ABSTRACT As far as the land use is concerned, land is the issue that most of the people are generally in touch with and it is indispensable for the development of social economy. If land problems occured have been inappropriate and resulting in land use disputes, they are bound to affect national construction and economy. The focus of this study is to solve the various controversial disputes facing the owners of the joint ownership lands. This research first collected and analyzed the actual land registration cases in Miaoli County’s Land Affairs offices, including Miaoli, Tongluo, Tungshiau, Dahu, Toufen and Chunan. From 2006 to 2015, there were a total of 195,625 cases. Among them, there were a total of 114,486 “sale” registered cases, which is accounted for 58.3% of all types of cases registered; “gift” 15.39%; “inheritance” 13.16%; “auction” 3.20%; “spouse gift” 2.93%; “segmentation” 2.14%; “trust” 1.59%; “judgment” 0.57%; “acquisition” 0.41%; “exchange” 0.22%; “others” 1.42%. It indicates that “sale” has the largest bulk and may have the most disputed cases, followed by gift and inheritance. This was proofed to be true after interviewing one of the land administration agents in Miaoli County. Since each joint ownership land dispute case is unique, it is highly unlikely to study and discuss them all. Therefore, this research next investigated and resolved land dispute issues by using a few proper cases. Some of the actual dispute cases in “sale”, “gift” and “inheritance” categories were chosen to demonstrate how to solve and analyze the land dispute problems and present their legal basis. It is hoped that this study can help solve joint ownweship land disputes and achieve the most efficient use of lands. Keywords: real estate, civil law, land law, construction law, land disputes

abstract: 当前，民营企业已成为中国重要支撑力量，而未来5到10年，约有300多万家民营企业面临传承困境。但学术研究领域在传承整体框架、配套机制建设方面有完整论述、有成功案例的所见不多。首先，针对以上民营企业的传承现状，本文将研究、回答五个问题：1、成功传承的标准和要素是什么？2、传承模式有哪几种，每种模式配套的传承机制是什么，该如何建立？3、民营企业应选择何种传承模式，如何选择？4、民营企业的整套传承方案如何落地搭建？5、是否有普适性的、可借鉴的民营企业传承模型，包含哪些要素？
其次，本文主要使用文献研究、案例研究、实证分析，选取中、美、德、日四家不同传承阶段、不同传承模式的知名民营企业，对其传承情况进行深入研究。在此基础上，归纳总结出传承的关键要素，对前述五个问题进行系统解答。同时，本文创新性地结合理论研究、案例研究及企业实践，提出适合我国大部分民营企业的传承全周期管理框架。
最后，根据以上研究，本文总结出关于中国民营企业传承的八大结论及建议：1、本质：权力的交接和义务的传递；2、两大风险：继任风险（继任人的能力要求）、代理风险（继任人对企业核心理念的意愿/忠诚度）；3、降低风险的四大机制：领袖锻造、人才梯队、管控治理、激励机制；4、两大成功要素：“选领袖”和“建机制”；5、四大机制是并行推进、相辅相成的，要尽早构建、持续优化；6、三大模式：家族成员继承、内生培养经理人、外聘职业经理人；7、民营企业传承模型包含七大要素、五大步骤；8、民营企业在制定传承方案时，除了要注意传承模型中的要素，还要注意其他关键要素。Dissertation/Thesis

The concept of Project Management is originated from North America since 1970. It has been first adopted by American Ministry of National Defense & NASA and at the same time, they have also requested their co-manufacturers to employ such principle. Since then, many constructions and engineering works start introducing the project management in managing their projects. The leap of IT industry has further put Project Management forward in 1990''s. Project management is the discipline of organizing and managing resources in such a way that the project is completed within defined scope, quality, time and cost constraints. The project management is not a one-way management. It emphasizes on the integration of management both vertically and horizontally across departments. Under the globalization nowadays, the request of using project management in tackling projects among departments, between companies or even across oversea enterprises is rather common. Hence, the equipping of Project Management knowledge has become vital important in most companies. Good and effective project management can enhance the project working well. Consequently, the project can be adhered to the planed schedule; within the cost budget, reduce the project risk and assure its quality. It will also increase stronger enterprise’s competition ability, efficiency as well as to secure the organization development. Relatively, the poor project management will not give a positive impact to the project but it will even ruin the existence and the development of the company. The project management system of western enterprise will normally comprise of: building up a project management platform, developing project management professionals, good operation management, systematic project management system, promotion, supervision, cross-checking, reviewing & improvement and auditing. The good project management demands the ability of leadership, communication, negotiation, problem solving, and organizational influence. During the five project stage: the starting (project defining), planning, delivery, control and close-down & review, the requirement of using the technique of integration management, scope management, time management, cost management, quality management, human resource management, communication management, risk management, procurement management can enable the completion of the project successfully. The main purpose of this research is to study how the project organization that will affect the performance of the Project Management. It is hoped that by studying of this, it can help the enterprises or organizations’ management to have better understand on what kind of factors that will influence the result and the control of the project during the execution of Project Management.

