AbstractThe right to emigrate-the free movement of people into and out of their country of origin-is a right recognized by international human rights law. The Soviet Union has recognized its obligations under these laws and the Constitution of the USSR and the "fundamental principles" of its legislation require actions consistent with international treaties to which the USSR is a party. Nevertheless, the Soviet Union discourages and prevents emigration by manipulating its legal system. Only members of a few ethnic groups are allowed to emigrate. Over the years emigrants have been mainly Jews, Armenians, and ethnic Germans, as well as some Japanese and Koreans. Emigration is limited by the Soviet Union's policy of "reunification of families," which effectively eliminates the vast majority of Soviet citizens from emigrating. Even those groups allowed to emigrate in limited numbers face substantial impediments. Complicated procedures, great expense, economic and social ostracism, and oftentimes harassment or arrest await those who apply for an exit visa. Applications for emigration are handled in an arbitrary manner, at best, and in a punitive manner, at worst. The resulting system is one in which emigration is not a right, but the grant of an administrative indulgence. Emigration law, and the Soviet Union's policy toward it, is the focus of discussion herein. Analysis of emigration law and practice is necessary to counter the legal justifications advanced by the USSR to defend its restrictive policy of emigration. First, I will discuss the Soviet Union's obligation under international law to respect the right to emigrate; next, I will analyze Soviet emigration law and citizenship renunciation law. Third, I outline the application process; and last, I address the legal basis for refusing emigration.

Emigration has been known to mankind for more than a century. We name the factors contributing to emigration, give examples from the history of emigration both abroad and Russia. We emphasize that at the present time, Russian citizens emigrate to other countries, using the right to freely leave the state, and can also have dual citizenship under Russian law, or renounce citizenship, and then get it again. We pay special attention to the settlement of the territory of North Caucasus, which began in the 8th – 7th – 6th – 5th thousand BC. We analyze the features of emigration of people from North Caucasus after the October Revolution of 1917. The specifics of the emigration of people from this region of country are emphasized. Thus, the majority of people emigrated to the Ottoman Empire, and then moved to Europe. We indicate that in fact, after the adoption of the Decrees of the Central Executive Committee, the SNK of RSFSR in 1921, “On the deprivation of the rights of citizenship of certain categories of persons who are abroad” many emigrants from Russia, including North Caucasians, have become disenfranchised. This circumstance greatly influenced the publication of the Nansen passport (it was introduced in 1922 and became widespread in 1924), according to which emigrants were granted a number of legal and social rights. In addition, it is applicable to emigrants from Russia, including from the North Caucasus, in 1922 and 1926. The Geneva definition of “Russian refugee” was given, and the International Convention on the International Status of Refugees of 1933 created an alternative to naturalization for refugees from Russia. Subsequently, before the outbreak of the Second World War, people received, as a rule, the citizenship of the countries in which they began to live.

The migration issues make an extensive and multifaceted subject in John Paul’s teaching. Expressions of these are, among other things, his Messages for the World Migration Day. In twenty-six years of his pontificate the Pope pointed out the problems of modern migration, which concern individual aspects of life of the Church and of the World. In his Messages the Pope also undertakes canonical issues of migration and shows us the ways to solve them. The Pope’s leading item is a statement that all migrants need special concern on account of their specific situation. It is a duty of the Church to provide a pastoral care for them. Pope John Paul II always defends human rights especially a human right to emigrate and he supports migrants’ right to maintain their own identity. The Pope pays special attention to their rights to form the family and to maintain the family rights.

Interestingly, the right to leave, which is generally considered to be at the core of liberal states, has rarely been substantiated in the history of philosophy. This neglect is unfortunate, in particular since this right is currently contested both theoretically and practically. Against this background, the present text takes up Kant’s right to emigrate, formulated in § 50 of the Doctrine of Right, and examines it with respect to its content as well as its legal-philosophical implications. This paragraph has so far received little attention in Kant scholarship, but a closer look at it is worthwhile in several respects in particular with regard to current debates, as will be elaborated.

Анотація:
The Soviet Union and post-communist states are outstanding case studies of the changing meaning of expatriation and citizenship. The historical shifts in voluntary and forced expatriation and the relationship between the two signify the changing perceptions of citizenship. Although there appears to be a disjunction between the two periods, I argue that this difference is mainly in scale and is symbolic rather than a transformation of the philosophical principle that allows free movement and free emigration. Both philosophically and legally, the right to exit one’s country and emigrate is considered a basic democratic human right. However, like all philosophical and actual manifestations of this right, during both the communist and post-communist periods the right to leave was conditional. Similarly, most post-communist countries adhere to the traditional conception of citizenship that sees dual citizenship as a violation of the exclusiveness of national political membership.

