Full textSkiljenämnders anlitande av sekreterare har i flera år varit föremål för debatt och undersökningar visar på att användandet av sekreterare varierar i praktiken. Lagen om skiljeförfarande samt Stockholms Handelskammares Skiljedomsinstituts skiljedomsregler och regler för förenklat förfarande reglerar inte sekreterarens tillsättande och behörighet. Kraven för att skiljemännen ska kunna tillsätta en sekreterare och omfattningen av sekreterarens behörighet påverkas dock indirekt av generella rättsprinciper samt bestämmelser i lagen om skiljeförfarande. Angående kraven för att kunna tillsätta en sekreterare, hävdas i denna uppsats att skiljemännen borde inhämta parternas samtycke till tillsättandet. Det är dock oklart om skiljemännen måste observera några andra krav när de ska tillsätta en sekreterare. Sekreterarens behörighet begränsas främst av avtal som parterna har slutit samt reglerna om klander och ogiltighet av skiljedomar. Om sekreteraren har blivit tillsatt med parternas samtycke och parterna inte har avtalat om sekreterarens behörighet, så får sekreteraren troligtvis åtminstone utföra administrativa uppgifter, men skiljemännen får inte delegera deras beslutsfattande funktion eller uppgiften att underteckna skiljedomen. Den exakta gränsen mellan tillåten och otillåten delegering kan dock inte fastställas. I den avslutande diskussionen framhålls att det vore fördelaktigt med ytterligare vägledning angående sekreterarens behörighet. Det föreslås att sådan vägledning ska ges genom att SCC antar riktlinjer som rekommenderar skiljemännen att: inhämta parternas samtycke till tillsättandet av sekreteraren, avtala med parterna angående vilka uppgifter som skiljemännen får delegera till sekreteraren, vara öppna med parterna angående sekreterarens inblandning i förfarandet och avstå från att delegera uppgifterna att underteckna skiljedomen och avgöra tvisten.

Full textThe concept of procedural loyalty is not enshrined in the legal frameworks that govern administrative legal proceedings. Nonetheless, it has been subject to significant debate throughout the administrative legal doctrine. In contrast to judicial case law and civil doctrine where the concept of loyalty of debates is essentially focused on the moralization between the parties involved, the administrative doctrine on loyalty aims to disclose and justify the guaranties and safeguards given to the parties involved. An inductive approach, consistent in systematizing the doctrinal discourse, has lead to a concept of procedural loyalty that is unique to administrative legal proceedings. It provides justification over the key features of legal proceedings, features that are enshrined in either legal texts or case law but do not have explicit legal foundations and for which the common feature is to recognize safeguards afforded to the parties involved. This concept brings about a new set of legal terminology. The fact that the principal of procedural loyalty is not explicitly covered in legal frameworks, does not mean however that the conceptual usage of loyalty should be discarded. This concept allows us to acknowledge the opportunity in devoting litigation mechanisms to administrative legal proceedings, in order to identify the difficulties brought about in respect of the integrity, accessibility and efficiency with regards to all parties involved. Full textThe economic activity, considering the constitutional treatment for consumer protection, is not developed freely and exclusively towards coping with suppliers wishes. The existence of other concepts and the necessary compliance with certain duties impose an obligation upon suppliers to perform their activities as designed by the legal system, notably by the Federal Constitution of 1988. In that context, the omissive or comissive conduct, subject to give rise to the application of an administrative penalty, imposes the need for supplier to be properly repressed, in accordance with the proper legal proceedings. Thus, since the Federal Constitution of 1988 approximated the administrative to the legal proceedings, creating a similar legal regime resulting from the clause of the proper legal proceedings, without forgetting the underlying principle of some of its norms and the need of a uniform treatment of the theme throughout the national territory, Law # 9,784/99, for being a true Code of Administrative Proceedings, must be used to regulate the administrative proceedings of consumer protection. Sanctioned after eleven years of the effectiveness of the Federal Constitution of 1988, Law # 9,784/99 reflects the Administrative Reform of the State, allowing the effective implementation of a Democratic Rule of Law since it allows the administered to participate in the creation of the sanctioning administrative act. Notwithstanding, Law # 9,784/99, as a result of the possibility of implementing the reformatio in pejus, which is nothing more than the possibility of aggravating the situation of the appellant upon the judgment of their appeal, means an important instrument of perfecting and preserving the consumer protection rules while it permits coping with constitutional wishes related to consumer protection and abiding by the grounds and fundamental objectives of the Federative Republic of Brazil
O desenvolvimento da atividade econômica, à vista do tratamento constitucional atribuído à defesa do consumidor, não ocorre de forma livre e voltada unicamente ao atendimento dos anseios do fornecedor. A existência de conceitos outros e a necessária observância a certos deveres impõem a obrigatoriedade de o fornecedor desenvolver suas atividades conforme os caminhos desenhados pelo ordenamento jurídico, notadamente pela Constituição Federal de 1988. Nesse contexto, a conduta, omissiva ou comissiva, passível de dar ensejo à aplicação de uma penalidade administrativa impõe a necessidade de o fornecedor ser adequadamente reprimido, respeitado o devido processo legal. Assim, uma vez que a Constituição Federal de 1988 aproximou o processo administrativo do judicial, criando um regime jurídico similar decorrente da cláusula do devido processo legal, sem olvidar sobre o caráter principiológico de algumas de suas normas e da necessidade de tratamento uniforme do tema em todo o território nacional, a Lei n°9.784/99, por consistir em verdadeiro Código de Processo Administrativo, deve ser utilizada para regular o processo administrativo de defesa do consumidor. Sancionada após onze anos de vigência da Constituição Federal de 1988, a Lei n°9.784/99 reflete a Reforma Administrativa do Estado, permitindo a implementação efetiva de um Estado Democrático de Direito na medida em que permite ao administrado participar da formação do ato administrativo sancionador. Não obstante, a Lei n°9.784/99, em decorrência da possibilidade da implementação da reformatio in pejus, que nada mais vem a ser do que a possibilidade de agravamento da situação do recorrente quando do julgamento de seu recurso, configura um importante instrumento de efetivação e de preservação das normas de proteção do consumidor na medida em que permite o atendimento dos anseios constitucionais referentes à defesa do consumidor e o atingimento dos fundamentos e objetivos fundamentais da República Federativa do Brasil

