This chapter provides a brief review of selected settlement bargaining models in some areas where new work is developing and where additional work is likely to yield further important results. The focus is on what might be thought of as the environment of the settlement negotiation process, where bargaining failure generally results in trial; this perspective is used to organize the work discussed. The chapter considers the impact on settlement and trial of procedural strategies such as motions for a preliminary injunction, permissive joinder, and discovery and disclosure; pre-trial investments, either by the parties themselves, or by third parties; and the delegation of bargaining authority to the plaintiff’s attorney.

Abstract:
This article describes the experience of reconstruction of a ship built by a seventeenth century ship builder. The lower hull and partial cargo of La Belle were discovered in 1995 and excavated within a dry cofferdam. The hull was documented, disassembled, and subjected to additional recording and reassembled in order to conserve it as a unit. On the basis of the present remains, the hull was reconstructed and several aspects of design and construction were understood. The discovery of new information, whether in the process of the reconstruction of the archaeological remains or from documentary research, necessitated a reexamination and/or a reworking of earlier recordings, preliminary reconstructions, and working hypotheses. Studying the design of La Belle was to a great extent a circular process—much like a design spiral in modern naval architecture.

Abstract:
This chapter critically examines recent legislative proposals to reform patent litigation in the United States. It begins by providing background on the dynamics that are driving the calls for reform, including complaints about so-called patent trolls. It then reviews proposed bills that would, among other things, impose heightened pleading standards on plaintiffs, limit discovery, and create a presumption that the loser should pay the winner’s attorneys’ fees. After surveying many recent changes to patent law already made by the courts and by Congress in the America Invents Act, the chapter concludes by arguing that additional legislative reform is largely unnecessary. Rather, Congress should focus on discrete problems in patent litigation that the courts may be unable to solve on their own, such as the unusually heavy concentration of cases in the rural Eastern District of Texas.

Abstract:
This chapter defines do-it-yourself urban design in detail. It does so first in contrast to existing social science perspectives (in sociology, criminology, art criticism, psychology, and critical theory) on unauthorized urban space interventions more generally: place-based direct actions that challenge normative uses of particular urban spaces. It argues that DIY urban design is distinct in its intentions and its form. The chapter describes the process of inquiry and discovery at the outset of the research and initial observations. Definitions for other key terms, including informality and formality, are also given. Additional findings about the actions themselves and the people who create them flesh out the definition while introducing some points of distinction among types of DIY urban design activities. Three main categories of DIY urban design are described: spontaneous streetscaping, renegade renewal, and aspirational urbanism. The discussion raises many of the questions that guide the remainder of the study.

Abstract:
The best proxy for the end of epilepsy is the complete cessation of seizures and the permanent ending of the need for further treatment. This marks the end of the biology of epilepsy, but not necessarily of all its societal consequences. The good news is that today over 80% of people developing epilepsy will reach this goal after a few years of treatment. Unfortunately, though, not all patients can reach this point, and it is for these patients that we seek improvements in the future. The end of epilepsy is not always easy to predict at the beginning. The taking of drugs is an issue, as always, of risk versus benefit, and although there are some benefits to discontinuation, this has to be balanced against the risk of seizure recurrence. Even if drugs alone don’t work, additional surgery may end epilepsy in as many as one in four people with amenable epilepsy. New thinking and new strategies for drug treatment, which not only control seizures but also address the underlying processes resulting in epilepsy, offer new horizons. The bottom line is that a revolution in discovery and development is needed. Epilepsy is, as pointed out throughout this book, more than having seizures, and so thus the scope of its treatment should be broader than simple seizure suppression. The end of epilepsy is, like the end of the rainbow, on the horizon, but equally tantalisingly difficult to reach.

Magnetic resonance imaging (MRI) provides excellent anatomic detail and soft tissue contrast for the evaluation of patients with renal disease. MRI needs longer scan time than computed tomography (CT); however, no radiation is involved. Gadolinium-based contrast agents (GBCAs) are used to help provide additional image contrast during MRI. MRI is indicated for characterization of renal mass, staging of malignant renal neoplasms, and determination of vena cava involvement by the renal tumour. Magnetic resonance (MR) angiography is widely accepted as a non-invasive imaging work-up of renal artery stenosis. MR urography is an alternative to CT urography to assess the upper urinary tract but does not identify urinary calculi. Diffusion-weighted imaging is a functional MR technique being used to characterize parenchymal renal disease and renal tumours. Nephrogenic systemic fibrosis is a rare but debilitating and potentially life-threatening condition which has been linked to exposure of GBCAs in patients with severe renal insufficiency. The risk versus benefit must be assessed before proceeding.

Abstract:
Biomarker testing in the evaluation of a patient with acute chest pain is best established for cardiac troponins that allow the diagnosis of myocardial infarction, risk estimation of short- and long-term risk of death and myocardial infarction, and guidance of pharmacological therapy, as well as the need and timing of invasive strategy. Newer, more sensitive troponin assays have become commercially available and have the capability to detect myocardial infarction earlier and more sensitively than standard assays, but they are hampered by a lack of clinical specificity, i.e. the ability to discriminate myocardial ischaemia from myocardial necrosis not related to ischaemia such as myocarditis, pulmonary embolism, or decompensated heart failure. Strategies to improve clinical specificity (including strict adherence to the universal myocardial infarction definition and the need for serial troponin measurements to detect an acute rise and/or fall of cardiac troponin) will improve the interpretation of the increasing number of positive results. Other biomarkers of inflammation, activated coagulation/fibrinolysis, and increased ventricular stress mirror different aspects of the underlying disease activity and may help to improve our understanding of the pathophysiological mechanisms of acute coronary syndromes. Among the flood of new biomarkers, there are several novel promising biomarkers, such as copeptin that allows an earlier rule-out of myocardial infarction in combination with cardiac troponin, whereas MR-proANP and MR-proADM appear to allow a refinement of cardiovascular risk. GDF-15 might help to identify candidates for an early invasive vs conservative strategy. A multi-marker approach to biomarkers becomes more and more attractive, as increasing evidence suggests that a combination of several biomarkers may help to predict individual risk and treatment benefits, particularly among troponin-negative subjects. Future goals include the acceleration of rule-in and rule-out of patients with suspected acute coronary syndrome, in order to shorten lengths of stay in the emergency department, and to optimize patient management and the use of health care resources. New algorithms using high-sensitivity cardiac troponin assays at low cut-offs alone, or in combination with additional biomarkers, allow to establish accelerated rule-out algorithms within 1 or 2 hours.
