Abstract:
Achieving constitutional unity (expressed by the adoption of the Constitution on March 29, 1923) and legislative unity (in three steps, especially by extending the regulations of the “Old Kingdom: 1928, Bessarabia, 1938 – Bukovina, 1943 – Transylvania) stand as major national acts related to the process of completion the political union of 1918 and consolidating the Romanian national unitary state. They have caused ample debates, facing, in specific terms, beyond conjunctural interests and priorities, there major legal visions and conceptions regarding justice in the Europe of the times, present in the reunified Romania: the neo-Latin, majorly formalist; the Austrian, of “material justice”; and, respectively, the Russian, of a strongly social nature. If regarding the necessity and even the urgency of legislative unification there has been a unanimous standing, the disputes concerned the method of realization, and regional resistances have delayed its effective and full realization. The experiences generated by these contexts – from the four draft projects of a constitutional pact, to laws for partial unification, and successful – the Criminal Code and the Criminal Proceedings Code of 1937 – or failed – the Civil Code, the Civil Proceedings Code and the Commercial Code, adopted in 1939-1940 but their entry into force delayed sine die, the sole imposed solution being eventually the extension of the regulations of the “Old Kingdom” over the unified provinces – bear as well several important scientific and cultural meanings. The have confirm the creation of a Romanian model for juridical development, built upon the Romanic inheritance, the adhesion to the neo-Latin juridical modernity, under its own print, consolidated and diversified by the receptions and synthesis of the juridical inter-war unification. The same unifying context, of European synthesis and national affirmation, gave birth to a Romanian school of law and a national jurisprudence. The traditions the configurated and completed have generated the landmarks of a juridical identity that have endured over time, with the specific nuances, and serve today as indispensable orientation in accepting and expressing the European integration and the generalized globalization, perceived as hybridizing and dialogue, and not as a one-sided obtrusion and deletion of national legal specificities.

Abstract:
Endothelium forms an inner layer of vascular wall. It plays an important role in inflammatory process, regulation of vascular tone, and synthesis of thromboregulatory substances. Leukocyte and endothelium interactions during inflammation are regulated by different families of adhesion molecules. Increased levels of soluble forms of adhesion molecules have been detected in the circulating blood in conditions such as autoimmune diseases, transplant rejection, ischemia-reperfusion injury in addition to neutrophil- and endothelial membrane-bound forms reflecting the level of endothelial dysfunction. It is known that endothelial dysfunction is a risk factor for ischemic events such as stroke, myocardial infarction, unstable angina pectoris, ventricle fibrillation, necessity of revascularisation procedures, and death from cardiovascular reasons. Clinical studies showed that cardiac surgery has an impact on vascular endothelial function as well. The amount of endotheliumderived soluble forms of vascular-1 and intercellular-1 adhesion molecules increases after cardiopulmonary bypass suggesting endothelial dysfunction. However, further investigations are needed to be done to support the evidence that endothelial dysfunction proceeding heart surgery is one of the reasons of tissue ischemia-reperfusion injury.

Abstract:
The adhesion force between rail and wheel is one of the important factors for proceeding towards the realization of high-speed railway. On the other hand, it is supposed that the water film formed between the rail and wheel has a remarkable influence on the adhesion force under rainy condition at higher speeds. In this paper, taking Bett and Cappi's viscosity values of water, which show quite a different behaviour from the viscosity of oil, the influence has been investigated of important factors such as rolling speed, contact pressure and temperature on water film thickness for a smooth surface by applying elastohydrodynamic lubrication theory. Based on the numerical solutions, an empirical equation has been developed for water film thickness relating to rolling speed, load and material parameter by using a linear regression method and comparing it with other authors' works on a lower material parameter or elastic-isoviscous contact. Furthermore, in order to understand the influence of the above factors and the surface roughness on the adhesion force, adhesion coefficients have been calculated on a trial basis in the case of rough surface contact under limited conditions, and the theoretical results have been compared with the measured values of the tests on Japanese Shinkansen vehicles in the field.