Full textTopic of the MA in Law thesis is relevant, whereas legal status aspects of the parties to the administrative proceedings yet have not been scrutinized in sufficient detail in Lithuania. The problem is that the draft Administrative Process Code, which is currently under preparation, intends to regulate legal status of both the parties to the administrative court proceedings and the parties to the administrative offence proceedings. Meanwhile, class differences between the said types of administrative cases are self-evident and gaps and obscurities of the existing legal regulation are factual. In case of failure to display peculiarities of legal status and position of the parties of such cases many principles of administrative law and administrative process shall be violated. Research subject of the thesis is factors determining legal status of the parties to the administrative court proceedings. Object of the research is factors determining legal status of the parties to the administrative court proceedings and the administrative offence proceedings as a whole. Full textThe present thesis proposes to examine the hypothesis of carrying the instrumentalist theory to the antitrust proceedings before the Brazilian Competition Policy System (SBDC). Structural and procedural technique assumptions were collated in order to examine whether the antitrust proceedings is able to achieve the grand purpose of pacification with justice, availing itself of appropriate procedural techniques to reach those social, political and legal scopes established as premise of reasoning thinking. Throughout the present thesis, the history of the foreign and Brazilian antitrust thought is analyzed to define the scope of the antitrust law in Brazil, and it exams the concept of administrative adjudicate function (almost jurisdictional) exerted by the Brazilian Council for Economic Defense (CADE), conceived from the absence of formality of the tripartite conception of the function-power-activities of the State. The agency nature, its conception in the institutional design of the State and the influence of the politics and the administrative discretionarity on its activity is discussed. In the scope of the procedural axioms, the democratic principles, the concept of process and its definition in a constitutional procedural model are analyzed throughout the text. The General Theory of the Process also supplies relevant methodological disciplines applicable to all and any procedure, amongst them, the administrative-antitrust procedure, whose nature is also examined. Moreover, a critical analysis of the process by means of its scope and by its respective techniques of performance is proposed, from the structure provided by the instrumentalist thought of the process by Professor Candido Rangel Dinamarco. The social scope is examined in the light of the techniques related with the immunization, the structural suitability, the impartiality (considering the principle of the action, the dispositive principle, the examination of the appointment, term and quarantine of the Commissioners) and the educational purpose. The political scopes are discussed taking into account the conceptions of power and freedom (constitutionality and due process of law), democratic participation (as access of interested parties and third parties to the legal system), right to information and publicity of acts. Finally, the legal scope of the process is examined from the perspective of the practical performance of the preexisting law by means of techniques incident on the subjects of the conflict between Unitarian and Dualist doctrines, the pursue of the possible truth and its relation with the ideal of pacification brought with the definitive and fast solution of controversies by techniques of immutability and acceleration of judgments, of legal certainty afforded by the forms, of the right of production of evidence and those inherent instruments, of the right of appeal to a hierarchically superior body and the predictability of decisions. In conclusion, sensitive points are identified where the administrative procedures do not satisfactorily achieve the scope of process, but where the system moves toward the legitimization of its activity.

Full textAs iniciativas de inovações implantadas nas organizações públicas pressupõem a busca pela eficiência e pela qualidade na prestação de serviços. Para que essas melhorias efetivamente aconteçam, Guimarães (2000) explica que são necessários o rompimento com os modelos tradicionais de administrar recursos e a introdução de uma nova cultura capaz de atender as diferentes complexidades atualmente enfrentadas nessa área. No contexto geral da administração pública federal, as universidades são órgãos burocráticos que demandam intensos estudos sobre o seu aspecto organizacional, assim como competente análise de seus processos administrativos, considerando que são instituições com marcante responsabilidade social, haja vista as suas funções específicas de geração e disseminação de conhecimentos. Essa linha de pensamento corrobora o exposto no Plano de Desenvolvimento Institucional PDI 2011-2015 da Universidade Federal de Santa Maria UFSM que evidencia a valorização das pessoas, a qualidade dos serviços e a melhoria permanente das condições de trabalho, como grandes desafios a serem vencidos pela Universidade. A título de contribuição para a superação desses desafios, este estudo buscou como objetivo geral: realizar o mapeamento dos processos administrativos executados no âmbito dos Departamentos Didáticos do CAL/UFSM e identificar dificuldades com vistas à operacionalização dos procedimentos. Para atingir os objetivos propostos realizou-se um trabalho classificado como de natureza descritiva, envolvendo abordagem qualitativa. Na estratégia de pesquisa a partir dos Departamentos Didáticos do Centro de Artes e Letras CAL - foi utilizado o método do estudo de caso por estar alinhado com os objetivos propostos e com a questão de pesquisa que norteou o estudo. A coleta dos dados ocorreu por meio de análise documental e de entrevistas semiestruturadas com os servidores técnico-administrativos lotados nos Departamentos Didático do CAL. Entende-se que o resultado encontrado possibilitou conhecer o quantitativo de procedimentos administrativos pertinentes ao âmbito departamental, bem como a classificação dos processos que exigem formalização documental em Primários e Críticos, baseado no modelo de Valle e Oliveira (2009). Outro elemento significativo do estudo foi a identificação das dificuldades operacionais na execução dos procedimentos, pois apontou diversas demandas e demonstrou práticas operacionais e gerenciais arraigadas na cultura da Instituição, que poderão impulsionar debates visando a proveitos institucionais. Além disso, foi elaborado um Tutorial - instrumento prático que visa a operacionalização dos processos Críticos que intenta contribuir para possíveis avanços e efeitos mais profícuos no contexto departamental. Conclui-se que esta pesquisa, tendo em vista a busca da excelência, tanto pode colaborar para a consolidação de uma mudança como para a melhoria na gestão de pessoas, no sentido de estimular ações mais expressivas, ágeis e coerentes com o que se espera da organização pública contemporânea.

Full textEn el presente artículo, el autor destaca la importancia del principio-derecho a la debida motivación en el marco de los procedimientos administrativos. En esa línea, afirma que todas las entidades públicas están obligadas a expedir actos administrativos debidamente fundamentados, pues este constituye un requisito de validez que, de ser inobservado, acarrea la nulidad del acto. Pero más allá de validar al acto administrativo, el autor sostiene que el principal beneficio de que se cumpla con la debida motivación radica en la mejora de la interacción entre los administrados y la Administración Pública, generando mayor confianza en la actividad estatal y propiciando el desarrollo de actividades económicas con cada vez mayores niveles de formalidad.

