Abstract:
Discrete choice models (DCMs) are used to forecast demand in a variety of engineering, marketing, and policy contexts, and understanding the uncertainty associated with model forecasts is crucial to inform decision-making. This thesis evaluates the suitability of DCMs for forecasting automotive demand. The entire scope of this investigation is too broad to be covered here, but I explore several elements with a focus on three themes: defining how to measure forecast accuracy, comparing model specifications and forecasting methods in terms of prediction accuracy, and comparing the implications of model specifications and forecasting methods on vehicle design. Specifically I address several questions regarding the accuracy and uncertainty of market share predictions resulting from choice of utility function and structural specification, estimation method, and data structure assumptions. I1 compare more than 9,000 models based on those used in peer-reviewed literature and academic and government studies. Firstly, I find that including more model covariates generally improves predictive accuracy, but that the form those covariates take in the utility function is less important. Secondly, better model fit correlates well with better predictive accuracy; however, the models I construct— representative of those in extant literature— exhibit substantial prediction error stemming largely from limited model fit due to unobserved attributes. Lastly, accuracy of predictions in existing markets is neither a necessary nor sufficient condition for use in design. Much of the econometrics literature on vehicle market modeling has presumed that biased coefficients make for bad models. For purely predictive purposes, the drawbacks of potentially mitigating bias using generalized method of moments estimation coupled with instrumental variables outweigh the expected benefits in the experiments conducted in this dissertation. The risk of specifying invalid instruments is high, and my results suggest that the instruments frequently used in the automotive demand literature are likely invalid. Furthermore, biased coefficients are not necessarily bad for maximizing the predictive power of the model. Bias can even aid predictions by implicitly capturing persistent unobserved effects in some circumstances. Including alternative specific constants (ASCs) in DCM utility functions improves model fit but not necessarily forecast accuracy. For frequentist estimated models all tested methods of forecasting ASCs improved share predictions of the whole midsize sedan market over excluding ASC in predictions, but only one method results in improved long term new vehicle, or entrant, forecasts. As seen in a synthetic data study, assuming an incorrect relationship between observed attributes and the ASC for forecasting risks making worse forecasts than would be made by a model that excludes ASCs entirely. Treating the ASCs as model parameters with full distributions of uncertainty via Bayesian estimation is more robust to selection of ASC forecasting method and less reliant on persistent market structures, however it comes at increased computational cost. Additionally, the best long term forecasts are made by the frequentist model that treats ASCs as calibration constants fit to the model post estimation of other parameters.

Abstract:
People of Black African heritage in the UK have increased susceptibility of being diagnosed with Type 2 Diabetes Mellitus (T2DM) compared to the general White population. Nutrition is central in halting T2DM and the progression of complications such as cardiovascular diseases. However, little is known about the factors influencing the diet of women of Black African heritage with T2DM. In addition, clinical and public health conceptions of the problem tend to be individualistic in orientation. This study is an exploratory and in-depth inquiry into food choice and the implications of dietary change for women of Black African heritage who self-manage T2DM by diet alone. Eight participants were recruited using purposive sampling. Recruitment sites included Black and Minority Ethnic charities in Norfolk and Suffolk. Data was derived from direct observation using the ‘Accompanied Shopping Task’, combined with a ‘Think Aloud Technique’ called a ‘Product Choice Reasoning Task’. In-depth interviews were undertaken and transcribed verbatim. Framework Analysis was used to provide a procedure to manage data analysis, which was informed by the PEN-3 public health cultural model which moves beyond overly individualistic conceptions of the issues. The study showed that six participants prioritised the disease and used what I have called a ‘Disease Focused Approach’ to self-manage T2DM. Two used a ‘Family Focused Approach’, as family played a crucial role in T2DM self-management. All participants undertook T2DM self-care by following a culturally appropriate diet. Their least preferred options for managing T2DM were medical therapy and physical activity. The study showed that although food choice is influenced by many factors, culture was particularly important. Moreover, participants showed greater knowledge than had been anticipated about the role of nutrition to prevent progression of T2DM. Results are explored and presented for three main domains of experience for the participants: first, food shopping and decision-making; second, diet choice and lifestyle; and third, the interface with health services. For each of these the culture was found to be of paramount importance. The implications of the findings are presented in relation to the importance of culturally appropriate advice; culturally sensitive service provision; and the significance of household composition in managing the illness, especially for people with T2DM who have young children living at home.

