去中心化金融是近年分散式帳本技術與智慧合約的最新金融應用發展，其於過去1年的快速成長亦顯示其確實具有發展潛力，但其創造的新型態金融服務關係亦對現行民事法律與金融監理帶來挑戰。本文以去中心化借貸為研究對象，介紹此新興金融科技模式發展出的虛擬通貨借款與貸款業務、治理代幣以及去中心化自治組織，釐清此種以智慧合約為核心創造出的新型態金融服務與商業組織的法律關係與定性，並且分析去中心化借貸可能涉及的銀行監理與證券監理問題，探討虛擬通貨借款業務是否構成吸收存款，以及治理代幣是否構成證券性質虛擬通貨，期盼除能釐清去中心化借貸涉及的法律議題之外，亦能藉此機會檢視相關的現行銀行法制與證券法制。<br />

抽象的 從現代台灣地區客語出發，佐以巴色會客語和跨漢語方言中關於雙及物結構的考察，本文討論客語中由「分佢」和結果式動補（V-R）結構互動所產生的致使結構，並聚焦於「分佢」出現在V和R之中和之後的例子。本文主要觀點如下：第一，「分佢」句式表達言者主觀性，凸顯說話者的意志，但此特點不是因為「我者」視角，而是來自於構式本身；第二，「分佢」句式的複句性質仍然存在，但在語法化的路徑上，整個構式逐漸演變成單子句結構，其中的關鍵在於「佢」的指稱限制降低，經歷了「單數指稱>兼具單數、複數指稱>複數指稱>泛稱>無指稱」等演變階段，這造成了主語的泛化，帶動句式的整體變化，而隨著使用頻率的提高，「分佢」甚至合音成bi2 ，演變成單一的語法標記，單子句的性質益發明顯；第三，「分佢」致使結構不是構詞型，而是分析型；第四，「分佢」在這些結構中的句法位置和雙賓A和B式中接收者的位置有關，非因語意冗贅而產生的自由變換、非取決於R的語義指向、也非源自於雙及物結構中的介賓補語式和複合詞式中「分+賓語」的位置。

With the onset of English education in elementary schools in Japan mandated at an earlier age than in the past, the need to understand the extent to which children obtain international posture (Yashima, 2002) has become increasingly crucial. Toward that end, in the current study a validation of the International Posture-Child instrument (Monoi-Yamaga, 2010 ; Yamaga, 2007) precedes an investigation of the configuration and level of International Posture that 5th- and 6th-grade students at 5 Japanese public elementary school students possessed. Results indicated that configurations of children differed from that of adults, with 5th graders exhibiting a 2-factor configuration and 6th graders either an identical 2-factor configuration or a more complex 3-factor structure. Using the 2-factor configuration, levels of International Posture of the 5th and 6th graders were found to be statistically indiscernible. Implications and suggestions for further research are discussed. 日本の公立小学校における英語教育（外国語活動）が必修化されたことに伴い、児童が国際的志向性（Yashima, 2002）を有する程度を把握する必要性がますます高まっている。そのため、本研究では児童用国際的志向性測定尺度（Monoi-Yamaga, 2010 ; Yamaga, 2007）の妥当性を確認し、その後、5つの公立小学校に在籍する5，6年生の国際的志向性の構造及びその値を調査した。その結果、児童のもつ国際的志向性の構造は大人のそれとは異なること、具体的には、5年生が2因子の下位構造、6年生は2因子ないしはより複雑な3因子の下位構造であることが明らかになった。5，6年生の有する国際的志向性がともに2因子構造であるとして比較分析を行った結果、その数値に統計的な有意差は見られず、学年によって数値に差がみられないことが確認された。この結果を踏まえ、今後の研究への示唆について議論する。

