AbstractEuropeans have long justified a right to something or other by invoking ‘prescription’ (that is, the creation of a legal entitlement by the passage of time). Yet for all the importance of prescription in the creation of international geopolitical order, no genealogy of the idea has emerged from historical or legal scholarship. This article will explore the relationship between prescription and empire within private, public, corporate, and ecclesiastical legal contexts. The idea of prescription is then considered within the specific ideological context of European imperialism between 1580 and 1640, when a series of diplomatic disputes and intellectual debates were had in Europe principally regarding maritime navigation and foreign dominion by ‘donation’. The metamorphosis of prescription in legal and political thought from Justinian (483–565) to Hugo Grotius (1583–1645) is therefore explored. Additional colour is given to this intellectual history by contrasting how corporate interests in North America attempted to justify their foreign land holdings in forts, ports, and hinterland by invoking ‘prescription’ during the early stages of colonial expansion. The case will be made for historians of early modern imperialism and international law to take closer notice of the opportunism of those prepared to justify prescription in theory and practice.

Parish records are an interesting source material for researching the issue of beliefs in returning dead. Parish records of deaths rarely relate the funerals of people other than the God-fearing citizens who rested in the parish necropolis or those killed in tragic circumstances, usually as a result of an accident. From the end of the 16th century, the areas of the Silesian-Moravian borderland, or northern Moravia itself, were the scene of fierce struggles against the dead rising from their graves. Later, mainly eighteenth-century publications began to use the term defining these phenomena as magia posthuma. The intensity of beliefs in posthumous magic peaked in late 17th and early 18th centuries. It was widely thought at the time that a deceased person whose body does not show normal, post-mortem changes (rigidity) was a witch or a sorcerer. In Silesia and Moravia effective forms of dealing with harmful deceased people were developed in the period of 16th-18th centuries. Based on the analysis of existing source material, we know that the most frequent course of action was to find the grave of the “undead”in the cemetery, exhume the corpse and destroy it. All these measures against corpses who rose from their graves had to leave a trace in the parish books. In the discussed area, the oldest entries from records of death concerning the beliefs in dead who returned to plague the living can be found in the volume for the Silesian city of Strzegom (German: Striegau) covering the years 1589–1715. Some interesting research material is also provided by entries made in the records of death in the small town of Ryžoviště(German: Braunseifen) for the years 1583–1640 and 1640–1717. One of the last entries in the death records was made on 1 March 1755, when the Empress Maria Theresa issued a decree forbidding the persecution of people accused of witchcraft, treasure hunts with the aid of magic and also the exhumation or burning of the bodies of people accused of posthumous magic.

The funeral epigraphic material of Elbląg and the surrounding area, relating to the period preceding the XVIth century, remains, first of all thanks to the researches of Polish epigraphists, relatively more explored and introduced into the scientific circulation array. At the same time the Renaissance-Baroque gravestone monument of the XVIth–XVIIth centuries, which is extremely important for the comprehensive study of the reformed Circum-Baltic, often continues to need a detailed research commentary. To the epitaph of the burgomaster of Elbing (Elbląg) Johann Jungschultz (1583–1630), as well as to the Latin text of the funeral Eulogy, associated with this epitaph, composed by the Bohemian humanist Venceslav Klemens, is expected to address in this article. The epitaph of Johann Jungschultz was established in 1630–1640. From the compositional point of view closest to the epitaph of Johann Jungschultz, and almost prototypical for it, is the epitaph of Edward Blemke (1591), in the St. Mary’s church of Gdansk. It allows to speak about the author of the epitaph of Johann Jungschultz as oriented to samples of the Dutch monumental tombstones of the end of the XVIth century, or even as belonging to the circle of Willem van den Blocke (circa 1550–1628), which was the principal mediator of the influence of the Dutch art in the South-Eastern Baltic in the end of XVIth – the first quarter of the XVIIth century. The compositional and decorative solution of the epitaph also has close matches in the works of Johann Pfister (1573 – circa 1642/1645 or 1648).

