a problemas y desafíos humanitarios, a partir del esquema de evaluación de procesos decisorios participativos deliberativos propuesto por Tenorio et al. (2008) y la valorización de aspectos territoriales en dicha gestión. Concretamente, se estudia la Red de Tecnología Social (RTS) existente en Brasil entre los años 2005 y 2011 en función de las siguientes categorías teóricas: proceso de discusión, inclusión, pluralismo, igualdad participativa, autonomía, bien común y territorialidad. Se trata de un estudio exploratorio cualitativo, descriptivo e interpretativista, en el que se utilizan diferentes técnicas de recolección de datos y fuentes primarias y secundarias. Se constata, en el proceso de articulación e interacción de la Red, la existencia de una instancia deliberativa (el comité coordinador) y de otra propositiva (los foros nacionales). Se concluye que si bien la RTS presentó una significativa pluralidad, esta funcionó esencialmente conforme los objetivos estratégicos de las instituciones financiadoras integrantes de su comité coordinador.

Este trabalho analisa em que medida o desenho e implementação do Programa Territórios da Cidadania no Norte-RJ valorizam o pluralismo, especificamente quanto à inclusão dos representantes dos empresários no âmbito desta política. Foram realizadas entrevistas semiestruturadas, complementadas por análise documental, e tratadas por meio de análise de conteúdo com grade mista elaborada com base no conceito de cidadania deliberativa habermasiano. O desenho da política revela o incentivo hesitante à inclusão dos empresários, de tal sorte que aspectos de natureza política das parcerias intersetoriais são brevemente apontados. Além disso, o processo de formação do território valoriza os agricultores familiares; os representantes da sociedade civil opõem-se à inclusão dos empresários no colegiado territorial; e o processo de avaliação dos projetos territoriais dificulta a propositura de iniciativas inovadoras articuladas com os empresários. Resta claro que a experiência de gestão social analisada não conseguiu promover a concertação das forças sociais dinâmicas presentes no território.

Este trabajo estudia cómo la colaboración y cooperación interparlamentaria en un Estado descentralizado, en particular el Estado autonómico, ha contribuido y puede sustentar la conformación de un substrato sólido, real, de naturaleza federal, de la mano de lo que se denominará federalismo legislativo. El punto de partida será el estudio de cómo en España se ha afrontado dicha cooperación interparlamentaria, para –sin perder el referente de la irrupción de la cooperación interparlamentaria en un orden global– referenciar desde un punto de vista comparado, centrado en los casos estadounidense y canadiense, cómo los parlamentos en Estados federales han contribuido a sostener dicha estructura territorial desde su colaboración. El federalismo legislativo será un punto final en el que se compendiarán todas las enseñanzas de esa revisión casuística previa. Un análisis de los logros y retos de la cooperación interparlamentaria será la reflexión final sobre la concepción de la colaboración interparlamentaria territorial como garantía del pluralismo y como eslabón entre la unidad y la diversidad que sustenta la esencia de una federación.

Este trabajo propone una reflexión sobre la institucionalización de la Cátedra de Paz en los planes de estudio de las instituciones de educación superior, considerando la siguiente pregunta: ¿Cuáles deberían ser los criterios institucionales sobre los cuales debería articularse la Cátedra de Paz para cumplir con las regulaciones incluidas en la Ley 1732 de 2014 “Por la cual se establece la Cátedra de la Paz en todas las instituciones educativas del país”? Se analiza el importante papel que tienen las instituciones de educación superior en este momento histórico, llamado por algunos posconflictos y por otros post-acuerdo, por su propia dinámica multifactorial que afecta los entornos universitarios en algunas regiones del país como el departamento del Cauca. Dentro de esos entornos, la noción de coexistencia pacífica ha tomado otra dimensión, abriéndose a conceptos como el pluralismo ideológico, la diversidad étnica y cultural vinculados a la libertad de expresión, enseñanza y aprendizaje. La reflexión tendrá como objeto de estudio la inclusión de la Cátedra de Paz en la Universidad Comfacauca, Colombia y la forma en que esa inclusión ha contribuido a la construcción de la paz territorial.