This paper reports on a study investigating changes in L2 motivation for Japanese learners of English as they completed their first communicative English language course at university. I aim to describe the strength and structure of students’ motivation and the degree to which these changed over one semester. A 36-item questionnaire was used to measure components of the L2 Motivational Self System and International Posture. The questionnaire was administered twice to 202 second-year university students in Japan: during the first week of the semester and 11 weeks later. Structural equation models were created to describe the causal relationships between motivational variables for the two time periods. Paired t tests revealed that both motivated learning behavior and ought-to L2 self significantly increased over the semester. A comparison of the two models indicated that there was a change in the motivational structure from Week 1 to Week 12. 本研究は、英語学習者の動機づけの強さと構造、及びその変化に焦点をあて、日本人大学生の外国語（L2）に対する動機づけの変化を調査した。大学で最初に履修するコミュニケーション英語の授業を対象に、第2言語習得を動機づける自己システム（L2 Motivational Self System）と国際志向性の2側面を測定する36項目からなる質問紙を作成し、2年生202名に対して授業第1週目とその11週間後に調査を実施した。分析は、まず構造方程式モデリングで2回の調査間の動機づけの変化を分析し、それに基づき対応のあるt検定を実施した。分析の結果、動機づけの高い学習行動と義務自己ought-to selfに関する数値が1学期を通して向上したことが明らかになった。

This article discusses the experiences of Megumu (first author) and her students as they engaged in collaborative learning (CL) in their intermediate Japanese course at an American university. CL was one of three types of teaching and learning employed in Megumu’s course, but it enabled students to learn aspects of Japanese language and culture that other types of teaching and learning are not designed to accomplish. We first discuss the concept of CL from our social constructionist perspective; i.e., we see learning as a social process of knowing instead of merely a construct of individual minds (Berger & Luckmann, 1966; Gergen, 1999). This is then followed by a description of how this social constructionist perspective was incorporated in Megumu’s course, based on her and students’ reflections on their CL experiences. Finally, we close with an invitation to readers to explore the potential of CL in various Japanese language classroom environments. 本論では、米国大学の中級日本語のクラスで、筆者とその学生達が協働学習教授法（Collaborative learning: CL）に参加した際の経験を論じる。CLはこのクラスで用いられた3種類の教授法の1つで、学生達が日本の言語や文化を学ぶ上で、他の教授法では可能でないことを達成するのに大変役立った。本論では、まず、社会構造主義の視点に基づいたCLの概念を論じる。ここで言う社会構造主義とは、学習を単に個人の知の構築ではなく、物事を知るという社会的過程であるとみなす理論である (Berger & Luckmann, 1966; Gergen, 1999)。次に、この社会構造主義の側面が筆者のクラスでどう用いられているかを、学生達との実際の経験を振り返って叙述する。最後に、様々な日本語教育現場におけるCLの可能性を、共に探求するよう読者に提案する。 *A version of this paper was presented at the 25th Annual Conference of the Southeastern Association of Teachers of Japanese (SEATJ) at Duke University, NC, in May 2010.

Abstract:
With this study, we aimed to obtain a better understanding of the factor structure of the complexity, accuracy, and fluency (CAF) of English speaking proficiency. For this purpose, 224 Japanese junior and senior high school students with an English level of elementary to lower intermediate took an English speaking test. We transcribed what they said, computed measures to assess CAF, and used structural equation modeling (SEM) to examine whether the model in which the CAF factors are related fit the data. We found that syntactic complexity (SC), accuracy, speed fluency, and repair fluency represent distinct factors and that there are weak, moderate, or strong correlations among these factors. This generally suggests that those who speak fluently by using more words per minute tend to repair their speech more, but they also produce more accurate utterances with more clauses. We suggest pedagogical implications of considering CAF separately in teaching and assessment and benefits of using SEM for analyzing CAF. 本研究では、スピーキング熟達度における複雑さ、正確さ、流暢さ (complexity, accuracy, and fluency: CAF) の因子構造を調べる。中学生・高校生（初級から中級下レベル）の日本人学習者224名に、スピーキングテストを受けてもらった。発話をCAFの指標で数値化し、CAF因子が関連しあうモデルを共分散構造分析を用いて分析した。その結果、統語的複雑さ、正確さ、スピードに関する流暢さ、修正に関する流暢さの4因子の相関モデルがデータに適合し、4因子は関連しあいながらも別個に捉えられることが分かった。因子間の関連は弱いものから強いものがあったが、全体的には、1分間あたりにより多くの語を使って話す学習者は、修正をより多く行うが、より正確な発話と、より多くの節を産出する傾向が見られた。指導や評価の際にCAFを別々に考慮することの重要性や、共分散構造分析でCAFを分析する利点が示された。