As normas que conferem ao órgão de julgamento administrativo a competência para reduzir ou relevar penalidades tributárias, denominada de atividade de moderação sancionatória, representam o desejo de aplicação das sanções com observância dos postulados da igualdade, da razoabilidade e da proporcionalidade. A jurisprudência do órgão de julgamento administrativo paulista aponta o exercício da atividade de moderação sancionatória em diferentes quantidades, intensidades e qualidades, o que sedimenta injustiças impassíveis de revisão em sede de uniformização de jurisprudência, sobretudo por óbice imposto por súmula vinculante impeditiva. As injustiças foram empiricamente demonstradas, assim como a imprópria interpretação da súmula vinculante impeditiva. A situação atual prestigia antinomia sistêmica, na medida em que consagra uma inadmissível figura de juiz superpoderoso e da destinação do processo relegada significativamente à sorte da distribuição do recurso. Há decisões que apresentam fundamentos vagos e impróprios para definir a intensidade da moderação sancionatória, sobretudo quando apoiadas em conceitos vagos e inadequados de porte econômico, reincidência e antecedentes fiscais. Há parte substancial das decisões que sequer apresentam justificativas para definir a intensidade da moderação sancionatória, maculando-as com vício de nulidade. A justificativa da decisão é o instrumento que viabiliza o controle da legalidade dos atos administrativos, sobretudo quanto à efetividade das finalidades da própria sanção, com especial atenção aos bens jurídicos tutelados. A discricionariedade do julgador não diz respeito à dispensa de justificar, mas ao dever de justificar sem recorrer a padrões previamente definidos, senão de forma lógica, razoável e juridicamente aceita.
The rules granting the administrative ruling organ competence to decrease or increase tax penalties, denominated moderate sanctionary activity, represent the will to impose penalties in compliance with the equality, reasonability and proportionality postulates. The São Paulo ruling organ precedents point out to the exercise of moderate sanctionary activity in different amounts, intensity and qualities, consolidating injustices not liable to review at the jurisprudence standardizing process, above all due to obstacles imposed by a blocking binding abridgment of law. The injustices were empirically demonstrated as well as the inadequate interpretation of the blocking binding abridgment of law. The current situation privileges a systemic antinomy as it consecrates the figure of an unacceptable all-powerful judge, with the proceedings destination significantly relegated to the whims of the appeal distribution. There are decisions presenting vague and inappropriate bases to define the intensity of the moderate sanctioning, mainly when supported by vague and inadequate concepts of an economic nature, relapse and tax background. A substantial part of the decisions does not even present justifications to define the intensity of the moderate sanctioning, tarnishing them with the nullity flaw. The decision justification is the tool making feasible the administrative acts legality, moreover as to the effectiveness of the purposes of the sanction in itself with special attention to the protected legal assets. The judge’s discretion is not related to justification exemption but to the duty of justifying without resorting the previously defined standards, unless in a logic, reasonable and legally accepted form.

Full textThe objection of parallel proceedings, judge-made law created by the Council of State from the middle of the Second Empire, is traditionally explained like an absolute bar to proceedings devoted to misuse of powers. Indeed, the action is inadmissible if the applicant may bring another action, the parallel proceedings, with similar effect. This primary version has been modeled with a synthesis of notion characteristics. A standard model was produced and the judge can settle other situations of parallel proceedings. This second version of the objection of parallel proceedings is adapted to new proceedings like emergency proceedings or the implementation of European Union law. The practice of the objection of parallel proceedings is not theorizable. The judge is using this notion intuitively as a method for leading his judicial policies

A ênfase recai nos aspectos que circundam gestão de pessoas por serem, em boa parte das vezes, propulsores dos PASD publicados e, ainda, pelo fato de os gestores estarem envolvidos de forma direta nos processos como denunciantes ou mesmo como sindicados. Os pressupostos deste estudo baseiam-se na análise de dados e informações avistadas nas próprias portarias de instauração de processos publicadas em Diário Oficial do Município (DOM) e, principalmente, pelos depoimentos prestados ao longo da instrução, colhidos pela Comissão Permanente de Sindicância/Disciplinar (CPSD), cuja autora deste trabalho atuou como membro de fevereiro de 2010 a março de 2013. Entretanto, os casos destacados neste plano sofreram o recorte dentre os processos que tramitaram no período de 2010/2012, devido estarem dentro do período de vigência da CPSD e, também, em razão de terem composto o período de maior número de processos com o tema em estudo. De fevereiro de 2010 até julho de 2012, a CPSD instruiu 101 processos administrativos, dos quais vinte e três emergiram por problemas interpessoais. Pelos teores apreciados nos processos, facilmente se denota que a maioria destes casos resultou em punibilidade aos sindicados, que poderia ser evitada, se houvesse no município adoção de meios alternativos de resolução para pequenos incidentes cometidos por servidores, antecedendo, desse modo, abertura de sindicâncias, visto que os conflitos interpessoais entre a comunidade interna nos casos analisados foram remetidos em primeira instância ao campo processual, e não como último recurso. Ademais, os processos administrativos, além de onerarem os cofres públicos ainda não contribuem para que seja dissipada a desarmonia no ambiente escolar, em face de ter como proposição, caso comprovada a irregularidade, caráter punitivo e não preventivo.
The present Educational Action Plan (PAE) was driven by the needs of analyzing the context of Investigation/Disciplinary administrative proceedings (PASD), which the school managers are involved at the Municipal Secretary of Education in Limeira, being the main reason of studies due to investigation actions related to divergences in school environment between school managers/employees or employees/employees. The emphasis is on the issues surrounding people management for being, in parts, the propellants of published PASD, and also by the fact that they are directly involved in the proceedings as complainants or even Union members. The assumptions of this study are based on database and information observed in instauration ordinance proceedings published at the Municipal Official Journal (DOM), and mainly, by the statements given during instruction, collected by the Investigation/Disciplinary Standing Committee (CPSD), whose author of this present paper acted as a member from February 2010 to March 2013. Therefore, the highlighted cases in this plan suffered the cutting among the proceedings that were submitted between 2010 and 2012, which were in CPSD validity and also being part of the longest period of proceeding numbers as the subject of this study. From February 2010 until July 2012, the CPSD instructed 101 administrative proceedings, from which twenty-three happened because of interpersonal problems. We can easily observe, by the appreciated amount in the proceedings, that in most cases it resulted in punishment to the unions, which could have been avoided, if there were alternative ways of resolution adoptions to small incidents made by servers, preceding, this way, union openings, as the interpersonal conflicts between the internal community in the analyzed cases were sent to first instance to the tribunal, and not as last resort. In addition to that, the administrative proceedings cost money and they do not contribute for having harmony in the school environment, in case of the evidence of irregularity, punitive and not disciplinary character.