AbstractOver the last couple of years, a stream of pluralist theories of international legal order has developed at the intersection of international law and political theory, having immediate implications for conceptualizing self-determination. The understanding of self-determination under the framework ofbounded,constitutional, andradicalpluralism markedly departs from the previous wave of normative theories in the 1990s: self-determination is now evacuated from the field of national pluralism and struggles over territory.This article does not question the thrust of pluralists’ recent work, but complements their critical attunement to global disparities of power, and complicates their neglect of nationalism and rejection of territorial reconfigurations as self-determination's core meaning. In doing so, it unearths two visions that come from the (semi-)periphery of the international political order. The first belongs to Edvard Kardelj, pre-eminent Yugoslav theorist of socialist self-management and the Non-Aligned Movement. The second belongs to Leopold Sédar Senghor, the poet and politician, advocate ofnégritude, a proponent of French West African integration, and a constitutional advocate for the reconfiguration – not abolition – of the French Union, the heir to the French Empire. While they are suspicious of extensive territorial reconstruction, like contemporary pluralists, unlike them they have seen a role for territorial reconfigurations in the name of national plurality.

Resumen:El Derecho Administrativo aborda con creciente frecuencia fenómenos jurídicos que podemos denominar como «transnacionales». Esta calificación se debe a que no son susceptibles de una ordenación integral por el Derecho Administrativo estatal. En este estudio abordamos el análisis de esos fenómenos jurídicos desde la perspectiva del principio de territorialidad. El objetivo es mostrar los efectos de la incompatibilidad de fenómenos inherentes a la globalización con el paradigma de la territorialidad del Derecho Administrativo y su concepción estatutaria como Derecho del Estado. El estudio comienza con una exposición sobre la trascendencia del principio de territorialidad en la Teoría General del Estado y en la Teoría jurídica; esta parte analiza la relevancia del territorio como base y límite del poder público, y en las relaciones con otros ordenamientos. A continuación, el estudio aborda los fenómenos jurídicos alumbrados en el contexto actual de fragmentación y pluralismo jurídico, para mostrar una realidad jurídica que condiciona la capacidad explicativa del principio de territorialidad. La constatación de la superación del paradigma territorial del Derecho Administrativo provoca la necesidad de afrontar las consecuencias de ese panorama jurídico transformador. El estudio muestra cómo la desterritorialización del Derecho tiene implicaciones directas no sólo en las relaciones entre órdenes normativos, sino también en la summa divisio, al igual que en la vis autoritaria que tradicionalmente ha caracterizado al Derecho Administrativo. Estas transformaciones abren paso a un Derecho Administrativo no exclusivamente estatal, basado en relaciones interordinamentales y focalizado en relaciones jurídicas dinámicas. SummaryI. Abstract:Administrative Law is increasingly tackling with legal phenomena that can be named as «transnational». This denomination is due to the fact that cannot be embraced entirely by State Administrative Law. In this paper we approach the analysis of these legal phenomena from the perspective of the territoriality principle. The objective of this paper is to show the effects of the incompatibility of a legal phenomenon inherent to globalization, with the paradigm of the territoriality of Administrative Law and its statutory conception as State law. The study begins with an exposition on the relevance of the territoriality principle in the State General Theory and in the Legal Theory; for this reason, we analyze the relevance of the territory as the basis and limit of public power, but also in the relations other legal orders. Then the study deals with the current context of fragmentation and legal pluralism to show a legal reality that undermines the explanatory capacity of the territoriality principle. The verification of the overcoming of the territorial paradigm of Administrative Law causes the need to face the consequences of this transforming legal reality. The paper shows to what extent the deterritorialization of law has direct implications not only in the relations between legal orders, but also in the «summa divisio» and in the traditional authoritarian characterization of Administrative Law. These changes open the scene to a non-statist legal regime, based on relations between legal orders and focused on dynamic legal relations.