The Case Study of “Inquiry and Discovery” Teaching Method -on Pythagorean Theorem Abstract The main purpose of this study is to understand: under the circumstances of the educational environment in Taiwan, if it is feasible to utilize a different teaching method-“Inquiry and Discovery” teaching method other than the traditional way of teaching, how it affects a senior teacher and what the impact is of trying a new teaching method on her ordinary daily teaching, and observe the students’ learning process and performance during the teaching. And because the Pythagorean Theorem is the main theme of the teaching context, students’ learning concerning generating conjecture, justification of the conjecture and reasoning and proving the result is also analyzed. The results of this study show that: 1. Students’ performance under the teaching method of “Inquiry and Discovery” （i） Students are able to manipulate the geometric figures through cutting, combining, translating and rotating in order to explain the area of different squares. （ii） Some of the students are able to apply the equivalence concept of if P then Q and if ~Q then ~P. And about 2/3 of the class can differentiate the relationship between P and Q among the proposition of if P then Q. （iii） Students are able to do the explanation and reasoning via multi-representation towards deductive reasoning with symbols. Study shows that teaching with “Inquiry and Discovery” teaching method is feasible in mathematics classroom in Taiwan.

The study of deep excavation in Kaohsiung case is by collecting information, and sorting and analysis, how to reduce the damage of nearby house and to control ateral wall deformation effectively, to increase the stability of excavation, In this paper, Using RIDO program as analysis tools, to analysis the sand layer and clay layer sensitivity, respectively, to study parameter changes effect on the retaining wall deflection analysis of ground movement. On-site wall deflection analysis of measured values obtained with RIDO bit capacity of the wall to make a co-ordination of comparison, the soil strength parameters with the horizontal coefficient of subgrade reaction, the level of support stiffness reduction and the correction factor for changes in water pressure on the wall deflection analysis of relationships, the analysis of deep excavation retaining wall deflection select a different amount of sensitive parameters, will have different amount of wall deflection analysis, these results will influence the design of retaining structures. Analysis showed that the results of deep excavation in Kaohsiung case clay layer parameters Su / σ'v roughly between 0.3 and 0.4, Kh / Su value of about between 60m -1 to 160m -1; sand layer parameters Kh / N value of between about between 50 t/m3 to 150 t/m3. Therefore, the establishment of a more appropriate area of deep excavation in Kaohsiung simplified numerical analysis of program operations; as the Kaohsiung area, engineering design and analysis of information, could be applied to other regions, further study and research.

