Abstract:
The enactment of Law No. 30 of 2014 concerning Government Administration very much changes the paradigm of the proceedings in the State Administrative Court. One of the fundamental things is about administrative proceedings as pre-litigation proceedings. Under Article 75 of Law No. 30 of 2014 concerning Government Administration, citizens who feel disadvantaged by a Government’s Decision or Action can file an administrative proceedings, and then file a lawsuit in the Administrative Court. Regarding this regulation, two interpretations arise regarding the obligation of administrative proceedings as pre-litigation proceedings. One party argues that the administrative proceedings as pre-litigation proceedings must be carried out before filing a lawsuit in the Court, and the other argues this is not mandatory. For a period of four years, the interpretation of the obligation of administrative proceedings as a pre-litigation proceedings in Law No. 30 of 2014 concerning Government Administration is floating in the realm of discourse. It was only on December 4th, 2018 that the Supreme Court issued a Supreme Court Regulation (PERMA) No. 6 of 2018 concerning Guidelines for Resolving Disputes Regarding Government Administration After Administrative Proceedings, finally the Supreme Court dictates that administrative proceedings as a pre-litigation proceedings is a must. However, the PERMA does not regulate fundamental things regarding lawsuit after administrative proceedings, namely, who will be seated as the defendant, and what is the object of the lawsuit. In addition, there are also a number of things that needed to be reviewed regarding the arrangements in the PERMA, such as regarding the deadline for a lawsuit in the Court.

Mediation is a new institution in administrative proceedings aims to provide a partnership approach of the administration to citizens and to enable which participation of the public in administrative governance. However, the introduction of mediation into administrative proceedings raises doubts as to its practical applicability, especially given the current reluctance of administration to the binding provisions of the agreement in view of the fact that mediation proceedings bring many unquestionable benefits also to the administration, there is a hope that it will adapt better than in judicial-administrative proceedings, where it is not applied.

Abstract:
The article analyzes the range of participants in administrative proceedings, depending on which of the two groups of proceedings they belong to: conflict or non-conflict. It is noted that for the terminological designation of participants in non-conflict proceedings, special attention should be paid to the procedural position they perform in administrative proceedings. The article defines two groups of participants in non-conflict proceedings, the first of which consists of state executive bodies and local governments and their officials who consider and resolve administrative cases. The second group of participants in non-conflict proceedings consists of individuals and legal entities, as well as, under certain conditions, associations of citizens without the status of a legal entity, who protect personal rights and legitimate interests in the administrative process. The laws establishing the procedure for conducting administrative proceedings do not contain standard procedural terms for designating individuals and legal entities as participants in administrative proceedings in Ukraine. It is proposed to analyze the subjects of conflict proceedings depending on the type of proceedings in which they participate, that is, focusing on such types of administrative proceedings as: administrative-tort proceedings, disciplinary proceedings, proceedings on complaints of citizens, administrative proceedings by way of administrative proceedings. The authors concluded that system of subjects of conflict and non-conflict proceedings is complex and branched, what affects the flexibility of the mechanism of protection of the rights and legitimate interests of citizens as a whole today. It is considered to reform the system of conflict proceedings and to minimize of authorized bodies with broad competence. Also, the need for a unified approach to the terminological definition of participants in non-conflict proceedings is a significant problem in law enforcement that needs to be addressed urgently.

Abstract:
This article is devoted to the problem of delimitation and correlation of civil and administrative manners of proceeding. The purpose of the research is to define clear criteria to delimit the civil and administrative legal proceedings to increase the efficiency of civil and administrative legislation regulations when solving disputes connected with the violation of rights, liberties and legitimate interests of an individual. The said is based on the hypothesis that the scope of public-administrative relations is wider than the scope of relations that are governed by the norms of administrative law. Classification problem in the study is considered in the context of defining proceeding manners (administrative or civil). Besides, the cases of courts of general jurisdiction have served as a research base. The author suggests some criteria models for delimiting administrative and civil court proceedings by the legal classification between the parties as well as by the suit character of stated claims. The latter in the future might lead to the formation of new, more accurate methods of applying administrative norms and a reduction in the number of precedents for incorrect proceedings.

