ABSTRACT Coming with the progress in economic development in Taiwan recently, the number of various public constructions has continued to increase. This also implies that the resources for land use are changing fast. Relatively, there is, however, no comprehensive data of land use aimed at special application for the needs of integrated planning of all developments. Based on the above requirements, this research studies how to generate the comprehensive data of land use in the Taiwan area. Because the remote sensing image from the satellite covers a large area, in order to get the best results among all choices, the SPOT satellite image offers the temporal and spatial resolution that can best meet our requirements.Traditionally, if we want to get the various types of land use from remote sensing data, we usually adopt the method of classification. because the spectral resolution from satellite images are limited, and the classification generated from remote sensing images is data of land cover, if we want to know the actual way land is used, we cannot rely solely on the spectral information to make classification, additional auxiliary data are required. This research is using radio network to plan the required data of land use. According to the characteristics of radio broadcasting, charts of land use consisting of five classifications including forest, water, open space, urban, and suburban are generated. Previous studies have shown that the spectral classification of satellite images in this application will encounter some difficulties. For example, clouds and its shadows would have cover effects; the classfication of forest would be affected by the mountain geographic effects; the bottoms of rivers would emerge above water during drought seasons, making the classification of rivers (or water) inconsistent; satellite image classification can only classify the classfication of built-up land, and cannot classify the land use of urban and suburban. As a result, this research tries to combine satellite images from SPOT and the vector data from Geographic Information Systems (GIS) to faciliate the selection of training areas of supervised classification and further processing of land use classification, overcoming all difficulties so as to generate the charts of land use required by radio network planning.

Abstract Land use regulation is an indispensable implement. In order to advance public interest, it can limit the rights of use, profit and transfer of landowners through the restraint of land use. Whenever the effect of land use regulation exceeds the social obligation that everyone can bear, the unfairness is caused. In order to overcome such unfairness, this research project quotes the taking theory from America to fulfill the deficiency in Taiwan. Taking theory offers property owner protection against reductions in property value caused by government regulation, applying the theory into the land, is so-called land use regulatory taking. This research project gets the following conclusions and achievement. Firstly, ‘Defensive nation’ is the main concept of the property institution in Taiwan. In other words, the nation is more protecting than limiting the property. Secondly, the existence of land use regulatory taking has it own necessity, but the unfairness of regulation will obstruct the purpose and effort of restraint; therefore it has to improvement. Thirdly, the verdict of land use regulatory taking in America is a way of the suffering, according to public interest, due process of law, and economic impact, the courts sentence to hold a taking claim or not. When regulation goes too far, the landowner can get a reasonable compensation. Fourthly, the laws didn’t prescribe in Taiwan when land use regulatory forming to taking, only for according to ‘besonderes opfer‘ in the Council of Grand Justices to compensate when regulation goes too far. Finally, in order to accomplish the equity of land use regulation, this research project analyses the laws in Taiwan and quotes the taking theory from America, it roughly sets up a judgment of land use regulatory taking, including the legitimate concept,the limit of property and besonderes opfer. This research project appears to land use regulatory laws in Taiwan trending to constitute taking about the assigning, prohibiting and limiting architectural laws, but there is no compensating rules, it causes damages to people. This research project stresses on the unfairness of land use regulation, and hopes that it can serve as a reference of adjustment of land use regulatory laws.

McDonald(1981)提出估計資本/土地替代彈性之大小,可衡量土地與住宅服務投資之 分配比率,隱含著地租與居住密度之變動,為分析都市住宅市場空間結構之重要指標 之一。本研究即應用資本/土地替代彈性模型,結合台北市房屋個案交易資料,並建 立特徵價格方程式,作為分離土地與資本價格之中間步驟,以期估計土地價格接近市 場,增加估計資本/土地替代彈性之可信度,以確實掌握台北市土地使用強度分佈之 特性。 台北市資本/土地替代彈性為0.62,顯示土地/資本價格變動1%,資本/土地使用量 即土地使用強度變動 0.62%。因都市的成長,係由資本陸續投入累積之結果,故屋齡 在五年內之新建住宅的替代彈性比屋齡較久的住宅來得高,且解釋能力亦較好。顯示 台北市之土地使用逐漸朝高強度發展之趨勢。 最後估計台北市各行政分區之資本/土地替代彈性發現,因舊市區地價高昂發展集中 ,且新市區可居住用地較有發展空間的情況下,造成台北市土地使用強度之分佈,雖 以市中心區為核心,但有朝向新市區明顯發展之趨勢。因此,新市區的現況與計畫容 積率之差距比率將較大,影響居住環境之品質,故宜由均衡區域發展之觀點,全盤檢 討台北市土地使用強度。