抽象 霍爾語是四川境內較少人知的語群，屬於漢藏語系羌語支嘉戎語組。本文首度詳細介紹中部霍爾語格西話動詞的時－體範疇。保守的嘉戎語組語言，動詞均採「三分式」時－體系統，一般以方向前綴區別完整體與非完整體，以不同的詞幹標記過去與非過去時。相較於這種保守的形態格局，格西話動詞的時－體系統有數項重要的創新：（一）動詞詞幹交替大幅簡化，標註時間的功能基本喪失；（二）方向前綴從體標記轉成「相對過去時」標記，可通用的相對過去前綴də-開始逐步取代其他前綴，且有聚焦於動作結果的延伸功能；（三）以贅語式造出一般非完整體及「持續體」構造。這些重要的創新既源自內部衍變的機制，也明顯受到本地主流藏語的接觸影響。

受疫情影響，各國關於民事訴訟之數位化，尤其是線上遠距審理，產生大幅躍進，並成為未來民事訴訟變革之方向。因應數位化發展，溝通媒介之改變，民事紛爭處理制度必須面對從紙本到電子文件、從實體場域到網路空間之轉變。本文從國外線上法院程序之發展狀況，探討線上民事法院之目的論，並以線上起訴及遠距審理為對象，分析傳統訴訟以紙本文書及到庭辯論所形塑之訴訟文書交換及送達、兩造言詞辯論、直接審理、公開審理等程序架構及基本原則，於民事訴訟數位化下所受之影響及挑戰。除個別面向之數位化外，由於線上程序具簡速性及經濟性，亦宜思考有無何類事件（例如：小額事件），適合增設全面性之線上程序，使當事人得合意選擇利用，以保障其近用法院及程序選擇之權利，亦可合理分配司法資源，使法院更有餘力處理複雜困難之案件。各國有關民事法院之數位轉型仍持續發展中，本文並不在於蓋棺論定，而是期待就此議題能激發更多之討論。<br />

Abstract:
The present study examined differential social experiences of international students living in a residential hall called ‘Nihongo House’ (Japanese language house) at a Japanese university. By conducting social network analysis (SNA), as well as making use of ethnographic data collected through participant observation and semi-structured interviews, we explain how constellations of interpersonal relations at the house transformed over the course of one semester and what factors were responsible for those changes. Additionally, we present three focal cases of international students. These students—with different motivational orientations, personal dispositions and abilities, and social standing—went through diverse social processes, which led to different levels of success in respective accounts. Based on the analysis, we discuss how social experiences of these students in this particular setting can be understood in relation to their language use and potential development and how this type of residential hall can effectively nurture interpersonal relationships. Abstract in Japanese 本研究では、日本の大学における外国人留学生と日本人学生の人間関係構築プロセスを記述し、言語使用・習得への示唆を考察する。特に、寮という制度的に区切られた空間に着目し、寮の中で、1) どのように人間関係が構築され、コミュニティが形成されたのか、2) どのような要因が人間関係構築やコミュニティ形成に影響を与えたかを明らかにすることを目的とする。対象は日本国内のある大学に近年設置されたテーマ別寮の一つである「日本語ハウス」に住む留学生と日本人14名である。データとして、学期開始前と終了後に行った社会ネットワーク調査、半構造化面接、参与観察、寮に関する文書等を一学期間収集した。これらのデータを言語社会化の観点から分析した結果、メンバーによる活動の企画や参加を通したコミュニティ形成の過程が観察された。一方で、個人による参加のプロセスの違いや、コミュニティ全体としての関係、細分化された個人間での関係といった多層性を持った複雑な人間関係の存在が明らかとなった。また、異なる参加のパターンを見せた３名の留学生のケースを紹介し、彼らの参加プロセスに与えた影響について、言語能力（日本語や英語）、各学生の所属する複数のコミュニティ（サークルや授業等）における日本語ハウスコミュニティの位置づけ、ハウス内外の環境という観点から例証し、生活・学びの環境づくりについて考察する。