Abstract:
Art. 124 § 1 point 6 in conjunction with Art. 56 of the Act on Proceedings Before Administrative Courts should be understood in accordance with Art. 2 and 45 of the Polish Constitution, in such a way that the suspension of proceedings on this basis requires prior consideration of all the circumstances of the case, including the circumstances justifying its immediate examination. This especially applies to cases where the court finds the possibility of abuse of procedural law. The circumstances which constitute the basis for the suspension of court proceedings, pursuant to Art. 125 § 1 point 1 of the Act on Proceedings Before Administrative Courts, must objectively condition the court’s decision. When applying the above-mentioned provisions, the court is obliged to consider the effects of possible waiting for a decision on a preliminary ruling. The purpose of the article is to draw attention to the need for a rational adjudication on the suspension of court and administrative proceedings, in order to maintain the principle of the speed of proceedings.

Abstract:
The article examines administrative coercion in enforcement proceedings as a legal phenomenon. The author considers it, firstly, as one of the types of state coercion, and secondly, as a kind of administrative coercion, and comes to the conclusion that enforcement proceedings are inseparable from administrative coercion by their nature. Both elements that make up the general concept under study are generated by the state, are necessary for the exercise of state power, the achievement of a publicly significant goal. This goal is determined by the actual enforcement proceedings as a necessary specific type of activity aimed at completing the cycle of jurisdictional proceedings: in cases of administrative offenses, civil, arbitration, administrative proceedings, and others, to solve its tasks. In enforcement proceedings, only its combination with administrative coercion can achieve the goal of public authority, to achieve the real execution of the act of a jurisdictional body, an official. In addition, administrative coercion is a method of public administration, an effective tool with which enforcement proceedings are carried out. The article also presents the author’s classification of types of administrative coercion in enforcement proceedings, and raises the problem of improving the legislation on it.

Abstract:
The legislator placed mediation in administrative and court-administrative proceedings. The normative regulation of this institution is mainly similar to the solutions applicable in civil proceedings. Mediation is voluntary and its conduct is entrusted to the mediator. The practical use of mediation in administrative or court-administrative proceedings makes an amicable formula that makes resolving administrative cases real. Considering the fact that in 2017 the legislator amended the administrative procedure by embedding mediation in the administrative law system, the authors of the study undertook the evaluation of the mediation institution in administrative and court-administrative proceedings.

The article analyses adjudication processes: decision-making, incentives, factual states and legal conditions influencing the content of adjudication. A practical solution to problems by adjudication and a custom as part of this practice. A custom can be defined as a non-legal habit of conduct virtually observed within a given organizational structure (unit) of administration in similar situations and in specified time.The society, including the bodies that govern it, should be characterised by legality, i.e. act within law. In our conditions an administrative decision is of phenomenal significance and leaves a clear mark on our everyday life. It is virtually impossible to meet a person that has never been a subject of an administrative decision. Because of the importance of an administrative decision in our life, this article is addressed to those clerks in administrative bodies that in the course of administrative proceedings draw up the content of a ruling or decision that terminates the proceedings in a particular instance and feel anonymous. Underestimating familiarity with law by stating that one does not know law or that one is not a lawyer is frequently repeated by those employees in administrative bodies that are responsible for the content of those decisions and in this way they reveal their ignorance. Ignorantia legis non excusat (Latin for “ignorance of the law excuses no one”), therefore one cannot excuse oneself with unfamiliarity with law.

Abstract:
The administration of justice on the basis of a fair trial is not an easy task, as both parties to the dispute are usually certain of their rightness, which they are trying to prove to the court. If one of these parties is a state or its bodies, the judiciary can become a dangerous tool to influence any process in society. Specific cases against Ukraine show that high-ranking officials of all periods of power did not neglect the possibility of influencing the outcome of the case, pursuing goals not related to the administration of justice. The influence of the European Convention and the case law of the European Court of Human Rights has become decisive for Ukraine in the formation of a separate procedure for the administration of justice: administrative proceedings. Some aspects of its functioning are investigated in this work, in particular, the preconditions for the differentiation of administrative proceedings in Ukraine, the problem of defining the concept of the authorities and the state as a party to the case, the implementation of the right to a fair trial in administrative proceedings, access to court and the principle of the equality of parties; oral and open administrative proceedings; adversarial proceedings and the right of the court to establish the circumstances of the administrative case. Abstract:
Using a set of 4708 observations, we analyze the impact of Dodd-Frank on shifting cases from federal courts to administrative courts. Overall, we find that there is a higher probability of a case being an administrative proceeding post Dodd-Frank. In addition, we find a higher average total payment for administrative proceedings post Dodd-Frank, and a lower average total payment for federal court cases post Dodd-Frank. We also find a higher average disgorgement payment for administrative proceedings post Dodd-Frank. While this finding could be the result of the SEC shifting more complex and thus higher paying cases from federal courts to its own, we find that the SEC is not shifting cases strictly away from federal courts that have the highest average payments. Higher average disgorgement payments are simply the result of the SEC litigating more cases with higher average payments in general. Lastly, we find a higher probability of settling for administrative proceedings overall. However, settlement rates for administrative proceedings decrease post Dodd-Frank. This finding reflects an overall decrease in the SEC’s “home court” advantage and undermines the argument that the SEC is shifting weaker cases to its own courts.

