Abstract:
This thesis examines possible synergies and points of friction between understandings of disability that emphasise its social contingency and jurisprudential debates on substantive equality and access to social security in the context of the promotion of access to work for disabled persons in South Africa. In consequence of an analysis of theoretical debates in the field of disability studies and how these find application in the sphere of employment equity law, it is concluded that, while social understandings of disability mostly focus on structural changes that would see people with disabilities who can and want to work gain access to such work, the positive obligations imposed on employers and the state in terms of equality rights and employment equity legislation are of limited depth and breadth. It is proposed that one potential course of action to address the limited scope of equality law would be to emphasise the state's obligations in terms of socio-economic rights where these rights are relevant to work inequality. Particular emphasis is placed on how the interpretation and application of the right to access to social security could be used to activate government's duties in respect of unemployment protection and work creation. The conclusion reached is that while this strategy poses risks and has its limitations, it can be used to improve information gathering in respect of disabled work seekers that will aid planning and enforcement; to facilitate support for disabled work seekers who experience discrimination; to compel government to improve the implementation and enforcement of employment equity laws in respect of disabled work applicants; to catalyse a holistic approach to social security that considers the interrelationship between social assistance and promoting unemployment protection for disabled persons who are willing and able to work; and to provide different forms of support to disabled people who do not operate in the formal labour market, but who can and do perform work that falls outside the scope of traditional labour market regulation.

A ausência do tema acesso e qualidade da atenção à saúde da pessoa com deficiência, no âmbito de todas as prioridades de pesquisa do Ministério da Saúde, ilustra a invisibilidade dessa população. Mais invisíveis ainda são as Pessoas com Deficiência Múltipla que necessitam de apoio pervasivo, eleitas como participantes deste estudo. Fundamentado nessa asserção, buscou-se analisar o acesso da Pessoa com Deficiência Múltipla que necessita de apoio pervasivo aos serviços de saúde bucal, à luz das seguintes dimensões: necessidade percebida, disponibilidade dos serviços, uso dos serviços de saúde, aceitabilidade, acessibilidade, adequação funcional e capacidade financeira. Para o alcance do objetivo, efetuou-se uma pesquisa de campo, descritiva, transversal, de âmbito regional, que se desenvolveu em Associações de Pais e Amigos do Excepcional do estado de São Paulo equipada com Unidade de Cuidados Diários ou unidade similar, nos municípios que compõem o Departamento Regional de Saúde VI - Bauru. O estudo contou com a participação de 71 pais e/ou responsáveis por Pessoas com Deficiência Múltipla que necessitam de apoio pervasivo, ou seja, constante, de alta intensidade, nos diversos ambientes. A investigação foi realizada por meio da aplicação de um questionário com perguntas abertas e fechadas aos pais e/ou responsáveis. Para a análise estatística foram utilizados os softwares: SPSS V17, Minitab 16 e Excel Office 2010. Os dados foram analisados por meio de três testes estatísticos - Teste de Igualdade de Duas Proporções; Intervalo de Confiança para a Média e P-valor. Os resultados, à luz das dimensões, denotam alta prevalência da percepção da necessidade de cuidados odontológicos pelos pais e/ou responsáveis por Pessoas com Deficiência Múltipla e presença de serviço de saúde bucal público acessível, no território. No entanto, a média de confiança dos pais na capacidade desses serviços em resolver prontamente a necessidade de saúde bucal da pessoa com deficiência múltipla foi expressa pelo número 1,42 ±0,58. Mais de setenta por cento dos pais e/ou responsáveis afirmaram que a Pessoa com Deficiência Múltipla não utiliza os serviços odontológicos de forma regular. A aceitabilidade relacionou-se diretamente com o perfil do profissional e com as características organizacionais dos serviços. A acessibilidade foi dificultada por obstáculos humanos, arquitetônicos (meios de transporte) e financeiros. A grande maioria dos pais verbalizou incapacidade de arcar com os custos de um tratamento odontológico, sem contar com a ajuda de alguém ou de algum benefício. Conclui- se que o acesso da Pessoa com Deficiência Múltipla que necessita de apoio pervasivo aos serviços de saúde bucal, que frequenta APAES com UCD, no DRS VI - Bauru, não é regular, nem oportuno e muito menos propicia o alcance dos melhores resultados possíveis para as especificidades da pessoa com deficiência. O acesso foi mediado, principalmente, por barreiras atitudinais e programáticas, ou seja, pelas atitudes, comportamentos e reações dos pais e/ou responsáveis pelas Pessoas com Deficiência Múltipla em relação ao cirurgião-dentista e as características dos serviços de saúde bucal, bem como das atitudes, comportamentos e reações dos cirurgiões-dentistas e dos serviços de saúde bucal em prestar assistência às pessoas com deficiência e aos seus responsáveis.
The absence of the theme access and quality of attention to health, concerning People with Disabilities, under all the research priorities of the Ministry of Health, illustrates the invisibility of this population. Still, more invisible are the People with Multiple Disabilities in need of pervasive support, elected as participants of this study. Based on this assertion, the access of People with Multiple Disabilities in need of pervasive support to oral health services was analysed in light of the following dimensions: perceived necessity, availability of services, use of health services, acceptability, accessibility, functional adequacy and financial status. To reach the goal, a regional, descriptive, cross-sectional field research was performed, which developed into Association of Parents and Friends of Disabled People of São Paulo state, equipped with Daily Care Unit or similar, in the municipalities taking part of the Regional Health Department VI - Bauru. The study had the participation of 71 parents and/or guardians of People with Multiple Disabilities in need of constant or high intensity pervasive support, in different environments. The research was conducted by applying a questionnaire with open and closed questions to parents and/or guardians. For statistical analysis SPSS V17 software, Minitab 16 and Excel Office 2010 were used. Data were analyzed using three statistical tests - Equal Test of Two Proportions; Mean Confidence Interval and P-value. The results, in light of the dimensions, denoted high prevalence of perceived need of dental care by parents and/or guardians for People with Disabilities and Multiple and presence of accessible public oral health services in the territory. However, parents\' confidence concerning the ability of these services to promptly address the need for oral health of people with multiple disabilities was expressed by 1,42 ±0,58. More than seventy per cent of parents and/or guardians informed that the People with Multiple Disabilities do not use dental services regularly. Acceptability was related directly to the professional profile and the organizational characteristics of the services. Accessibility was hampered by human, architectural (means of transport) and financial obstacles. Most parents voiced inability to afford the cost of a dental treatment, unless they received help from someone or some benefits. It is concluded that People with Multiple Disabilities, in need of pervasive support for oral health services, attending APAES with UCD in DRS VI - Bauru, are not regular or timely, and do not achieve the best possible results for the specificities of disabled people. The access were mediated, primarily, by attitudinal and programmatic barriers, i.e., by attitudes, behaviors and reactions of parents and/or responsible for People with Multiple Disabilities, in relation to the dentist and to the characteristics of oral health services, as well as the attitudes, behaviors and reactions of the dentists and oral health services in assisting people with disabilities and their caregivers.