After 40 years of a long rising emigration from Mexico to the United States, the number of Mexicans increased to 12 million in 2006, while the increased input of remittances reached $26 million dollars in 2007. Yet, the increasing migration and remittances mainly in Zacatecas and Michoacan states do not achieve economic and social development because of the persistent backwardness, unemployment and marginalization. It demands the need for new Policies of Development, Migration and Human Rights that allow exercising the right to not emigrate in a medium term. Positive products of this long migration are the Mexican Migrant Clubs and their Federations that elaborated the concrete development proposals. Whereas, the possibility that these proposals can become a Development, Migration and Human Rights, Comprehensive and Long Term State Policy will depend on the capacity and participation of Mexican Civil Society and the Transnational Communities in both countries.

AbstractThis article looks at the issue of the origin of the Ethiopian Jews and how they have survived the odyssey of their return to Yerusalem. The questions of how and when ancient Judaic influences entered Ethiopia remain the subject of controversy. Their impact on the last surviving Ethiopian Jews, the Beta Israel, and the Ethiopian Jews' right of return to modern Israel are of undoubted importance today. This raises the issue of whether the religious ideal and the automatic right of all jews to emigrate to Israel are equally applied. Furthermore, the concrete experiences of the Ethiopian Jews in Israel compel one to ask new questions about the possibility of the Beta Israel beginning to rethink their relationship with Ethiopian society.

Prior to the massive wave of emigration to South America during the nineteenth century, inhabitants of rural communities in the western French Pyrenees emigrated in large numbers to Saint-Domingue and other Caribbean islands. This article examines the connections between migratory movements and the organization of these communities into “house societies” (Lévi-Strauss) in which the continuation of the “house” was paramount and no new “houses” could be founded. Adopting a microhistorical approach, it analyzes the complex role of inheritance rights in the decision to emigrate and reconstructs the networks that made emigration possible. Unlike the traditional belief that sons were forced to leave because they were deprived of their share of inheritance, the family unit fully supported the emigration of its younger members. This article also argues that emigration simultaneously resulted from and undermined the “house system.”

Alors que les flux migratoires « spontanés » sont en recrudescence depuis le début du XXIe siècle, la mer est devenue le théâtre d’un drame humanitaire qui semble sans fin. Sur toutes les façades maritimes européennes, les décès ou disparitions de migrants demeurent fréquents du fait de conditions de transport extrêmes, le plus souvent liées au trafic dont ils sont l’objet, ou de manoeuvres dangereuses opérées à l’occasion de leur arraisonnement. Au risque de perdre la vie en mer s’ajoutent des atteintes répétées à la dignité et à la liberté du migrant imputables à certains États côtiers de départ et de destination qui cherchent à interrompre sa navigation, y compris lorsqu’il manifeste un besoin de protection internationale. Si la lutte contre l’immigration irrégulière ou la criminalité organisée constitue un motif légitime d’interception en vertu du droit international de la mer, les actions (recours abusif à la force, refoulement, expulsion collective, privation arbitraire de liberté) et inactions (refus de coordonner un sauvetage ou de coopérer au débarquement des rescapés dans un lieu sûr) de certains États dans cet espace constituent une grave méconnaissance des droits de l’Homme, du droit des réfugiés et du droit relatif à la sauvegarde de la vie humaine en mer. Le comportement des acteurs privés du monde maritime peut également se révéler préjudiciable au migrant en détresse, rescapé ou passager clandestin. While “spontaneous” migratory flows are on the increase since the beginning of the 21st century, the sea has become the scene of a humanitarian drama that seems endless. On all the European seaboards, the deaths or disappearances of migrants remain frequent due to extreme transport conditions, most often linked to the smuggling in which they are the object, or dangerous maneuvers carried out during their boarding. In addition to the risk of losing their life at sea, there are repeated attacks on the dignity and freedom of the migrant attributable to certain coastal States of departure and destination which seek to interrupt his navigation, including when he requires international protection. The fight against irregular immigration or organized crime constitutes a legitimate reason for interception under the international law of the sea; however, the actions (abusive use of force, refoulement, collective expulsion, arbitrary deprivation of liberty) and inactions (refusal to coordinate a rescue or to cooperate in the disembarkation of the survivors in a place of safety) of some states in this space constitute a serious disregard for human rights, refugee law and the law relating to the safeguard of human life in sea. The behavior of private users of the sea can also be detrimental to migrants in distress, survivors or stowaways. This observation requires to think about how to ensure the effective enjoyment and exercise of the rights of migrants at sea. In this respect, the thesis proposes to resolve issues that are insufficiently or not apprehended by positive law and which concern the content and scope of the fundamental right to emigrate applied to the maritime space, the question of the legality of a refusal to disembark opposed to a surviving migrant, or the apparent inability of supranational jurisdictions to control the practices of European States which attempt to dilute their responsibility with regard to the migrant at sea in that of third States