Abstract:
The purpose of this research was to examine food security for people with prediabetes participating in the Supplemental Nutrition Assistance Program (SNAP), focusing on their food choice decisions and coping strategies over a 30-day benefit cycle that potentially increases the risk of Type 2 diabetes. A cross-sectional, quantitative design based on food choice process model constructs was used. SNAP participants (n = 36) with prediabetes, aged 21â??70 years, were recruited as outpatients from Bronx Lebanon Hospital and completed self-reported questionnaires on demographics and health, food security, and food frequency. Descriptive statistics, Pearson chi square tests, and regression analysis were performed using SPSS. Also, independent t test, and Levene's test were used for ad hoc analysis to assess variation of food choice decisions over 30 days. Of the sample, 5% had low and 95% very low food secure status. Food security status did not predict coping strategies (p = .724); however, food security status and type of coping strategy had a moderate relationship (p < 0.01; r =.60). Food choices of 11 food categories changed over a 30-day cycle with greatest variation for Week 1, compared to Weeks 2â??4 (p < .005). Use of coping strategies to minimize hunger was limited. Very low food security associated with certain coping strategies disrupted eating patterns. Disrupted eating patterns affect food variation over time, increasing the intake of non-nutrient-dense foods and the risk of obesity and Type 2 diabetes. The implications for positive social change include the potential to change SNAP's benefit allotments, make nutrition education mandatory, and create a nutrition package, thereby lowering food insecurity and the risk of Type 2 diabetes.

Abstract:
This work explores a novel vision model based coding approach to encode medical images at a perceptually lossless quality, within the framework of the JPEG 2000 coding engine. Perceptually lossless encoding offers the best of both worlds, delivering images free of visual distortions and at the same time providing significantly greater compression ratio gains over its information lossless counterparts. This is achieved through a visual pruning function, embedded with an advanced model of the human visual system to accurately identify and to efficiently remove visually irrelevant/insignificant information. In addition, it maintains bit-stream compliance with the JPEG 2000 coding framework and subsequently is compliant with the Digital Communications in Medicine standard (DICOM). Equally, the pruning function is applicable to other Discrete Wavelet Transform based image coders, e.g., The Set Partitioning in Hierarchical Trees. Further significant coding gains are ex ploited through an artificial edge segmentation algorithm and a novel arithmetic pruning algorithm. The coding effectiveness and qualitative consistency of the algorithm is evaluated through a double-blind subjective assessment with 31 medical experts, performed using a novel 2-staged forced choice assessment that was devised for medical experts, offering the benefits of greater robustness and accuracy in measuring subjective responses. The assessment showed that no differences of statistical significance were perceivable between the original images and the images encoded by the proposed coder.

Abstract:
Det primära syftet med denna uppsats var att studera den subjektiva uppfattningen av prestationsbaserade löner i korrelation till stress, oro, missnöje, motivation och utvecklingsmöjligheter. Till detta ingick det även att ta reda på varför informanterna valde att ta anställning på en arbetsplats med prestationsbaserad lön och slutligen gjordes en jämförelse mellan de två informantgrupperna, medarbetare och mellanchefer. Då syftet var att studera den subjektiva uppfattningen hos informanterna användes en kvalitativ ansatts där empirin samlades in genom semistrukturerade intervjuer med fyra medarbetare från ett företag och fyra mellanchefer från fyra olika företag.  Det empiriska materialet har analyserats utifrån sociologiska teorier och annan arbetsmarknadsforskning. De sociologiska teorier som användes var, Rational choice, 2-faktorteorin och Expectancy teorin. Arbetsmarknadsforskning som användes för analysen var krav-kontroll-stöd-modellen och ledarskapsforskning. Resultatet tyder på att incitamentet initialt för att ta anställning på ett företag med prestationsbaserad lön är möjligheten till att få en större inkomst än det vore möjligt på annan plats. Vidare tyder resultatet på att informanterna upplevde att den prestationsbaserade lönen bidrog till deras motivation och utvecklingsmöjligheter. Resultatet pekade även på att stress som en följd av den prestationsbaserade lönen är närvarande hos samtliga informanter men den uppfattades som större hos mellancheferna då de upplevde att de hade större ansvar än medarbetarna. Mellanchefernas upplevelse av stress förstärktes på grund av den brist på kontroll de hade över personalomsättningen och företagets policy vad det gäller deras arbete. Slutligen indikerade resultat av studien att mellancheferna uppfattade den status som den prestationsbaserade lönen gav dem som ett starkt incitament.