Abstract:
Arbitral tribunals’ engagement of secretaries has for several years been the subject of debate and surveys show that the use of arbitral secretaries varies in practice. The Swedish Arbitration Act as well as the Arbitration Rules and Rules for Expedited Arbitrations issued by the Arbitration Institute of the Stockholm Chamber of Commerce do not regulate the appointment and authority of an arbitral secretary. The requirements for the arbitrators’ appointment of a secretary and the extent of the secretary’s authority are, however, indirectly affected by general principles of law and provisions in the Swedish Arbitration Act. Regarding the requirements for appointment of a secretary, it is asserted in this thesis that the arbitrators ought to obtain the parties’ consent to the appointment. However, it is unclear if there are any other requirements that the arbitrators must observe when appointing a secretary. The limitations on the secretary’s authority mainly consist of agreements concluded by the parties and the provisions on challenge and invalidity of awards. Where the secretary has been appointed with the parties’ consent and the parties have not agreed on the secretary’s authority, the secretary is probably at least allowed to perform administrative tasks, but the arbitrators are not allowed to delegate their decision-making function or the duty to sign the award. However, the exact dividing line between proper and improper delegation cannot be established. In the final discussion it is asserted that further guidance on the authority of the arbitral secretary would be beneficial. It is proposed that such guidance should be provided through guidelines issued by the SCC, which shall recommend the arbitrators to: obtain the parties’ consent to the appointment of the secretary; conclude an agreement with the parties which states the duties that the arbitrators are allowed to delegate to the secretary; be transparent with the parties on the secretary’s involvement in the arbitral proceedings; and refrain from delegating the tasks to sign the award and decide the dispute.
Skiljenämnders anlitande av sekreterare har i flera år varit föremål för debatt och undersökningar visar på att användandet av sekreterare varierar i praktiken. Lagen om skiljeförfarande samt Stockholms Handelskammares Skiljedomsinstituts skiljedomsregler och regler för förenklat förfarande reglerar inte sekreterarens tillsättande och behörighet. Kraven för att skiljemännen ska kunna tillsätta en sekreterare och omfattningen av sekreterarens behörighet påverkas dock indirekt av generella rättsprinciper samt bestämmelser i lagen om skiljeförfarande. Angående kraven för att kunna tillsätta en sekreterare, hävdas i denna uppsats att skiljemännen borde inhämta parternas samtycke till tillsättandet. Det är dock oklart om skiljemännen måste observera några andra krav när de ska tillsätta en sekreterare. Sekreterarens behörighet begränsas främst av avtal som parterna har slutit samt reglerna om klander och ogiltighet av skiljedomar. Om sekreteraren har blivit tillsatt med parternas samtycke och parterna inte har avtalat om sekreterarens behörighet, så får sekreteraren troligtvis åtminstone utföra administrativa uppgifter, men skiljemännen får inte delegera deras beslutsfattande funktion eller uppgiften att underteckna skiljedomen. Den exakta gränsen mellan tillåten och otillåten delegering kan dock inte fastställas. I den avslutande diskussionen framhålls att det vore fördelaktigt med ytterligare vägledning angående sekreterarens behörighet. Det föreslås att sådan vägledning ska ges genom att SCC antar riktlinjer som rekommenderar skiljemännen att: inhämta parternas samtycke till tillsättandet av sekreteraren, avtala med parterna angående vilka uppgifter som skiljemännen får delegera till sekreteraren, vara öppna med parterna angående sekreterarens inblandning i förfarandet och avstå från att delegera uppgifterna att underteckna skiljedomen och avgöra tvisten.

