LANGUAGE NOTE | Document text in Chinese; abstract also in English.近年來得益於女性地位的提升與名人效應，單身女性凍卵問題日趨成為社會輿論關注的焦點，由此也引發了法學界對單身女性生育權的討論。然而，單身女性凍卵不僅僅是一個法律議題，更是一個倫理問題。不僅法律和法規的制定和修訂中多有涉及對倫理的關照，凍卵的臨床實踐中也廣泛存在對倫理的考量。在結婚率和生育率持續走低當下社會，相當一部分單身 女性選擇凍卵的動機是希望脱離婚姻而進行自主的生育行 為。值得深思的是，東亞的儒教國家對輔助生殖的使用限制最為嚴格、政策最為保守。本文試圖通過分析儒家會如何看待脱離婚姻的生育行為，來探討儒學倫理對單身女性凍卵抱有怎麽樣的態度、能夠帶來怎麽的啟示。本文認為，儘管在法律維度上應該肯定單身女性擁有生育權，但在倫理層面上，脱離婚姻的生育行為應該極為審慎，因為其有違儒家倫理中對家庭秩序的看重，同時也讓“雙親撫育”難以得到實現。In recent years, thanks to the promotion of the status of women and the celebrity effect, the issue of the frozen eggs of single women has become a focus of public

LANGUAGE NOTE | Document text in Chinese; abstract also in English.自從20世紀80年代末，隨著中國和其他國家在生物醫學科研上合作的增多，與之有關的倫理問題隨之增加。尤其是20世紀以來，如果說科研倫理學是生命倫理學領域的一顆新星不過分的話，那麼，赫爾辛基宣言就是科研倫理學的核心的說法是很恰當的。為了提高科研倫理學的意識，保護受試者的權益，預防潛在的倫理問題的發生，順著赫爾辛基宣言發展的歷史並找尋其中變遷的線索是非常必要的。具體來說，從紐倫堡法典產生的背景和內容開始，追溯1964、1975、1983、1989、1996、2000和2002年赫爾辛基宣言變化的原因，並把主要變化的內容單獨注出來，以利於讀者進行比較分析。探詢歷史發展的軌跡，是為了從中吸取經驗教訓，完善對受試者保護權益保護的機制。本文所有的材料都是為了這個目的服務的。關於國際前沿性的對最新的赫爾辛基宣言的爭論，讀者頭腦中要有各國對科研倫理學原則的多元化的理解這樣一個概念，同時要知道聲音最大的背後的原因，而且更重要的是要有結合中國實際情況的意識，以及是否適合中國的情況的分析，否則仍要停留在被動盲從的地位，不能真正實現科研倫理學應有的實踐性價值。Along with the development of biomedical research cooperati

LANGUAGE NOTE | Document text in Chinese; abstract also in English.本文通過中國和美國的醫學生對同一個案例的不同看法，提出了醫學倫理學教育的本質問題，即如何實現醫學生的道德？作者根據芝加哥大學臨床倫理中心和北京大學醫學倫理學教研室工作的實際情況繪出了兩個單位的工作示意圖，基於此，作者嘗試對北京大學和芝加哥大學醫學倫理學教育和實踐械制進行比較研究。總的來說，無論是從學生入學時的年齡和學生對學醫目的的明確上，還是從醫學倫理學的教學方法上，以及學校在醫學倫理學的教育體制等方面，二者都存在很大的差別。我國的醫學倫學教學雖然已經比較普及地進行案例教學。但案例教學若想深入下去還是比較困難的，若不成功，非常容易使學生得出學習醫學倫理學之後沒有什麼長進的感覺，表面上看是因為學科本身的對案例分析沒有明確答案的原因，但本質上是教師在引導學生思考的方式、角度和啟發性存在問題，沒能真正提高學生分析和解決問題的能力。所以，本文提出了我國的醫學倫理學教育是個系統工程，需要在案例分析方法、教師的素質本身的提高、帶教老師的倫理學培訓、教師與醫生聯合進行課題申請和研究、醫院成立醫院倫理委員會和IRB兩個與倫理學有關的職能部門等方面必須加強，也開展定期的發生在醫院內的案例討論，這樣既可以使醫學倫理學教學和科研人員能通過正常渠道進入醫療實踐中，充分實現醫
