Full textFrom the well-known court rulings pronounced by the Social Chamber of the Court of cassation on July 10th 2002, the most notorious is the reversal of jurisprudence about non-competition clauses inserted into an employment contract: to be valid, these stipulations now have to satisfy several cumulative conditions, among others the payment, to the employee, of a financial compensation. But the visa – never seen before – of the “fundamental principle of free exercise of a professional activity” didn’t get as much attention. For some people, this norm was just a substitute of more classical principles (as the principles of freedom of work, of freedom of trade and industry, or of freedom of enterprise), while others found the real foundation of these rulings in article 1131 of the Civil Code, that requires that any obligation has a cause. However, this principle of free exercise of a professional activity recognized in these decisions and used in a series of subsequent court rulings is a major contribution.Through this norm – without detailing its textual foundation – the Court of cassation built the non-competition clauses’ rules in labour law and drove a real case law policy. Furthermore, thanks to this norm, the validity of other clauses and other practices was questioned. The promotion of this norm makes it a singular element of positive law, able to improve many discussions and to govern many legal cases, beyond salaried work relationships. Also, its advent and conquests pertain to largest phenomena which affect the French legal order, for example its constitutionalization. Its topicality as well as its potentialities required to devote a study to this authentic “principle”, in order to identify it accurately and to evaluate its impact

Full textThe aim of this work is to study the professional ubiquity of Lebanese lecturers who are also working as entrepreneurs. The literature review is organized around the themes of acadepreneurship, the theory of displacement and the concept of strategic vision.Then, the legal framework related to the studied phenomenon, the scientific research and the Lecturer profession in Lebanon was studied.A preliminary study was carried out in order to identify a sample of the largest possible number of respondents.Then, in the light of the data collected from about a hundred Lebanese lecturers, five respondents were identified, giving that six were contacted upstream. Eleven individuals are subject to the qualitative study.The results of the qualitative study show that the lecturer's career satisfaction depends on his profile, spouse's profession and some indirect compensations offered by his academic institution. They also indicate that the majority of the lecturers are not satisfied by the amount of pay offered by their university.On the other hand, Ph.D. holders generally pursue a strategic career path and their entrepreneurial activity has been created before the start of their academic career, unlike those who do not have a Ph.D.Professional ubiquity is sustainable when thoughtful and when it doesn’t require any manual work. Finally, lecturers who do not carry out any research project as part of their academic career are usually looking for social reputation

Full textThe community of property is inadequate for couples where each spouse has a professional activity, as they represent today most of married couples. Spouses who have community of property face various difficulties. Some arise from imperfections that can be corrected without affecting the system’s coherence. Others are, by contrast, caused by the legal regime’s fundamental flaw, the article 1413 of the civil Code. This article has a key role in the rules of liability and has close links with the other provisions of the regime, making important changes necessary for who wants to adapt the legal regime to professionally bi-active couples. Follows a forward-looking approach that aims to elaborate solutions made to give both spouses the possibility to keep the assets purchased thanks to their work and to have an independent professional activity. Despite its shortcomings, the present legal regime has undeniable qualities. A first series of proposals tends to improve the spouses’ situation, especially those who have an independent professional activity, by limiting the scope of the principle formulated in the article 1413 of the civil Code without eliminating the principle of concurrent management which is its corollary. However, an overall redrafting of the legal regime would be more likely to meet the needs of the professionally bi-active spouses. Given the French people’s commitment to the principle of community of property, the proposed new legal regime would keep this nature, but it would nevertheless allow the reinforcement of the spouses’ independence and autonomy

Full textBetween 1890 and 1914, there has been a deep upheaval in Russia as well as on the international political scene : new alliances set up in Europe, Russia experienced in 1905 one of its worst defeat versus Japan and, from1906, the Russian Empire modified its governmental organization by setting up a semi constitutional system. The Russian Foreign Office was shaken by these changes : the Russian diplomats, as well as there European colleagues, felt the necessity to reorganize the structure of the diplomatical apparatus. These reforms, set up in 1907, coincided with the arrival of a new generation of diplomats, younger and better educated than their predecessors, at the head of the Foreign Office. The perception they had of their duty influenced their work and their expectations. From this time on, the high-ranking civil servants refused to have merely an executive power. They wanted also to be part of the elaboration of the foreign policy doctrine as well of the governement life

Full textVocational guidance was developed in successive stages in the course of the 20th century. While it focussed on the measurement of skills in order to guide the person towards an appropriate trade until the 1960s, it subsequently acquired a more educative definition, where more emphasis was laid on educating the person to guide themselves. Some studies of the support given to job-seekers (Revuz, Boursier) have brought out the possibility, available to guidance counsellors, of relying on a clinical approach. The author of this thesis attempts to make that approach towards the guidance interview clearer, by reference to the different types of clinical work completed in the area of human sciences - psychology, sociology, psycho-sociology and life history. At the same time, some references provided by the contributions of Vermersch in the "explicitation interview" and Clot in the "activity clinic" could be integrated to the approach. The clinical approach towards the guidance interview is intended to be multireferential, in that it uses a variety of methods from the different disciplines, each of which throws light on the different processes involved in the interaction between the counsellor and the counsellee - learning, exploration of the past, interventions by the counsellor, awareness, meaning vested in a trade, transference and counter-transference etc. Seven cases of support are analysed on the basis of actual interviews that have been reconstructed from written notes. These detailed analyses bring out the diversity of the work of the counsellor and the "complexity" of the specific situation of each job-seeker. They raise a number of questions and open avenues for research that can only be touched upon in this practical analysis. The clinical approach to guidance counselling, taken as a practical-poetic activity (Castoriadis), can therefore enrich educative guidance by analysing the dimension of dialogue that is built in the course of the relationship

Full textMonitoring practice is a learning object whose conceptualization is still unstable in information science. Mainly studied in management science in the context of professional practices, studies on monitoring practices in everyday life seeking situations, (in a personal and non-professional approach), or « amateur » practices remains limited to date.Our research focuses on the current practice of online monitoring and seeks to empirically demonstrate the emergence of « amateur » practices and everyday life seeking practices. Our central hypothesis is that the professional practice in the iterative and continuous monitoring of the environment, has found a place in everyday information practices of Internet users. Two central issues concern us: who are the current watchmen and what are their motivations. Indeed, our work is based on two structural axes: monitoring as an informational practice and as an amateur watchmen practice. Our methodology is based on a corpus of semi-structured interviews with seventeen watchmen professionals and seventeen watchmen amateur between 2012 and 2014. Our analysis of thematic content is structured around two focal points : professional watchmen versus amateur watchmen, and professional monitoring versus everyday life monitoring.Our results show a diversification of online intelligence practices, information needs singular characteristics, the use of confidence criterion for the selection of human sources, and practice conducive to sérendipiennes discoveries. In addition and more focused on everyday life seeking practices, we note first, three major informational reasons : an easiest and constant collect of information, a way to capitalize information, and a way of learning, and secondly an expressive dimension, through the setting visibility of its interests and in the act of sharing
