In its present form, the control of legality is the result of an historical evolution which sets it in a complex systemic relationships involving multiple interactions. The objectives of the administration are very different from what they were at the tum of the century. The attitude of the administrators and those under their administration has also changed. Inevitably, a new equilibrium must therefore be found. To that purpose, a compensating force, of an equal intensity but of an opposite direction, must be created. Thus, as the judge, for reasons of effectiveness and credibility, is gradually becoming more of an administrator. Compensating mechanisms are emerging that bring the judge back to his essential functions. In fact, the judge of legality is certainly more an administrator as a result of his methods ans his new powers. But, on the other hand, the judge of legality is also certainly more a judge as a result of the evolution of his status and, in a more general sense, as a result of the evolution of the collected body of judges. Finally, the correlative decrease in the role of the administrative authorities, traditionally acting as judges of legality, is another manifestation of this evolution. However, the administrative judge, the key person in the control of legality, realizes that the path of progress is changing direction. This, strictly considering the contentious issues, raises some questions so far left unanswered

The thesis focuses on the german constitutional case law and doctrine relating to the principle of the separation of powers. The analysis of the problems concerning the meaning of the rule deducted under article 20 paragraph 2 of the German Basic Law of 23 May 1949 point up its practical application today. The interpretation of the solutions of the Federal Constitutional Court constitues the main part of this research however it is impossible to globally appreciate and understand the principle of the separation of powers without make the necessary effort to explain its genesis in the german constitutionnal law. Ergo, the theories of the Vormärz also the thought of the legal scolars of the Empire and the Weimar Republic are an important key stage that permit to grasp the present form of the principle in the decisions of the judge. The functional justice or the theory of the substantial decision complete the definition of the constitutional separation of powers. The concretisation of these integral elements of the principle create the system of checks and balances that govern the conflicting relations between legislative, executive and judicial powers

The principle of subsidiarity has become a principle of european law with the article 38 of the european community treaty. The purpose of our work is to show that this article wich is supposed to protect member states against the growing communautaries competences will not succed in his task. The principle will fail because of his ambivalence. In his classical meaning, it must protect the inferior level against the superior level's intervention. But, in his modern meaning, it justifies the intervention of the superior level so that it can help the inferior one. The analysis of the practice shows that in domestic affairs, in international law and in european law the subsidiarity was an inefficient barrier in such cases. The theory of the implied powers is responsible for this failure. This jurisprudential creation born in the u. S. Law and transposed in international and european law cohabits with the principle but has an inverted function : it legalizes the growth of competence of the superior level so that it has the necessary powers to take action for the fulfilment of the purpose of the constituent instrument (constitution or treaty). Well then, the implied powers have always succeeded in their confrontation with the subsidiarity (in his classical meaning). It will be the same with article 3b. Beyond, it seems possible to demonstrate that because of his ambiguous formulation, the subsidiarity of that article 3b is essentially a conventional ratification of the theory : the modern meaning of the principle is in fact nothing but a conventional illustration of the theory

Based on the analysis of the French Constitutional Council case law, this research studies a specific technique which the constitutional judge uses when interpreting reference norms. Doing so, the constitutional judge creates concretization norms. Concretization norms are built on reference norms of the constitutional law review, and can be viewed as a user manual of these norms. They are infra-constitutional norms. Some of them are binding to the legislator while other command the constitutional judge itself. Indeed, one category establishes the criteria the legislator must follow in order to pass laws in compliance with the Constitution. A second category establishes methods which the constitutional judge will use when proceeding to the constitutional law review. These news rules are a concretization of reference norms on two levels. First, they specify the content of these norms. Second, they facilitate their application. Hence, concretization norms are a judicial tool and a legal norm. Through all these characteristics, concretization norms are used by the constitutional judge in order to extend its jurisdiction but also to stabilize its case law
