s education and to investigate whether the students attending Curriculum Laboratory Schools are satisfied with the physical, instructional and social opportunities (services) offered at these schools. The sample of the study consisted of 440 seventh grade students and 14 parents from seven curriculum laboratory schools in the province of Ankara. Two instruments were used for data collection
interview questions for parents and a questionnaire for students. To analyze quantitative data, descriptive statistics such as frequency analyses and percentages were conducted. The open-ended questions in the parents&rsquo
interview were analyzed through content analysis. The results indicated that parents preferred these schools for several reasons including convenient location, technological opportunities, physical conditions and instructional opportunities. However, the availability of the opportunities was not as defined in the CLS model. Nevertheless, the students who were attending CLSs were moderately to highly satisfied with the services provided in the CLSs.

Full textThis dissertation addresses international choice of law, through the lens of cosmopolitan standards collected from other humanities, undertaking an interdisciplinary approach. Many recent studies on cosmopolitanism are examined, as well as its remote origins, so as to propose links between choice of law and cosmopolitanism. In chapter I, a historical study is undertaken, going back to the origins of cosmopolitanism (Greek and Roman philosophers), dealing moreover with Kants cosmopolitanism (18th century) and contemporary cosmopolitanisms. Accordingly, a division into categories is proposed and some theoretical notions of special importance to choice of law are tackled. In chapter II, cosmopolitan concepts are applied to legal theory. First, consequences are drawn from the idea of cosmopolitanizing law. Afterwards, the relation between Conflict of Laws and cosmopolitanism is addressed. The focus is on the application of the idea of cosmopolitan justice to choice of law. In chapter III, the three existing choice of law methods are addressed (multilateralism, unilateralism and substantialism), historically and critically. It is concluded that the adoption of multilateralism as a general framework, flexibilized by the principe de proximité, is a better option in terms of cosmopolitan impartiality than the other two methods. In chapter IV, a cosmopolitan vision of public policy is proposed, focusing upon two important theories recently conceived: the notions of ordre public de proximité and of truly international public policy. Also, a critical address of the recent application of the public policy exception by Brazilian courts (within the choice of law context) is made. At the end, the main conclusions are enumerated.

Full textSince the promulgation of the Constitutional Charter of 1988, there were reforms in the Brazilian legal system aimed at introducing adherence to precedents. The author argues that institucional and cultural peculiarities, such as deliberation procedures, the decision-making process and the practices of structuring and justification in the judicial decision writing were hindrances to the implementation of those reforms. Besides, changes were restrained to the normative level, therefore, leaving untouched the deliberative model of the tribunal. They revealed a strong concern with the submission of lower courts, rather than recognition of the importance of precedents by itself. Nevertheless, the author argues that, in the long term, the imposition of adherence to precedents may entail changes in the decision-making process and in the deliberative practices of the tribunal. The paper is divided into five parts. Initially, the author discusses the theoretical assumptions which underpin her hypothesis. The second part explains normative aspects of the ongoing reforms. The third and fourth sections deals with institutional and cultural factors related to judicial decision-making and adherence to precedents.

Full textThis thesis investigates foreign investors trust in Brazil, aiming at identifying theoretically and empirically its elementary aspects. It also intends to analyze the role played by Law at the creation and preservation of investors trust. From a theoretical standpoint, it discusses the rationality assumptions attributed to the economic man and reports alternative approaches for decision making other than rational choice. The work applies Behavioral Economics methodology, more specifically the Heuristics and Biases program, founded by Daniel Kahneman and Amos Tversky. The thesis also reviews interdisciplinary literature on trust, exploring the elusiveness of its concept. In addition, from a legal research perspective, it (i) compares the notions of trust and good-faith; (ii) discusses the legal grounds for trust protection under local law and (iii) points out regulatory mechanisms deemed capable of protecting or promoting trust. The empirical research presented at the end of the thesis illustrates how H&B may be applied to the analysis of Law, by assessing its role at promoting investors trust as well as assessing cognitive dissonances found among resident and non residents.

Full textThe thesis analyzes the relationship between the competition defense and the consumer protection, both public policies that offer mutual benefits and must be carried out in a harmonic way. So, there is a normative and theoretical substratum concerning the consumer welfare as one of the objectives of the antitrust policy. In Brazil such harmonization is imposed by the Constitution, since the free competition, the repression of the abuse of the economic power and the consumer protection are principles that pertain to the constitutional economic order. In this paper consumer is regarded as a unified concept, i.e., the economic final user of goods or services. Both policies use different instruments and perspectives for the protection of the consumer welfare, what is clear in the enforcement of the right of choice. The Consumer Defense Code refers to the isonomy as a remedy to make up for the vulnerability, establishing rules for a conscious choice, especially the right to the proper, true and accurate information. The antitrust rules are concerned with the freedom of choice and the possibilities of option from more than one supplier of products or services. The most outstanding example is related to the merger control: the antitrust authorities are required to guarantee a consumer surplus and the necessary conditions to exercise the right of choice, being totally banned the approval of mergers that may be harmful to the consumer welfare. The harmonization of both policies in the repression scope is intensified with the cooperation between antitrust and consumer protection authorities regarding to the law enforcement against practices that may represent infractions of the competition and of the consumer protection rules, as well. The thesis emphasizes the importance of class actions to repair consumer damages caused by antitrust law violations and defends the adoption of the multiplied damages and the maintenance of the allocation to the Diffuse Rights Federal Fund of amounts raised by fines collected by the Antitrust Authorities.

Full textThe information concerning the social-environmental impact of the product and the of the producers performance are necessary for the exercise of the sustainable consumption. The knowledge of the social-environmental impacts of the life cycle impact of the product is a requisite for the free choice of the consumers for products that present positive social-environmental impacts in any of these phases of its cycle of life. One of the instruments for the reach of the sustainable development is to make possible the consumption of products that use less finite resources of the nature and that they bring social improvements as its consequences. In Brazil, is possible to conclude that the legal system establishes the inclusion of the social-environmental data of the product in the information propagated to the consumer. Brazilian Constitution imposes the guarantee of access to the information, the consumer protection and the right of the preservation of the environment, as well as the dignity of the person human being. The social function of the companies, based in the constitutional principle of the social function of the property also justifies the duty of propagation of the referring data to the social-environmental impact of its products and concerning the social-environmental behavior of the company. In the legislative basis, there are strong rules concerning information in the Code of Defense of the Consumer and the environmental legislation. The propagation of these data benefits to the competition, creating incentives to the companies improving the means of production to attract the consumers that opt to sustainable products. The duties of clarity and veracity, attached with the good-faith principle established by Civil Code and Consumer Defense Code, need to be observed in the propagation of this information to prevent the greenwashing, that it is the propagation of the false image of social-environmental concern to the product. The essentiality or utility of the information is the parameter for its propagation under the risk to occur its excess, which hinders the correct understanding of all the presented data. Until the risks of social-environmental impacts not yet proven, they fit to be informed in attention to the Precautionary Principle. The view of this information can and must occur by all means of communication used for the spreading of the products, standing out itself the paper of the labeling.