This thesis describes a case study on the progress made by the industries that have established the Computer Prepress System. This case study includes the evaluation of quality costs and model collection. By researching on a specific company, this critical issue concludes as followed. 1. It is semi-irrelevant between the quality costs and the unit productivity, but they both achieve high standard. The quality costs and defect rate are highly relevant. They also both achieve high standard. The quality costs and the total factor productivity are semi-irrelevant, but they are below the standard. The quality costs and the usage of equipment are highly irrelevant, and they both achieve high standard. The above factors show that the quality costs can be estimated by the total factor productivity, defect rate, and the unit productivity. 2. Through collecting the data of the quality costs, the most influential factor to the quality of Computer Prepress System is expected to be found according to the Analysis of Pareto Distribution. The managers are also provided the priority when improving their business. 3. The graphics of quality costs trend analysis, of defect rate, of total factor and unit productivity all indicate that the improvement of the quality costs system can promote the quality, decrease the defect rate, and increase the total factor and unit productivity.

The economics in Taiwan has strongly grown in the last decades. The gross domestic income (GDI) has increased leading to a growth of the demand, on the market, for products with an high content of cutting edge technology. Following this trend, the range of products for which resin has been used has increased in the same way. The phenomenon has drawn great attention of writer to do more analysis and reach in the field. Nowadays the resin in Taiwan is facing high pressure and experiencing a difficult investment environment due to high production costs. Following massive foreign direct investment from Taiwan to China, the needs for new strategies has become essential in order to survive in the this completive market. Given the above scenario, the writer believes that the Taiwanese resin industry has to face a number of improvement such as enforcing marketing strategies, developing new products and increasing the effort in training of human resources. Following the above elements would lead to higher profits essential to the development of enterprises. In this thesis, Michael Porter's Five Forces Model and SWOT analysis has been used as in the study of management strategies. The writer has chosen Nanpao as the main case study performing a research which included both gathering information from books, magazines, journals, websites and interviewing Nanpao Senior Managers. The writer has found out that the industry competitive advantages of Nanpao resin are on: 1-high capability in quality control and manufacturing processes leading to high value products which allows the exploitation of new markets and enhances the opportunity of alliances with supply chain with subsequent increasing of competitivity；2- Adaptation to the new globalized market for which the enterprise has applied the most suitable strategies leading to high-profits. In this work, the writer would like to suggest that important points to succeed in a competitive market are the following: 1- knowledge of the importance of strategic alliance; 2- building of good relationship with clients; 3- respect of laws and regulations in the improvement of production processes; 4-enhancement of the capability in researching on high technologies; 5- the use of new products to improve competitivity. The writer hopes this study would be of beneficial to all readers in the resin industry.

How to create and maintain the enterprise’s competitive advantage is an issue of great significance for the whole company as well as the managers. In the past studies, industrial structure or firms’ interior as the main source of competitive advantage was investigated; however, the results of past empirical studies showed that under fast-moving environment, firms were often unable to be adapted to the condition of abrupt technical change. Based on dynamic capabilities perspective, this research is aimed at investigating how firms can renew and sustain their own advantages to be fit for an unstable environment. Using single-case study as the research method and taking one domestic telecommunication firm as an example, the research is to explore the way a firm can overcome all the difficulties and take its place in the telecommunication field under the situation that the original strategy failed due to the organizational transformation and recessive economy. Via interviews and proposition development, the research sorted out and collated data which described the variation of this firm’s dynamic capabilities dimensions during organizational change and global financial crisis. While analyzing and discussing the process that this firm faced the violent change of external environment, this research indicates the results as followings: 1. The more violently-moving external environment a firm faces, the more likely it is for a firm to make organizational change and transformation. 2. The more capacity a firm owns, the more likely it is for a firm to maintain a market leading position. 3. The more technical abilities a firm owns, the more room for development of enterprise recognition a firm will have.