It provides a brief explanation about the rights acquired through legislation, resolutions, Brazilian and international standards and resolutions, and service sectors within the UFPB for people with disabilities. Discusses the concepts of information and your access and use as a right and in factor (ex)inclusion at the University. It shows the differences between disabilities and special needs, emphasizing the educational needs as well as an overview of the challenges, struggles and achievements in recent decades. It aims to analyze access to information under the UFPB under the gaze and individual / collective memories of students with disabilities. It is characterized as an exploratory and descriptive, qualitative approach. Uses the data collection used the shadowing technique (monitoring) and the interview from the perspective of thematic oral history points out as research subjects, students enrolled in UFPB affected by a disability. Analyzes individual and collective memories of the subjects surveyed inherent theme crafted. Identifies from the memories, sectors, services, programs and other resources that help to retain the student with disabilities in UFPB. It concludes that the subjects are many to information access barriers in UFPB, a fact that hurts principles and rights with respect to such access, whose role in the personal and academic life of the subjects, is of paramount importance for its transforming nature.
Esta pesquisa traz uma breve explanação a respeito dos direitos adquiridos através da legislação, resoluções, normas brasileiras e internacionais, bem como as resoluções, setores e serviços no âmbito da UFPB destinadas às pessoas com deficiência. Em seu desenvolvimento, aborda os conceitos de informação, como também o seu acesso e o uso como um direito e fator de in(ex)clusão na Universidade. Também apresenta as diferenças entre deficiências e necessidades especiais enfatizando as necessidades educacionais, o panorama dos desafios, lutas e conquistas nas últimas décadas. O estudo objetiva analisar o acesso à informação no âmbito da UFPB sob o olhar e memórias individuais/coletivas dos alunos com deficiência e caracteriza-se como uma pesquisa exploratória e descritiva, de abordagem qualitativa. Para tanto, utiliza na coleta de dados a técnica Shadowing (acompanhamento) e a entrevista pela perspectiva da História oral temática. Como sujeitos da pesquisa, instituiu-se os alunos regularmente matriculados na UFPB, acometidos por alguma deficiência, analisando-se as memórias individuais e coletivas dos sujeitos pesquisados sob a égide da temática trabalhada. Esta dissertação identifica a partir das memórias, os setores, serviços, programas e outros recursos que auxiliam a permanência do aluno com deficiência na UFPB. Ao fim desta pesquisa, concluiu-se que os sujeitos da pesquisa encontram muitas barreiras para o acesso às informações na UFPB, fato que fere os princípios e os direitos que garantem o acesso, lembrando que este tem papel em sua vida pessoal e acadêmica e é de suma importância pelo seu cunho transformador e formador.

Denna uppsats behandlar en undersökning om tekniska hjälpmedel för funktionshindrade med nedsatt rörlighet. I dagens samhälle utvecklas tekniken i en mycket snabb takt, men tekniken ska vara tillgänglig för alla, inklusive personer med funktionshinder. Huvudsyftet med vår studie är att undersöka följande forskningsfråga: Vilka möjligheter finns det för motoriskt funktionshindrade ungdomar att ta del av den tekniska utvecklingen vad gäller interaktion med datorer? Intervjustudien som genomfördes visade att användarna använde pekskärmar och eye tracking, men också att de inte var helt nöjda med dessa verktyg som stöd. Vår genomförda litteraturstudie visar på att andra verktyg existerar, och även att dessa skulle kunna vara mer fördelaktiga för användarna. Aktuella forskningsstudier visar också att det finns riktlinjer som ska följas vid utvecklingen av tekniska verktyg till ungdomar med motoriska handikapp.
This essay deals with a study of technological aids for the physically disabled with reduced mobility. In today's society technology develops in a very fast pace, but the technology should be available to everyone including those with disabilities. The main aim of this study is to investigate the following research issue: Which are the opportunities for motoric disabled adolescents to take advantage of the technological developments in terms of interaction with computers? Our conducted interview study showed that the users were using touch pads and eye tracking. However, the study also showed that they were not fully satisfied with the aforementioned aid tools. Recent research studies discuss other existing aid tools, and that they could be more beneficial for the users. Furthermore, recent research results also show that there are guidelines to be followed when developing technical aid tools for adolescents with motoric disabilities.

A forced choice reaction time (RT) task was used to examine the relations between covert orienting (shifts in attention independent of eye movement) and filtering (the inhibition of processing of irrelevant stimuli) components of attention in persons with autism (n = 12) and developmentally disabled persons without autism (n = 20). Conditions varied with regard to the validity of the cue (related to covert orienting) and presence of distractors (related to filtering). ?'he RT/p(correct) scores of both groups were longer in the distractor-present conditions and in conditions when a cue provided incorrect information regarding the location of the subsequent target (invalid cue). The RT/p(correct) scores of persons with autism as compared to developmentally disabled persons without autism were slower overall. However the pattern of performance of persons with autism was not significantly different from that of the developmentally disabled persons without autism. These results are inconsistent with the notions of specific deficits in covert orienting and filtering among persons with autism and indicate that certain attentional difficulties may not be unique to autism. Alternatively, they may also reflect differences in the specific mechanisms assessed in different studies. Findings are discussed in terms of the specificity of visual filtering and covert orienting impairments in autism.