La loyauté procédurale n’est pas consacrée dans le droit du procès administratif. Elle fait pourtant l’objet d’un débat au sein de la doctrine publiciste. Alors que la jurisprudence judiciaire et la doctrine privatiste font de la loyauté des débats essentiellement un enjeu de moralisation du procès entre les parties, le discours de la doctrine publiciste sur la loyauté vise à révéler et justifier les garanties apportées aux parties dans le procès administratif. Une démarche inductive, consistant à systématiser le discours doctrinal, permet de formuler un concept de loyauté procédurale propre au procès administratif. Celui-ci apporte une justification à certains traits de procédure, consacrés par les textes ou la jurisprudence, qui n’ont pas de fondement exprès et dont le point commun est de reconnaître des garanties aux parties. Ce concept offre une grille d’analyse du droit du procès. La circonstance que le principe de loyauté procédurale est rejeté en droit n’exclut pas, en outre, l’intérêt d’un usage conceptuel de la loyauté. Le concept de loyauté permet d’apprécier l’opportunité de consacrer certains mécanismes contentieux et d’identifier les difficultés posées par le procès administratif selon les critères de l’intégrité, de l’accessibilité et de l’efficacité à l’égard des parties. Envisagée comme un concept d’explication, la loyauté procédurale devient un concept d’analyse de la procédure suivie devant le juge administratif et suggère certaines évolutions des règles applicables au procès administratif
The concept of procedural loyalty is not enshrined in the legal frameworks that govern administrative legal proceedings. Nonetheless, it has been subject to significant debate throughout the administrative legal doctrine. In contrast to judicial case law and civil doctrine where the concept of loyalty of debates is essentially focused on the moralization between the parties involved, the administrative doctrine on loyalty aims to disclose and justify the guaranties and safeguards given to the parties involved. An inductive approach, consistent in systematizing the doctrinal discourse, has lead to a concept of procedural loyalty that is unique to administrative legal proceedings. It provides justification over the key features of legal proceedings, features that are enshrined in either legal texts or case law but do not have explicit legal foundations and for which the common feature is to recognize safeguards afforded to the parties involved. This concept brings about a new set of legal terminology. The fact that the principal of procedural loyalty is not explicitly covered in legal frameworks, does not mean however that the conceptual usage of loyalty should be discarded. This concept allows us to acknowledge the opportunity in devoting litigation mechanisms to administrative legal proceedings, in order to identify the difficulties brought about in respect of the integrity, accessibility and efficiency with regards to all parties involved. Initially envisaged as an explanatory concept, procedural loyalty has been transformed into a conceptual analysis of the proceedings presided over by administrative judges