Dental adhesives are bonded to a wet surface of live tissue, dentin. There are two important stages of surface preparation for adhesive application: 1) Etching the tooth structure creating a layer of collagen network free from mineral, and 2) Applying a primer, in this case a water solution of hydrophilic monomer of 2-hydroxyethylmethacrylate (ScotchBond Multipurpose®, 3M). During the priming stage, the resin monomer should penetrate the fibril network and coat collagen fibrils. Subsequent adhesive resin penetration into the collagen network (hybrid layer) is not uniform, influenced by the presence of residual water and degree of resin polymerization. Dependence of bond strength of dental adhesives on time or intensity of light activation is well known, but no direct microscopic observations of the dynamics of polymerization were performed. This was due to the fact that during specimen dehydration for conventional SEM the polymerization process is still proceeding and residual monomer could be washed out.

It was found that in an osteoporotic bone the fraction of nanosized pores decreases, the mineral phase amorphizes, hydrated shells around mineralized particles of the bone matrix thicken, and adhesion forces increase. This contributes to the formation of water clusters similar to bulk water clusters compared to the healthy bone tissue and leads to the accumulation of more viscous liquid with increased intermolecular interaction forces in the pores of the bone matrix. Given this, the rates of chemical reactions proceeding in the water phase of ultrathin channels of general parts of collagen fibrils decrease. Ultimately, nanopores of collagen-apatite interfaces lose, to a certain extent, the capability of catalyzing the hydroxyapatite crystallization.

Abstract:
The polymer formation proceeding with the participation of cardosilazaoxane organosilicon oligomers are considered. By the interaction of cardocyclic silazaoxanes with organosiloxane diols, new types of organosilicon oligomers are synthesized. They are capable to form elastic spatial-netted structures due to polymerization processes with the discovery of cyclic siloxane fragments without isolation of low molecular weight by-products. The influence of temperature and the silazaoxane: diol ratio on the nature of the products formed is studied. It was established that at 120-130 °C soluble oligomers of cyclolinear structure are formed, which are structured at 180-190 °C, with the most dense network structure being formed when the silazoxane: diol ratio is close to equimolar; a certain excess of hydroxyl groups at the final stage of polymerization leads to the association of the released ammonia with OH end groups and the formation of nucleophilic particles at the ends of the polymer chains – siloxanolate anions, possibly initiating structuring. The formation of regular three-dimensional structures – polysilazaoxanes, initiated by siloxanolate anions without the use of a special catalyst, is a new approach to the creation of adhesive compositions. In this case, in contrast to catalytically cured siloxane analogues, the resulting cross-linked polymer structures exhibit enhanced adhesion to the substrate material. Such polysilazaoxane oligomers can be used: a) as a basis for adhesives, only thermal effects and compounds containing siloxane films and coatings with various metals and characteristics can be used as a catalyst; b) for hydrophobic impregnation of textile materials and leather half-finished products, since this is clearly ammonia, which does not have a destructive effect on them.