Background: Emigration of health-care workers is a problem within global health systems which affects many countries, including Peru. Several factors have caused health-care workers to emigrate, including burnout syndrome (BS). This study aims to identify the association between BS and its dimensions with the intention of physicians and nurses to emigrate from Peru in 2014. Methods: A cross-sectional study, based on a secondary analysis of the National Survey of Health Users (ENSUSALUD - 2014) was conducted. Sampling was probabilistic, considering the 24 departments of Peru. We include the questionnaire for physicians and nurses, accounting for 5062 workers. BS was measured by the Maslach Burnout Inventory-Human Services Survey. Adjusted odds ratio (OR) was calculated using multiple logistic regression. Results: Of the study population, 44.1% were physicians, 37.7% males, and 23.1% were working in Lima. It was found that 2.8% [95% confidence interval (CI): 2.19–3.45] of health-care workers had BS. The overall prevalence of intention to emigrate among health-care workers was 7.4% (95% CI: 6.36–8.40). Association was found between BS and intention to emigrate in Peruvian health-care workers (OR = 2.15; 95% CI: 1.05–4.40). Emotional exhaustion was the BS dimension most associated with intention to emigrate (OR = 1.80; 95% CI: 1.16–2.78). Conclusion: Physicians and nurses from Peru who suffered from BS were more likely to have intention to emigrate. Policies should be established to reduce BS as a strategy to control “brain drain” from health-care workers of Peru.

Arrhythmogenic right ventricular cardiomyopathy (ARVC) is an inherited heart disease, where sudden cardiac death in young seemingly healthy persons may be the first symptom. There is a need for more sensitive and accurate diagnostic methods to detect signs of disease, at an early stage and in relatives of affected individuals. The aim of this thesis is the evaluation of new non-invasive modalities in assessment of right ventricular (RV) volume and function with focus on patients with ARVC. Clinical and non-invasive follow-up of fifteen patients with ARVC during a mean period of 8 years permitted the evaluation of disease progression. RV volume analysis by magnetic resonance imaging relies on short axis (SA) views. A new axially rotated modality acquisition was tested and its feasibility in assessment of RV volume was evaluated. This acquisition seems to be able to improve the assessment of RV volume and function by reducing the uncertainty in defining the basal slice of the RV. A third study concentrated on analysis of RV regional and general function by echocardiography, using tissue Doppler imaging as well as two dimensional (2D) longitudinal strain based on speckle tracking in patients with ARVC, their first degree relatives and in healthy subjects. 2D strain showed a good feasibility in analysis of the RV function in relatives and controls but less in ARVC patients probably due to the progressive myocardial cell death with fibro-fatty replacement of the RV wall. In order to detect and follow up echocardiographic changes an index was developed combining dimensional and functional parameters for the left and for the right ventricle. Advances in the molecular genetics of ARVC have provided new insights into the understanding of the disease. Hitherto, 9 candidate genes have been identified. A new mutation in the plakophilin 2 gene was detected in a three generation family. The clinical phenotype related to this mutation was investigated. The studies have evaluated and developed methods for studying the right ventricle with special emphasis on ARVC. With the ultimate goal of preventing sudden death in ARVC, a combination of genetic testing and improved diagnostic methods may create an improved algorithm for risk stratification and selection to prophylactic treatment.

The article provides for an analysis of the legal nature of Article 30 of the Charter of Fundamental Rights of the European Union, which declares "the right to protection against unjustified dismissal". In the focus of attention is the question, whether this right constitutes a human or a fundamental right or it is a right without the status of being fundamental or alternatively only a basic principle. The considerations are based on the legal theory of human rights and particularly social rights, as well as on the understanding of this right in the various international treaties and the constitutional traditions of the Member States. Furthermore, the article addresses the question of implementation of Article 30 in the national laws, scrutinizes the interpretation of Art. 51 Abs 1 of the Charter and highlights the deficiencies and possibilities. Also the image of this right mirrored in the European Union's law and the case law of the Court of Justice of the European Union is examined.