Abstract:
With technological advances in testing for gene mutations, a new population of BRCA1/2 women is becoming aware of their increased risk for developing breast and/or ovarian cancer. A salient issue these women face is which risk-reducing option to choose. Little is known about the decision making factors underlying the choice of prophylactic mastectomy for women with a BRCA1/2 mutation. To address this issue, 137 unaffected, positive BRCA1/2 gene mutation carriers (42 who opted for prophylactic mastectomy, 95 who did not) served as participants. All women completed an on-line battery that assessed the following theory-based decision making variables: advantages and disadvantages of prophylactic mastectomy (normative decision theory), physician recommendation (shared decision making theory), cancer worry (affect theory), and information-seeking coping style. With the exception of information-seeking style (p = .8715), the decision making variables of advantages and disadvantages of prophylactic mastectomy, physician input, and cancer worry did have a significant relationship with risk-reduction option chosen. Women who rated the advantages higher than the disadvantages of prophylactic mastectomy (r = .31, p ≤ .001), whose physician had recommended prophylactic mastectomy exclusively (X² = 11.85; p < .001), and who reported higher cancer worry scores a month after receiving BRCA1/2 positive results (r = .28, p ≤ .001) were more likely to have chosen prophylactic mastectomy. The perceived impact (conflict, regret, cancer worry, and general well-being) of risk-reducing option selected was also explored. The direction of these relationships indicates that having chosen prophylactic mastectomy was associated with less decisional conflict (r = -.38, p ≤ .0001), decisional regret (r = -.58, p ≤ .0001), depressive symptomatology (r = -.19, p ≤ .05), and cancer worry (r = -.39, p ≤ .0001). The results suggest higher assessments of advantages over disadvantages of prophylactic mastectomy, doctor recommendation for prophylactic mastectomy exclusively, and higher cancer worry at time of testing is associated with choosing the risk-reducing option of prophylactic mastectomy. In addition, women who chose prophylactic mastectomy fared better psychologically than those who did not. Continued research addressing decision making variables and the impact of risk-reducing decisions may lead to improved understanding on how best to approach these difficult decisions.

The aim of this study was to identify the reasons of parents&rsquo
preferring Curriculum Laboratory Schools (CLSs) for their children&rsquo
s education and to investigate whether the students attending Curriculum Laboratory Schools are satisfied with the physical, instructional and social opportunities (services) offered at these schools. The sample of the study consisted of 440 seventh grade students and 14 parents from seven curriculum laboratory schools in the province of Ankara. Two instruments were used for data collection
interview questions for parents and a questionnaire for students. To analyze quantitative data, descriptive statistics such as frequency analyses and percentages were conducted. The open-ended questions in the parents&rsquo
interview were analyzed through content analysis. The results indicated that parents preferred these schools for several reasons including convenient location, technological opportunities, physical conditions and instructional opportunities. However, the availability of the opportunities was not as defined in the CLS model. Nevertheless, the students who were attending CLSs were moderately to highly satisfied with the services provided in the CLSs.

Abstract:
Aim PRECIS (PRagmatic Explanatory Continuum Indicator Summaries 2009) is a tool with a simple wheel format that trialists can use when designing their trials to improve the applicability of results but users highlighted problems. The aim of the study was to produce an improved and validated version of PRECIS, called PRECIS-2 and test this tool out with trial teams designing primary care trials. Methods Brainstorming and a 2-round Delphi survey of authors who cited PRECIS plus user-testing of candidate PRECIS-2 models was followed by validity and reliability testing of the most promising PRECIS-2 candidate using a sample of 15 trials rated by 19 different trialists. The validated PRECIS-2 tool was then used to consider the risk of bias (internal validity) and estimates of treatment effect of a matched set of explanatory (ideal conditions) and pragmatic (real world) trials. The PRECIS-2 website was also created with a database of pragmatic trials and a toolkit for trial groups. This was tested out at the Pragmatic Clinical Trials Unit (PCTU) in London with trial teams designing primary care trials. Results Forty-two people responded to the Delphi and highlighted scoring, domain choice, and tool format as issues. An expert panel of 14 in Toronto provided the basis for a PRECIS-2 model that was then user tested by 19 other methodologists and trialists. After 13 iterations, a PRECIS-2 model with 9 domains (i.e. Eligibility, Recruitment, Setting, Organisation, Flexibility Delivery, Flexibility Adherence, Follow up, Primary Outcome, Primary Analysis) was tested for validity and reliability. Inter-rater reliability was generally good, with eight of nine domains having an ICC over 0.65. Discriminant validity was reasonable for all domains, though with wide confidence intervals. Matching trials taking pragmatic (‘real world’) and explanatory (‘ideal world’) approaches was challenging but we found no indication that a pragmatic approach compromises internal validity. We were unable to extract sufficient information for a planned analysis of estimates of treatment effect. At the PCTU, the tool highlighted differences in opinion with trial team members and demonstrated convergence of opinion following discussion. There was acknowledgment that scoring of PRECIS-2 domains assisted trials teams in considering the intended audience and creation of trials relevant to practice. Useful feedback was obtained to improve the PRECIS-2 tool software for users. Conclusions PRECIS was improved by the addition of scoring and additional domains after consultation with over 80 international trialists. We have a validated PRECIS-2, in the visually appealing wheel format with 9 spokes, which is being made available through an increasingly accessed website. Work at the PCTU improved the usability of the PRECIS-2 website and demonstrated that the tool increases transparency in trial design and assists trialists in considering applicability of trial results. More matching work on the impact of design approaches on effect size is needed, and further data to support the risk of bias results would be valuable.