The economic activity, considering the constitutional treatment for consumer protection, is not developed freely and exclusively towards coping with suppliers wishes. The existence of other concepts and the necessary compliance with certain duties impose an obligation upon suppliers to perform their activities as designed by the legal system, notably by the Federal Constitution of 1988. In that context, the omissive or comissive conduct, subject to give rise to the application of an administrative penalty, imposes the need for supplier to be properly repressed, in accordance with the proper legal proceedings. Thus, since the Federal Constitution of 1988 approximated the administrative to the legal proceedings, creating a similar legal regime resulting from the clause of the proper legal proceedings, without forgetting the underlying principle of some of its norms and the need of a uniform treatment of the theme throughout the national territory, Law # 9,784/99, for being a true Code of Administrative Proceedings, must be used to regulate the administrative proceedings of consumer protection. Sanctioned after eleven years of the effectiveness of the Federal Constitution of 1988, Law # 9,784/99 reflects the Administrative Reform of the State, allowing the effective implementation of a Democratic Rule of Law since it allows the administered to participate in the creation of the sanctioning administrative act. Notwithstanding, Law # 9,784/99, as a result of the possibility of implementing the reformatio in pejus, which is nothing more than the possibility of aggravating the situation of the appellant upon the judgment of their appeal, means an important instrument of perfecting and preserving the consumer protection rules while it permits coping with constitutional wishes related to consumer protection and abiding by the grounds and fundamental objectives of the Federative Republic of Brazil
O desenvolvimento da atividade econômica, à vista do tratamento constitucional atribuído à defesa do consumidor, não ocorre de forma livre e voltada unicamente ao atendimento dos anseios do fornecedor. A existência de conceitos outros e a necessária observância a certos deveres impõem a obrigatoriedade de o fornecedor desenvolver suas atividades conforme os caminhos desenhados pelo ordenamento jurídico, notadamente pela Constituição Federal de 1988. Nesse contexto, a conduta, omissiva ou comissiva, passível de dar ensejo à aplicação de uma penalidade administrativa impõe a necessidade de o fornecedor ser adequadamente reprimido, respeitado o devido processo legal. Assim, uma vez que a Constituição Federal de 1988 aproximou o processo administrativo do judicial, criando um regime jurídico similar decorrente da cláusula do devido processo legal, sem olvidar sobre o caráter principiológico de algumas de suas normas e da necessidade de tratamento uniforme do tema em todo o território nacional, a Lei n°9.784/99, por consistir em verdadeiro Código de Processo Administrativo, deve ser utilizada para regular o processo administrativo de defesa do consumidor. Sancionada após onze anos de vigência da Constituição Federal de 1988, a Lei n°9.784/99 reflete a Reforma Administrativa do Estado, permitindo a implementação efetiva de um Estado Democrático de Direito na medida em que permite ao administrado participar da formação do ato administrativo sancionador. Não obstante, a Lei n°9.784/99, em decorrência da possibilidade da implementação da reformatio in pejus, que nada mais vem a ser do que a possibilidade de agravamento da situação do recorrente quando do julgamento de seu recurso, configura um importante instrumento de efetivação e de preservação das normas de proteção do consumidor na medida em que permite o atendimento dos anseios constitucionais referentes à defesa do consumidor e o atingimento dos fundamentos e objetivos fundamentais da República Federativa do Brasil

