Abstract:
First, from the distributive justice perspective, strong perceptions of distributive injustice are found among undergraduates from national minority and lower-middle and lower classes. The perceptions of distributive injustice can further be differentiated into injustice in educational accesses, educational processes, educational outputs and educational outcomes. Both undergraduates from national minority and from lower-middle and lower classes have registered strong sense of "accumulative distributive injustice" in their educational-advancement experiences. Attributions of educational distributive injustice to disparities of educational resources among regions have also been revealed in this study. However, educational injustice attributed to gender differences seems to be insignificant among perceptions of the subjects under study.
Second, from the relational justice perspective, the perceptions of educational injustice among undergraduates are investigated and categorized in accordance with Young's framework of relational injustice, namely exploitation, marginalization, powerlessness, cultural imperialism and violence. It is common among undergraduates from national minority and lower-middle and lower classes to have relatively strong sense of relational injustice relating to cultural imperialism and violence. However, the experiences of violence revealed are mostly in the form of symbolic rather than physical violence. They also have substantive sense of relational injustice pertaining to marginalization and powerlessness. Experiences on exploitation are rarely reported among subjects from national minority and lower-middle and lower classes. This study finds that perceptions on relational injustice attributed to gender differences are insignificant among female subjects.
Social justice has risen to be one of the major social issues in Chinese mainland. As attainment of higher education has become one of primary determinants of attainments in social status among future generations, justice in higher education has therefore constituted as one of the areas of concerns among scholars in the field of Chinese education.
Third, differences in ethnicity and class have been revealed as the primary contributing factors to the perceptions of educational injustice among the subjects under study. Perceptions of educational injustice reported by undergraduates from national minority are mainly concentrated on subjects who are Islamite and Tibetan Buddhist from Xinjiang and Tibet. Among subjects of lower-middle and lower classes, subjects from rural areas have relatively stronger sense of injustice than those of comparable class backgrounds from urban areas. Therefore, it seems that disparities in class position and regional differences seem to have crystallized and asserted reinforcing effects on students' perceptions of educational injustice.
This study focuses on a group of the undergraduates from disadvantaged social backgrounds. It investigates their perceptions on educational injustice that they have experienced during their studies. The perceptions of injustice will be studied from the perspectives in both the distributive and relational justice. This study aims to provide an in-depth understanding of the perceptions of justice among students of higher education in Chinese mainland. Twenty-two undergraduates from disadvantaged social backgrounds have been selected to be subjects of the study from four universities in Nanjing city of Jiangsu province. From the data collected, the following major findings are revealed.
This study has contributed to the scholarly discourses on distributive and relational justice by injecting first-hand qualitative data generated from the context of higher education in Chinese mainland. Furthermore, this study has provided some deep descriptions of the perceptions and experiences of educational injustice in a group disadvantaged background undergraduates in Chinese mainland. It is hoped that these data may help policy makers in formulating educational policy in the future. These data may also sensitizing teachers and other persons working in higher education sectors to address the perceptions and experiences of injustice among undergraduates from disadvantaged social backgrounds. Lastly, it is hoped that the study may be viewed as one of the tiny efforts that have been accumulated over the years by educators all over the world to constitute a relatively more equal and just educational system in human societies.