Сформулированные положения и предложения основываются на результатах наявных научных исследований, анализе таможенного и административноделиктного законодательства, международных конвенций, статистических данных правоприменительной деятельности таможенных органов и практики административных судов. Систематизированы научные исследования, касающиеся проблемы определения содержания административно-юрисдикционных производств и их места в деятельности таможенных органов, выделены признаки и обосновано понятие «административно-юрисдикционные производства в деятельности таможенных органов», предложены стадии таких производств, а также определены виды производств. Признание связи между материальными и процессуальными нормами обусловило необходимость определения административно-юрисдикционными производствами в деятельности таможенных органов только той части отношений по осуществлению административно-юрисдикционной деятельности, которая урегулированы нормами Кодекса административного судопроизводства Украины, Кодекса Украины об административных правонарушениях и корреспондирующими с ними нормами Закона Украины «О предупреждении коррупции», Таможенного кодекса Украины. Иные юрисдикционные отношения (по применению должностными лицами таможенных органов мер административного принуждения, привлечения к дисциплинарной ответственности, рассмотрения и разрешения жалоб) предложено рассматривать такими, которые урегулированы административно-процедурными нормами. Выделены факторы влияния на формирование и реализацию таможенными органами правового статуса и его особенности в административно-юрисдикционных производствах, исходя из генезиса их правового статуса и компетенции в административно-юрисдикционных производствах.
The dissertation carried out a theoretical synthesis and proposed a new solution to the scientific task of determining the essence and content of administrativejurisdictional proceedings in the activities of customs authorities. The formulated provisions and proposals are based on the results of existing research, analysis of customs and administrative-tort legislation, international conventions, statistics on the enforcement of customs authorities and the practice of administrative courts. Scientific studies on the problem of determining the content of administrativejurisdictional proceedings and their place in the activities of customs authorities have been systematized, the signs and rationale of the concept of administrative-jurisdictional proceedings in the activities of customs authorities were identified, the stages of such proceedings have been proposed, and the types of proceedings have been defined. Recognition of connection between the material and legal procedure caused need of definition by administrative and jurisdictional productions in activities of customs authorities only of that part of the relations for implementation of administrative and jurisdictional activity which are settled by standards of the Code of Administrative Legal Proceedings of Ukraine, the Code of Ukraine on Administrative Offences and corresponding to them the provisions of the law of Ukraine «On the prevention of corruption», the Customs Code of Ukraine. Other jurisdictional relations (on the application by customs officials of measures of administrative coercion, disciplinary liability, consideration and resolution of complaints) are proposed to be considered as regulated by administrative and procedural rules. The factors of influence on formation and implementation by customs authorities of legal status and its peculiarities in administrative-jurisdictional proceedings have been identified, based on the genesis of their legal status and competence in administrative-jurisdictional proceedings.

Full textThe present work aims the study of the Due Process of Law and its implications in administrative disciplinary proceedings. It starts with the background of Due Process in the Brazilian legal and a brief historical description of the principle and its analysis, based on the phenomena of constitutionalization of the law. The study of administrative disciplinary proceedings is made, initially from the general approach of this process at the federal level, from the perspective of Law 8112/90, with the analysis of each of its phases, moving after, the study of principles that give concreteness to the Due Process of Law as well as the consequences of its impact on the process under study. The work contains, therefore, the study in furtherance of the principles of due process of law, namely: contradictory and full defense, natural judge, reasonableness and proportionality and, finally, a reasonable duration of proceedings. In items where the above principles are studied, sought to conceptualize them and examine its foundations, scope and direction in the processes of disciplinary sanctions in order to verify their impact in specific cases, as well as the understanding of the Superior Courts on the matter
O presente trabalho tem por objeto o estudo do devido processo legal e suas implicações no processo administrativo disciplinar. Parte-se da contextualização do Devido Processo Legal no ordenamento jurídico brasileiro e de uma breve descrição histórica do princípio e da sua análise, tomando por base o fenômeno da constitucionalização do Direito. O estudo do processo administrativo disciplinar é feito, inicialmente, a partir de abordagem geral desse processo na esfera federal, sob a ótica da Lei 8112/90, com a análise de cada uma de suas fases, passando-se, após, ao estudo dos princípios que conferem concretude ao Devido Processo Legal, bem como as consequências da sua incidência no processo em estudo. O trabalho compreende, assim, o estudo dos princípios concretizadores do Devido Processo Legal, quais sejam: contraditório e ampla defesa, juiz natural, razoabilidade e proporcionalidade e, por fim, a razoável duração do processo. The dissertation research is aimed at determining the essence, content of the procedural competence of public administration bodies, defining its principles, as well as types of its implementation, formulating on this basis concrete proposals for improvement of the existing administrative legislation, outlining the directions of its further development. The scientific researches on the essence of the procedural competence of public administration bodies and its differentiation with related legal concepts have been systematized. The scientific approach to characterizing the essence of the procedural competence of public administration bodies is substantiated. A scientific view on the definition of public administration bodies as a system of executive bodies and local self-government bodies which are delegated powers of the executive power is supported. The concept has been formulated and the types of procedural forms of exercising competence by public administration bodies have been defined. The essence of the procedural competence of public administration bodies is characterized by taking into account the elements of the legal status of such bodies in administrative proceedings. The following elements define: the task of participating in the conduct of a particular entity; the scope of his competence, which is determined by the rules of administrative substantive law. The content of these elements in a particular administrative procedure is determined by the rules that determine its procedural form. The expediency of classifying these forms by the criterion of the tasks performed is substantiated. This criterion identifies proceedings aimed at: resolving disputes and / or bringing a person to justice (jurisdictional); management tasks (non-jurisdictional). As the administrative jurisdiction is exercised (implemented) in the procedural form, the following administrative jurisdictional proceedings are distinguished: a) proceedings before the administrative courts; b) proceedings for the application of measures of administrative coercion; c) disciplinary proceedings. Criteria for delimitation of procedural competence of public administration bodies in administrative jurisdictional and administrative non-jurisdictional proceedings are defined. Characterization of procedural competence of public administration bodies in extrajudicial administrative jurisdiction proceedings is given. The necessity to consider the procedural competence of public authorities in extrajudicial administrative jurisdictional proceedings not only from the point of view of the totality of their rights, duties and powers in these proceedings, but also must include legal personality as an ability to participate in these proceedings. It is stated that there are grounds for systematizing the competence of public authorities on the basis of the scope of its implementation and the legal nature of the rules of law in which it is enshrined: substantive and procedural. It is proved that the competence of the procedural jurisdiction is to determine the competence of a public authority in a particular administrative proceeding or in an administrative proceeding before a court. However, the provisions on the interrelation of the categories of "powers", "sphere of competence", "functions" may also apply to competence in procedural legal relations. Based on the above, it is substantiated that the competence of a public authority may be considered as the basis of its legal personality not only in material administrative legal relations but also in procedural ones. The description of procedural competence of public administration bodies in judicial administrative process is given. The directions of improving the procedural competence of public administration bodies as subjects of proceedings are outlined: in cases of administrative offenses; on complaints of citizens in public administration bodies; disciplinary proceedings. The perspective direction of improving the procedural competence of public administration entities is to determine the unification of the legal regulation of the procedure of conducting official investigations in cases concerning: disciplinary proceedings in labor matters and in matters of administrative legal relations. At the same time, an approach similar to the regulation of the procedural form of disciplinary proceedings in general is considered promising: to determine the general principles of such an investigation in a separate normative act, and to set particularities, depending on the specific activity of specific subjects of public administration, at the level of special normative acts. The expediency of defining the concept of service discipline, which is one of the ways of ensuring the unity of the law enforcement practice of the law on bringing to disciplinary responsibility, is justified, since it presupposes the avoidance of different views on the content of the service discipline, formation of a single non-conflict legal understanding.