Los derechos territoriales indígenas son analizados en el presente trabajo como una reivindicación indisolublemente unida a la defensa de un modo de vida opuesto al modelo de desarrollo convencional y al mantenimiento del Derecho, autoridades e instituciones indígenas. Partiendo de la oposición de muchos pueblos indígenas y tribales a planes y proyectos de desarrollo e inversión, se plantea la necesidad de analizar conjuntamente las reivindicaciones de los pueblos indígenas por sus derechos sobre sus tierras, territorios y recursos naturales a la luz de las críticas al desarrollo convencional enunciadas desde la perspectiva postdesarrollista y de los estudios sobre el pluralismo jurídico que cuestiona el monismo asociado al Estado-nación moderno. Abstract Legal pluralism in former colonial territories, like South Africa, often involve the simultaneous existence of multiple marriage forms, distinguishing marital forms associated with former colonial systems from indigenous forms of marriage. These pluralist systems are not value-neutral but continue to favour marriages associated with colonial rules and processes. In addition, they create complicated distinctions between different forms of marriage which are thought to reflect the distinctive cultural or religious identities of those who marry according to these systems. This article argues for an alternative approach: the explicit recognition and encouragement of legal hybridisation as a strategy for disrupting colonial identities and hierarchies which recognises and values the historical and contemporary processes of hybridisation in the law and social practices. It uses the metaphors of the language politics around Afrikaans to describe a rigid form of pluralism based on claims of authentic identity on the one hand, and of isishweshwe, a colourful cotton fabric, which represents the resilience, vitality, and creative exchange which characterises hybridity and which promises to address gender and racial inequality inherent in the current model.

This article focuses on how people of Mexican descent fit within the definition of "American" during the early twentieth century. It argues that during the final years of debate over Arizona and New Mexico statehood, nativos (U.S.-born people of Mexican descent), Mexicans (immigrants from Mexico), and Anglos developed and promoted strategies of pluralism and marginalization for incorporating people of Mexican descent into the nation. Pluralists worked to ensure that nativos in New Mexico would become full members of the United States as Spanish Americans, while Anglos promoting marginalization strove to limit people of Mexican descent in Arizona to second-class citizenship. Although both territories became states in 1912, the two strategies resulted in very different consequences for people of Mexican descent and provided two very different models for how they could be considered American.

The problem of the «northern territories» in the relations between the USSR / Russia and Japan is a kind of echo of the Second World War, which makes itself felt up to the present time. The territorial issue between Moscow and Tokyo has turned into an anachronism, which Russia and Japan have been unable to overcome despite their efforts. In the article the works of Russian scientists have been analyzed and an attempt has been made to consider the key aspects of the historiography of the issue, including the discrepancy between points of view on its specific components. The author of the article studies the scientific works of domestic researchers on the topic and highlights the time of the emergence of the territorial dispute between the USSR and Japan; title documentation regulating the territorial delimitation between the USSR and Japan after the Second World War; points of view on the attachment of the legal rights of the Soviet Union to the Kuril Islands. Moreover, the assessments of Moscow’s refusal to sign the San Francisco Treaty of 1951; alternative points of view of researchers on the historical and legal foundations of the USSR and Japan to possess the Kuriles; pluralism of opinions regarding the belonging of Shikotan and Habomai to the Kuril Islands; whether the rights of the USSR / Russia to possess the Kuril Islands are vulnerable; views on the degree of importance of solving the territorial problem for Japan, etc. have been considered.