Abstract:
The importance for disabled people of accessible transport is now widely recognised, as is the reality that this also benefits many non-disabled people. Many previous commentaries offer a qualitative perspective, but quantitative evidence, particularly of benefits to the population as a whole, has been lacking. This research, underpinned by the Social Model of disability, established that the absence of such evidence creates a barrier to the inclusion of disabled people in mainstream transport. Further, it demonstrates that there is a way to remove this barrier: by applying stated preference techniques, the benefits of providing access to transport systems can be robustly monetised and successfully incorporated into the economic appraisal of transport projects. A multiple-case study of tram systems investigated how practitioners currently incorporate disabled access into project appraisals. Analysis showed that isomorphic forces identified by new institutional theory have led to similarity in practice, with the effect that ways of incorporating the costs of disabled access are well established, but ways of incorporating the benefits remain unclear. Resulting benefit:cost ratios, often apparently unfavourable, may be misleading. A systematic literature review catalogued methods for valuing non-market goods, and from these identified methods transferable to disabled access. Stated preference, a method of monetisation common in the transport environment, emerged as an appropriate method, with discrete choice modelling a suitable technique. A discrete choice experiment enabled calculation of monetary values for platform-to-platform access at stations. Using a cross-section of the population and addressing socioeconomic factors such as age, disability, and attitudes to disabled people, willingness-to-pay figures were derived for access methods suited to disabled people‘s needs. Finally, these willingness-to-pay figures were incorporated into two appraisals. The amended benefit:cost ratios more accurately represent the value of access provision, and the figures incidentally enable the relative values of different access options to be distinguished.

Abstract:
Over the last 25 years geographers, amongst other social scientists, have become increasingly interested in the lived experience of childhood (Cloke and Jones, 2005). One area of interest has been children’s environmental access, with a focus on independent access, mobility and play (Thomson and Philo, 2004). The dominant narrative of this work has been focused on the decreasing quantity and quality of children’s natural environment experiences (Valentine and McKendrick, 1997), positioned primarily as a result of changing approaches to risk perception and management, in both families and schools (Malone, 2007). This thesis explores children’s own perspectives, specifically looking at the lived experiences of learning disabled children, a group largely absent from geographical research (bar Goodfellow, 2012; and Holt, 2010). A mixed qualitative methods approach is used, borrowing from participatory geography techniques and using a range of media including video diaries. The thesis finds that learning disabled young people experience stigma in their interactions with outdoor spaces that are characterised by being highly structured and supervised. As a result learning disabled young people struggle to develop skills and interests in accessing outdoor spaces, and do not utilise outdoor green spaces as sites of peaceful solitude or landscapes of socialising. This research contributes to children’s geographies through the interpretation of new empirical data and the development of methodological approaches for including learning disabled young people in research.

Abstract:
The overall purpose of the study was the identification of factors which influence the freedom of physically disabled people, within South African society, to make choices that will enable them to conduct their daily lives independently. Qualitative research methods (observation and semi-structured interviews) were utilised to explore the problem from the disabled person's perspective. In total there were ten participants, sampling being purposive and opportunistic. The study was essentially narrative, with the results analysed and grouped thematically. Factors influencing independence related to the individual's functioning, as well as the social environment and the study's setting in Mitchells Plain, Cape Town. The relative strength of each factor varied at any one time for a given subject, and between the respondents. Overall there was strong agreement amongst participants and with the literature. Recommendations made related to future research, student training and occupational therapy practise.

ENGLISH ABSTRACT: Progress has been made in the approach to combating the spread of HIV/AIDS with regards to the Department of Health's presentation of the HIV/AIDS/STD Strategic Plan for South Africa. However, deep concem exists with regards to specific marginalized groups such as disabled persons within the South African sector threatened by the spread of HIV/AIDS. The aim of this paper was to review published academic papers on the specific ways in which disabled people are at risk for contracting HIV/AIDS, and the existence of primary prevention programmes designed and specifically aimed at the disability sector. The roles of non-governmental and other organisations were also looked at. The first section of the review focused on high-risk behaviour among disabled persons for contracting HIV/AIDS. Existing literature covered mainly areas of intellectual disability and psychiatric disability. Disabled persons struggle with the same issues of good education, workers' rights, gender equality, health care and social support and well-being as the general population. These issues are however exacerbated by struggles unique to those living with a disability. Inadequate public and social support increase disabled people's vulnerability to issues such as poverty, lack of resources, and inadequate education, heightening their risk of contracting HIV/AIDS. The second section of the review discusses the area of primary prevention, explaining why prevention programmes should be tailormade for specific needs such as those of disabled persons. Examples of prevention programmes from the literature are looked at, as well as a prevention initiative launched in South Africa.
AFRIKAANSE OPSOMMING: Vooruitgang is gemaak op die gebied van die voorkoming van die verspreiding van MIVNIGS met die bekendstelling van die Departement van Gesondheid se MIVNIGS/STD Strategiese Plan vir Suid-Afrika. Daar is wel steeds kommer oor spesifieke gemarginaliseerde groepe, soos gestremde persone, binne die Suid- Afrikaanse sektor wat bedreig word deur die verspreiding van MIVNIGS. Die doel van die studie was om 'n oorsig te kry van akademiese materiaal wat gepubliseer is oor die spesifieke wyses waarop mense met 'n gestremdheid in gevaar verkeer om MIVNIGS op te doen, asook primêre voorkomingsprogramme wat spesifiek ontwerp en gemik is op die gestremde sektor. Daar is ook gekyk na die rol van nie-regerings- en ander organisasies. Die eerste deel van die studie fokus op hoë risiko gedrag van gestremde persone wat hulle in gevaar mag stel vir die opdoen van MIVNIGS. Bestaande literatuur handel meestaloor die areas van intellektuele gestremdheid en psigiatriese siektes. Gestremde persone moet dieselfde uitdagings oorkom as diegene in die algemene populasie, soos byvoorbeeld die gebrek aan goeie onderwys, arbeidsregte, diskriminasie op grond van geslag, gesondheidssorg, asook sosiale steun en algemene welsyn. Gestremde persone se kwessies word egter vererger deur sekere uitdagings wat uniek is aan 'n lewe met 'n gestremdheid. Gestremde persone ontvang meestalonvoldoende publieke en sosiale steun wat dikwels armoede, gebrek aan hulpbronne en onvoldoende opvoeding tot gevolg het. Laasgenoemde verhoog gestremde persone se kanse om MIVNIGS op te doen. Die tweede deel van die studie bespreek primêre voorkomingsprogramme en waarom dit noodsaaklik is om voorkomingsprogramme te ontwerp wat uitsluitlik gemik is op spesifieke populasies. Daar word dan ook gekyk na voorbeelde van primêre voorkomingsprogramme in die literatuur, asook 'n voorkomingsinisiatief wat in Suid-Afrika geloods is.