Problema slypi tame, kad rengiamame Administracinio proceso kodekso projekte žadama reglamentuoti tiek administracinės bylos proceso dalyvių teisinę padėtį, tiek administracinių teisės pažeidimų bylos proceso dalyvių teisinę padėtį. Tuo tarpu šių administracinių bylų kategorijų skirtumai yra pernelyg akivaizdūs, o egzistuojančios teisinio reglamentavimo spragos ir neaiškumai - realūs. Neatskleidus šių bylų proceso dalyvių teisinio statuso bei teisinės padėties ypatumų, bus pažeisti daugelis administracinės teisės ir administracinio proceso principų. Topic of the MA in Law thesis is relevant, whereas legal status aspects of the parties to the administrative proceedings yet have not been scrutinized in sufficient detail in Lithuania. The problem is that the draft Administrative Process Code, which is currently under preparation, intends to regulate legal status of both the parties to the administrative court proceedings and the parties to the administrative offence proceedings. Meanwhile, class differences between the said types of administrative cases are self-evident and gaps and obscurities of the existing legal regulation are factual. In case of failure to display peculiarities of legal status and position of the parties of such cases many principles of administrative law and administrative process shall be violated. Research subject of the thesis is factors determining legal status of the parties to the administrative court proceedings. Object of the research is factors determining legal status of the parties to the administrative court proceedings and the administrative offence proceedings as a whole. A presente tese propôs-se a examinar a possibilidade de se transportar a teoria instrumentalista ao processo administrativo de apuração de condutas perante o Sistema Brasileiro de Defesa da Concorrência. Foram cotejadas premissas estruturais e de técnicas processuais, de modo a examinar se o processo administrativo de apuração de condutas anticoncorrenciais é hábil para a consecução do escopo magno de pacificação com justiça, valendo-se ainda de técnicas processuais adequadas para o alcance daqueles escopos sociais, políticos e jurídicos estabelecidos como premissa de raciocínio. O trabalho faz uma análise da história do pensamento antitruste estrangeiro e no Brasil para a definição do escopo do direito antitruste no Brasil, expõe o conceito de função administrativa judicante (quase jurisidicional) exercida pelo CADE, concebida a partir da ausência de rigidez da concepção tripartite das funções-poderes-atividades do Estado. Debate-se a natureza do órgão, sua concepção no desenho institucional do Estado e a influência da política e da discricionariedade administrativa sobre a sua atividade. No âmbito dos axiomas processuais, são analisados ao longo do texto os preceitos democráticos, o conceito de processo e sua definição em um modelo processual constitucional. A Teoria Geral do Processo também fornece relevante disciplina metodológica aplicável a todo e qualquer processo, dentre eles, o administrativo-concorrencial, cuja natureza também é examinada. Propôs-se então a análise crítica do processo administrativo concorrencial por meio de seus escopos e respectivas técnicas de atuação, a partir da estrutura fornecida pelo pensamento instrumentalista do processo de Dinamarco. O escopo social é examinado à luz das técnicas relacionadas com a imunização, a idoneidade estrutural, a imparcialidade (sob a ótica do princípio da demanda, do princípio dispositivo, do exame da nomeação, mandato e quarentena dos julgadores) e a finalidade educativa. Os escopos políticos são cotejados com as concepções de poder e liberdade (constitucionalização e devido processo legal), participação democrática (como acesso à ordem jurídica justa de representantes, terceiros interessados), direito à informação e publicidade de atos. Por fim, o escopo jurídico do processo é examinado sob a ótica da atuação prática da vontade jurídica preexistente mediante técnicas incidentes sobre os temas do conflito entre correntes unitárias e dualistas do direito, da busca da verdade possível e sua relação com o ideal de pacificação trazido com a solução definitiva e célere de controvérsias por técnicas de imutabilidade e de aceleração de julgamentos, da segurança jurídica outorgada pelas formas, do direito à prova e os meios inerentes ao seu exercício, do duplo grau e da uniformização de decisões. Conclui-se pela identificação de pontos sensíveis em que o processo administrativo não atinge satisfatoriamente os escopos do processo, mas que o sistema caminha em direção da legitimação de sua atividade.
The present thesis proposes to examine the hypothesis of carrying the instrumentalist theory to the antitrust proceedings before the Brazilian Competition Policy System (SBDC). Structural and procedural technique assumptions were collated in order to examine whether the antitrust proceedings is able to achieve the grand purpose of pacification with justice, availing itself of appropriate procedural techniques to reach those social, political and legal scopes established as premise of reasoning thinking. Throughout the present thesis, the history of the foreign and Brazilian antitrust thought is analyzed to define the scope of the antitrust law in Brazil, and it exams the concept of administrative adjudicate function (almost jurisdictional) exerted by the Brazilian Council for Economic Defense (CADE), conceived from the absence of formality of the tripartite conception of the function-power-activities of the State. The agency nature, its conception in the institutional design of the State and the influence of the politics and the administrative discretionarity on its activity is discussed. In the scope of the procedural axioms, the democratic principles, the concept of process and its definition in a constitutional procedural model are analyzed throughout the text. The General Theory of the Process also supplies relevant methodological disciplines applicable to all and any procedure, amongst them, the administrative-antitrust procedure, whose nature is also examined. Moreover, a critical analysis of the process by means of its scope and by its respective techniques of performance is proposed, from the structure provided by the instrumentalist thought of the process by Professor Candido Rangel Dinamarco. The social scope is examined in the light of the techniques related with the immunization, the structural suitability, the impartiality (considering the principle of the action, the dispositive principle, the examination of the appointment, term and quarantine of the Commissioners) and the educational purpose. The political scopes are discussed taking into account the conceptions of power and freedom (constitutionality and due process of law), democratic participation (as access of interested parties and third parties to the legal system), right to information and publicity of acts. Finally, the legal scope of the process is examined from the perspective of the practical performance of the preexisting law by means of techniques incident on the subjects of the conflict between Unitarian and Dualist doctrines, the pursue of the possible truth and its relation with the ideal of pacification brought with the definitive and fast solution of controversies by techniques of immutability and acceleration of judgments, of legal certainty afforded by the forms, of the right of production of evidence and those inherent instruments, of the right of appeal to a hierarchically superior body and the predictability of decisions. In conclusion, sensitive points are identified where the administrative procedures do not satisfactorily achieve the scope of process, but where the system moves toward the legitimization of its activity.