Belize, país anglófono da América Central, é descrito,normalmente, em termos da sua diversidade cultural e da multiplicidade dos grupos étnicos que o compõem. Contudo, essa diversidade não é uma característica estável, não é gerida nem interpretada de uma única forma. Suas populações suscetíveis de serem reconhecidas como afrodescendentes têm origens múltiplas, populações essas que foram conformadas ou que chegaram a Belize em circunstâncias históricas muito diversas: alguns escravizados, outros livres, urbanos ou rurais, agricultores ou assalariados, anglófonos ou não, etc. Diante dessa complexidade de articulações, o artigo busca interpretar as práticas políticas observadas em matéria de “gestão da diversidade” (a colonial de “divide and rule”, a neoliberal, a multicultural...) em dois aspectos que determinam o campo da autonomia – ideológica ou territorial – do país e que elaboram as condiciones de existência da Nação e dos grupos que a compõem: políticas culturais e regulamentação das terras. A análise mostra que as variações nas políticas implementadas referem-se menos a composição étnica da população que ao posicionamento dos grupos sociais e governos frente às forças exógenas (o império colonial, as arenas transnacionais, a globalização dos direitos autóctones) e endógenas (o paradigma desenvolvimentista, a construção da Nação). However, this diversity is not a stable characteristic; it is not managed or interpreted in one single way. Their populations most susceptible to being recognized as African descent have multiple origins. These populations either have been assimilated completely or came to Belize in very different historical circumstances: some enslaved, some free, urban or rural, farmers or wage earner, Anglophone or not, etc. Given this complexity, the article seeks to interpret the political practices observed in the field of "diversity management" (the colonial "divide and rule", neoliberal, multicultural) on two aspects that determine the field of autonomy - territorial or ideological - of the country and that prepare the conditions of existence for the nation and for the groups that comprise it: cultural policies and regulations of the land. The analysis shows that changes in implemented policies refer less to the ethnic composition of the population than to the position of the social groups and Governments in the face of exogenous forces (colonial empire, transnational arenas, and the globalization of indigenous rights) and endogenous forces (the development paradigm, the construction of the Nation). La economía urbana (EU) surgió de la mano de propuestas espacialistas y economicismos y continúa siendo tallada por estas A pesar de una evidente institucionalización de la economía social y solidaria (ESS) en América Latina, que da cuenta de un creciente pluralismo económico, en la EU perdura la hegemonía del enfoque del sector informal urbano y sus presiones por transformar en capitalistas cada práctica de economía popular. Buscando el reconocimiento de la economía social (ES) en este campo, el artículo ilustra brevemente la institucionalización de la ESS y plantea una provocativa exploración por poner en diálogo a la ES con la teoría de los dos circuitos. Un diálogo como este constituye una deuda pendiente que puede aportar a la disputa del campo así como a encontrar mejores comprensiones y, también, a transformar las economías de nuestros territorios en un sentido progresivo.Palabras-clave: economía urbana; dos circuitos de la economía urbana; economía social; economía social y solidaria; economía popular. Abstract: The urban economy has been hardly influenced by spatial proposals and economicism. In Latin America, while the institutionalization of social and solidarity economy of the last few years shows a growing economic pluralism, in the urban economy field persists the hegemony of urban informal sector perspective, and its pressures of transforming in capitalist every popular economy practice. Seeking for recognition of social economy in this field, the article succinctly illustrates social and solidarity institutionalization in the region and suggests a provocative exploration to put in dialogue social economy with two circuits of urban economy theory. Such a dialogue is considered as a debt, which we understand could contribute to dispute the field, to get better explanations and also to transform in a progressive sense the economy of our territories. Si le christianisme a fait naître des idéologies universalistes, les premiers nationalismes se sont développés en Europe à partir du Moyen Âge. Quand les Français viennent en Amérique, c'est pour élargir la chrétienté et agrandir le Royaume. Après la Conquête, les Québécois s'enferment dans l'espace laurentien à l'abri des seigneuries et de l'Église. Quand ils chercheront de nouvelles frontières, leurs mouvements de colonisation seront empreints d'idéologies françaises. Pour Rameau de Saint-Père, la conquête de l'espace canadien est une dernière chance offerte à la race française en Amérique. C'est sous cette influence que les Québécois vont commencer à se penser sous la forme d'une collectivité territoriale nationale. Le problème du Québec actuel, c'est d'avoir à choisir entre deux idéologies territoriales : le modèle européen de la communauté nationale spatialement circonscrite et cimentée par la langue ou le modèle américain d'une société pluraliste à langue unique. City-regionalism is now established as a key spatial arena for shaping sub-national urban policy. In these spaces, economic growth interests are marshalled within a competitiveness narrative as the dominant approach for the development of governance and policy. Yet such dominance in principle does not preclude other policy approaches from emerging and re-fashioning city-regionalism. In this paper, making reference to evolving city-region arrangements in the UK, specifically Cardiff, we explore and conceptualise policy pluralism. Our core argument is that to determine the possibilities for plural approaches to emerge, researchers can productively assess the intersections of relational and territorial geographies filtered through a micro–meso–macro framework. The framework positions governing principles, institutions and practices as mediators of, or triggers for, relational and territorial policymaking processes whose interaction may open up windows through which pluralistic approaches might develop. With such a conceptual approach applied in the context of city-regionalism, the break points in competitiveness-focused policymaking may more readily come into view.