Introduction: Accessibility for disabled people at primary healthcare units has a fundamental role in the use of health services, as well as the organization of health services targeted at this population, since there is an impressive number of disabled people in the state of Goiás and in Brazil in general. Objective: To analyze accessibility of disabled people to primary healthcare services in the state of Goiás. Method: A descriptive cross-sectional study was conducted with secondary data from an external evaluation of the National Program for Improvement of Access and Primary Healthcare Quality (PMAQ-AB, as per its acronym in Portuguese). The study was developed in all 246 cities of Goiás. The sample was made up of 1,216 healthcare units and 677 healthcare professionals in the cycle 1 of PMAQ-AB; and 975 healthcare units and 1,180 healthcare professionals in the cycle 2 of PMAQ-AB. Data were collected between June and August 2012 in the cycle 1 and from January to March 2014 in the cycle 2. The variables were analyzed descriptively and presented by means of absolute numbers, frequencies and means. Results: Only 30% to 40% of the studied healthcare units had sidewalks, floors and ramps accessible to disabled people. Between 20% and 35% of the healthcare units had adapted doors and hallways, except for units in cities with up to 50,000 inhabitants in cycle 2, which accounted for almost 50% of the units with these elements. Regarding adapted restrooms, less than 20% of the healthcare units in cycle 1 had them, whereas between 20% and 55% of the units in cycle 2 presented this feature. As for the organization of healthcare services toward disabled people, almost 95% of the teams defined the coverage area, however only half of them had records on the number of cases of disabled people. Conclusion: Primary healthcare units and services in the state of Goiás are not structured in terms of accessibility to disabled people, which makes the delivery of care to this population poor. In this sense, there is a clear need for investments on the part of health managers and professionals for continuing education and financial resources to adapt these units and qualify healthcare teams to provide universal, comprehensive and humanized health care to disabled people.
Introdução: A acessibilidade às pessoas com deficiência física nas unidades de saúde da Atenção Primária tem papel fundamental no usufruto dos serviços de saúde, bem como a organização dos serviços de saúde voltados para essa população, pois há um número expressivo de pessoas com deficiência na população do Brasil e do estado de Goiás. Objetivo: Analisar a acessibilidade às pessoas com deficiência física aos serviços de saúde da Atenção Primária no estado de Goiás. Metodologia: Estudo descritivo de corte transversal, utilizando dados secundários da avaliação externa do Programa Nacional de Melhoria do Acesso e da Qualidade da Atenção Básica (PMAQ-AB). Estudo realizado nos 246 municípios do estado de Goiás. Amostra constituída por 1216 unidades de saúde e 677 profissionais de saúde no Ciclo 1 do PMAQ-AB; e 975 unidades de saúde e 1180 profissionais de saúde no Ciclo 2 do PMAQ-AB. A coleta de dados foi realizada de junho a agosto de 2012 no Ciclo 1, e de janeiro a março de 2014 no Ciclo 2. As variáveis foram analisadas de forma descritiva e apresentadas por meio de frequências, médias e números absolutos. Resultados: Identificou-se que apenas 30% a 40% das unidades de saúde possuem calçadas, pisos e rampas acessíveis às pessoas com deficiência física. Entre 20% e 35% das unidades de saúde possuem portas e corredores adaptados, à exceção das unidades dos municípios com até 50.000 habitantes no Ciclo 2 que atingiram quase 50% das unidades com esses elementos. Em relação aos banheiros adaptados, menos de 20% das unidades de saúde os possuíam no Ciclo 1, enquanto que no Ciclo 2 entre 20% e 55% das unidades apresentaram essa característica. Quanto à organização dos serviços de saúde para as pessoas com deficiência, encontrou-se que quase 95% das equipes realizavam definição da área de abrangência, no entanto apenas a metade delas possuíam registros do número de casos de pessoas com deficiência. Conclusão: As unidades e os serviços de saúde da Atenção Primária no estado de Goiás não estão estruturados quanto à acessibilidade para as pessoas com deficiência física, fragilizando, assim, a assistência à essa população. Nesse sentido, faz-se necessário investimentos por parte dos gestores e profissionais de saúde para educação permanente e recursos financeiros para instrumentalizar essas unidades e equipes de saúde para prestarem um cuidado de forma universal, integral e humanizada às pessoas com deficiência.