The initiatives of innovations implemented in public organizations assume the search for efficiency and quality in services. To make these improvements happen effectively, Guimarães (2000) explains that it is necessary to break upwith the traditional models of managing resources and to introduce a new culture able to meet different requirements and complexities currently faced in this area. In the general context of the federal public administration, universities are bureaucratic agencies that require intensive studies on their organizational aspect, as well as a competent analysis of their administrative proceedings, since they are institutions with remarkable social responsibility because of their specific functions for generating and disseminating knowledge. This line of thinking corroborates the Institutional Development Plan (IDP) 2011-2015 of the Federal University of Santa Maria - UFSM, which shows the value of people, the quality of services, and the continuous improvement of working conditions as major challenges to be reached by the University. As a contribution to overcome these challenges, this study aimed to map the administrative proceedings within a Teaching Departments atCAL/UFSM and to identify difficulties to operationalize procedures. In order to achieve the objectives proposed, a study classified as a descriptive approach was carried out. In the research strategy, based on the Teaching Departments of Arts & Letters Center (CAL), the case study method was used to be aligned with the proposed objectives and with the research that guided the study. Data collection was conducted through document analysis and semi-structured interviews with the technical and administrative staff of the Teaching Departments at CAL. Results allowed us to learn about the quantitative of the administrative procedures regarding the department, as well as the classification of processes that require documentary formalization in Primers and Critics, based on the Valle e Oliveira (2009) model. Another significant element of the study was the identification of operational difficulties in implementing the procedures, since various demands have been pointed out. Moreover,operational and management practices rooted in the culture of the institution were demonstrated, which may boost debates aiming at institutional advantages. We have also designed a Tutorial,a practical tool aiming at operationalizing Critical processes, which may contribute to possible advances and positive effects ina department context. This research, with a view to the pursuit of excellence, may contribute to the consolidation of some changesas well as to the improvement of the management of people in order to stimulate more expressive, agile and consistent actions,which areexpected of a contemporary public organization.
As iniciativas de inovações implantadas nas organizações públicas pressupõem a busca pela eficiência e pela qualidade na prestação de serviços. Para que essas melhorias efetivamente aconteçam, Guimarães (2000) explica que são necessários o rompimento com os modelos tradicionais de administrar recursos e a introdução de uma nova cultura capaz de atender as diferentes complexidades atualmente enfrentadas nessa área. No contexto geral da administração pública federal, as universidades são órgãos burocráticos que demandam intensos estudos sobre o seu aspecto organizacional, assim como competente análise de seus processos administrativos, considerando que são instituições com marcante responsabilidade social, haja vista as suas funções específicas de geração e disseminação de conhecimentos. Essa linha de pensamento corrobora o exposto no Plano de Desenvolvimento Institucional PDI 2011-2015 da Universidade Federal de Santa Maria UFSM que evidencia a valorização das pessoas, a qualidade dos serviços e a melhoria permanente das condições de trabalho, como grandes desafios a serem vencidos pela Universidade. A título de contribuição para a superação desses desafios, este estudo buscou como objetivo geral: realizar o mapeamento dos processos administrativos executados no âmbito dos Departamentos Didáticos do CAL/UFSM e identificar dificuldades com vistas à operacionalização dos procedimentos. Para atingir os objetivos propostos realizou-se um trabalho classificado como de natureza descritiva, envolvendo abordagem qualitativa. Na estratégia de pesquisa a partir dos Departamentos Didáticos do Centro de Artes e Letras CAL - foi utilizado o método do estudo de caso por estar alinhado com os objetivos propostos e com a questão de pesquisa que norteou o estudo. A coleta dos dados ocorreu por meio de análise documental e de entrevistas semiestruturadas com os servidores técnico-administrativos lotados nos Departamentos Didático do CAL. Entende-se que o resultado encontrado possibilitou conhecer o quantitativo de procedimentos administrativos pertinentes ao âmbito departamental, bem como a classificação dos processos que exigem formalização documental em Primários e Críticos, baseado no modelo de Valle e Oliveira (2009). Outro elemento significativo do estudo foi a identificação das dificuldades operacionais na execução dos procedimentos, pois apontou diversas demandas e demonstrou práticas operacionais e gerenciais arraigadas na cultura da Instituição, que poderão impulsionar debates visando a proveitos institucionais. Além disso, foi elaborado um Tutorial - instrumento prático que visa a operacionalização dos processos Críticos que intenta contribuir para possíveis avanços e efeitos mais profícuos no contexto departamental. Conclui-se que esta pesquisa, tendo em vista a busca da excelência, tanto pode colaborar para a consolidação de uma mudança como para a melhoria na gestão de pessoas, no sentido de estimular ações mais expressivas, ágeis e coerentes com o que se espera da organização pública contemporânea.