Will Kymlicka is widely known in the world for the research in the field of the theoretical principles of liberal pluralism and justification of the policy of multiculturalism. In his scientific work, he pays attention not onlyto his native Canada but also draws attention to other regions of the world, including Central and Eastern Europe. The scientist asks whether the export of Western model of liberal pluralism and multiculturalism policies available in the region? Are Western models of multiculturalism and minority rights relevant for the post-Communist countries of Central and Eastern Europe? In the following article, we analyze Will Kymlicka’s views on this issue. Kymlicka explains why conventional ways of distinguishing between ethnic relations in the East and West do not help in understanding or responding to ethnic conflicts in the post-Communist world. He argues why the states of Central and Eastern Europe are not inherent in the territorial autonomy in their state building. He also argues why federalism as a form of government is not the solution of interethnic interaction’s problems. In addition, Will Kymlicka tries to highlight the unique characteristics of the region, which do not suggest the possibility of the introduction of liberal pluralism and multiculturalism in Central and Eastern Europe in the near future. This article offers an assessment of the ethical status of territorial borders, arguing for a partial defence of their role in international relations. Utilising the English School as one way such a defence has been developed, it assesses pluralist and solidarist arguments, suggesting both are flawed. The article develops a notion of territorial borders as contributing to the value of tolerating difference in international relations, and that this is an ethically desirable thing to do. It doing so it utilises the political theory of Hannah Arendt as an alternative to more common, if usually implicit, liberal understandings.

Na atualidade, os paladinos das políticas neoliberais passaram a entender que as lutas sociais de hoje são o reflexo de uma sociedade erigida por uma multiplicidade de vozes e pluralismo de posições. Essa é uma concepção advinda do pensamento pós-moderno, que junto a sua particular maneira de interpretar a realidade traz na narrativa do fim da civilização ocidental e de seus valores dominantes, o fio condutor para se traçar uma nova perspectiva de compreensão e atualização da realidade social. É diante desse contexto que situamos o objeto de pesquisa aqui adotado: a sociedade civil e sua interpretação pós-moderna. As lutas populares e as contestações sociais são indicadores de uma condição estabelecida pelo capital, que é a da contradição classista, e nesse processo o ato da luta política só pode se transformar em unidade transformadora à medida que deriva de um movimento em direção à consciência de classe. Desse modo, um dos principais objetivos aqui dimensionados situa-se em tentar compreender como a diversidade, ou ainda, a identidade, ambas rotuladas pela leitura pós-moderna como fragmentárias e individualistas, podem se transformar em uma identidade totalizadora, a de classe, quando movida pela força motriz de superação do capital. Com o processo de globalização, ou ainda, mundialização do capital, como prefere Chesnais (1996), houve um considerável agravamento das condições de vida da população mundial, o que produziu como reflexo imediato uma serie de transformações econômicas e políticas. E nesse bojo, o pensamento pós-moderno surge como instrumento de (re)organização e interpretação do “novo” momento vivido pelo capitalismo mundial e por sua forma de desenvolvimento, estando no centro dessa reorientação interpretativa a negação da centralidade do trabalho e do conceito de classes. É neste ínterim que se busca justificar a validade e a necessidade de uma reflexão teórica que faça o contraponto à visão reducionista e maniqueísta do posicionamento pós-moderno de entendimento da realidade atual. Este empreendimento teórico é um desdobramento da dissertação de mestrado intitulada: “Participação Social e Política de Desenvolvimento Territorial: a produção de uma sociabilidade estabelecida pelo consenso”, defendida em setembro de 2014 na Universidade Federal de Sergipe. Para tanto, se fez necessário um grande esforço no sentido de traçar uma investigação bibliográfica que desse conta de conceitos como, classes sociais, sociedade civil, pós-modernidade, neoliberalismo e identidade. O método foi o dialético, com ênfase na lei dialética da unidade e luta dos contrários. A investigação e o debate aqui travado deixam claro que os pós-modernos possuem uma intencionalidade muito bem definida, a de patrocinar e legitimar processos de individualização humana, deturpando a validade do conceito de classes em detrimento de uma eloquente valorização de termos fragmentadores da realidade.