BACKGROUND: The access and utilization of maternal health care services by disabled and Dalit women in Nepal has not been well studied, and yet disparities in these may result in poor health outcomes. Co-existence of caste and disability may lead Dalit women with disability to further exclusion and marginalization, preventing them to access basic human rights and opportunities such as maternal health care services. It is therefore important to understand disabled and Dalit women’s access and utilization of health care service and the effect of intersectionality between their caste status and disability in the use of services. Previous efforts have focused on disability, gender and caste separately, but few studies have attempted to understand the inter-relationship between them or where they co-exist. This study explored this complex relationship and the multiple perspectives of Dalit women with and without disability about their access and utilization of maternal health care services with the assumption that all of these factors interacting together lead to exclusion and marginalization preventing their access and utilization of services. The study objectives were: (i) to compare and determine maternal health care service access and utilization patterns among disabled and non-disabled, Dalit and non-Dalit women in the Rupandehi district; (ii) to understand the attitude and behaviours of society and maternal health care providers towards disability; and (iii) to identify inhibiting and enabling factors for disabled and Dalit women with regards to access and utilization of maternal health care service. METHODS: The study employed a mixed methods design combining quantitative and qualitative components of data collection and analysis. Quantitative data was obtained from survey questionnaires administered to women between aged 15 - 49 years and also of their health care providers. A total 354 women, of which 79 were disabled (18 disabled Dalit and 61 disabled non-Dalit) and 275 non-disabled (133 non-disabled Dalit and 142 non-disabled non-Dalit) participated in the survey. While qualitative data was gathered from 37 in-depth interviews, six focus group discussions with women (disabled and non-disabled; Dalit and non-Dalit), and six key informant interviews with activists, community leaders and policy makers. Quantitative data was analysed using descriptive statistics, bivariate and multivariate analysis with a logistic regression model and theme content analysis was applied to the qualitative data. RESULTS: The study found inequitable utilization of maternal health care services, with disabled women having lower utilization of ANC one (83.5% vs 96.7%, P < 0.001), HF delivery (52.6% vs 69%, P < 0.05) and PNC (18.4% vs 32.5%, P < 0.05) services compared to non-disabled women. Household indicators relating to education, wealth and family circumstances were the main determinants for disabled women having less service utilization (P < 0.05). Low utilization of postnatal care (PNC) services among all groups found due to the poor information received by women from local health providers and strong negative traditional beliefs among communities. The study did not find differences in the utilization of maternal health care services between Dalits and non-Dalits (P > 0.05). Rather it found that maternal health care services are not easily or equitably accessible to all social groups, preventing full utilization for disabled. Societal and health care providers’ attitudes towards disability were often found to be negative, although there were positive and negative user experiences and perceptions of provider’s attitude and behaviours. A further finding of the study was that the health care needs of disabled women are invisible at the policy level, which appeared to translate into unsuitable health care settings and ill-prepared health care providers to cater for them. Women from all social groups encountered a number of barriers to access, relating to personal, socio-cultural, and policy or system factors; however, disabled women faced additional barriers. Women with disabilities from all social groups faced physical, attitudinal, socio-cultural and policy related issues, including a lack of knowledge and skills among providers were critical barriers for women with disabilities; whereas having positive providers, a favourable family environment, as well as education and information, were enabling factors for disabled women’s access and utilization of care. Women with disabilities from all social groups also have higher levels of fear and perceived risks associated with pregnancy and delivery. This is primarily linked to worries about delivery complications associated with their disability and also that the baby would inherit their disability. The study did not find any compounding effect of caste and disability in access and utilization of maternal health care services. CONCLUSION: Improving equity and maternal health care access and utilization for disabled and other marginalised women requires that policy and existing traditional strategies be re-examined, re-developed and implemented through a human rights-based lens, with programme interventions focused on addressing persistent negative attitudes and socio-cultural barriers. Women’s education, social status, decision-making power and access to resources are critical factors associated with health care access and utilization among all groups of women. Significantly, women with disabilities, no matter what their social group, faced greater barriers than non-disabled women. Therefore, in order to increase access and utilization of maternal health care services across the population, holistic approaches including multi-sectoral interventions should be adopted.

Access to justice for persons with disabilities is specifically safeguarded in a number of international conventions, standards and recommendations. The Rights of Persons with Disabilities to access to justice is explicitly referenced in Article 13 of the Convention on the Rights of Persons with Disabilities. Access to justice was first formally referenced in the Universal Declaration of Human Rights(UDHR), which is a formative human rights document, the term access to justice was not however specifically used to label the right therein. The International Covenant on Civil and Political Rights (ICCPR) also sets forth this right in Article 14, which states that: "all persons should be equal before the courts and tribunals." However in reality persons with disabilities, often lack access to justice and equal protection of the law.

The accessibility, predictors, and use of health care and social services among developmentally disabled elderly adults in Canada were examined using a nationally representative social survey. The first research hypothesis is that the independent variables will contribute significantly to the prediction of the dependent variables. A second hypothesis is that the slope of any given independent variable will not equal zero. The results of this research show that the illness (need) variables are the most predictive correlate of the utilization of health care and social services. The predisposing variables have secondary explanatory power, with the enabling variables accounting for the least amount of variance. The hypotheses were tested by step-wise multiple regression analysis using SPSS-X.