SUMMARY The demands for changing urban land uses are increasingly with social and economic developments. The government, developers and the society always dispute the fat profits from high-density uses of urban lands and its impacts on the environment. Thus, the government establishes the urban land-using mechanism wishing to solve the disagreements. But the inefficient bureaucracy, and the buck-passing of government departments result in the developers fail to take the opportunities instead. Moreover, the extra costs and unpredictableness will influence the motivation and decisions of the developers. Thus, my study takes the theories of transaction cost and property to discuss the types of transaction costs deriving from the land-using mechanism. I take the Nan-Rong ironworks as case study and make an investigation of the developers by the AHP questionnaire to find out the transaction costs could influence the land operation decisions. The result of my research shows that the developers will burden kinds of transaction costs and the costs will influence the decision-making process when the developers face the uniqueness of the properties, the uncertainty of the environment, and the speculation of the behaviors. Moreover, from the case study, the plan-modifying costs, bargaining costs and the development delaying costs will also influence the decision-making process. The AHP shows that the costs of plan developing and information-collecting at planning process; the costs of development-delaying and barging at examining process; the costs of the treaty-retracting at building permission process have obvious influences on the development decisions. Due to fast economic development and the trends of globalization and liberalization, urban and rural development has been completely restructured, and there is a growing need for development of non-urban lands and conversion of farmlands. In addition to maintenance of food sufficiency, farmlands also have other “external benefits”, including preservation of the natural ecological environment, maintenance of an ecological balance, and balancing of overall use of lands. Many nations around the world, including the US, Germany, and Japan, have been devoted to preservation of farmlands through strict control of conversion of farmlands. In an overview of the domestic regulations on land use control and conversion, it can be found that since legislation of the Land Act in 1930 and Regulations on Non-Urban Land Use Control in 1976, our government had been engaged in protection of farmlands. After 1980, the importance of agriculture for the national economy gradually decreased due to promotion of industrial and commercial industries. In 1995, the “Farmland Release Policy” was implemented, ushering in liberalization of farmlands. In 2000, the Agricultural Development Act was amended to lift the ban on free trading of farmlands. The amendment of this act further liberalized the use of farmlands. However, liberalization of farmlands was bound to certain limitation and should be based on strict control of land use. The relaxation of the farmland control policy has made many standard agricultural zones filled with lands used for specific businesses, such as factories, gas stations, and waste processing plants, and caused public worries over environmental pollution. Although release of a portion of farmlands is necessary for commercial and economic development, planning of farmlands or conversion of farmlands for non-agricultural use should be carried out on the condition that “completeness of the agricultural production environment is unaffected”. Based on “farmland protection”, the impact or harm of agricultural changes and economic development on farmlands should be avoided, and the completeness of the agricultural production environment should be maintained, so as to ensure sustainable development of food production and agriculture. Therefore, investigation of issues concerning conversion of farming and grazing lands and regulations governing the impact of such conversion on the agricultural production environment is indeed necessary. In the present, most studies of related issues are focused on regulations on conversion, management, and feedback mechanisms of agricultural zones in urban plan or holistic farmland resources (including non-urban lands in urban plans). However, there is no comprehensive “empirical analysis” of regulations on review of conversion of non-urban farming and grazing lands, difference in regulations for various types of lands (including lands of different sizes and in different regions), subsequent control mechanisms, and the impact of the conversion on preservation of farmland resources or the agricultural production environment. Besides, issues such as whether the regulations on conversion of different types of farming and grazing lands is feasible, whether these lands can be converted on the condition that “the agricultural production environment is unaffected”, and whether conversion of these types of lands causes different effects on their surrounding agricultural production environments, have not been thoroughly investigated so far. Therefore, through an empirical analysis of cases in Taoyuan County, investigation of related issues, and interview with experts and public/private departments, this study aimed to explore the domestic regulations on conversion of use of non-urban farming and grazing lands and protective measures for farmlands. Further, based on farmland protection policies adopted in foreign nations, this study further proposed strategies for improving the current system and protective measures to distinguish itself from other existing studies.