Abstract:The idea of a perfect national political community, entirely confined within the contours of a corresponding state, is one of the foundational fictions of global modernity. Its formal crystallisation in the legal grammars of the right to self-determination has been however, particularly in the post-colonial era, highly problematic and full of ambiguities. Drawing on this background, this article contends that diplomacy offers frequently a more promising venue for dealing with the challenge of political pluralism than appealing to either the unstable grammars of the right to self-determination or a reified understanding of the principle of territorial integrity of states. In so doing, firstly, the right to self-determination is critically examined. Instead of attempting to articulate its formal content, the malleability of its legal grammars and political realities, will be emphasised. Secondly, based on the discussion of a variety of historical cases, the notion of ‘constituent diplomacies’ will be advanced, aiming to show how the agonistic accommodation of political and territorial pluralism through diplomacy was crucial not only in the formative processes of modern sovereign states but also nowadays. Finally, this relational understanding of the historical forms of governance of political pluralism within and beyond state boundaries will be re-examined, beyond its ethno-political dimensions, through the prism of the complex interplay between the material and ideational conditions for the co-production of sovereignty in the context of new global capitalism.

El artículo socializa parte de los resultados de una investigación centrada en problematizar las relaciones entre pluralismo informativo y mass-mediación del conflicto chileno-mapuche en la Araucanía, región ubicada al sur de Chile, en la cual se desarrollan diversos acontecimientos de confrontación entre el Estadonación chileno, el movimiento mapuche y las empresas transnacionales emplazadas en territorios ancestrales. A partir de un análisis argumental aplicado a un corpus de 18 entrevistas a comunicadores de la región de La Araucanía en el período 2018-2019, se identifican los tópicos y las estructuras argumentativas que operan como tramas de sentido en torno al grado de pluralismo informativo en esta región y sus efectos en el tratamiento informativo del conflicto chileno-mapuche. Asimismo, se discuten propuestas de transformación del ecosistema mediático para avanzar hacia un modelo de pluralismo informativo de carácter democrático e intercultural. The new paradigm in legal pluralism is closely related to the phenomenon of globalization. Laws of various levels move into limitless territories. There is a strong contact and adoption between international, transnational, national and local laws. Such circumstances make it impossible for mapping that a certain law (international, national, local) is separated from other law systems. This is a normative legal research with a comparative law approach. Law as a global phenomenon has the common values throughout the world, namely ethical moral values, social values and formal values of the state. The same values apply to the consumer protection law in Indonesia. Law Number 8 of 1999 on Consumer Protection (UUPK) in Indonesia was developed on the basis of legal pluralism. The data were analyzed using a Triangular Concept of Legal Pluralism developed by Werner Menski. In conclusion, UUPK is a form of legal pluralism. It is enacted based on the community needs, legitimized by the state and based on values and ethics.