Abstract:
The relationships between and among questions from a survey in three different areas, namely food and food related health, food safety and hygiene, and information gathering concerning food, with the main focus on the first two areas, are investigated. Data from older people have been analyzed. The questions are both about knowledge and behavior in relation to the areas mentioned above. Earlier studies have shown that people in general do not know about or act according to dietary advises about health and hygiene. The results from this study show that there are fairly strong correlations for all groups but men when it comes to knowledge and behavior about fruit and vegetable consumption. The results also show a significant association between fruit and vegetable consumption and gender and that women consume more than men. A factor model estimating the relationships between health, hygiene and information shows that the fitted factor model can be considered having an acceptable fit, with at least two variables, knowledge about the recommended amount of fruit and vegetables to eat per day and trust for grocery stores concerning food and health, being classified as good indicators.

The purposes of this study were to examine (a) what views Year 2 hold about physical activity, (b) how they perceive their own ability, and how much effort they give, with regard to physical activity, and (c) how they explain the importance of being physically active. In addition, a physical education (PE) intervention was put in place to see if it would change the children's perceptions, choices and knowledge in regard to physical activity. Two groups of four Year 2 children from a private city school took part in individual and group interviews before and after the teaching intervention. Results indicated that the children viewed physical activity, PE and physical fitness, positively. The children in this study held high self-perceptions of their ability to do physical activity and sport and attributed their abilities to previous physical experiences and effort. Before the teaching intervention the children's knowledge of concepts of health related physical activity were vague and incomplete. Following the eight-week intervention the children in this group were able to answer the knowledge questions accurately and in detail.

