Abstract:

原告X為職業災害保險之被保險人，其於2014年1月23日早上7時許夜班結束下班途中，於中山東路吃鹹粥當早餐後，返家途中發生車禍，致受有「頭部外傷左側併蜘蛛網膜下腔出血及硬腦膜下出血、左側顱骨骨折」等傷害，故於民國（下同）103年11月19日檢據申請職業傷害傷病給付及職業傷害醫療給付。嗣經被告Y（勞動部勞工保險局）審查，認為X下班後前往中山東路吃早餐之行為，已脫離自就業場所返回日常居住處所之應經途徑，非屬勞工保險被保險人因執行職務而致傷病審查準則第4條第1項所定得視為職業傷害之情形，核定職業災害保險不予給付。X不服，申請爭議審議，訴願皆被駁回，遂提起行政訴訟。<br />