IntroduzionePochi Stati sono Stati nazionali, e gran parte delle nazioni non sono destinate a raggiungere la condizione di Stato sovrano. Una trasformazione delle società plurinazionali in Stati nazionali «monocromatici» come quelli esistenti in passato è impossibile nel contesto di istituzioni liberaldemocratiche. La maggioranza delle cosiddette «nuove nazioni» sono in realtà Stati multinazionali o quantomeno multiculturali. Non solo i cittadini risiedono geograficamente in ambiti frammisti; le loro famiglie hanno un background eterogeneo e, dato non meno e forse più importante, hanno identità duali. Le istituzioni e i processi democratici devono riconoscere queste situazioni di fatto, questo tipo di pluralismo. In che misura, in uno Stato democratico, il pluralismo deve essere basato sulla rappresentanza e sui diritti di gruppo oppure sui diritti individuali? In che misura particolari soluzioni istituzionali rischiano di condurre ad un conflitto tra questi due principii ed approcci nel contesto della politica democratica? In che modo sarà protetta la libertà degli individui di scegliere la propria identità senza vedersi imporre identità inclusive? Questi sono problemi teorici e pratici sia per le democrazie contemporanee, sia per i paesi avviati verso la democrazia. Come potranno, gli Stati democratici multinazionali, guadagnarsi una legittimità sufficiente a rendere i processi decisionali democratici possibili e compatibili con il pluralismo nazionale e culturale? In particolare, come si potrà, in società di questo genere, rendere compatibile il federalismo con i diritti delle minoranze all'interno di unità territoriali, se in queste unità esistono maggioranze «nazionali»? Se non diamo soluzione a questi interrogativi, rischiamo di riprodurre in scala ridotta i problemi creati dai fondatori degli Stati nazionali in società multinazionali. Quali forme può assumere il pluralismo nazionale e culturale nelle società democratiche, e qual è il ruolo che le istituzioni e i processi democratici possono svolgere per rendere compatibili il pluralismo e la libertà individuale? Questi sono alcuni dei quesiti che dobbiamo sollevare e a cui dobbiamo dare risposta.

In the conclusion to this collection, I critically examine the theme of pluralism through the legacy of the poet Sargon Boulus (1944‐2007), Kirkuk’s most famous writer. Boulus once described Kirkuk’s culture as a ‘crucible’ whose vernacular multilingualism made him into a writer. If Iraqis see Kirkuk as a microcosm of Iraq’s diversity, Boulus is most often claimed as a human exemplar of the value of that pluralism. Yet, there are competing versions of his legacy that lead to incompatible readings of his work. Boulus’s own words reveal that he was less interested in diversity, heterogeneity or ethnicity than he was in developing layered understandings of literature and land. His literary project was not nostalgic and did not elide differences. Ultimately, northern Iraq’s history of conflict amid pluralism must be reclaimed and explicitly reckoned with in order to understand the extreme divisions and homogenization of communities and territories facing Iraq today.

The main idea of the article is that Soviet law is a global phenomenon both in the territorial, demographic, and in the sense of the transformation of the human personality. The main conclusion of the article defines Soviet law as an alternative to Western law in the context of the prospects for the legal development of mankind.

The paper formulates the definition of the principle of subsidiarity, and indicates that this principle can be used as a tool to find and maintain an optimal balanced ratio between the volumes of centralization and decentralization in the regulation and implementation of domestic relations, as well as relations between supranational associations and their member-states. At the same time, it is emphasized that the organizational and functional-target variables of the principle of subsidiarity are oriented towards strengthening the decentralization of the public administration system (public authority) by fixing the presumption of priority right (along with guarantees) of lower units to exercise powers in specific subjects of competence. In addition, when applying the principle of subsidiarity, the strengthening of decentralization is due to the need to ensure the implementation of the resources of participatory democracy, as well as the focus on pluralization of the entire public administration system. The distinction between territorial and extraterritorial forms of decentralization is substantiated, the similarities and differences between the principle of subsidiarity and devolution, deconcentration and delegation of powers are revealed. The correlation relationship between the principle of subsidiarity and the characteristics of the state-territorial structure is analyzed. The author formulates the thesis that the subsidiarity principle can be implemented in any multi-level system of organization of public power, functioning on the basis of a synthesis of the principles of solidarity, adaptability, pluralism, autonomy, democracy. It is concluded that in its synthetic unity the achievement of efficiency, the establishment of pluralism and participatory democracy acts as a paradigm of the principle of subsidiarity.