A presente dissertação versa a teoria geral da determinação da lei aplicável no Direito Internacional Privado, sob a ótica de parâmetros cosmopolitas colhidos em outras ciências humanas, em perspectiva interdisciplinar. Analisam-se vários estudos recentes sobre o cosmopolitismo, bem como suas origens remotas, de modo a propor possíveis relações do tema com o método conflitual do Direito Internacional Privado. No capítulo I, empreende-se estudo histórico, retornando às origens do cosmopolitismo (filosofias grega e romana), passando pelo cosmopolitismo de Kant, no séc. XVIII, para então, finalmente, examinar os cosmopolitismos contemporâneos. Quanto a estes, procede-se à uma taxionomia e se exploram algumas proposições teóricas de especial utilidade para a determinação da lei aplicável. No capítulo II, busca-se transpor o cosmopolitismo do plano das demais ciências humanas para o plano da teoria jurídica em particular. Analisa-se, primeiro, o que implica a ideia de cosmopolitização do direito e, após, a relação entre o cosmopolitismo e o Direito Internacional Privado em específico. Dá-se especial atenção à aplicação da ideia de justiça cosmopolita no contexto da determinação da lei aplicável. No capítulo III, trata-se dos três grandes métodos de determinação da lei aplicável (multilateralismo, unilateralismo e materialismo), em perspectivas histórica e crítica. Conclui-se que a adoção do multilateralismo enquanto estrutura principal de determinação da lei aplicável, flexibilizado pelo princípio da proximidade, atende mais à imparcialidade cosmopolita que os outros dois métodos. No capítulo IV, propõe-se uma visão cosmopolita do princípio da ordem pública, concentrando-se em duas importantes evoluções teóricas mais recentes: as noções de ordem pública de proximidade e de ordem pública verdadeiramente internacional. Procede-se, ademais, a exame crítico da aplicação da exceção da ordem pública, no que se refere à lei aplicável, na jurisprudência brasileira recente. Ao fim do estudo, as principais conclusões são enumeradas.
This dissertation addresses international choice of law, through the lens of cosmopolitan standards collected from other humanities, undertaking an interdisciplinary approach. Many recent studies on cosmopolitanism are examined, as well as its remote origins, so as to propose links between choice of law and cosmopolitanism. In chapter I, a historical study is undertaken, going back to the origins of cosmopolitanism (Greek and Roman philosophers), dealing moreover with Kants cosmopolitanism (18th century) and contemporary cosmopolitanisms. Accordingly, a division into categories is proposed and some theoretical notions of special importance to choice of law are tackled. In chapter II, cosmopolitan concepts are applied to legal theory. First, consequences are drawn from the idea of cosmopolitanizing law. Afterwards, the relation between Conflict of Laws and cosmopolitanism is addressed. The focus is on the application of the idea of cosmopolitan justice to choice of law. In chapter III, the three existing choice of law methods are addressed (multilateralism, unilateralism and substantialism), historically and critically. It is concluded that the adoption of multilateralism as a general framework, flexibilized by the principe de proximité, is a better option in terms of cosmopolitan impartiality than the other two methods. In chapter IV, a cosmopolitan vision of public policy is proposed, focusing upon two important theories recently conceived: the notions of ordre public de proximité and of truly international public policy. Also, a critical address of the recent application of the public policy exception by Brazilian courts (within the choice of law context) is made. At the end, the main conclusions are enumerated.

Desde a promulgação da Constituição de 1988, mecanismos de vinculação de decisões foram introduzidos no sistema jurídico brasileiro, com vistas, principalmente, à redução da sobrecarga de trabalho do Judiciário. A autora argumenta que peculiaridades institucionais e culturais brasileiras, como os procedimentos de deliberação e tomada de decisão no STF e as formas de estruturação e justificação das decisões, seriam fatores obstativos à operacionalização de práticas decisórias pautadas na aplicação de precedentes. Ademais, ao endereçar tão somente o plano normativo, as reformas em curso chancelariam o modelo deliberativo e decisório do tribunal, revelando uma maior preocupação com a vinculação dos juízos inferiores do que uma valorização dos precedentes da corte. Não obstante os fatores refratários às mudanças em curso, a autora argumenta que é possível que a introdução progressiva de mecanismos de vinculação de instâncias inferiores possa implicar mudanças mais profundas na praticas deliberativas da corte e na condução discursiva de seus julgados. A exposição é segmentada em cinco partes. A autora, inicialmente, trata dos pressupostos teóricos que sustentam a hipótese de trabalho; expõe, em seguida, as modificações normativas que instituíram formas de vinculação judicial a precedentes; aborda então os fatores institucionais problemáticos a operação de retomada e replicação de precedentes; e, finalmente, discute como a ausência de uma cultura de precedentes no Brasil interfere na efetividade das reformas em curso.
Since the promulgation of the Constitutional Charter of 1988, there were reforms in the Brazilian legal system aimed at introducing adherence to precedents. The author argues that institucional and cultural peculiarities, such as deliberation procedures, the decision-making process and the practices of structuring and justification in the judicial decision writing were hindrances to the implementation of those reforms. Besides, changes were restrained to the normative level, therefore, leaving untouched the deliberative model of the tribunal. They revealed a strong concern with the submission of lower courts, rather than recognition of the importance of precedents by itself. Nevertheless, the author argues that, in the long term, the imposition of adherence to precedents may entail changes in the decision-making process and in the deliberative practices of the tribunal. The paper is divided into five parts. Initially, the author discusses the theoretical assumptions which underpin her hypothesis. The second part explains normative aspects of the ongoing reforms. The third and fourth sections deals with institutional and cultural factors related to judicial decision-making and adherence to precedents.