Abstract:
Le professionnel que l'on croyait capable de défendre ses intérêts, par opposition au salarié ou au consommateur, s'est révélé tout autant victime de contrats déséquilibrés depuis quelques décennies. L'apparition de puissantes entreprises privées dans différents secteurs entraîne, de toute évidence, une inégalité entre les professionnels. Notre étude souligne la complexité de trouver un juste critère pour identifier de manière juste ce qu'est un professionnel partie faible. Il n'est pas possible de dire si, de manière générale, telle entreprise est plus puissante qu'une autre, car la personne morale partie au contrat peut cacher des intérêts difficiles à cerner au premier abord. Le juge ne peut pas non plus être l'arbitre autoritaire des prix sans risquer un détournement de sa fonction. Nous développerons le parti suivant : un contrat entre professionnels est dit d'adhésion lorsque celui-ci n'a pas donné lieu à une négociation idoine ; le juge doit alors s'efforcer de regarder le processus de pourparlers ainsi que les circonstances qui ont précédé la convention. De multiples critères peuvent aider le juge, tels que la taille de chaque entreprise, les parts de marché, les propos échangés par les parties, leur bonne ou mauvaise foi ou encore les efforts engagés par elles. Si le choix de l'analyse des négociations nous apparaît ultimement le plus juste, nous tiendrons cependant compte de ses limites. Il serait illusoire de penser que le juge peut toujours parvenir de manière certaine à connaître l'intégralité des circonstances antérieures au contrat. C'est pourquoi nous ajouterons à l'analyse des négociations un système de présomptions - quoique réfragables - lorsque la disproportion des prestations ou la différence de taille des entreprises ne laisse pas de place au doute. Nous mettrons enfin en lumière les stratégies employées par les parties fortes pour contourner cette analyse des négociations, comme des stipulations néfastes ou une tactique d'internationalisation. Il sera donc préféré une impérativité renforcée en droit national ainsi qu'en droit international. Une fois l'analyse des négociations effectuée, nous essayerons de proposer des sanctions à la hauteur du phénomène. Le juge, selon nous, doit être en mesure de modifier le contrat de façon souple, aussi bien de manière rétroactive que par un changement en cours d'exécution du contrat. Le caractère extrême de certains comportements contractuels nous incite à réfléchir à la possibilité d'un droit pénal plus dissuasif ou bien un droit « quasi pénal » sanctionnant ces comportements de manière plus appropriée. Néanmoins, c'est surtout au niveau de la procédure que se joue la protection contractuelle des professionnels. Un référé ajusté à cet objectif a tout lieu de répondre aux exigences de célérité qui gênent les parties faibles dans leurs démarches. Nous soulignerons aussi l'importance d'un système d'actions collectives qui surmontent efficacement l'écueil du coût du procès. À l'inverse, la sécurité juridique des entreprises nous conduira à proposer une procédure de protection par un système de droit doux. Première partie : L'identification du contrat d'adhésion entre professionnels. Deuxième partie : Le traitement judiciaire des contrats d'adhésion entre professionnels
The professional, supposed to be able to defend his interests, by opposition to the employee or the consumer, has proven to also be victim of imbalanced contracts for a few decades. The emergence of powerful private companies in various sectors clearly leads to inequalities between professionals. Our study underlines the difficulty to find the best criterion to identify what a professional weaker party is. It is impossible to say that globally such company is stronger than another because the legal person party to the agreement can hide many interests, which are hard to seize at first sight. Nor can the judge arbitrate prices in an authoritarian way without risking a misappropriation of his part. We shall side for this idea: a business-to-business agreement is to be qualified of adhesion contract as long as it does not give place to adequate bargaining; so the judge has to look the bargaining process and the circumstances preceding the contract. Many criteria can help the judge such as the size of the company, market parts, exchanged words, the good or bad faith of the parties or the efforts they have made. If we consider the bargain analysis as the ultimately rightest choice, we have to contemplate its limitations. It would not be realistic to consider that the judge could always discover every circumstance prior to the agreement. This is why we shall join a system of presumptions - albeit rebuttable - to the bargain analysis, when the difference of size of companies or the disproportion of provisions is obvious. We shall put into light the strategies used by strongest parts to bypass the bargain analysis, such as harmful clauses or internationalization tactics. Thus, we shall opt for high obligatory standards, as well as in national law than in international law. Once the bargain analysis is done, we shall try to suggest sanctions adapted to the concern. The judge, in our opinion, must be able to modify the agreement in a very flexible way, either retroactively or during the implementation of the said agreement. The gravity of various contractual behaviors must lead us to think about a form of criminal law or a "quasi criminal" law in order to combat those behaviors in a more suitable mean. Nevertheless, the protection of the professional weaker part is also to be dealt on a procedural ground. A proceeding for interim measures is likely to face the needs for celerity, which bother the weakest parts for their action. We shall also underline the advantages of a class action, which could overcome the financial issue of the lawsuit. Conversely, the legal security of business will bring us to foster a protection by a soft law system. First Part: The identification of the business-to-business adhesion contract. Protection of the Injured Party in Criminal Proceedings The diploma thesis deals with the issue of the injured party and his protection in criminal proceedings. Its main goal is to analyze the position of the injured party in criminal proceedings and to analyze in more detail his selected rights, which in this proceeding serve to protect him. The partial goal of the thesis is to summarize the most important aspects of adhesion proceedings and draw attention to the shortcomings of the protection of the injured party in criminal proceedings de lege lata. To meet this goal, the core of the work is divided into three main parts. In the first chapter, the thesis deals with the injured party as a subject and a party to criminal proceedings, negative and positive definition of the term victim, categorization of this term, the issue of victim representation, the issue of victims according to Act No. 209/1997 Coll. and Act No. 45/2013 Coll. and categorization of the rights of the injured party. Since the aim of the thesis is not to exhaustively analyze all the rights of the injured party arising from the Criminal Procedure Code, only the selected rights are analyzed in more detail. Abstract:
The doctoral thesis focuses on the part of criminal proceedings in which the court adjudicates the injured person's private claims which arose in connection with a criminal act (so-called collateral proceedings). The importance of collateral proceedings lies in the fact that by using it the injured party may avoid time-consuming, financially as well as procedurally demanding civil proceedings. However, the institute of collateral proceedings comprises a number of specific issues since a criminal court adjudicates the private claims of the injured party in compliance with substantive law rules being outside of the scope of criminal law (mainly civil law and labour law regulations) but, still, within the framework of criminal proceedings. The basic source of the submitted thesis is the Czech legal order. However, it is not the only one taken into consideration. The doctoral thesis also contains comparative analysis of legal regulation of collateral proceedings from the point of view of the German and Swiss legal orders. Following the analysis of collateral proceedings de lege lata, as well as the comparison with foreign models I am submitting proposals for the improvement of legislation that could be used in connection with the planned recodification of the Czech Criminal Procedure.

