Abstract:

Electromagnetic compatibility in techno-sphere used to be evaluated by the magnitude of longitudinal electromotive force induced in secondary circuits (automation, communication, relay protection, telemechanics, railway alarm and high-voltage interlock and other ones). Subsequent experience has shown insufficiency of such an evaluation because that providing permissible or even lesser values of voltages induced in secondary circuit could not always prevent damages of their elements. Generally speaking, design of secondary circuits and their elements based on taking into consideration just permissible induced voltages cannot provide electromagnetic compatibility especially at transitional modes of primary circuits (short circuits, lightning stroke etc). So there have been working some new approaches to the problem via taking into consideration dissipation of so called influence energy (i.e. additional energy appeared in the secondary circuit due to transition taken place in the primary circuit). This paper presents a new method to evaluate dissipation of influence energy in techno-sphere’s secondary circuits. The method is based on the integration of complex density of the current amplitude. A formula for determination dissipated energy for the case of rectangular pulse got in the paper expresses it via current, resistance and pulse’s duration.

O tema comércio internacional e desenvolvimento sob a perspectiva do tratamento especial e diferenciado tem sido objeto de debates acalorados, principalmente no que diz respeito à efetividade das regras existentes no âmbito da Organização Mundial do Comércio (OMC). A revisão dos mecanismos de tratamento especial e diferenciado e diferenciação tem sido objeto de obstáculos negociais que têm impedido que tais instrumentos sejam aplicados de forma a proporcionar uma diminuição das diferenças de desenvolvimento dos membros da OMC. Uma das alternativas propostas é a possibilidade de utilização de precedentes vinculantes como mecanismos passíveis de permitir a adaptação das normas existentes, a fim de que estas se aproximem da realidade efetiva dos membros da OMC e respondam à problemática do desenvolvimento de forma mais específica.

Abstract:

A partir das graves enchentes ocorridas no Brasil nos últimos anos, os planos de drenagem urbana são parte por um conjunto de ações a serem implementadas pelos Poderes Públicos, na busca de proteger as cidades e sua população desses acidentes. O objetivo deste artigo é analisar as questões relativas às Áreas de Preservação Permanente(APPs) localizadas no meio urbano, que constituem um núcleo de conflitos envolvendo a municipalidade, os munícipes, o meio ambiente e o próprio Direito. Em face da ilegalidade das ocupações, agravada pela consolidação das áreas ocupadas e pela real necessidade de proteção das APPs, cabe considerar que as soluções para o futuro são distintas daquelas necessárias à solução dos fatos consolidados. Para o futuro, há que implementar a atuação dos Poderes Públicos, assumindo a politicamente difícil tarefa de proibir a ocupação nas áreas protegidas, o que remete a outras mudanças na estrutura político-administrativa das cidades. Para solucionar os problemas de ocupação ilegal já consolidada, a compensação efetuada por meio de parques ao longo dos rios ou nas encostas de morros desocupadas surge como uma possibilidade de remediar a situação.

Abstract:

A investigação relativa à exploração do petróleo no estado do Espírito Santo e a interferência do Poder Judiciário é de extrema importância, tendo em vista que a referida atividade econômica atrai muitos recursos financeiros para esse ente federativo. No entanto, há que se considerar que a exploração de petróleo, embora extremamente lucrativa, apresenta grande risco ambiental. Daí a necessidade de prevenção e avaliação desses riscos. Como se sabe, antes da exploração de uma atividade econômica potencialmente danosa ao meio ambiente é necessária a elaboração de um estudo prévio de impacto ambiental, a fim de prevenir os danos ao meio ambiente. Após esse estudo,o administrador pode emitir licença ambiental para a exploração da atividade econômica, ou não. É nesse momento que o Poder Judiciário pode ser convocado a intervirem uma atividade típica da Administração Pública, com o intuito de tentar preservar um direito fundamental, que é o meio ambiente ecologicamente equilibrado. Todavia, essa interferência pode gerar diversas discussões envolvendo, inclusive, a própria legitimidade de atuação desse Poder. Assim, o presente texto aborda o tema “controle da Administração Pública pelo Poder Judiciário”, tendo como base a investigação bibliográfica e jurisprudencial.