So come，that consumer will make the decision on wrong information. According of Ministry of the Interior real estate information system’s information ,that average price of one estate is NT 2,160,000 on 2018.it huge amount for Resident that live at Taipei city. therefore if consumer to buy a estate by false advertising information that will be make huge damage .and maybe will suit in the court. According The Real Estate Broking Management Act article 22, real estate agency should be employee Real estate broker to review and sing on the advertising , Real estate transaction specification. The advertising should be qualified after Real estate broker’s view , why still occurred false advertising? According Department of Land, Taipei City Government’s information ,there are 290 violation item between 2017~2018. About false advertising case is 78 item. It Important proportion in violation item. So we know, false advertising is main violation item of Real estate agency. And why? It must further study for consumer’s right. Abstract Since the banking industry in our country implemented financial liberalization in 1990, sixteen new banks have been gradually established. Because the products of each bank are very similar, the banks compete with pricing strategies in order to seek for business growth and gain clients. In addition, some banks improperly expand client credit, leading to unfavorable results such as: dropping the profit spread of banks, increasing the amount of overdue loans, worsening of credit quality and declining performance. Several important issues need to be considered which can influence the success of the bank''s operation in the future. Firstly, how can the innovation or differentiation of products or services to segment market be achieved; and how can better credit risk control be achieved? In addition to facing the problems mentioned above, the banking industry is one that mainly relies on information technology. Especially, since the introduction of Internet banking, banks can provide online services to break through space and time limitations via Internet banking or electronic commerce. These new creations have had a great impact upon the business model and operating management. Under the impact of information technology and the change of operating environment, several points need to be investigated: 1. How to set up a suitable information strategy to match the business strategy for enterprises? 2. How to establish favorable information framework and system to induce efficient development of information? in order to reduce costs for banks, to increase operation management performance and to improve the quality of service and to create competitive advantage. In order to establish foundation of this research, this research searched literature review from the operational challenges facing the banking industry, the need for practical application, business strategies, IT framework and application, resulting in the collection of the following data: 1. Business strategy largely influences the performance of operation and competition. 2. Correct information strategy will be helpful in achieving business strategy so as to influence operating performance. Information technology will demonstrate different strategic roles in different businesses. The planner of information strategies should understand business strategy and further clearly understand the role of information technology within the organization so that the suitable information strategy can be planned and implemented. In the meantime, businesses need to understand which information strategies should be applied in order to help the positioning of business operation and resource allocation not only to avoid failure but also to increase operating performance. The structure of this research is based on business strategy, information strategy, and information framework and business practice. There are four components whose interrelationships need to be discussed and which induce subordinate and lesser relationships between information strategy and the other components, and the application and impact of different information strategies. Research method mainly utilizes literature review and case studies. Selected case study companies were chosen for their operation characteristics and suitability of timing and objectiveness of information. Study tool mainly uses extensive interview and data analysis as the main focus. The starting point for researching the case study company was the arrangement of relevant data of this company. The next step was to study the company''s setup of related components of information strategy. Finally, a summary analysis was made and the proposed conclusions and suggestions are as follows: A. A case study company has the following operation and information strategy issues: 1. With regards to operations, it should be considered how to effectively improve the current information system only as a supporting role. In the meantime, from the structure graph of the current influence of information, it is understood that information strategy, information framework and business strategy all emphasize upon solving current problems. Actually, it should focus on how to position future business direction and strategy establishment for the guidance of future business development and information development. 2. Information strategy issue should include effective linking with business strategy, changing the currently supporting information strategy into strategic information strategy, integrating different systems, strengthening network formalization and providing integrated services and changing the role and position of the information department. B. Suggestions: The case study company wishing to set up information strategy should consider the following: 1. Take the opportunity of information transformation. 2. Suggestion of information strategy implementation into practice: a) Streamlining of operation workflow to save cost and time of processing b) Effectively integrating many currently used complicated systems c) Changing information department from the previous functions of system development and maintenance into capturing strategic resources, allocating information resources, promoting information management and educational training d) Establishing the responsibility of the CIO of information and policies of information e) Establishing information development project management system based on Balanced Score Card Keywords: Information strategy; information framework; business strategy; business practice; competition strategy; bank