Изучен генезис института административной ответственности за проявление неуважения к суду. Охарактеризованы нормативно-правовые основы административной ответственности за проявление неуважения к суду. Доказана необходимость признания вредных последствий квалифицирующими признаками административного правонарушения, предусмотренного статьей 185-3 КУоАП. Предложено разработать единые нормы должного поведения участников судебного процесса и присутствующих во время судебного заседания, а также закрепить их в специальном нормативном акте. Раскрыт юридический состав административного правонарушения, предусмотренного статьей 185-3 КУоАП. Выявлены общие принципы производства по делам о проявлении неуважения к суду. Определены процессуальный статус участников производства по делам о проявлении неуважения к суду. Охарактеризованы и раскрыты особенности стадий производства по делам о проявлении неуважения к суду. Обобщен зарубежный опыт правового регулирования привлечения к ответственности за проявление неуважения к суду и определены возможности его использования в Украине. Определены перспективные направления совершенствования привлечения лица к административной ответственности за проявления неуважения к суду в Украине.
The dissertation is focused on studying the content and specific features of administrative liability for direct contempt in Ukraine. Due to the retrospective analysis of the development of administrative and legal liability for direct contempt the author has defined the stages of development of the administrative liability institution for direct contempt. Based on the conducted analysis of the scientific literature, the author has offered the definition of the concept of “proceedings in cases on administrative offenses”. It has been found out that administrative liability for offenses in cases of direct contempt, taking into account the subject matter of legal regulation, is attributed to such offenses that encroach on the established management procedure. It has been established that the proceedings in the case of direct contempt have their own characteristics related to the sectoral specifics of the trial, as well as the possibility of issuing a decision to impose an administrative penalty without drawing up minutes in case of admission of guilt, while the formation and execution of materials on an administrative offense in cases on direct contempt is carried out according to general rules defined by regulatory legal acts and the Code of Ukraine on Administrative Offenses taking into account the above characteristics. The author has substantiated the concept of “normative basis of administrative liability for direct contempt” and its differences from the concept of “normative ground for administrative liability for direct contempt”. It has been found out that the normative basis of administrative liability for direct contempt determines the introduction of corpus delicti of an administrative offense into the system of legal norms, which consists in the manifestation of direct contempt, determines the basic characteristics of the normative structure of this administrative offense (object, objective aspect, subject, subjective aspect). The corpus delicti of an administrative offense under the Art. 185-3 of the Code of Ukraine on Administrative Offenses has been considered as a legal construction that combines subjective and objective features that collectively indicate the illegality of the action. It has been noted that the subjects of administrative offenses for direct contempt can be divided into general and special ones. It has been emphasized that an expert as a special subject of an administrative offense under the Art. 185-3 of the Code of Ukraine on Administrative Offenses is liable solely for the contempt of the Constitutional Court of Ukraine. Based on the conducted analysis of the scientific literature, the author has suggested definition of the concept of “proceedings in cases on administrative offenses”. It has been established that the proceedings in the case for direct contempt have their own characteristics related to the sectoral specifics of the trial, as well as the possibility of issuing a decision to impose an administrative penalty without drawing up minutes in case of admitting the guilt by a person. It has offered to develop uniform norms of proper conduct for the participants of the trial and those present at the court hearing and to enshrine them in a special normative act entitled “Rules of conduct during court hearings and the trial”, which would cover all types of proceedings. It has been offered to amend the current legislation in order to differentiate and specify administrative liability for direct contempt. It has been clarified that the main stages of proceedings in cases on administrative offenses for direct contempt are: initiation of proceedings in the case on direct contempt, court proceedings, ruling, appeal against the decision in the case on direct contempt. It has been established that during the initiation of proceedings in cases on direct contempt, the judge while hearing the case performs functions of prosecution that are not peculiar to him. In this regard, the author has offered to amend the norms of procedural law, in particular on the need in these cases to transfer the case on direct contempt to a judge who is not a member of the court hearing the case in order to ensure the principle of impartiality. The author has carried out the analysis of the experience of legal liability for direct contempt or established court rules in the United States, Canada, France, Australia, Belgium, Poland, Great Britain, New Zealand, Ireland, India. That allowed us to form the ways of improving the current legislation of Ukraine. The author has singled out seven perspective areas for improving administrative liability for direct contempt, which include: consolidating the regulation of the procedure for bringing a person to administrative liability for direct contempt at the legislative level; ensuring the realization of the right to professional legal assistance; ensuring a fair and impartial trial by bringing another person to justice for insulting a judge by another judge; determining both the court room and the adjacent territory as the place of direct contempt; attributing publications, statements and interviews in the case before the court’s decision to the manifestations of direct contempt; preventing the return of materials on administrative offenses.

Full textThe European perspective has shed new light on the question of whether maintaining or ruling out jurisdictional dualism in France through two main approaches: on the one hand, the resilience of substitutable models and, on the other hand, the scrutiny of European standards. Considered as a model, the French system has inspired the majority of states in Europe. This wave of inspiration has nevertheless been short-lived. Indeed, most states in Europe have established a judicial system, which is different from the French model. Bringing the French system towards the one adopted by most states in Europe is juridically feasible but raises several issues in practice. As a result, the French system, albeit minor amongst the European states, is probably prone to live on. Furthermore, bringing the French system towards European standards raised the question of a likely end of it. In fact, the French system came under critics, whether effective or potential, of its administrative courts and legal proceedings, together with critics concerning its so-called “Tribunal des conflits” and the legal proceedings. These critics point to the fact that reforming the French system was inevitable. Such reforms led the French system back on some of its secular anchored practices. Eventually, reforms also contributed to bring closer both the administrative court and the administrative legal proceedings to both civil court and civil legal proceedings. Saved at the cost of numerous reforms, the French system nevertheless managed to preserve its basic structures. This in turn provides evidence that the French system is able to adapt itself to an evolving European environment. Finally, the technical founding principles of jurisdictional dualism have been reinforced

З’ясовано сутність і особливості процесуального представництва та процесуального правонаступництва в адміністративному судочинстві. Визначено поняття та охарактеризовано види забезпечення адміністративного судочинства України. Встановлено особливості участі правоохоронних органів в адміністративному судочинстві України. Dissertation is devoted to the analysis of legal principles of organization of Administrative Proceedings of Ukraine. Essence, features and objectives of Administrative Proceedings of Ukraine are determined. The system of legal regulation and the principles of Administrative Proceedings in Ukraine. The author carried out the characteristics of administrative courts as leading subjects of Administrative Proceedings in Ukraine. In particular, concepts of administrative courts and their species are clarified. We also revealed concept, types and features of administrative court’s jurisdiction. A definition and the classification of members of the administrative process are proposed. We singled out features of the legal status of persons involved in the case, entities serving administrative process, knowledgeable people. The essence and characteristics of procedural representation and procedural succession in administrative proceedings are found. It was determined the concept and types of collateral of Administrative Proceedings of Ukraine. The peculiarities of participating of law enforcement agencies in Ukrainian administrative proceedings are established. The author proposed ways of improving of legislation regulating the organization and implementation of the Administrative Proceedings of Ukraine.

