Full textExpertise is a tool used by the judiciary for additional technical information or better accuracy can be cleared and can be assist in making decision sentence. This study is the proposal to examine case law reports of the labor courts in order to determine how important the medical/dental expertise has been for decision making by the judge. This is an observational, cross-sectional, descriptive and analytical study that was conducted through the data of document analysis. Seventy-two cases of labor claims have been assessed and the selection was carried out eliminating the repeated menus and actions for collective bargaining resulting in 38 cases from 1996 to 2014. The variables \"WRMD as a result of damage\" (p=0,1723), \"Medical/dental Expertise\" (p=0.1504) and \"Technical Expertise\" (p=0.1975) were able to elaborate adjusted model with the use of multiple logistic regression, backward method, with 95% confidence interval. The variable Medical Expertise\"(OR= 14,5319; IC 95%= 2,3263 to 90,7780) and \"WRMD as a result of damage\" (OR= 7,8989; IC 95%= 1,2755 to 48,9151) remained in the final model adjusted, revealing that the chance of the judge require expertise is 14 times more than when it is the medical /dental type and when the damage suffered involves WRMD there is 7,89 times more chance to the judge accept expertise. The analysis of the adjusted model with use of ROC curve was found to be very good its predictive capacity (AUC= 0,8661; SE= 0,06194; IC 95%= 0,7163 to 0,9545). The medical/dental expertise is of high relevance to labor actions, characterized as a essential proof for decision making by judges.

Os documentos de notificação utilizados foram a Comunicação de Acidente do Trabalho, CAT, para os acidentados cobertos pelo Seguro Acidente de Trabalho, SAT, e Relatório de Atendimento ao Acidentado do Trabalho RAAT, para os não cobertos. Propôs-se modificação do RAAT, visando aprimorá-lo para melhor especificar a inserção do trabalhador no mercado de trabalho e o diagnóstico da lesão. Descrevem-se aspectos da organização do Hospital das Clínicas relevantes para a análise da implantação do sistema de captação. Discutem-se peculiaridades, dificuldades e limitações relacionadas à dinâmica de funcionamento de um hospital escola, apresentando-se algumas hipóteses explicativas. As informações obtidas através das notificações possibilitaram analisar os 275 acidentes captados no período do estudo (julho de 2004 a agosto de 2005). Houve predomínio de acidentes do trabalho tipo ou típicos: 81,1% dos casos. Quanto ao instrumento de captação, 76% dos casos foram registrados por meio de CAT e 24%, de RAAT. Com relação à inserção do acidentado no mercado de trabalho, observou-se que a informação havia sido registrada em 149 (54,2%) notificações, dentre as quais 123 eram empregados regidos pela Consolidação das Leis do Trabalho. Este estudo revelou a existência de numerosos acidentes pérfuro-cortantes em empregados de empresa de limpeza hospitalar, que exerciam atividades no Hospital das Clínicas, o que evidencia descarte inadequado de pérfuro-cortantes neste hospital... Full textDespite frequent disputes about the regime for work accidents and occupational discases (AT-MP), no in-depth study attempting to define this system's legal nature has been undertaken so far. Yet, the precise identification of the way the regime operates seems necessary to properly discuss the relevance of its rules, and contemplate its future. Striving to contribute to the debate, this study endeavors to situate the AT-MP regime within the broader framework of compensation law. The regime cannot, as has tradicionnally been the case, be conceptualized opposite civil liability -nor can it be assimilated to this system. Rather, it provides an original compromise bringing together liability and the need for social guarantees. Based on this analysis, one may assess the hurdles facing the incorporation of the AT-MP regime within compensation law, and appraise the relevance of the varions political proposals that have been put foward to this end

Full textThis empirical study, on the law area, analyzed the decisions of the labor courts to know the role that this institution has done on the prevention and indemnity of work accidents, as well as at identifying whether the theoretical and legislative progress made, consistent in juridical instruments available to promote protection of life of workers and accountability of those involved, are being used in court practice. This study aims at understanding the role of labor courts on the accountability by work accident or occupational disease and the prevention of new accidents as well as check for criminal convictions of those responsible for this type of injury. The basic unit to analyze this role are the judicial processes and decisions, which are tangible records of the influence that the judiciary has played and how this sector acts. The exploratory quali-quantitative research collected data through online queries of the jurisprudence database of four Brazilian courts, two of São Paulo state and two nationwide (TST, TRT2, TJSP and STJ). This decisions were published in 2015. The judgments about work accidents and occupational diseases had their foundations and results analyzed and categorized. Two methods of analysis were used: Comparative Analysis, in which the value of the conviction and duration of the judicial decisions process of the same period in state labor courts was compared, and Grounded Theory, in which the coding began inductively, from the reading of data from the judgments of all courts. The results showed that the issues of Health and Safety do not have found suitable approach in jurisprudence Brazilian labor, and the preventive protection of work accidents and occupational diseases is timidly used by legal legitimated. In labor indemnity actions, two different situations were found. The regional court confirmed the initial hypothesis of attachment to forensic reports and accountability of workers by the accidents and with small charge of convictions when the responsibility of the employer was recognized. In the nationwide court, the results indicated uniformity of jurisprudence in order to use the theory of risk (strict liability) in segments or functions with high risk, and theory of guilt (subjective responsibility) in other cases, but with presumed guilt of the employer.

Full textThe Department of Education, by the number and the variety of the statutes of itsstaffs, constitutes a laboratory of study interesting on the conditions of employment of thecivil servants, notably when they are victims of accidents or diseases on the occasion of theirprofessional activity. Rules stemming from the Labour Law and from the law of the publicservice and the crossed intervention of multiple actors make complex this type of dispute.New occupational hazards (suffering in the work, professional cancers) add, which are inphase of legal and social recognition.The prevention of the occupational hazards became a preoccupation of authorities, aswell as the health in the work in the public service. The study of this risks could pull a betterrecognition of the professional accidents and the diseases, which suffers at present from acomplex administrative process worsening the principle of legal security. Finally, the repair ofthe occupational hazards always leads to disparities according to the facts of the origin of theaccident or of the disease, the status of the agent or the gravity of the damage. The overtakingof the rule of the fixed price of pension terminates certain injustices but house of the limitedreach.The link with the general regime could make the civil servants of the assumptionbenefit of imputability. The implementation of a Fund of compensation benefiting to all thecivil servants and having for vocation the repair of all the professional risks could allow thevictim of this risk to obtain a complement to compensation, allowing a complete repair of thedamage