Kiekvienas darbas (130cm. x 130cm.) atliktas ant MDF - vidutinio tankio medienos plaušų plokštės, naudojant: popierinius rankšluosčius - „paloma“, universalius klijus - „lipalas“, gipsinį tinką - „knauf rotband“, aliejinius dažus.Kūrybinio darbo – asambliažo - kolekcijoje „Emigracija“ nagrinėjama problema – jaunų žmonių išvykimas svetur dėl ekonominių priežasčių. Žmonės dabar emigruoja dėl geresnio gyvenimo, nes, Lietuvoje leidžiama darbdaviams pasipelnyti iš darbo jėgos. Savo kūrybiniame darbe šią temą ar koncepciją interpretuoju simboliškai. Man svarbu pats žmonių „išnykimo“ faktas. Tai lyg „kryžiukų - nuliukų“ žaidimas. Tik neaišku kas žaidžia- manipuliuoja žmonėmis.
Diploma paper consists of two parts: theoretical description and practical creative job. In the theoretical part I discuss the conception, idea and analogs of assemblage. I explain also the course of the work, means, the technique of implementation. The craetive job consists of the collection of three works. Every work (130cm x 130cm) is implemented on MDF – average density fibreboard using paper towels, universal glue, gypsum plaster and oil color. In the creative work‘s collection „Emigration“ the problem of people leaving to other countries is analyzed. Now people emigrate due to expectations of better life, as, according to Rimas Armaitis,in Lithuania employers try to gain too much from their employees. However, in my creative work I analyze this theme symbolically. For me the fact of „disappearing“ people is most important. That is like the game of „crosses and nills“. Just it is not clear who plays and manipulates with people.

AbstractImmigration policies and immigrants’ rights to social protection in the UK have evolved dramatically over the past few decades, due to changing immigration flows, the UK’s membership of the European Union (EU) and participation in the European Single Market, and increasing anti-immigration sentiment, which culminated with the decision to leave the EU in January 2020. In this chapter, we argue that, at present, access to social protection is hierarchically structured depending on the interplay of three key variables: benefit type, immigration status and residency status. British citizens residing in the UK and immigrants with a permanent leave to remain have access to full social protection. So do generally European Economic Area (EEA) immigrants with the right to reside, though the precise basis of the right to reside is important in determining the types of benefits the person is entitled to. Migrants with a temporary leave to remain are excluded from most non-contributory benefits, as generally are British citizens living abroad, though those residing in EEA countries and those residing in a country with which the UK has a social security agreement are still entitled to a limited range of benefits. Many changes in access to social protection, especially as regards EEA immigrants in the UK and British nationals living in the EEA, are likely to stem from the UK leaving the EU, though these changes are currently being negotiated and, at present, no definitive post-Brexit regulatory framework is available.

AbstractDespite having one of the largest diaspora in the world, the United Kingdom peculiarly has no diaspora engagement policy to speak of. Policy, not legal right, underpins consular affairs and social protection policies are extremely limited. Such absence stems from a lack of distinctive British national identity in large part due to the UK being multi-national state, a heterogonous and typically prosperous diaspora driven by lifestyle migration, and in turn the assumption that Britons living abroad do not want or need to engage with the homeland state. Policy towards Britons residing abroad is characterised by limited engagement but effective communication leading to a disengaged state that keeps the dialogue open. Whilst social protection policies are rudimentary, the state is a world leader in providing online information in preparing British emigrants for living overseas. Voting rights of overseas citizens (namely the 15 year residency requirement) has and will continue to be a contentious issue following Brexit − and one subject to change − as has pension inflation adjustment. As the effects of Brexit on Britons residing abroad come to fruition, the politics of social protection and the rights of Britons residing abroad will be an imperative issue on the political agenda.