The Philippines is one of the many countries that currently acknowledge the presence of indigenous peoples (IPs) within their territories. This acknowledgment often comes with a formal recognition of the rights of IPs, including the right to practice their customary laws. Because of the equal existence of overarching state laws, this formally leads to a situation of legal pluralism for IPs. For many forest conservation advocates, legal pluralism for IPs, particularly with regard to land ownership and forest management, is expected to help conserve forests. This expectation, however, is founded on the erroneous assumption that the traditional land use of IPs is nondestructive and that traditional land ownership is communal. Using a relatively long historical perspective, this article demonstrates that these assumptions do not apply to the Kalanguya of Tinoc, the Philippines. In contrast to the notion of IPs being market-averse, this article further demonstrates that many Kalanguya have been and remain “capitalists”. The article favors the inclusion of a market-based forest conservation policy, which is arguably consistent with the reality of value pluralism.

AbstractThis article discusses difficulties in recent works advocating differentiated rights for ethnic groups based on the vulnerability of their cultures. Concentrating on the recent works of Will Kymlicka, the author suggests that such culturalist theories are based on an anachronistic vision of the relation between ethnos and culture and underestimate the depth and extent of the pluralism we face. The author focuses on two central difficulties. One is the tendency to overplay the contrast between the vulnerability of mainstream and minority cultural groups, overestimating the importance of ethnic institutions compared to other cultural infrastructures. The other is the problem of territory. Kymlicka's theory supports a model of ethnic hegemony over particular territories. The author suggests that in an era of densely overlapping cultures a model of ethnic hegemony over territory cannot be sustained as part of a theory which takes cultural fairness seriously. The article concludes with suggestions for an alternative perspective which might allow us to address the predicaments of culturally vulnerable individuals without incurring the difficulties that culturalism entails.

J’explique notamment en quoi le conceptnehirowisiw otiperitamowin, utilisé pour parler des droits, des pouvoirs et des responsabilités, fait aussi référence à des valeurs fondamentales comme l’autonomie et la réciprocité. En articulant ma réflexion à l’aide de la perspective issue du pluralisme juridique et des travaux de Roberts (1998), de Panikkar (1999) et de Jullien (2008), l’article montre en quoi cette perspective peut être une amorce intéressante à un exercice de dialogue entre les ordres juridiques autochtones et étatiques. Cet exercice soutenu par des exemples ethnographiques est une prémisse à la comparaison et à l’analyse des dynamiques d’enchevêtrement, de négociation et de résistance entre les ordres juridiques autochtones et étatiques.

Jean A. Laponce contributed significantly to the study of political science, particularly in the fields of French and comparative politics, pluralism, the meaning of right and left, and the politics of ethnicity and language. His most influential writings focused on the politics of multilingual societies. He examined the place of language from three perspectives: the territorial imperative—a bounded formal space providing safety and dominance for a single language; the problems of nonterritorially based linguistic minorities; and the rivalries and conflicts between languages in contact. Finally, he dealt with the survival of minority languages and the fate of languages globally. This review article evaluates Laponce’s contributions to political science.

The article is focused on the chronology and classification of territorial development agencies (corporations) as an instrument of state regional policy. The paper shows the threat of transformation of the potentially constructive role of corporations into a negative plane. The example of Poland illustrates the EUʼs intervention in the countryʼs internal affairs through regional development corporations as contact points. In Kazakhstan, the first wave of social and entrepreneurial corporations, which were created in 2006–2007 on an extraterritorial basis, caused an internal conflict between the elites, which led to the reformatting of this institution and its subordination to the existing system of regional management (“one district – one region”). The pluralism of approaches to the formation of a network of regional development corporations (“bottom-up” – “top-down”, monoterritoriality – extraterritoriality, etc.) provides opportunities for managerial experimentation, the results of which in the territory of the Russian Federation were expressed in the mass of economic and managerial structures at the federal and regional levels. At the same time, the macroeconomic success of their joint activities remains unclear. For the Russian Federation, the model of consolidation and development of the internal economic space on the basis of corporations of macroregions representing a set of neighboring subjects of the Russian Federation and historically having economic ties of varying degrees of breadth and strength seems appropriate. The model under consideration is based on a new institution of state ownership (macroregion ownership), which allows solving the problems of economic integration of territories by building extraterritorial production and economic complexes.