Определены сущность, особенности и задачи организации административного судопроизводства Украины. Охарактеризована система нормативноправового регулирования организации административного судопроизводства в Украине. Установлена сущность и осуществлена классификация принципов организации административного судопроизводства в Украине. Охарактеризованы современные модели административной юстиции зарубежных стран и выяснено их влияние на организацию административного судопроизводства Украины. Осуществлена характеристика административных судов как ведущих субъектов административного судопроизводства в Украине, в частности выяснено их понятие и обозначены их виды. Раскрыты сущность и особенности юрисдикции административных судов Украины. Определены понятие, виды и особенности подсудности публично-правовых споров административным судам. Осуществлен анализ организации деятельности административных судов по рассмотрению и разрешению публичноправовых споров на отдельных стадиях административного процесса. Full textThis dissertation aims at analysing the aplicability of the disregard doctrine in administrative proceedings before the Administrative Council of Economic Defense´s (namely CADE). As part of such analysis, this work includes an overview of the insertion of the disregard doctrine in the Brazilian legal system, as well as an evaluation on the doctrine\'s compatibility with the principles applicable to the administrative procedure. It will also be analysed the substantive and procedural challenges posed to the application of the disregard doctrine in the administrative procedure, especially those arising from the proceduralization of the administrative activity; the regulation of the disregard doctrine as an incidental application under the new Code of Civil Procedure; and the case law findings on the matter. In Chapter One, there are considerations concerning the disregard doctrine\'s purposes, effects and impacts on the Brazilian legal system and case law. Chapter Two deals with the conformation of the disregard doctrine to the principles applicable to the administrative law procedure. Chapter Three presents an investigation on the procedural and material difficulties faced by CADE in applying the disregard doctrine to administrative proceedings. In the end, it was concluded that, despite the growing application of the disregard doctrine to administrative proceedings, this trend is not observed under the competition law. The difficulty in obtaining evidence of the infringements provided for in Article 34 of Law No. 12.529/2011 and the existence of other legal mechanisms conveying direct responsibility to others beside the infringing entity slowed the development of the disregard doctrine under the competition law.