Depuis la loi du 11 février 2005 pour « l’égalité des droits et des chances, la participation et la citoyenneté des personnes handicapées », l’École s’est engagée sur la voie de l’inclusion des élèves en situation de handicap. Pour répondre à la nécessité de rendre accessibles les apprentissages à ces élèves, l'Education Nationale finance notamment du « matériel pédagogique adapté ». Plus spécifiquement, la possibilité offerte aux élèves dyslexiques de contourner ou de surmonter leurs difficultés en langage écrit grâce à l’utilisation d’aides technologiques ouvre de nouvelles perspectives d’apprentissage et d’enseignement mais suscite aussi bon nombre d’interrogations. Au coeur de notre thèse qui s’inscrit dans ce contexte, nous conduisons une étude sur l’efficacité des outils de compensation attribués aux élèves dyslexiques et dysorthographiques scolarisés dans le second degré, corrélée à leurs contextes d’usage et d’appropriation. Le recours à deux démarches, l’une expérimentale, comprenant des tests de lecture et d’écriture, et l’autre compréhensive, combinant les questionnaires et les entretiens semidirigées, permet d’aborder les phénomènes et les enjeux qui s’opèrent dans l’utilisation des outils informatiques par les adolescents dyslexiques dans le cadre de leur apprentissage de la lecture et de l’écriture en classe ordinaire. Par l’analyse et le croisement de l’ensemble des données recueillies, nous tentons de décrire les facteurs personnels et environnementaux qui sous-tendent la réalisation du projet de compensation et de mettre en lumière les obstacles et les facilitateurs à l’utilisation efficace des aides technologiques. L’approche de la complexité des processus et des interactions en jeu dans la mise en oeuvre du projet de compensation nous permet finalement d’exposer quels sont les leviers fondamentaux et indispensables à un usage efficient des outils informatiques en classe par les élèves dyslexiques-dysorthographiques mais aussi de proposer les axes dominants d’un contexte éducatif inclusif susceptible de soutenir leur usage
Since the act of February 11, 2005 on equal rights and opportunities and the inclusion and citizenship of the disabled was passed, French schools have embarked on the path of the inclusion of pupils with disabilities. To respond to the need of making learning accessible to these pupils, the French Education system does finance some appropriate educational learning materials. More precisely, the opportunity for dyslexic pupils to avoid or overcome the difficulties with written language thanks to new technologies opens up new prospects for learning and teaching but also raises concerns.At the very core of this thesis lies the study I have carried out on the effectiveness of those compensatory tools given to dyslexic and dysorthographic pupils in secondary education depending on the way they use these tools and become familiar with them. Two different approaches have been used, one being experimental including reading and writing tests and the other one being comprehensive combining questionnaires and semi-structured interviews. Both have permitted to identify the phenomena and the issues related to those pupils’ use of computer tools when they learn how to read and write in a mainstream class. By analysing and crossing data, I have tried to describe the personal and environmental factors which lead to the successful completion of the compensatory project and to identify the barriers but also the facilitators leading to a more effective use of these technological tools.Examining the complexity of the processes and the interactions involved in a compensatory project not only helps to identify key leverage actions to enhance the effectiveness of the use of computer tools but also permits to define priority axes to create an inclusive learning environment that is most likely to support this usage

This thesis deals with the historical background concerning the development of disability-related employment measures and the employment exclusion experienced by disabled persons. In particular, the enquiry focuses upon the early post-war period up until the introduction in 1997 of the New Deal for Disabled Persons. The thesis postulates that: 1. major policy shifts within the Employment Service Disability Services (ESDS) in the early 1990s did not sufficiently reflect the employment integration needs of disabled persons; in spite of a major social values shift, to welfare-to-work measures for disabled persons these measures proved to be problematic; problems existed because of the following three inter-related negative social factors; 3.1 lack of adequate neeeds assessment and response to disabled persons labour-market requirements; 3.2 lack of support for work capability enhancement; and 3.3 lack of suitable work-integrated environments,accessible jobs and adequate socially 'adjusted' working conditions. Although the study was carried out prior to the New Deal for Disabled Persons (NDDP), the main concerns raised by this study, regarding disabled persons labour market integration needs, would still appear to prevail. However, the post- NDDP developments and implications for the employment of disabled persons under the NDDP would require further research that is beyond the ambit of the present study which terminated prior to the introduction of the New Deal. The study examined national developments of disability policy of the Employment Service (ES), in the light of transitions within service philosophy during the 1990s. This took the form of a major shift on the part of policy makers of the 'position' of disabled persons to mainstream labour markets. Prior to the early 1990s, the position of disabled persons was largely one of relative labour-market marginality. Many disabled persons experienced social alienation, denoting exclusion from or restricted entry into employment, on terms that were often significant of a position of exploitative 'integration'. With the collapse in the 1980s and 1990s of the Keynes-Beveridge Welfare State, the outcome for disabled persons was a reconceptuality of their relationship to labour markets. This factor was driven by rising state-benefit dependency and decommodification. The perspective of the New Right, with its anti-statedependency ideology, ushered in a new regime wherein disabled persons were to be exposed to similar labour-market rigours as the non-disabled. While the two tier disability-employment regulatory system, set in place by Tomlinson (1942), remained relatively intact, the new requirements of what has been described as a 'Schumpeterian Workfare State' (Jessop, 1992,1994), ensured that the ES, Disability Service, faced a need for radical reform. It is the framework and conception of this revised approach, to disabled persons labour-market involvement, that constitutes the basis of the present study. The research ' contribution to disability and employment lies in the presentation of employment service users' own perceptions of the suitability of the ESDS. However debate presented, maintains that the fundamental relationship of disabled persons to employment, without corresponding change towards the social values perceptions of disabled persons, ensures that employment associated alienation will remain intact.

Provision for disabled people has been made so that the system is intended to be fully accessible throughout. This thesis comprises an evaluation of these facilities for disabled people and the main findings are as follows: i) The system was not originally intended to incorporate facilities for disabled people, but a gradual change of policy resulted in the provision of full access; ii) Surveys of disability indicate that about 7% to 8% of the population of the Tyne and Wear area suffer from some disability. However, those disabled people most likely to use Metro and benefit from its facilities (i.e. non-housebound, physically handicapped or visually impaired people) together comprise only about 2% of the Tyne and Wear population; iii) Only a minority (perhaps one-third) of local disabled people use the system and disabled people account for only about 0.5% of Metro passengers. However, the facilities for disabled people are also used by non-disabled passengers, such as people with prams, pushchairs, luggage, shopping, and so on. In fact, these non-disabled users considerably outnumber disabled users; iv) The ergonomic performance of the facilities for disabled people was varied. Provision at new purpose-built stations was generally more satisfactory than at older stations taken over from British Rail, even where the latter had undergone some modernisation; v) Among disabled people who had not been on Metro, non-use appeared to be mainly due to poor overall mobility rather than any specific problems with Metro; vi) A social cost-benefit analysis nevertheless suggests that the total value of all benefits likely to accrue from the facilities for disabled people will, over time, offset the capital cost and also provide a social return on investment. This is mainly due to the large number of non-disabled, but "legitimate" users of these facilities. Costs per trip also compare very favourably with other forms of transport for disabled people.