La notion de communication politique reçoit des définitions diverses qui paraissent irréconciliables : définition de politologue fondée sur une organisation contemporaine de la politique poussant le concept dans le domaine de la propagande, définition de médiéviste mettant l'accent sur l'oralité et la symbolique des images. Amorcé en Allemagne dans les années 1990, un mouvement historiographique tend à se développer en France, mais sans pour autant offrir une définition applicable à l'ensemble de la modernité.En revenant au sens premier de la communication politique, soit à l’histoire politique et plus particulièrement diplomatique, il s'agit ici d’étudier la politique extérieure de la France et ses moyens (réseaux de communication et d'information, correspondances, production imprimée, etc.) et ainsi de retrouver le sens de l’action diplomatique française. Au-Delà de la simple étude fonctionnelle, seule une étude approfondie de la communication peut permettre de voir si et comment un État peut maîtriser un tel outil et dans quel(s) espace(s).Pour ce faire, le Saint-Empire au début de la guerre de Trente Ans fait office de terrain d'étude. La mise en place des différents acteurs et le déroulement des premiers affrontements en font un élément d'observation riche. L'étude se place également dans une période bien définie de l'histoire politique française : l'exercice personnel par Pierre Brulart, vicomte de Puisieux, de la charge de secrétaire d'État aux Affaires étrangères entre avril 1617 et février 1624
The concept of political communication is confronted to various definitions which seem incompatible. The political one is based onto a contemporary management of the politics which pulls the concept to the field of propaganda. The medievalist one emphasizes the orality and the symbolic of images. Some studies have been led in Germany since the 1990's and intend to grow up in France but they do not offer a definition which could apply the modern era.We would come back to the initial meaning of the political communication, i.e. to the political and diplomatic history, in order to study the foreign politics of France and its means (communication and information networks, correspondences, printed documents, etc.) and find the direction of the diplomatic action of France. In addition to a classic functional study, a thorough study of communication should allow to observe if and how a State can control such tool and in which space(s).The Holy Roman Empire at the beginning of the Thirty Years War has been chosen as object for this study. The establishment of the various protagonists and the first confrontations turn it to a rich observation field. The study focuses too on a well defined period of the french politic history: the personal practice by Pierre Brulart, viscount of Puisieux, of the office of secretary of State for Foreign Affairs between april 1617 and february 1624

The theory of decadence in early seventeenth-century drama has generally been misapplied. Chapter I suggests that the moral uncertainty found in many plays is not the product of some kind of perversity but of a sea-change in the way belief, knowledge and law were perceived. The application of an ethical standard which equates a corrupt court with a corrupt private theatre imposes an ideological and inappropriate interpretation on the drama. I argue that changes in morality, the theatre and literary style are not symptoms of decay. If they are, then Shakespeare may be as culpable as Beaumont and Fletcher. I suggest, in Chapter II, that Shakespeare's tragedies and tragicomedies, like Beaumont and Fletcher's tragicomedies, are tragic and tragicomic precisely because they are uncertain. We usually find an unresolved tension in the ending which prevents us from carrying home a moral for our use and edification. We are disturbed rather than comforted. Massinger's method in collaboration is similar. His independent tragicomedies, as I argue in Chapter III, exploit the tension between romantic and satiric action to illustrate a complex moral world in which characters may have an uncertain and changing moral status. Typically he uses satiric characters and methods to undercut romantic assumptions and conventions. The process can sometimes lead, however, to confusions which make some of Massinger's plays morally dubious rather than ambiguous. The questions, paradoxes and tensions in Massinger's tragedies are more acute than those to be found in his tragicomedies. He presents a shifting world in which it is difficult to judge characters accurately, and in which justice seldom seems to be done. Our sympathies are complicated by the multiple moral status of his protagonists, or their antagonists, who are never totally evil or wholly redeemable. The Renaissance plays, in Chapter IV, exploit the problems inherent in the idealistic and malicious pursuit of revenge. The Roman plays, in Chapter V, deal with more political complexities, largely the result of a simultaneous sympathy for the individual and acceptance of the identity imposed on him by the state. The tension between perceived and imposed identity, and the tragic destruction of the integrity of the individual, are most fully realised in The Roman Actor and Believe As You List. The simultaneity of equal and opposite values in these plays is common to Massinger's work as a whole. The tension of uncertainty - whether broken, as in the tragedies, or not - seems to express exactly that "negative capability" which Massinger has been denied. Only if we read him on the most superficial level, can we consider him to be moralistic or simplistic.