Full textУ дисертаційному дослідженні здійснено комплексну наукову розробку теоретичних та прикладних проблем правової охорони відносини щодо використання бюджетних коштів. У результаті проведеного дослідження сформульовано низку нових наукових положень, запропонованих особисто здобувачем. Запропоновано вважати, беручи за основу нормативно-правові конструкції, елементом яких є поняття «використання бюджетних коштів» та операції (стадії) виконання бюджету за видатками, що відносини щодо використання бюджетних коштів передбачають взяття розпорядниками та одержувачами бюджетних зобов’язань, отримання товарів, робіт і послуг, здійснення платежів відповідно до взятих бюджетних зобов’язань, а також використання товарів, робіт і послуг для виконання заходів бюджетних програм. При цьому, відносини щодо використання бюджетних коштів складають окремий вид правовідносин у структурі видаткових бюджетних відносин, передумовою їх виникнення є відносини щодо фінансування з бюджету, а необхідною умовою належного функціонування ‒ бюджетний контроль. Доведено доцільність переглянути систему правової охорони відносин щодо використання бюджетних коштів, імплементувавши до неї норми щодо охорони ефективного використання коштів за допомогою застосування заходів державного примусу. Доведено, що відповідно до принципу цільового використання бюджетні кошти повинні бути використані на цілі, визначені бюджетними призначеннями, бюджетними асигнуваннями, паспортом бюджетної програми чи порядком використання бюджетних коштів. Використання коштів за невідповідними кодами економічної класифікації видатків може свідчити про можливе порушення цього принципу, однак не може вважаться єдиною достатньою підставою для кваліфікації діяння як нецільове використання. Зокрема, необхідно враховувати, що в умовах застосування програмно-цільового методу не буде вважатися використанням коштів не за цільовим призначенням здійснення видатків за кодом економічної класифікації, що не в повній мірі відповідає економічній сутності платежу, однак відповідає цілям, визначеним у паспорті бюджетної програми чи в порядку використання бюджетних коштів. Запропоновано механізмом правової охорони відносин щодо використання бюджетних коштів вважати сукупність правових засобів, за допомогою яких держава здійснює правовий вплив на відносини щодо використання бюджетних коштів з метою профілактики, виявлення і припинення протиправного використання бюджетних коштів, притягнення винних осіб до юридичної відповідальності та вирішення публічно-правових спорів у цій сфері. Елементами механізму правової охорони відносин щодо використання бюджетних коштів є: норми права, правовідносини (щодо застосування заходів юридичної відповідальності за протиправне використання бюджетних коштів; профілактики порушень бюджетного законодавства, що регулює використання бюджетних коштів; виявлення і припинення протиправного використання бюджетних коштів; судового розгляду спорів, що виникають під час використання бюджетних коштів), акти безпосередньої реалізації прав і обов’язків та акти правозастосування. Доведено, що до суб’єктів правової охорони відносин щодо використання бюджетних коштів належать суб’єкти правотворчості (Верховна Рада України, Президент України, органи місцевого самоврядування, органи виконавчої влади), органи бюджетного контролю, правоохоронні органи та суди. Відзначено, що систему підрозділів, які здійснюють оперативно-розшукову діяльність як суб’єкти правової охорони відносин щодо використання бюджетних коштів, складають оперативні підрозділи Національної поліції, Національного антикорупційного бюро України, Державного бюро розслідувань, Служби безпеки України та податкової міліції. Створення Бюро фінансових розслідувань зумовить передачу частини повноважень Національної поліції та Служби безпеки України щодо здійснення оперативно-розшукової діяльності до нової правоохоронної структури, а також ліквідацію податкової міліції. Наголошено на тому, що застосування заходів впливу за порушення бюджетного законодавства є одним із ключових елементів системи фінансово-правової охорони відносин щодо використання бюджетних коштів. До заходів впливу, що застосовуються з метою правової охорони відносин щодо використання бюджетних коштів, слід віднести попередження про неналежне виконання бюджетного законодавства з вимогою щодо усунення порушення бюджетного законодавства, зупинення операцій з бюджетними коштами, призупинення бюджетних асигнувань, зменшення бюджетних асигнувань, повернення бюджетних коштів до відповідного бюджету. Підставою їх застосування є найбільш поширене та небезпечне правопорушення, що посягає на досліджуваний вид відносин ‒ нецільове використання бюджетних коштів. Безспірне ж вилучення коштів з місцевих бюджетів, підставою застосування якого є здійснення видатків (кредитування) місцевого бюджету, які відповідно до Бюджетного кодексу України мають проводитися з іншого бюджету, як захід впливу спрямований на правову охорону як відносин щодо використання бюджетних коштів, так й іншого виду видаткових відносин ‒ щодо фінансування з бюджету. Зважаючи на те, що попередження про неналежне виконання бюджетного законодавства з вимогою щодо усунення порушення бюджетного законодавства може застосовуватися усіма органами бюджетного контролю, доведено доцільність врегулювання порядку застосування цього заходу впливу за допомогою нормативно-правового акту Кабінету Міністрів України. Крім загальних процесуальних аспектів (письмова форма, строки та процедура складання і направлення попередження) у постанові Кабінету Міністрів України «Про порядок застосування попередження про неналежне виконання бюджетного законодавства з вимогою щодо усунення порушення бюджетного законодавства» важливим є: розділити повноваження органів бюджетного контролю щодо підстав (конкретних порушень бюджетного законодавства) застосування цього заходу впливу; закріпити принцип реагування на порушення бюджетного законодавства єдиним правозастосовним документом, що включає змістовні характеристики і попередження, і вимоги щодо усунення порушення бюджетного законодавства, а також забороняє направлення окремо попередження, а окремо вимоги; встановити критерії конкретизації (визначеності) вимоги щодо усунення порушення бюджетного законодавства, зазначивши, що в ній в обов’язковому порядку мають бути зазначені які саме дії повинен здійснити учасник бюджетного процесу для усунення порушення та на підставі яких положень нормативно-правових актів. Зважаючи на поширеність адміністративно-караного нецільового використання бюджетних коштів, значну суспільну шкідливість цього правопорушення та непоодинокі випадки уникнення відповідальності посадових осіб розпорядників (одержувачів) бюджетних коштів у зв’язку із закінченням строків притягнення до адміністративної відповідальності, доведено необхідність посилення відповідальності за це адміністративне правопорушення. Для цього необхідно вилучити нецільове використання бюджетних коштів з ч. 5 ст. 164-12 КУпАП, зазначивши цей проступок у ч. 7 цієї статті, і передбачивши за його вчинення штраф у розмірі від ста до двохсот неоподатковуваних мінімумів доходів громадян. Крім того, доцільно збільшити строки накладення адміністративного стягнення за нецільове використання бюджетних коштів (протягом шести місяців з дня його виявлення, але не пізніше двох років з дня його вчинення), внісши відповідні зміни у ч. 3 ст. 38 КУпАП. Обґрунтовано думку про те, що позивачам ‒ розпорядникам чи одержувачам бюджетних коштів під час формулювання змісту позову про оскарження рішення щодо застосування заходів впливу за порушення бюджетного законодавства (вимоги органів державного фінансового контролю про усунення порушень) слід враховувати, що оскарженню підлягають лише ті положення, на підставі яких у них виникають обов’язки вчинити певні дії. Такі обов’язки не виникають у випадку отримання від органів бюджетного контролю вимоги відшкодувати збитки, заподіяні бюджету нецільовим використанням коштів (оскільки стягнення збитків здійснюється або у добровільному порядку, або за рішенням суду, а не на підставі владного рішення відповідного суб’єкта), що зумовлює визнання судами звернення з позовом про скасування цих вимог неналежним способом захисту порушеного права та відповідно відмову у задоволенні позову. Відзначено, що адміністративні суди під час розгляду справ щодо оскарження вимог органів державного фінансового контролю про усунення порушень бюджетного законодавства (нецільового використання бюджетних коштів) у випадку зазначення у вимозі не лише зобов’язання відшкодувати збитки бюджету, але й здійснити інші дії щодо усунення порушення (притягнути винних осіб до відповідальності, привести у відповідність до вимог чинного законодавства правові акти бюджетної установи тощо), прохання позивача щодо скасування вимоги у цій частині повинні визнавати належним способом захисту порушеного права, у зв’язку з чим суди мають дати правову оцінку вимозі, а також фактичним обставинам, на підставі яких у вимозі було зобов’язано учасника бюджетного процесу здійснити певні дії (у тому числі й щодо наявності чи відсутності факту нецільового використання бюджетних коштів). Обґрунтовано думку про те, що у справах за позовом органів державного фінансового контролю до розпорядників (одержувачів) про відшкодування значної суми збитків, завданих держаному чи місцевим бюджетам нецільовим використанням бюджетних коштів, важливим є забезпечити можливість використання правил загального позовного провадження та касаційного оскарження. Для цього потрібно внести зміни до ч. 4 ст. 12 Кодексу адміністративного судочинства України, передбачивши, що за правилами загального позовного провадження розглядаються справи у спорах щодо відшкодування збитків, завданих держаному чи місцевим бюджетам, у сумі, що перевищує п’ятсот розмірів прожиткового мінімуму для працездатних осіб. The dissertation deals with the comprehensive scientific elaboration of theoretical and applied problems of legal protection of relations concerning the use of budgetary funds. As a result of the research, a number of new scientific statements proposed by the applicant are formulated. Taking the normative and legal constructions as a basis, the element of which is the concept of "use of budgetary funds" and operations (stages) of execution of expenditure budget, the relations concerning the use of budgetary funds involve managers and recipients of budget commitments, goods, works and services, making payments in accordance with the budget commitments, as well as the use of goods, works and services to implement budget programs. At the same time, the relations concerning the use of budgetary funds is a separate type of legal relations in the structure of budget expenditure relations, a precondition for their emergence is the relations concerning the budget financing, and a necessary condition for proper functioning is budget control. The expediency of revising the system of legal protection of relations concerning the use of budgetary funds with implementing to it the norms on the protection of effective use of funds through the application of state coercive measures is grounded. It is proved that in accordance with the principle of ring-fenced financing, budgetary funds must be used for purposes determined by budgetary appropriations, budgetary allocations, budget program passport or the procedure for using budgetary funds. The use of funds under inappropriate codes of economic classification of expenditures may indicate a possible violation of this principle, but cannot be considered the only sufficient basis for the classification of the act of non-ring-fenced use. In particular, it should be taken into account that in terms of application of the program-target method, the use of funds without a particular purpose will not be considered expenditure execution under the economic classification code, which does not fully correspond to the economic essence of the payment, but meets the objectives specified in the passport of the budget program or in the use of budgetary funds. The mechanism of legal protection of relations on the use of budget funds is defined as a set of legal means by which the state has a legal influence on relations on the use of budget funds in order to prevent, detect and stop the illegal use of budget funds, bring perpetrators to justice and resolve public law disputes in this area. The elements of the mechanism of legal protection of relations on the use of budget funds are as follows: law, legal relations (on the application of legal liability for misuse of budget funds; prevention of violations of budget legislation governing the use of budget funds; detection and termination of misuse of budget funds; litigation, arising from the use of budget funds), acts of direct realization of rights and obligations, and acts of law enforcement. It is proved that the subjects of legal protection of relations on the use of budget funds include law-making entities (the Verkhovna Rada of Ukraine, the President of Ukraine, local governments, executive authorities), budget control bodies, law enforcement agencies and courts. It is noted that the system of units that carry out operational and investigative activities as subjects of legal protection of relations on the use of budget funds consists of operational units of the National Police, National Anti-Corruption Bureau of Ukraine, State Bureau of Investigation, Security Service of Ukraine and tax police. The establishment of the Bureau of Financial Investigations will result in the transfer of authority of the National Police and the Security Service of Ukraine in the sphere of operational and investigative activities to the new law enforcement agency, and the elimination of the tax police. It is emphasized that the application of measures of influence for violation of budget legislation is one of the key elements of the system of financial and legal protection of relations on the use of budget funds. The measures of influence applied for the purpose of legal protection of relations on the use of budget funds should include the warning about improper execution of the budget legislation with the requirement on elimination of violation of the budget legislation, suspension of operations with budget funds, suspension of budget allocations, reduction of budget allocations, return of budget funds to the relevant budget. The reason for their application is the most widespread and dangerous offense that encroaches on the investigated species relationships which is the misuse of public funds. The undisputed withdrawal of funds from local budgets, the basis of which is the implementation of expenditures (crediting) of the local budget, which according to the Budget Code of Ukraine should be carried out from another budget, as a measure aimed at legal protection of relations on the use of budget funds and other expenditure relations - on financing from the budget. Taking into consideration that the warning about improper implementation of budget legislation with the requirement to eliminate violations of budget legislation can be applied by all budgetary control bodies, the expediency of regulating the application of this measure of influence by a normative-legal act of the Cabinet of Ministers of Ukraine is proved. In the resolution of the Cabinet of Ministers of Ukraine "On the procedure for applying the warning on improper implementation of budget legislation with the requirement to eliminate violations of budget legislation" there are following important issues in addition to the general procedural aspects (written form, terms and procedure for drafting a warning): to share the powers of budgetary control bodies on the grounds (specific violations of budget legislation) of the application of this measure of influence; to consolidate the principle of responding to violations of budget legislation with a single legal document, which includes substantive characteristics, warnings, and requirements for eliminating violations of budget legislation, as well as prohibits sending separate warnings and separate requirements; to establish criteria for concretization (certainty) of the requirement to eliminate violations of budget legislation, noting that it must specify the provisions of normative-legalacts, on the basis of which a participant in the budget process has to take actions to eliminate such violation. Taking into consideration the prevalence of administratively punishable misuse of budget funds, significant social harm of this offense and the frequent cases of evasion of officials’ responsibility, managers (recipients) of budget funds in connection with the expiration of administrative prosecution, the need to strengthen liability for this administrative offense is determined. To do this, it is necessary to remove the misuse of budget funds from Part 5 of Article 164-12 of Code of Ukraine on Administrative Offenses, having noted this misdemeanor in Part 7 of this article and provided the penalty at a rate from one hundred to two hundred non-taxable minimum incomes of citizens for its commission. In addition, it is advisable to increase the period of imposition of administrative penalties for misuse of budget funds (within six months from the date of its detection, but not later than two years from the date of its commission), making appropriate changes in Part 3 of Article 38 of Code of Ukraine on Administrative Offenses. The opinion is substantiated that the plaintiffs – managers or recipients of budget funds when formulating the content of the claim to appeal the decision on the application of measures of influence for violations of budget legislation (requirements of public financial control to eliminate violations) should take into account that only those provisions are subject to appeal, on the basis of which they have obligations to take certain actions. Such obligations do not arise in the case of receiving from the budget control authorities a claim for covering damages caused to the budget by misuse of funds (because the recovery is carried out either voluntarily or by court decision, and not on the basis of an authoritative decision of the entity), which causes the courts to recognize the appeal with a claim for cancellation of these requirements in an improper way to protect the violated right and, accordingly, the refusal to satisfy the claim. It is noted that the administrative courts during the consideration of cases on appealing the requirements of state financial control to eliminate violations of budget legislation (misuse of budget funds) in the case of specifying in the request not only the obligation to compensate budget losses, but also to take other actions to eliminate violations (bring the perpetrators to justice, bring in line with the requirements of current legislation, the legal acts of the budgetary institution, etc.), the plaintiff's request to cancel the claim in this part should be recognized as the appropriate way to protect the violated right, in connection with which the courts must give a legal assessment of the claim, as well as the factual circumstances on the basis of which the claim required the participant in the budget process to take certain actions (including the presence or absence of the fact of misuse of budget funds). The opinion is substantiated that in cases of lawsuits of state financial control bodies to managers (recipients) for compensation of a significant amount of damages caused to the state or local budgets by misuse of budget funds, it is important to ensure the use of general claims and cassation appeals. To do this, they need to amend Part 4 of Art. 12 of the Code of Administrative Procedure of Ukraine, providing that under the rules of general claim proceedings the cases are considered in disputes over covering damages caused to the state or local budgets in the amount exceeding five hundred living wage for able-bodied persons.

