At the same time, it negated the intention of Parliament which represents majoritarian interests. The Constitutional Court is, in contra-distinction with Parliament, unelected. Abstract:
This thesis examines the role of legal institutions in enforcing the Environment Conservation Act in Bangladesh. Applying the legal analytical method, it analyses in public law perspective how the Department of Environment, the High Court Division of Bangladesh Supreme Court, and the Special environmental courts enforce this law. The thesis argues that these legal institutions can enforce the law effectively if they adhere to the rule of law norms, particularly legitimacy, fairness, and justice in adopting environmental legal actions and measures. Effective enforcement of the law also requires

On June 26th, 2015 the United States Supreme Court handed down a much anticipated decision answering whether or not the Fourteenth Amendment of the Constitution requires a State to license a marriage between two people of the same sex.[1] In a divisive 5-4 decision, the majority ruled that marriage as a fundamental liberty applies to same-sex couples. Although, Obergefell v. Hodges was facially related to the LGTBQ movement, in reality, this case was pivotally about the Supreme Court's role in our society. This thesis aims to assess the role played by disagreement in the High Court???s constitutional law decisions. It does so firstly by considering the theoretical arguments in favour of allowing expression of dissent and those which urge judicial restraint and observance of precedential values. The tensions between change and conformity, and also the individual and institutional aspects of adjudication, intersect when the Court divides. The complex nature of disagreement on a multimember judicial body is further examined in the context of devising an empirical methodology for the quantification

The replacement of traditional seriatim opinions with an "Opinion of the Court," offers what initially appears to be an interesting but seemingly trivial characteristic of American law. In fact, this departure from convention represents an exceptional shift in the behavioral actions and expectations of American appellate judges. This switch in the method of judicial communication is an exemplar for the belief that institutions, and the rules that regulate them, matter seriously. Failure to appreciate and insist upon "sincerity" as a distinctive judicial trait has impoverished historical and st
