This chapter presents a thorough descriptive analysis of automobile fatal accident and insurance claims data. Major components of the artificial neural network (ANN) are discussed, and parameters are investigated and carefully selected to ensure an efficient model construction. A prediction model is constructed through ANN as well as generalized linear model (GLM) for model comparison purposes. The authors conclude that ANN performs better than GLM in predicting data for automobile fatalities data but does not outperform for the insurance claims data because automobile fatalities data has a more complex data structure than the insurance claims data.

Abstract During the mid-1980s most U.S. jurisdictions faced a crisis in the availability and affordability of liability insurance: premiums skyrocketed, sometimes by several hundred percent in one year; in some cases, coverage itself became unavailable. Total premiums for general liability insurance, which includes product liability, tripled in only 2 years in the mid-1980s, from $6.5 billion in 1984 to over $19.4 billion in 1986.2 Over the decade 1968-78, general liability insurance premiums written increased from $] .13 billion to $6.49 billion (a real annual growth rate of 8.8%). From 1979 to 1988, premiums increased from $6.61 billion to $19.08 billion (a real annual growth rate of more than 4%)..Between 1975 and 1989 the number of product liability claims filed annually in federal district courts increased from 2,393 to 13,408 (a 460% increase) and from 2.04 to 5.76 as a percentage of all federal civil cases over this period.. Average product liability jury awards increased from $195,020 in 1971 to $1,535,944 in 1988, and median awards increased from $71,500 to $405,000 over this period, an annual increase in real terms of between 4% and 6%..However, some scholars have argued that the perception of a crisis in product liability is unfounded. Corley and Hanson contend that empirical evidence does not support a negative interpretation of the above cited trends and that the expansion of product liability in fact furthers the deterrence and insurance goals of tort. While not disputing the statistics themselves, Corley and Hanson argue that the rise in insurance premiums represents an internalization of costs that had been externalized prior to liability expansion; thus, the rising costs of insurance and withdrawal of products from the market evidence a shift to a more efficient level of deterrence..

Insurance fraud has been identified as a significant risk that undermines investor and customer trust. This chapter examines the effect of insurance fraud on the financial performance of the insurance industry of Tanzania. A standardized questionnaire was used to conduct a survey of 119 insurance companies and brokers. The data were analyzed using the multiple regression technique. The findings reveal that policyholder fraud, internal fraud, and intermediary fraud have a negative effect on the financial performance of insurance companies and brokers. Fraudulent documents, customers demanding significant compensation relative to the actual damage, a fake accident, weak internal control, employee dishonesty, poor staff compensation, ineffective supervision, and the inability to detect fraud were the causes of insurance fraud. In order to reduce insurance frauds, it is suggested to (1) thoroughly evaluate claims, (2) establish a transparent anti-fraud bureau, (3) use information technology for effective internal audit, and (4) implement a comprehensive internal fraud policy.

Abstract The crisis in the mid-1980s in the availability, affordability, and adequacy of liability insurance in the United States and to a lesser extent in Canada, and the widespread public attention that has been generated in the United States in a number of huge mass tort claims, such as the asbestos, DES, and Agent Orange litigations, have precipitated much anguished political, judicial, and academic soul-searching as to the goals and future of the tort system, especially with respect to personal injuries. While some scholars have questioned whether the perception of a so-called litigation explosion in recent years is empirically well grounded,. calls for a re examination of the tort system and its alternatives continue unabated.. In any event, the pervasiveness and cost of accidents underscore the immense importance of law and policy decisions in this area. One of every four Americans is injured each year. In 1985, million Americans were injured seriously enough to require medical attention or to restrict their activities, and 143,000 of these died from their injuries, making injuries the fourth leading cause of death in the United States.. One study estimated the cost of injuries in the United States in 1985 to be $182 billion (in 1988 dollars).. This book documents the ways in which the traditional tort regime has come underseige on a number of different fronts. While upward trends in frequency and size of claim have been less dramatic for automobile accidents than for other accidents, concerns over escalating costs of premiums-which most drivers must payhave led to questioning of various features of the tort system, as well as proposals for partial or total replacement of it by various forms of no-fault compensation schemes. Although medical misadventure is still ostensibly governed by a negligence regime, the frequency and size of both medical malpractice claims and insurance premiums have escalated dramatically in the last two decades. In turn, this escalation has led to criticisms that the tort system has induced enormously expensive forms of defensive medicine rather than cost-justified improvements in precautions. Again, as in automobile accidents, commentators have urged either major tort reforms or the replacement of tort with some form of no-fault compensation scheme.

Our concern with accidents and their consequences seems to have increased over the past few years as newspapers have frequently reported on lawsuits for damages from plane crashes, product malfunctions, medical malpractice, workplace accidents, even tearing down football goalposts or being hit by a foul ball at a baseball game. In recent decades there has been a legal revolution in liability law that has increased the share of the victim’s accident costs paid by employers and producers. While changes in liability law might aid the unfortunate victims of accidents, they may also lead to unintended consequences, like a sharp rise in product prices or a curtailment of some activities. Some claim, for instance, that a rise in the cost of malpractice insurance has led to a shortage in obstetricians to deliver babies. We can learn more about the unintended consequences of liability reforms by studying an earlier revolution in liability: the introduction of workers’ compensation for workplace accidents.

Abstract Although most torts are committed by individuals, almost all damages are paid by companies, usually employers or insurers: individuals are rarely worth suing unless they are either employed or insured. Insurance against liability is compulsory for motorists and also, in respect of injury to their workforce, for employers. This deals with two of the main sources of tort claims, traffic, and industrial accidents. Furthermore, people often take out liability-insurance of their own accord and for their own protection: employers generally have insurance against liability to the public, and many householders have policies which cover them and sometimes also the members of their household against liability to third parties. This helps to explain the frequency of claims under the Occupier’s Liability Act 1984. There is one important distinction between employers and insurers as regards their liability: whereas the employer can be sued directly at common law and his liability is regarded as part of tort law, the victim has no common law claim against the tort-feasor’s insurer and has a statutory claim only if he has first obtained judgment against the tort-feasor himself. The insurer’s role is consequently often overlooked.