This thesis describes the most commonly committed tax criminal offense i.e., the evasion of taxes, fees, and other mandatory payments pursuant to Section 240 of the Criminal Code. The goal of the thesis is to examine the problematic aspects of this criminal offense and to call attention to the discrepancies in proceedings and judgements, with special attention to substantive and procedural aspect, relevant case law of the domestic courts, and the opinion of professional public. The body of the thesis is divided into five chapters. The first two chapters introduce the substantive basis of the topic, provide a brief overview of the history of tax crimes and, last but not least, underline the importance and relevance of the whole topic using publicly available statistical data. The third chapter is focused on the mutual connection between the criminal offense pursuant to Section 240 of the Criminal Code and two selected criminal offenses. The first being the non-payment of taxes, social security contributions and similar mandatory payments pursuant to Section 241 of the Criminal Code, with a focus on the role of effective regret. Non-material damage in health injury and decision making in adhesive (criminal) proceedings Abstract The diploma thesis focuses on current legislature, issues and questions regarding compensation of non-material damage (non- property harm), specifically health injuries in adhesive proceedings. The topic presented hereby is a relatively young field of interest in the Czech law system, moreover it has gone through relatively dynamic development recently. The topic of the diploma thesis is effectively linking criminal, civil and health (medical / health care) law. Current issues of adhesive proceedings This thesis deals with current issues of adhesive proceedings. The thesis is divided into four chapters. The first chapter introduces the basic concepts essential for the definition of adhesive proceedings and related terms. These are primarily the definition of entities and parties to criminal proceedings, including the introduction of the institutes of harm as an overarching term, which includes damage, non-material damages and unjust enrichment. The first chapter also introduces the institute of bodily harm. The second chapter is devoted to the injured party, including a list of procedural rights and obligations that the injured party confers the Criminal Procedure Code and the injured party recognizes the law on victims of crime, if the injured party is also a victim under this law. The following subchapters are divided according to the rights that belong to all the injured parties and the rights that belong to the injured party, who is at the same time subject to the adhesive procedure. In the case of the injured party, the institute of consent of the injured party to criminal prosecution and representation of the injured party is also mentioned.