Esta tese realiza um estudo a respeito da confiança do investidor estrangeiro no Brasil, identificando teórica e empiricamente os aspectos jurídicos elementares à sua formação. A pesquisa tem como intuito analisar o papel do Direito tanto na geração quanto na proteção à confiança nutrida pelos investidores no País. Faz-se assim um percurso teórico que discute os pressupostos relacionados à racionalidade do homem econômico, sendo apresentadas algumas linhas críticas do paradigma de escolha racional. Dentre tais linhas, a Economia Comportamental é escolhida como opção metodológica do trabalho por fornecer uma visão alternativa para o estudo de tomada de decisão. Assim, com base no programa pesquisa Heuristics and Biases (H&B), fundado por Daniel Kahneman e Amos Tversky, avalia-se o processo de formação da confiança no Brasil. A revisão de literatura interdisciplinar busca fornecer alicerce teórico para o estudo empreendido, ao explorar a dificuldade e a abstração do conceito. A tese, no campo jurídico, (i) contrapõe as noções de confiança e boa-fé, (ii) discute como se dá a tutela da confiança pelo Direito brasileiro e (iii) destaca aspectos da regulação dos investimentos estrangeiros capazes de tutelar ou promover a confiança. A pesquisa empírica realizada ao final do trabalho aplica o H&B à análise do Direito, destacando as variáveis jurídicas consideradas essenciais à confiança do investidor no Brasil e analisando dissonâncias cognitivas a este respeito entre residentes e não residentes.
This thesis investigates foreign investors trust in Brazil, aiming at identifying theoretically and empirically its elementary aspects. It also intends to analyze the role played by Law at the creation and preservation of investors trust. From a theoretical standpoint, it discusses the rationality assumptions attributed to the economic man and reports alternative approaches for decision making other than rational choice. The work applies Behavioral Economics methodology, more specifically the Heuristics and Biases program, founded by Daniel Kahneman and Amos Tversky. The thesis also reviews interdisciplinary literature on trust, exploring the elusiveness of its concept. In addition, from a legal research perspective, it (i) compares the notions of trust and good-faith; (ii) discusses the legal grounds for trust protection under local law and (iii) points out regulatory mechanisms deemed capable of protecting or promoting trust. The empirical research presented at the end of the thesis illustrates how H&B may be applied to the analysis of Law, by assessing its role at promoting investors trust as well as assessing cognitive dissonances found among resident and non residents.

O objeto da tese de doutorado é a análise da relação entre a defesa da concorrência e a proteção do consumidor, duas políticas públicas que proporcionam benefícios mútuos e devem ser executadas de modo harmônico, havendo substrato normativo e teórico para incluir a preocupação com o bem-estar do consumidor como um dos objetivos da política de defesa da concorrência. No Brasil tal harmonização é uma imposição constitucional, já que a livre concorrência, a repressão ao abuso do poder econômico e a defesa do consumidor são princípios conformadores da ordem econômica. É defendida a utilização de um conceito unificado de consumidor, sendo adotada a teoria finalista, que o define como o destinatário final econômico do bem ou serviço. As duas políticas utilizam diferentes instrumentos e perspectivas na tutela do bem-estar do consumidor, o que fica claro na proteção do direito de escolha. O Código de Defesa do Consumidor oferece a isonomia como remédio para compensar a vulnerabilidade, estabelecendo regras destinadas à uma escolha consciente, sobretudo o direito à informação adequada e veraz. Já as normas de defesa da concorrência resguardam a liberdade preocupando-se em preservar a possibilidade de escolha entre mais de um fornecedor de produtos ou serviços. O exemplo mais contundente dá-se no controle de estruturas: a atuação das autoridades responsáveis pela análise dos atos de concentração é vinculada à preservação do excedente do consumidor e das condições imprescindíveis ao exercício do direito de escolha, sendo vedada a aprovação de fusões que prejudiquem o bemestar do consumidor. No âmbito repressivo a harmonização das duas políticas é intensificada com a colaboração entre as autoridades de defesa da concorrência e de proteção do consumidor para a fiscalização de condutas que configurem, ao mesmo tempo, infrações contra a ordem econômica e práticas abusivas, cuja dupla capitulação não acarreta bis in idem, pois são distintas as esferas jurídicas tuteladas, havendo assim diversidade de fundamentos. É salientada a importância das ações coletivas para reparação de danos causados aos consumidores por infrações contra a ordem econômica e defendida a adoção dos danos multiplicados e a manutenção da destinação dos valores arrecadados por multas a infrações contra a ordem econômica ao Fundo Federal de Direitos Difusos.
The thesis analyzes the relationship between the competition defense and the consumer protection, both public policies that offer mutual benefits and must be carried out in a harmonic way. So, there is a normative and theoretical substratum concerning the consumer welfare as one of the objectives of the antitrust policy. In Brazil such harmonization is imposed by the Constitution, since the free competition, the repression of the abuse of the economic power and the consumer protection are principles that pertain to the constitutional economic order. In this paper consumer is regarded as a unified concept, i.e., the economic final user of goods or services. Both policies use different instruments and perspectives for the protection of the consumer welfare, what is clear in the enforcement of the right of choice. The Consumer Defense Code refers to the isonomy as a remedy to make up for the vulnerability, establishing rules for a conscious choice, especially the right to the proper, true and accurate information. The antitrust rules are concerned with the freedom of choice and the possibilities of option from more than one supplier of products or services. The most outstanding example is related to the merger control: the antitrust authorities are required to guarantee a consumer surplus and the necessary conditions to exercise the right of choice, being totally banned the approval of mergers that may be harmful to the consumer welfare. The harmonization of both policies in the repression scope is intensified with the cooperation between antitrust and consumer protection authorities regarding to the law enforcement against practices that may represent infractions of the competition and of the consumer protection rules, as well. The thesis emphasizes the importance of class actions to repair consumer damages caused by antitrust law violations and defends the adoption of the multiplied damages and the maintenance of the allocation to the Diffuse Rights Federal Fund of amounts raised by fines collected by the Antitrust Authorities.

