Full textThe free software and the e-government constitue the manifestation of the use of Communication and Information Technologies (formely called NTIC) in the public services. The evolution of these concepts of American origin is due amongst other things, with awakening political of advantages of recourse to TIC like lever of reform of State. It is estimated that the free software would guarantee collaboratif work, interworking, safety, the reduction of the costs, technological independence. . . Although these advantages are not always checked, itis obvious today that the open programs source are a planetary success and become in certain cases a true credible alternative to the software owner. However, this evolution was done notwithstanding a legal absence of recognition which would make it possible to make safe use of the free software. There exist for the time being in France, any law, a final jurisprudence, no work of right, and yet the open programs source raise important legal questions. The use of the English language, yhe contractual nature of the user licence, the qualification of the licence agreement of free software, its validity as well as the validity of some of these provisions (clauses of unguaranteed and non responsability), the question of the right of the authors, of the contribuors and the users, the validity of the contract, the applicable law and the qualified judge for the contracts having an element of extraneity. All these questions tackled in the present study are not certainly diriment , but can cause a legal insecuriry likely to block the recourse to the free software

Full textThe deliberate participation of the French Civil Service in the society of information's development is likely to lead to a lot of disruptions in the subtle balances which have been slowly organized by our administrative law. Thus, the public contract's room, and more specifically the public markets’ one, has already undergone deep alterations that have lead to wonder about this juridical concept which is still under construction : the administrative e-contract (e-commerce, e-procurement). The " last " version of the public markets code (legislation) has indisputably broadened the field of the contract's dematerialization in introducing new procedures, in expecting new tranfer's conditions on dematerialized tenders, in shortling, in some case, the "dossiers de consultation des entreprises" (DCE)'s delays of tranfer or in guaranteing the security of information's exchanges, but it has also disrupted the forms and the formalities that those various deeds have to comply with. So the recent texts' examination shows the birth of a new contractual formalism. In fact, the aim isn't to erase any formalism but to rethink the formalities in mobilizing new technologies without weakening the essential principle of juridical security. Generally speaking, as the public e-procurement is now a reality, thus the question of the administrative contract’s execution is likely to be put in a new context. Beyond the renewal of contractual relations, the standard obligations of a sound public management then have to be rethinked althought other difficulties will rise. Therefore the administrative e-contract raises numerous interrogations, the answers of which, first of all, assess new methods of approach and new ways to define the administrative contract. Thus, this thesis will be on the basis of a typology’s essay about the contract’s dematerialization which has the aim to better understand the juridical consequences of this “transmutation de l’instrumentum” during the admnistrative contract’s development and then its carying out

Full textThe main goal of this research is to understand the 'paralysis' of public utilities in the dynamics of electronic government development (that is to say the use of ICT in the modernization process of public utilities). In addition to a managerial interest, the theoretical contribution of this research lies in the analysis of the dynamics of interactions between technologies, organization and its environment that extends structurational theories. Our study is an 'intervention research'. However, our research may be considered in the continuation of many studies that claim a multi-paradigmatic approach: according to the stages of our research, we rest on the use of qualitative or quantitative data. In order to understand the dynamics of electronic government development, this research demonstrates the relevance of the link between the structurational theories and Weick’s works on the sensemaking in organization. Indeed, this dynamics is equivocal and suggests taking into account the representation systems of the actors to analyze the process of structuration between technologies, organization and its environment. A direct implication of this approach in terms of equivocity is that a stage of fuzzy front end is important in the project management to discuss the leaders’ representations and to enact the future dynamics of electronic government development. Moreover, a multi-projects management becomes necessary because the management of the interdependences between the changes is currently essential to develop electronic government

Full textTo table about the Contribution of the Internet to the assertion of the democracy in Africa may seem not to be relevant. The démocraty is often a matter of power, Governents and nations. Yet, there exists neither a power, nor a homogeneous State even less one people in Africa (that is to say same culture, common history) which one can assimilate to a community. There exists in Africa a multiplicity of people each one with its own languages, its customs and its habits, and very often a form of government and a perception of democraty different from a nation to another. However it exists in Africa attemps to set up polical groupings or governents at the regional level. African Union and ECOWAS are feasible examples. It seems that these organizations are only ways and means for integration whereas integration doesn’t necessary mean democraty. They (organizations) are only a political will of many heads of states who want to apply the theory of Globalization (ex United States of America, European Community). The will of the Chief is not the emanation of a common popular desire of living together, expressed by the African populations. The latters are not involved in decisions taking (through a referandum as it was with the European Community) consequently they don’t define the form let alone the functioning principles of those institutions. How to talk about democraty in the African regional dimention if we know that this space, administratively speaking doesn’t exist ? How can we simply try to link the Intrnet with democraty without difining beforehand the space where physical and practical outlines should not be demarcated ? This topic is so challenged that we think it’s worth deepening the analysis on it. That’s the porpose of our Study. We focused on an general introduction about democraty and the ICT in Africa. The second part is a deep analysis on Senegal taken as an exemple ; it shows the different initiatives for the contribution of the ICTregarding the improvement of democraty in this country (Senegal). The third part is a study on the use of the ICT in general and that the Internet especially during the presidential elections in Senegal in 2007. We have observed and analysed the democratic uses of the Interrnet in three major levels of democraty in Africa ; that is to say : The Civil Society Organizations ; Members of parliaments Senegalese people during the Presidential election in 2007. This leads us to the following conclusion. Despite the Digital devide and the relativity of African young democraty, Internet contributes to a better particiapation of Africa regarding the World Social Movement. The exemple of Senegal has allowed us, without falling into technological determinism, to strenghen the hypothesis that the Internet participates in consolidating the assertion of democraty in Africa, even it it is going on slowly in some countries. Such a particiapation can be mainly measured by the management of the power with the e-administration, the dialogue between the representatives and those who have elected them ; without forgetting the conquest of the power thraough the contribution of the ICT in monitoring of the elections. At last, this work comes up with an analysis on identity and citizenship in the time of the digital era ; with also a few recommandations and guidelines of reflexion for a better democratic appropriation of the Internet, particulary in Senegal, in africa in General

Full textUne première partie traite de l'essor des critiques de l'administration comme justificatif des réformes actuelles ; c'est surtout un "survey" et des auteurs majeurs sont étudiés, tels que Weber, Downs, Leibenstein ou ceux du "public choice" comme Niskanen. Elle donne une approche générale des réformes de "nouvelle gestion publique" (NGP), mais aussi de la nouvelle architecture budgétaire publique en France à la lumière de la "loi organique relative aux lois de finances" (LOLF).
Une deuxième partie s'intéresse aux modélisations économiques du fonctionnement des administrations publiques, autour de la question des contrôles hiérarchiques et de celle des designs institutionnels optimaux de services administratifs interdépendants.
Une troisième partie se consacre exclusivement à l'évaluation empirique des réformes dans plusieurs domaines administratifs, notamment en faisant appel aux bases de données de l'organisation de coopération et de développement économiques (OCDE) et aux réformes françaises : décentralisation, recrutements, rémunération à la performance et "knowledge management" sont des thèmes majeurs. Enfin, ce travail met en relief les enjeux de l'administration électronique, en France mais aussi selon une approche comparée, sans omettre de considérer l'interdépendance des reformes de NGP.