O presente trabalho almeja trazer à baila da doutrina jurídica os principais aspectos e conceitos, oriundos da geografia, que permitem estabelecer a importância da perspectiva territorial da realidade na percepção da crise socioambiental. A partir do desenvolvimento dos pressupostos teórico-científicos do complexo de conexões fático-jurídicas entre território, espaço, direito e meio ambiente, objetiva-se traçar uma perspectiva jusgeográfica da crise socioambiental contemporânea, com vistas à formulação de reflexões acerca da relação entre a efetivação de direitos socioambientais e a gestão territorial.Para tal empreitada, a construção de uma epistemologia própria para análise jurídico-geográfica dos direitos socioambientais fez-se necessária, de modo a incluira problemática da conflituosidade e da complexidade envolvendo o território como elemento fundamental para a compreensão do quadro de inefetividade jusambiental.Destarte, nas diversas situações concretas objeto de tutela pelo direito socioambiental é que urge a análise do planejamento do território sob o ponto de vista jurídico, ou seja, um direito sobre a gestão territorial pela sociedade e pelo Poder Público.

Abstract:

Este artigo aborda o direito fundamental ao meio ambiente no ordenamento jurídico-constitucional de dois países lusófonos, o Brasil e São Tomé e Príncipe, de modo a demonstrar de que maneira se encontra resguardado o meio ambiente nesses dois países sob a ótica constitucional e analisar os impactos dessa tutela nos dois ordenamentos jurídicos. Assim, iniciou-se este artigo com um estudo comparado das instituições jurídicas no Brasil e em São Tomé e Príncipe. Em seguida, passou-se à análise do direito fundamental ao meio ambiente. Depois, abordou-se o meio ambiente nas Constituições dos dois países. Por fim, concluiu-se que o conceito de meio ambiente não seria um conceito de teoria geral do direito ambiental aplicável a qualquer ordenamento jurídico indistintamente, mas um conceito de direito positivo, pois a concepção de meio ambiente varia de acordo com cada sociedade, considerando as diferentes formas de percepção ambiental dos cidadãos e a realidade socioecológica de cada país.

Abstract:

July 7, 2019 marks the 60th anniversary of the renowned scientist in the field of plant physiology and microbiology, Doctor of Agricultural Sciences, Professor, Academician of the Academy of Sciences of the Higher School of Ukraine, Head of the Department of Botany and Zoology of the Ternopil National Pedagogical University and University Svitlana Vasylivna was born in the village of Ishkiv, Koziv district, Ternopil region, to a family of teachers. She started schooling at the Ishkiv eight-year school and later Ternopil Secondary School #8, which she graduated with honours in 1976. In August 1977, she entered Ternopil Pedagogical Institute, Natural Sciences faculty. She graduated with honors in 1982 and got qualification of a teacher of chemistry and biology Since July 1982, Svitlana Vasylivna's work has been associated with the Department of Botany (now the Department of Botany and Zoology of Ternopil Volodymyr Hnatiuk National Pedagogical University), where she became an assistant at the laboratory of plant physiology and biology. As a laboratory assistant, S.V. Pyda commenced her first scientific studies concerned with nitrogen nutrition of legumes supervised by Professor, Head of the Symbiotic Nitrogenation Department of the Institute of Plant Physiology and Genetics of NAS of Ukraine Yukhym Polikarpovych Starchenko, candidates of biological sciences, professor of the Department of Botany of Ternopil Pedagogical Institute Vekirchyk Kuzma Mykolaiovych and associate professor Butnytskyi Ivan Mykolaiovych. From 1989 to 1993 S.V. Pyda carried out scientific research at National Botanical Garden M.M. Hrishko NAS of Ukraine (Kyiv) supervised by professor, head of allelopathy department Holovko Erast Anatoliiovych. May 26, 1994 as a result of scientific research S.V. Pyda became a successful defense of a Ph.D. thesis for the degree of Candidate of Biological Sciences in the specialty 03.00.12 – plant physiology in the specialized scientific council of the Institute of Plant Physiology and Genetics of NAS of Ukraine entitled: «Allelopathic and symbiotic features of lupine at different levels of nitrogen nutrition». During her postgraduate studies, in 1990 S. V. Pyda was transitioned to the position of Assistant Professor of the Department of Botany of Ternopil Pedagogical Institute, and after the defense of her Ph.D. thesis in January 1995 – to the post of Senior Lecturer, Associate Professor of Botany – on December 25, 1997. Pyda S.V. was given the academic title of Associate Professor of Botany. Pyda S.V. managed to combine her teaching career with scientific research concerned with a wide range of questions of plant physiology, biochemistry and ecology, microbiology, agriculture. Her major research focuses on the biological fixation of molecular nitrogen by legumes, allelopathic and biochemical features of species of the genus Lupine and some floral-ornamental plants, problems of chemical interaction between plants in natural and artificial phytocenoses, microorganisms and agriculture. Her 13-year-long scientific work found its expression in the manuscript of the doctoral dissertation, successfully defended on June 14, 2007 for the degree of Doctor of Agricultural Sciences in the specialized academic council of the Uman Agrarian University (now Uman National University of Horticulture) entitled: “Physiology of symbiosis of Bradyrhizobium sp. (Lupinus) – Lupinus L.: allelopathic analysis” specialty 03.00.12 – plant physiology. On April 1, 2008, after a significant achievement in the scientific and pedagogical field, the decision of the Scientific Council of the Ternopil Volodymyr Hnatiuk National Pedagogical University Pyda S.V. was appointed the professor of the Department of Botany. On January 20, 2011, by the decision of the Attestation Board of the Ministry of Education and Science, Pyda S.V. was awarded the academic title of Professor of Botany. Since November 26, 2014 prof. Pyda S.V. has been the head of the Department of Botany and Zoology after the merging of the departments of Botany and Zoology. Svitlana Vasylivna Pyda’s legacy comprises 342 works, including 4 monographs, 7 utility model patents, over 30 scientific articles, 2 textbooks, 7 methodological tutorials, 1 bibliographic index, 2 e-courses etc. Professor S.V. Pyda has been teaching at the University for many years the disciplines "Plant Physiology", "Microbiology with the Fundamentals of Virology", "Research Methods", "Nutrition and Productivity of Plants", "Mechanisms of Plant Productivity". She is also a teacher of Ternopil Oblast Territory -Municipal Branch of the Ministry of Education and Science of Ukraine, a member of the jury and head at the numerous competitions of city and all-Ukrainian importance, the head of the Ternopil branch of the Ukrainian Society of Plant Physiologists and Ternopil branch of the Society of microbiologists of Ukraine. Abstract:

11051 Background: Resistance against anticancer drugs significantly limits the clinical use and efficacy. One of the most important mechanisms of the multidrug resistance is low accumulation of the drug in cancer cells caused by an increased efflux (mediated mainly by ABCs) or by a decreased uptake (mediated by some members of SLCs). The aim of the present study was to investigate prognostic importance of 13 anticancer drug-relevant SLCs and all 49 human ABCs in PDAC patients in association with clinical and pathological characteristics and the tumor KRAS mutation status. Methods: Tumors and adjacent non-neoplastic pancreatic tissues were obtained from 50 patients with histologically verified PDAC. The transcript profile of ABCs and SLCs was assessed using quantitative real-time PCR. KRAS mutations in exon 2 were assessed by high-resolution melting analysis and sequencing. Associations of transcript levels with clinical parameters were assessed by non-parametric Mann-Whitney tests. The Kaplan-Meier method with the log-rank test and Cox regression were used for analysis of overall survival (OS). Results: Most transporters investigated were deregulated in PDAC and 14 ABCs or SLCs were associated with clinical characteristics. Up-regulation of 7 drug resistance-associated ABC efflux transporters and down-regulation of 5 drug uptake-relevant SLC transporters was observed in tumors vs. non-neoplastic tissues. Moreover, expression levels of SLC28A1 and SLC22A1 were associated with OS of all patients (P=0.001). High transcript levels of SLC29A3 and SLC22A3 significantly predicted longer OS in chemotherapy-treated patients (P=0.004 and P=0.038, respectively). No association of ABC and SLC expression with KRAS mutation status was observed. Conclusions: Up-regulation of numerous drug resistance-associated ABCs and down-regulation of SLCs implicated in drug uptake may explain the generally very poor response of PDAC to cytotoxic agents. This study also identified some ABCs and SLCs as potential prognostic and predictive factors in PDAC. Abstract:

Formulation of the problem. At present in Ukraine environmental problems are very topical. A comprehensive and effective solution to theses problems can be grounded on the the use of modern approaches, expressed through harmonization with the best world practices. Training of highly qualified specialists is an important component of the integrated approach. Currently, in Ukraine it is performed on 4 environmenal specialties: 03.00.16 - Environmental Sciences, 08.00.06 – Economics of Environmental Resources Management (Economics), 11.00.11 - Constructive Geography and Wise Use of Natural Resources (Geographic Sciences) and 21.06.01- Environmental Safety (Engineering and Industrial Technology Sciences, Chemistry and Geology). In addition, separate issues of environmental protection are considered in 15 specialties from the List 2011. Resolution of the Cabinet of Ministers of Ukraine No. 266, dated April 29, 2015, “On approval of the list of branches of knowledge and specialties for which candidates for higher education are trained”(“List 2015”) canceled “List 2011” [2]. Order of the Ministry of Education and Science of Ukraine No. 1151, dated November 6, 2015, “On the peculiarities of introducing the list of branches of knowledge and specialties for which candidates for higher education are trained” [3], the table of compliance of the List of scientific specialties (“List 2011” and List of areas of knowledge and specialties for which candidates for higher education are trained, including PhDs (“List 2015”) [2] was approved. At the same time, up to the present day, theses have been defended according to “List 2011”. The problem of “dispersion” of environmental issues among various specialties in various branches of knowledge not only remained, but also grew up, as the number of the latter increased. This situation is of concern to the scientific community. The purpose of the article. To clarify the problems existing in the national system of postgraduate students’ training in environment-oriented specialties and defending theses by them in accordance with modern requirements, as well as finding ways to improve this situation, based on international experience. Methods. As part of the implementation of project Erasmus + “Integrated Doctoral Program for Environmental Policy, Management and Technology - INTENSE”, 586471-EPP-1-2017-1-EE-EPPKA2-CBHE-JP, an anonymous survey of leading scientists engaged in post-graduate training and doing research work in the field of the environment. The questionnaire was developed by Odessa State Environmental University and the survey covered institutions of higher education in almost all regional centres of Ukraine, as well as the cities of Uman and Kremenchuk. It should be noted that such cities as Kharkiv, Lviv, Kyiv, Dnipro, Vinnytsia, Poltava and Uman were represented by several universities. The rest of the regions were represented by the respondents of one institution of higher education. Results. The obtained results have shown the existing organisational and scientific problems. The key problem is the lack of a separate category for PhD (Environmental Sciences) in the updated List 2015. Scientific problems are scientific research of low quality, low level of application of modern technologies, non-correlation between topics with society demands, absence of foreign experience consideration in the solution to similar problems, etc. Organisational problems are poor technical supply, non-availability of training abroad for PhD students, low level of English, problems with publications in peer-review journals and visual presentation of the research at international conferences, etc.

Abstract:

Traditional Chinese herbal medicine has a long history in treating febrile diseases, according to the Shang Han Lun, a classical theory of traditional Chinese medicine developed by Zhang Zhongjing in the Han Dynasty. Some herbs have been formulated as prescription formulae or manufactured as finished medicine such as pills, capsules or injections. The Chinese government has recommended specific TCM prescriptions alone or combined with Western medicine to treat patients with COVID-9. Here, we introduce three prescription formulae, Qingfei Paidu Decoction, Huashi Baidu Formula, and Xuanfei Baidu Formula, three finished medicines, Lianhua Qingwen Capsule, Jinhua Qinggan Granule, and Xuebijing Injection; following this, several single herbs such as Ephedra herba, Honeysuckle, Scutellaria, Glycyrrhizae radix, Armeniacae semen, Sophorae flavescentis radix, and Curcuma longa. We review existing evidence of these traditional medicines and herbs for their related antiviral activities, efficacy, and underlying mode of action in virus-related diseases. Most of these drugs have been traditionally used in Chinese medicine for over a thousand years, and they have been proved to be safe in treating flu-like virus infections. It will be adequate to further test for their efficacy for COVID-19 and understand the underlying molecular mechanism.