Abstract:
Technological neutrality in law is, roughly, the idea that law should not pick technological winners and losers, that law should neither help nor hinder particular types of technological aItefacts. It has become an increasingly recognized principle in the international stage, adopted by courts, legislatures, governmental and inter-governmental organizations alike. The grounds on which the principle has been adopted, however, are yet to see more in-depth articulation. This thesis takes up the task of more rigorously questioning whether technological neutrality is a sound principle for law and policy making in the information age. It does so by asking both whether technological neutrality makes sense internally, as a coherent proposition of the institutional normative order, and externally, as an unsuspected manifestation of the much more established, if contested, idea of political neutrality. Internally, the thesis questions: i) the ability of the principle to itself enable law to survive technological change; ii) the coherence of excluding reasons concerning dimensions of technological altefacts beyond the utilitarian functions of these from incorporation by law; iii) the soundness of transforming an idea of vagueness into a general principle for law and policy making in the information age; iv) the extent to which technological neutrality fUlther exacerbates the already problematic idea of instrumentalism in law. Externally, after demonstrating the political contours of technological neutrality, the thesis questions: i) whether technological neutrality would be able to survive the challenges that have been levelled at political neutrality by authors of diverse theoretical affiliations; and ii) whether the normative articulation of new forms of authority in the background culture of the information environment calls on the state to protect personal autonomy in ways thl1t are incompatible with the exclusionary methodology of political neutrality. Technological neutrality, the thesis demonstrates, does not live up to these or other challenges that the thesis introduces.

O projeto de pesquisa âAcessibilidade da pessoa portadora de deficiÃncia fÃsica e / ou sensorial aos serviÃos de saÃde: estudo das condiÃÃes fÃsicas e de comunicaÃÃoâ tem por objetivos identificar as barreiras arquitetÃnicas que dificultam ou impedem o acesso do portador de deficiÃncia aos serviÃos bÃsicos de saÃde e aos hospitais gerias, procura, ainda, estudar as dificuldades de comunicaÃÃo entre estas pessoas e membros da equipe de saÃde. A participaÃÃo nesse projeto despertou para o tema e originou esta dissertaÃÃo, que tem por objetivo mapear as condiÃÃes arquitetÃnicas de acesso do portador deficiÃncia fÃsica aos serviÃos hospitalares na cidade de Sobral-Ce. O referencial teÃrico apÃia-se na Lei n 7.853 de 24/10/1989 que estabelece normas que asseguram o exercÃcio dos direitos individuais e sociais das pessoas portadoras de deficiÃncia e sua efetiva integraÃÃo social. Estudo quantitativo que utilizou instrumento de coleta de dados tipo cheque lista elaborado consultando a lei, foram incluÃdos no estudo os quatro hospitais gerias da cidade, a coleta ocorreu no mÃs de maio de 2004 e foram alguns dados documentados fotograficamente. A anÃlise estatÃstica constatou no que se refere Ãs suas adjacentes aos hospitais a ausÃncia de faixas, para pedestres e de rebaixamento de meio fio em pontos estratÃgicos (25 %); obras pÃblicas e particulares desprotegidas de tapumes (100%) , avenidas livres de buracos (50%); calÃadas que nÃo estÃo livres de buracos e desnivelamento (100%), placas de sinalizaÃÃo de trÃnsito visÃveis (75%); o percurso para a instituiÃÃo està sinalizado (100%); mas nÃo hà semÃforos em pontos estratÃgicos (100%). Quanto ao acesso ao hospital, possuem rebaixamento de guias (50%); ausÃncia do sÃmbolo internacional de acesso (100%); hà rampas de acesso (100%); escadaria sem corrimÃo (50%); as portas possuem a largura ideal (100%); as de vai e vem nÃo possuem visor (100%). As caracterÃsticas internas dos hospitais mostram que as Ãreas de circulaÃÃo possuem obstÃculos (100%), o piso das rampas à antiderrapante (50%); as rampas e escadas possuem corrimÃo (50%), mas fora do padrÃo legal. Um hospital tem apenas um pavimento os outros trÃs contam com 13escadas internas com degraus ideais; os balcÃes atendem a legislaÃÃo (80%) e assentos pÃblicos tambÃm (32%). Os bebedouros sÃo acessÃveis, mas os telefones nÃo. Conclui-se que hà barreiras arquitetÃnicas no percurso casa/hospital, no acesso direto ao hospital e nas suas dependÃncias internas. The search plan of the Nursing Department of the Federal University of Cearà called: accessibility of physically and/or sensorial deficient people to health care: the object of physical conditions and communication study is to point out any architectonic obstacles making difficult or obstructing any physically deficient people (pdp) to access basic health cares and general hospitals and study the communication problems amongst such people and health caring team members. My participation in such a plan called my attention to such a theme and gave rise to this dissertation, the objects of which are to map the architectonic conditions for the physically deficient people to access any hospital cares in the city of Sobral-CE and point out any internal architectonic obstacles and also in the hospitals for the physical move of PDPs. The theoretical system of reference is based on Law No. 7,853, dated 10/24/1989, which sets up rules to ensure the exercise of individual and social rights of physically deficient people and the effective social integration thereof. Such study is quantitative and used an instrument of data collection of check-list type made by consultation under law. Four general hospitals of the city were included in such study and data collections were performed in the month of May 2004. Some of them have been documented on photos The statistic analysis found out in connection with the areas around hospitals that there no crosswalks (100%) and lowering of curb at strategic points (75%); public and private works with no fence made of planks (100%); pavements with holes and unlevellings (100%); avenues with no holes (50%); visible transit signs (75%); the way going to the institution is signaled (100%), but there are no traffic lights at strategic points (100%). Concerning access to hospitals, there is no lowering of curbs (75%); there is no parking area for PDPs signalized with the International Access Symbol (100%); there is sloping roadway (100%), flight of stairs with no handrail (50%); doors are well sized (100%); swing doors has no appropriate visors (100%); the inner features of the hospitals show that the transit areas have obstacles (100%); the pavement on the outer sloping roadways are non skid. (100%); the inner sloping roadways and stairs have handrails available (50%) but not in compliance wit the lawful standard. One of the hospitals has one floor but the other three ones have three inner stairs; counters are in accordance with legislation (80%) and the public seats as well (33%). Drinking places and telephones are not accessible (95.5%) It was concluded that there are architectonic obstacles in the way from house to hospital, in the direct access to hospital in the inner rooms thereof. The legislation in force assuring the physically deficient people to access the health care has not been complied with. This means that the public service has obviously not been aware of such legislation and has been negligent. The health caring professionals who are also responsible for assuring the citizenship of such portion of population to be exercised have been negligent as well.