Abstract This chapter assesses the social protection policies enacted by the Maltese government to support Maltese citizens living abroad. First, the current status of the Maltese diaspora and their engagement with the homeland is contextualized, and key infrastructure and policies outlined. In the Maltese legal system, there is no domestic law granting the right to consular or diplomatic protection, however this is offered as a matter of practice based on respect for the fundamental rights of the individual. The strength of historic ties with the destination countries of Maltese emigrants is mainly reflected in the number of Reciprocal Agreements signed between Malta and partner countries. An overview of these formal treaties and their assured benefits is provided. Thereafter, five areas of concern for the social security needs of Maltese diaspora are addressed: unemployment, healthcare, pensions, family-related benefits, and economic hardship. The chapter concludes by acknowledging the communication initiatives between the Maltese government and its citizens abroad; however, it recognises that there is still a long way to go in terms of ensuring democratic participation of citizens in elections. Throughout, the evidence has been compiled primarily as a result of consultation with primary source material, as well as interviews with a range of experts within relevant Maltese governmental bodies.

AbstractFormal labour and affiliation to Ecuador’s social security system is the main gateway for access to social protection benefits, especially in the case of migrants. However, a large informal labour market and low levels on inclusion in the social security system forces large sectors of society to rely on family and community arrangements for the management of risk and economic uncertainty. The state provides some non-contributory benefits through cash transfer programs but, with the exception of health care, these only cover people living in conditions of extreme poverty. Universal, non-means tested programs are limited to the public health and education systems. Overall, migrants face several obstacles to access social protection benefits. Gaining the right to work legally is mostly reserved for white-collar and highly educated immigrants, excluding impoverished immigrants. Paired to the inability to access labour-related benefits and government programs for the so-called poor, immigrants lack the safety nets provided by extended family and a community setting. Nationals residing abroad have restricted access to social benefits, having access only to the contributory pension system on a voluntary basis. This chapter discusses the social protection system in Ecuador and focuses on eligibility criteria to show the extent of migrants’ access to the social benefits.

The concept of “Global Ethics” refers to the analysis and identification of ethical solutions to the challenges of the contemporary world. Among the current global problems we bring to the fore: illegal immigration as a component of human trafficking, but also other global issues interdependent with the two crimes above: violation of human rights and freedoms, poverty, resource scarcity, discrimination, illegal international business and trade, all of which, requesting from the authorities and beyond, legislative and ethical solutions. Legal migration is the widely accepted form globally, since it can be determined over time, but also controlled in terms of the number of people, fields and jobs. Illegal migration is the alternative used by people who cannot use the legal route to go abroad. A component of trafficking in human beings, illegal migration is a global scourge, hard to control, caused by organised criminal groups, but also by the increasing ingenuity of criminals. Although the phenomenon is manifesting itself worldwide, it is accentuated by the fact that there is a lack of appropriate legislation and an effective system of cooperation between government institutions and civil society.Trafficking in human beings must be related to the causes that led to its emergence: discrimination in the labour market revealed by high unemployment rates (women vs. men), poverty combined with low remuneration for work performed, corruption of authorities, poor border control, restriction of legal migration opportunities, internationalization of criminal groups correlated with high profits from human trafficking, poor information of people who want to emigrate about the real effects of the labour market. Knowing this phenomenon, but also of the causes that cause it to occur, determines the process of working for knowledge, resolution and fight against it. The present work is intended to be a source of information that makes available to those interested that information about illegal migration, as well as how state structures can and should be involved in the situation.

Instead, counties create their own rules that create serious gaps in constitutional protection. Subject of the article’s study – journalism of Ukrainian diaspora publications on the topic of liberation struggle of Ukrainian nation. The author emphasizes on variations of such a struggle, in particular on traditions of militarism and pacifism. A lot of Ukrainians who lived outside of Ukraine, because of third wave of emigration, used to believe that the USA will start another world war, will deal with the USSR and in this way will help Ukraine become independent. Similar thoughts were fundamental thesis of so-called «liberation conception». Such theories and hopes were outlined in columns of such magazines as «Visti Combatanta», «Vyzvolnyi Shliakh». But another part of political emigrants, concentrated around OUN (w) and URDP, positions of which were represented in such publications as «Ukrainskyi samostiynyk» and «Nashi posytsii», problem of Ukrainian independence tried not to deceive to war between the USA and the USSR and considered nonviolent methods of government change. Similar thoughts had the authors of «Suchasnist» and «Lysty do Pryiateliv». Time and historical realities showed that were right those journalists who believed in evolutionary, not revolutionary, theory of state development. Ukraine was able to become independent peacefully after the USSR decay and creation of sovereign states. Among this, modern Ukrainian society still lacks respect to Ukrainian army, nurturing of traditions of military valor, honor and justice, to which even diaspora journalists paid attention in the previous century.