Abstract Tap water is basic need of modern life. It is not only fundamental to supply of public security, public health, but also to development of national economy. In Taiwan, tap water is a monopoly public utility industry. Since tap water is associated with basic civilian utility, this industry is generally regulated by governments and monitored by public in most countries in the world for maintaining a good quality of life to public in general. Fundamental goal of this thesis is to examine adjustment mechanism of tap water price regulated by government in order to reflect cost of operation and prevent waste. Tap water price in Taiwan was never adjusted since1991. However, general commercial good price has been raised for several time, tap water price is controlled by the government and never adjusted for a political purpose. Government concerns that tap water as a basic public utility may have a negative impact on elections, if adjusted. Particularly, it may shake the base of political power of ruling party. It is obvious that price rate of public utility reflects a political complex of merely down never up. Revenues of Taiwan Water Company have encounters serious deficit, financial difficulty, capital shortage. It not only influences operation but also is unable to improve old water supply facilities. As a result, financial deficit may lower quality of water supply. This thesis examines running water price of various countries and make a proper comparison, and tries to analyze and construct an institution of water price adjustment. Main finding out in this thesis includes follows: 1. Government should establish an adjustment institution instead of administrative decision in order to reflect operation cost. Water price adjustment ought to be based on the of rational and professional principles. It should organize a proper Review Commission that plays a role of price assessment under the fairness and rationality. Most significant is that the price ought to reflect the cost in order to strengthen transparency and reduce doubt from public at large. 2. Price adjustment of tap water should be based on two fundamental principles: (1) basic needs for general public and lowest rate for public utility; (2) cumulative pricing, extending discriminating pricing from existing four-range system to six-range system. The more used, the higher charged. This new pricing system suggested by this research will be useful and practical for allocation of water resource and achieve a goal of maxismization of social welfare. 3. For several decades, Tap Water Company provides a deductive price for certain institutions or organizations, such as elementary schools, junior high schools, City governments, military service householders, etc. This research suggests that such a privileged pricing must be cancelled or directly subsidized by their superintendent agencies in order to reducing financial burden of this Company as well as accord to principle of user charge. 4. Enforced drought pricing system during water shortage period. Finally, this research suggests that tap water pricing system should establish an institutionalization that reveals as practical, flexible as oil pricing system has. This new system will provides public with a crucial idea of pricing of water resource. Government should be enlightened from political complex and reconsider price structure of public utility, such as water and electricity. Tap water pricing system should be comparable with oil pricing system which works a clear and accurate calculative formula. Government should decentralize public utility industries to adjust price in accordance with specific rational range; consequently, it will be able to reduce political considerations and reconstruct a proper and reasonable pricing structure of public utility industries. This research explains the history, the prevalent status, the operational efficiency and the positioning of bills financing in the domestic financial industry. It also describes the barriers and impediments hindering the progressive growth of the sector, and the solutions undertaken to overcome the numerous obstacles. Based on a compilation of officially released figures and statistics along with the annual reports of various bills financing corporations, an analysis of the operational efficiency of several companies is made possible. The conclusion is derived from a comparison of the financial ratios of the targeted companies covering repayment ability, profit ability, managerial ability and financial structure. Analysis shows that the three bills financing corporations longest in existence performed far more superior to the newer established ones due to the solid background of their major shareholders, the abundant experience of their management teams, bigger scale of operations, broader customer base, higher net worth and larger assets, which in turn lead to a higher current ratio, lower liability ratio and better profits. The newer corporations, concentrating their strategies on