"This paper addresses the right to dignity of a group of people with two vulnerabilities i.e. being a disabled person and a prisoner. The concept of dignity applies to prisoners and detainees irrespective of their offences at any given time. This is a right that is ascribed to a person by virtue of one's humanity and not one's circumstances. In Ghana and Nigeria, the rights of able and disabled prisoners are not given serious consideration. This is probably due to the fact that these two countries are still involved in violations of human rights and they are yet to implement most of the provisions in international human rights instruments. The protection of the rights of disabled prisoners is a mirage in the two countries probably because they constitute a minority and their vulnerability relegates them to the lower rungs of the society. However, international human rights instruments recognise that disabled persons have rights that should be respected. ... Despite these international standards, the treatment of disabled prisoners is still below the recommendation. This necessitates a study of the role which human rights law ought to play in the mitigation of the hardship of disabled prisoners, as their dignity is a central element to their existence." -- Introduction.

This study aims to identify barriers to access and participation of adult internally displaced persons (IDPs) within the metropolitan area of Medellin, Colombia, as perceived by a sample of advisors, administrators and educators working with this population. Displacement often presents substantial barriers to education and IDPs fulfilling their human rights. These barriers and their underlying structures are analysed and compared to Cross' (1981) situational, institutional and dispositional categories, as well as corresponding the data to Maslow’s (1943) 5-scale Hierarchy of Needs.  The study found a variety of reasons why IDPs do not participate in education, and complex networks between these, which could be mapped to Maslow’s and Cross’ theoretical models. Lack of resources, cost/ benefit choices (both economically and in terms of time) and family obligations figure as much as poor prior study experience, literacy skills and confidence in one's own abilities. This is not surprising, and agrees with the literature regarding adult education of this population. This study aims to contribute to a complex model of deterrents to participation. A full model could be combined with existing knowledge to form a dynamic model of participation in adult education of the IDP population.

Abstract:
This thesis investigates two different approaches to improving access to the Web for visually impaired people: the design of Web content; and the presentation of content. The potential for improving the design of Web content was investigated in an evaluation of the usability of the Web Content Accessibility Guidelines of the Web Accessibility Initiative. Student Web page authors used the Guidelines to adapt Web pages containing various elements (such as images and tables). These pages were collated into a Web site, which was evaluated by visually impaired people. The page authors found it difficult to find the information they required in the Guidelines document, and had difficulties with implementing the advice of the guidelines. The visually impaired people who evaluated the pages found that the extent of the accessibility of the different elements varied depending on the individual’s experience of using the Web, and the software they used. The accessibility of some elements was not improved by the implementation of the guidelines. The potential for improving the presentation of Web content was investigated using a haptic device. The perception of virtual textures and objects by blind and sighted people via this device was examined. It was found that the virtual textures were perceived differently to the real textures examined in the literature, and that the blind people could better discriminate between the textures than the sighted people could. The virtual objects were explored from the inside and from the outside. It was found that objects generally felt larger from the inside than from the outside. This has been termed the ‘Tardis’ effect. The thesis concludes that it is difficult to define what we mean by ‘accessibility’. Without a clear definition it is not possible to judge whether a Web site is ‘truly’ accessible. The difficulties in making Web content fully accessible mean that additional methods are required for presenting the content in different ways. The researcher believes that haptic devices offer one such method, and could be particularly useful in presenting information that is visual in nature, such as information laid out in columns.

In Saudi Arabia, as in other Arabic countries, disabled people are prevented by exclusion and marginalisation from obtaining their clear rights. In advanced countries, principles of equality and human dignity determine the position whereby disabled rights are a matter for procedures of justice, not merely for charity. Therefore in the West effective antidiscrimination legislation operates to protect the disabled. By reference to Western concepts and practice, this thesis attempts to propose appropriate means according to Islamic principles to establish the rights of disabled persons and to rectify problems of discrimination against them in Saudi Arabia. The concept of disability is here understood broadly, in order to include a social model that takes account of the stigma of impairment attached to disabled persons, and the social restrictions this entails. The rights of disabled persons rest on principles of their fundamental interests and real needs, equal respect, self-esteem, autonomy and citizenship. To establish the case for these rights is to establish a case resting on dignity, equality and recognition which prohibits discrimination against the disabled. Discrimination refers to exclusion, all forms of denial of opportunities, harm, such as losing out on benefits, and distributive injustice. Distributive justice is required in order to address disability-based discrimination. Its principles of egalitarianism, resources, deserts and difference offer practical solutions to problems of discrimination. The 'difference principle', resources and other principles here are linked to 'reparative justice', for example, through the application of reasonable adjustment to enable disabled persons to enjoy their rights. The concept of the 'veil of ignorance' is applied to the position of disabled persons as a disadvantaged group, to discover what real concept of justice - according to their circumstances and needs - must be adhered to. The UN's 2007 convention on the rights of disabled persons reflects these issues in terms of human rights, and offers a reform agenda for international consensus. It also stresses raising awareness of the clear rights of the disabled without discrimination. Examination of the situation regarding disability in Saudi Arabia reveals a range of inadequacies both in services provided and in legal response. The British and American disability acts offer norms and models informed by justice as a blueprint for reform. When disabled Saudis become legal and autonomous rights-holders, the goal of this thesis will have been achieved.