As informações acerca da performance e impacto socioambientais do fornecedor e do produto são necessárias para o exercício do consumo de forma sustentável. O conhecimento dos impactos socioambientais advindos da produção, uso e pós-consumo é requisito para a livre escolha dos consumidores por produtos que apresentem impactos socioambientais positivos em qualquer dessas fases de seu ciclo de vida. Um dos instrumentos para o alcance do desenvolvimento sustentável é possibilitar o consumo de produtos que utilizem menos recursos finitos da natureza e que tragam melhorias sociais como suas consequências. No Brasil, o fundamento para a inclusão dos dados socioambientais do produto nas informações veiculadas ao consumidor está presente no ordenamento jurídico, na garantia de acesso à informação e no direito à preservação do meio ambiente, ambos inseridos no rol dos direitos constitucionais fundamentais, ao lado do princípio da dignidade da pessoa humana, bem como em preceitos do Código de Defesa do Consumidor e da legislação ambiental. A função social da empresa decorrente do princípio constitucional da função social da propriedade também justifica o dever de veiculação dos dados referentes ao impacto socioambiental de seus produtos e acerca do comportamento socioambiental da empresa. A veiculação desses dados beneficia a concorrência, acarretando o aperfeiçoamento dos próprios meios de produção para atrair os consumidores que optam por produtos sustentáveis. Os deveres de clareza e veracidade, decorrentes do princípio da boa-fé objetiva previstos no CC e CDC, necessitam ser observados na veiculação dessas informações para evitar a maquiagem socioambiental, que é a divulgação da falsa imagem de preocupação socioambiental ao produto. A essencialidade ou utilidade das informações é o parâmetro para sua veiculação sob o risco de ocorrer seu excesso, que impede a correta compreensão de todos os dados apresentados. Até os riscos de impactos socioambientais ainda não comprovados cabem ser informados em atenção ao princípio da precaução. O repasse dessas informações pode e deve ocorrer por todos os meios de comunicação utilizados para a divulgação dos produtos, ressaltando-se o papel da rotulagem.
The information concerning the social-environmental impact of the product and the of the producers performance are necessary for the exercise of the sustainable consumption. The knowledge of the social-environmental impacts of the life cycle impact of the product is a requisite for the free choice of the consumers for products that present positive social-environmental impacts in any of these phases of its cycle of life. One of the instruments for the reach of the sustainable development is to make possible the consumption of products that use less finite resources of the nature and that they bring social improvements as its consequences. In Brazil, is possible to conclude that the legal system establishes the inclusion of the social-environmental data of the product in the information propagated to the consumer. Brazilian Constitution imposes the guarantee of access to the information, the consumer protection and the right of the preservation of the environment, as well as the dignity of the person human being. The social function of the companies, based in the constitutional principle of the social function of the property also justifies the duty of propagation of the referring data to the social-environmental impact of its products and concerning the social-environmental behavior of the company. In the legislative basis, there are strong rules concerning information in the Code of Defense of the Consumer and the environmental legislation. The propagation of these data benefits to the competition, creating incentives to the companies improving the means of production to attract the consumers that opt to sustainable products. The duties of clarity and veracity, attached with the good-faith principle established by Civil Code and Consumer Defense Code, need to be observed in the propagation of this information to prevent the greenwashing, that it is the propagation of the false image of social-environmental concern to the product. The essentiality or utility of the information is the parameter for its propagation under the risk to occur its excess, which hinders the correct understanding of all the presented data. Until the risks of social-environmental impacts not yet proven, they fit to be informed in attention to the Precautionary Principle. The view of this information can and must occur by all means of communication used for the spreading of the products, standing out itself the paper of the labeling.