market expansion, tend to keep prices extremely competitive as they try to lure existing clients of the older financing corporations to their sides. This factor coupled with the fact that they are newer field players and are in possession of fewer assets thereby worth lesser, undoubtedly leads to a higher ratio of liabilities and lower stability. Two notorious scandalous cases that have rocked the local bills financing industry are tackled in this thesis. The first case is that of International Bills Finance Corporation. It is a fraud case in which a company employee by the name of Yang Rey Ren embezzled tens of billions of company funds by issuing counterfeit commercial papers. The company took the blow as it was harshly blamed for its overly laxed and lenient standards of internal control. Panic withdrawal ensued. Both the Chairman and the President of the company were immediately ousted by the authorities concerned, the Central Bank of China and the Ministry of Finance. The authorities further instructed Taiwan’s five leading banks to support the company and appointed Lin Hwa Deh as its new Chairman. Lin, unveiling his five key job responsibilities, was able to pacify the storm soon enough and was able to recover 90% of the company’s sales volume in just less than a year’s time. The second currency scandal, the Central Bills Finance Corporation case, is one of mismanagement, erroneous strategy and unprofessional conduct. Aiming at increased operational efficiency, the President of Central Bills Finance employed a strategy of granting excessive loans not only to its major stockholders but also to clients with dubious standings with nowhere else to seek for credit with the hope of generating higher interests and commission fees. Nonetheless, the strategy backfired as the local economy went into a slump. The vicious domino-effect cycle was prominently felt as bounced checks from numerous Groups, particularly the construction sector, started pouring in and instigated the company’s loss of cash control. Concerned authorities immediately replaced both the Chairman and the President of the company. Further directives were given. All banks were told not to withdraw their monetary support to Central Bills and four large banks, Huanan Commercial Bank, First Commercial Bank, Chang Hwa Commercial Bank and Taiwan Business Bank, were specifically instructed to take credit rights through the conversion of debts to stocks. Hence, the goal of the new management focused on keeping its clients. Extensions were granted to the customers it guaranteed for the issuance of their commercial papers. Bad debts were written off; non-performing loans aggressively chased and paid in capital decreased to NT$ 1 million prior to a NT$ 6 billion cash-increased capital supported by the four banks. All these measures sought to sustain operations at normal levels and to regain what the company had lost in investments through time.

When you are observing a social phenomenon, does it worth to pay further attention? What’s the main reason behind it that influences the social phenomenon? And how much percentage does it explain the social phenomenon? This paper has made an initiative research based on this concept. Naïve Social Scientist is not a nomenclature. Almost everyone is born to play this role. By means of consecutive explorations and tries to accumulate one’s ordinary observations, inductions and judgments on the social phenomenon and make it become part of people’s daily life. Although the scope of explanation comes from the discovery made by this informal research is not wide enough, still it can become the key factor; therefore there is no reason to ignore it. This paper is divided into five chapters. The first Chapter describes the background, motive and purpose of this research and adds to this some relevant glossaries are at the end so that the readers can better understand the concept. Chapter II goes directly into Interpersonal Deception Theory (IDT) and explores relevant theory documents. This theory was translated from the article published by Buller and Burgoon in 1996. The contents are quite abundant therefore requires much more patience to read. Chapter III introduces the framework and methods of this research in which has taken the second-hand information analysis, case studies and penetrating interviews as the main body. Qualitative research has been taken as the major methodology, and quantitative research has been taken as supplementary. Furthermore, there is some explanation of the restrictions of this research. The former part of Chapter IV has taken quantitative data to explain the connection between the population variety and the victims, and pointed out the importance of this research. The latter part is the extracts of six real victimized cases. It reveals the dark side of the instant lottery fraud ring that endangered our society. In addition to it is the extracts of the combat guidebook of fraud ring. In here, we should think carefully why is the trick within the scope of common sense could cause so many people in great suffering both in mind and body. The conclusion and suggestions in Chapter V is aimed to make a perfect ending to this study. There are 15 appendixes to this study that included interviews with four experienced workers, six real cases, a dialogue between a victim and the fraud ring that proves the fierceness of deception persuasive communication and three classic combat guidebook at the end. Thus, we can have an overall perception of the so-called deception persuasive communication model of instant lottery. Instant lottery（scratch-off tickets） is a high-rewarded, low-convicted crime model, which sees neither the crime scene nor the inflictors. Its power to gradually persuade and convince the victims is quite amazing.