The main issue of my thesis focuses on whether realization of the ideal of justice and fairness in adjudication is possible. I discuss this main issue by means of Dworkin’s legal theory and his theory of equality. First of all, I start my discussion with analysis of Dworkin’s legal theory, which includes four stages: the semantic stage, the jurisprudential stage, the doctrinal stage, and the adjudicative stage. In semantic stage, Dworkin points out that the concept of law should be interpretive concept. In jurisprudential stage, he deems the concept of law as a concept of political values, and what the value presented by concept of law is the value of legality. Furthermore, he considers the best concept of the value of the legality, so as the best conception of law, is integrity. I believe this is the key concept which connects Dworkin’s legal theory with theory of equality. In Law’s Empire, Dworkin said that integrity in adjudication asks judges apply the laws which come from the principle of justice and fairness. This leads us to Dworkin’s theory of equality. Dworkin presents his theory of Equality with two dimensions. One is equality of resources, which could be narrowly seen as a theory about distributive justice. The other is political equality concerning the distribution of political power. These two dimensions of his theory of equality offer the possibility of realizing the justice and fairness in adjudication. The theory of equality of resources offers the guidelines for courts to follow when deciding if citizens have some sort of concrete rights, and if government violates the equal protection of citizen’s rights that demanded by the ideal of equal concern. According to political equality, it offers the basis of judicial review in democracy. Finally, Dworkin points out that how judges apply laws to concrete case is something related to those three stages as mentioned above. Dworkin distinguishes himself from the legal positivists, such as Hans Kelsen and H.L.A. Hart. The different between Dworkin and legal positivists is discretion power of judges. In his theory, it is judge’s legal obligation rather than moral responsibility as positivists regard. Inevitably, there are some critics to Dworkin’s theory of equality. Here I cited the research of Joseph Raz and Samuel Schaffler to exam Dworkin’s theory. Their articles offer reflective points of view to me. Joseph Raz criticizes Dworkin’s theory as something irrelative to the coherence that Dworkin himself requests. He further criticizes that Dworkin’s theory of adjudication ignores the role of authority in modern state. Samuel Scheffler criticizes that Dworkin’s theory of equality ignores the importance of political and social equality. Besides, how to distinguish circumstance and ambition is not clear enough in Dworkin’s theory. Furthermore, Scheffler considers that Dworkin’s theory of equality may allow a heirachy administration exists. Although they point out some defects, I do not think they did fulfill significant challenges to Dworkin’s theory. After all, I consider that Dworkin’s legal theories build up a perfect framework for realizing the value of legality, which can also be referred as the rule of law. Most importantly, his legal theories are coherent the other moral values and convictions of ethics. I think Dworkin’s theories of law and equality may offer the best possibility to realize the ideal of justice and fairness in adjudication. Untraceable electronic cash (e-cash) indicates a user made a payment, but no one knows who the payer was. It hence ensures user privacy and becomes an attractive payment tool. However, untraceability property, also called anonymity, is easily abused by criminals who use it for activities such as money laundering, bribing, or blackmailing. To address these problems, researchers introduced fair e-cash systems in which the anonymity of e-cash is maintained if the e-cash is used legally, but is revoked if misused. Except untraceability and anonymity revocation, e-cash should be publicly verifiable, unforgeable, double-spending resistance, and not to be spent by non-owners. In addition, the e-cash system preferably allows bank-offline payment and to give change. Untraceable e-cash is realized by blind signature schemes in which a signer signs a sealed document, and a receiver can unseal the signed result to obtain a signer’s signature to the original document. Furthermore, if letting the sealed document include some tracking information by some method, we can trace the sealer by some corresponding method. Such construction is referred to as fair blind signature schemes. For an e-cash system, the signer will be a bank and the sealer is a user. That the anonymity can be revoked through the tracking information infers fairness. In this dissertation, we present two pairing-based fair blind signature schemes and develop two corresponding fair e-cash systems, named IDB-Cash and LEB-Cash. IDB-Cash is an identity-based cryptographic application, using participants’ identity information such as name or email address as public keys, and thus has the advantages of simple key distribution, key management and key access. In addition, the protocols in IDB-Cash possess communication efficiency because each has built-in identity-authentication and key-agreement functions, and it therefore eliminates the cost of necessary pre-built secure channels. As for IDB-Cash, it employs Boneh, Lynn, and Shacham’s short signature primitive to design a license-embedded blind signature scheme (LEBSS) to properly embed a user license into e-cash while keeping the license anonymous to the bank. The LEBSS is provably secure in terms of blindness and unforgeability, providing more robust e-cash than IDB-Cash does. Compared to related pairing-based fair e-cash literature, IDB-Cash and LEB-Cash are efficient in e-cash size, issuing cost and paying cost. IDB-Cash is welcome to the practice while LEB-Cash possesses both efficiency and provable security.