Abstract:
Depuis le début des années 2000, les traitements anticancéreux oraux (TAO) sont en développement croissant, notamment dans le cancer du sein. Ils permettent aux patients la prise de comprimés par voie orale à domicile améliorant la qualité de vie. On estime que 10 à 34% des tumeurs du sein sur-expriment la protéine HER2 (HER2+) qui augmente le risque de métastases. Deux thérapies ciblées anti-HER2 sont actuellement disponibles : le trastuzumab, anticorps monoclonal administré par voie intraveineuse et le lapatinib, inhibiteur de tyrosine kinase administré par voie orale. D'après les recommandations de l'Agence Nationale d'Accréditation et d'Evaluation en Santé (ANAES, 2003), les TAO devraient être privilégiées par rapport aux formes intraveineuses prises à l'hôpital lorsque leur efficacité est équivalente. Dans la pratique courante des oncologues, les TAO semblent néanmoins sous-utilisées dans certains cas. En plus des freins médicaux connus (adhésion thérapeutique, gestion des effets indésirables), les TAO induisent une consommation de ressources hopitalières supplémentaires qui n'est pas valorisée dans le modèle de tarification à l'activité (T2A) des établissements hospitaliers, lequel repose sur la nature et la quantité d'activité médicale réalisée. Nous supposons que le modèle de T2A représente un frein économique à l'utilisation des TAO entrainant une disparité d'accès entre les traitements anticancéreux oraux et intraveineux. L'objectif de ce travail de thèse était donc de déterminer le rôle de la T2A dans l'accès des patients aux TAO au moyen d'une évaluation médico- économique de l'impact économique et organisationnel des TAO sur le système de soins. Une revue de littérature a permis de mettre en évidence le rôle du mode de financement des soins sur l'accès aux TAO en France et aux Etats-Unis. L'analyse des bases de données nationales hospitalières du Programme Médicalisé des Systèmes d'Information (PMSI) a permis de quantifier l'enjeu économique de la chimiothérapie pour les établissements de soins et qui représente la deuxième activité des hôpitaux en volume après l'hémodialyse. Le bénéfice lié aux séances de chimiothérapie a ainsi été estimé à 108 millions d'Euros en 2010 pour l'ensemble des établissements publics et privés en France. L'analyse a également permis de simuler le transfert d'allocation de ressources de l'hôpital vers les soins de ville induit par la substitution des séances de chimiothérapie par l'utilisation des TAO. Un modèle comparant le coût du traitement intraveineux (trastuzumab) aux TAO (lapatinib et capécitabine) dans le cancer du sein métastatique HER2+ a confirmé des coûts moindres pour les TAO (17 165€ versus 36 077€ par an et par patient) liés à une économie sur les transports médicalisés mais surtout sur les consommations hospitalières et ce, malgré un coût d'acquisition plus élevé des TAO. Malgré cet impact budgétaire négatif pour les hôpitaux, une étude de préférences (Méthode des Choix Discrets) conduite auprès d'un échantillon de 203 médecins hospitaliers et libéraux a montré que l'efficacité d'un traitement anticancéreux restait le déterminant principal de la décision thérapeutique (β=2,214, p<0,0001). L'étude a toutefois révélé que, aux stades avancés du cancer, la voie d'administration et son coût étaient également associés au choix du traitement (β=0,612, p=0,035 ;β=0,506, p<0,0001). Les résultats montrent donc que le modèle de financement de l'activité hospitalière influence le choix des modalités de traitement même si les critères d'ordre médicaux et environnementaux du patient demeurent des déterminants essentiels dans le choix du recours aux TAO (profil clinique du patient, adhésion thérapeutique, préférences du patient, environnement familial et socio-économique, conditions d'accès à l'offre de soins)
