Сервисы совместного потребления одним из первых пришли в автомобильный транспорт, в т.ч. в виде каршеринга. Каршеринг в г. Москве получил значительное развитие благодаря принятым специальным городским стандартам, а также мерам господдержки. Анализ рынка каршеринга Москвы позволил определить структуру парка транспортных средств и оценить тарифные сетки услуги каршеринга. Безопасность является важнейшей проблемой услуги каршеринга. Проведенные расчеты позволили определить уровень аварийности и их тяжесть по каршеринговым автомобилям в 2018 и 2019 годах, а также в I квартале 2020 г.

As a result of the study, the author comes to the conclusion that the complex subject composition of persons involved in the provision of carsharing services does not always allow in practice to give the correct qualification to relationships, which leads to incorrect application of the law. Abstract:

The concept of carsharing is not fixed in Russian legislation. The absence of a legally fixed concept of carsharing and its regulation entails legal uncertainty. There are different opinions among scientists and practicing lawyers regarding the legal nature of the carsharing agreement. The article examines the legal structure of the carsharing agreement and qualification issues. It should be concluded that currently a carsharing agreement is a legal constructor that includes elements of various agreements enshrined in the Civil Code of the Russian Federation.

The article is devoted to the study of the peculiarities of relations on the transfer of vehicles for short-term possession and use in order to establish the legal nature of the carsharing agreement. The necessity of establishing the place of the carsharing agreement in the system of contractual models is substantiated. Evaluating the characteristic features of contractual relations in the sphere of carsharing, the author concluded that it is possible to extend to such relations the provisions of the Civil Code of the Russian Federation on public contract.