LANGUAGE NOTE | Document text in Chinese; abstract also in English.中國大陸 DNA 親子鑒定機構日益增多，但缺乏統一標準和法律監管，訴訟外個人申請親子鑒定數量攀升，DNA 親子鑒定的技術分析異化為一些男性“鑒妻定子”的工具，其結果傷害了無辜的孩子。分析指出，僅靠道德約束不能消除DNA 親子鑒定機構間的無序的商業化運作，從而減少給未成年人造成的傷害。建議儘快制定“親子鑒定法”，確認子女利益最佳原則、親子鑒定受限原則和親子關係推定原則，建立親子鑒定監管機制、確立親子鑒定機構的考核標準和DNA 親子鑒定的認定標準、嚴格限定親子鑒定的範圍和申請人、規定親子鑒定的複檢制度、資料保護和DNA 隱私保密制度。Due to the ever increasing number of family disputes over the identification of children in mainland China, more couples are turning to DNA tests to disclose the identification of their children. The number of DNA test agencies has significantly increased in recent years, and it is reported that the number of tests has increased by 20% every year. In some developed areas such as Guangdong province, the annual rate of increase is as high as 40-50%. These DNA test agencies seem to be free of any authoritative supervision or legal regulation, and operate with commercial motives. There is thus a danger that DNA tests are being abused in practice.This essay argues that it is not enough to simply discuss the moral issues involved in using DNA tests. It is crucially important to formulate proper policy and law to supervise and regulate DNA testing agencies to protect the innocent children involved in such cases. The essay proposes and argues for the adoption of several principles to guide the formulation of proper policy and law in this regard. The first is the principle of the best interests of the child, which should be promoted to protect the children involved. The second is the principle of restriction, which should set down certain conditions to limit the use of DNA identification tests. The third is the principle of constructive parent-child relations, which could be used to determine parent-child relations without the need for a DNA test. Most study-abroad research has focused on visitors’ development overseas; however, fewer studies have investigated hosts’ development through intergroup contact experience in home environments. This study, which is situated within a larger project, builds on earlier research (see Deacon & Pholboon, 2020) that examined the intercultural communication competence (ICC) development of 8 local Thai tutor hosts (N = 8) who were buddy partnered with 8 Japanese university student visitors during a short-term study-abroad program. In the present study, a qualitative semi-structured interview approach helped to determine the effect and influence that one significant factor, near-peer role models (NPRMs), had on tutor hosts’ cognitive, affective, and behavioral dimensions in their “Internationalization-at-Home” context. Findings revealed the perceived impact that previous senpai tutor NPRMs had had on present tutors’ L2 self-efficacy, imagined and actual cross-cultural friendships, and ICC ability. Implications for effectively supporting hosts’ ICC development in local environments are offered. 従来の留学研究は、訪問者側の成長に焦点を合わせることが多かったが、自国環境における異種集団との接触を通じた受入側の成長を調査する研究は少なかった。本論は、短期留学中の8人の日本人大学生とバディを組んだ受入側8人のタイ人チューター(N=8)を対象とした異文化コミュニケーション能力に関する先行研究(Deacon & Pholboon, 2020) に基づいている。本論は質的な半構造化面接により、身近なロールモデルの存在が 重要な要素として受入側 チューターの「内なる国際化」における認知的、情緒的、行動的な側面に影響を及ぼすことを明らかにした。結果として、過去の先輩チューターのロールモデルが、現チューターの第二言語における自己効力感や、想像上または実際の異文化を超えた友情、そして異文化コミュニケーション能力に影響をもたらすことがわかった。本論は、受入側の異文化コミュニケーション能力の向上を効果的に支援するための示唆を与えるものである。