The present work aims to discuss the obligation to iniciate a previous administrativeproceedings among all interested parties before the commecement of the special proceedingsof extrajudicial liquidation of financial institutions provided for by Law nº 6.024, de13.3.1974. In view of this, Law nº 6.024, de 13.3.1974 framework will be discussed , as wellas financial institutions officers or directors’ constitucional rights to full defense, adversaryproceedings and presumption of innocence, when they violate legal or bylaw rules.
O presente trabalho pretende discutir a obrigatoriedade de instauração de processo administrativo prévio, com a participação de todos os envolvidos, para a aplicação do regime especial de liquidação extrajudicial, disposto na Lei nº 6.024/74 de 13 de março de 1974. Desta forma, se discutirá o tratamento conferido pela referida lei, além das garantias constitucionais da ampla defesa, contraditório e da presunção de inocência, nos casos de decretação da liquidação extrajudicial pela violação de normas legais e estatutárias por seus administradores.

Full textВ диссертации приводится теоретическое обобщение и новое решение научной задачи, которая заключается в определении сущности и особенностей административно-правового обеспечения апелляционного производства в Украине, а также путей совершенствования административного законодательства, закрепляющего правовые основы обеспечения апелляционного производства. Особенности апелляционного производства как объекта административного правового обеспечения характеризуются в контексте обобщения особенностей административно-правового регулирования организации деятельности апелляционных судов. Определяется место административно-правового регулирования апелляционного производства в Украине, которое заключается в том, что именно с помощью норм административного законодательства решаются вопросы организации и обеспечения апелляционного производства в Украине, к которым, в частности, относятся: правовой статус апелляционных судов; порядок их работы, создания, ликвидации; полномочия данных учреждений; требования по поводу их служащих (судей, председателей и их заместителей); различные аспекты финансирования и комплектации штата, взаимодействия с другими органами власти и т.д. Исследуются принципы административно-правового обеспечения апелляционного производства в Украине. Под принципами административно-правового обеспечения апелляционного производства предлагается понимать основные идеи государственно-правового воздействия на общественные отношения в сфере обеспечения, организации и реализации института апелляционного производства. Выясняется сущность механизма административно-правового обеспечения апелляционного производства в Украине. Доказывается, что элементами механизма административно-правового обеспечения апелляционного производства в Украине выступают: во-первых, объект административно-правового обеспечения; во-вторых, субъекты административно-правового обеспечения; в-третьих, нормативно-правовая основа; в-четвертых, специальный правовой инструментарий. Изучаются направления и предмет административно-правового обеспечения апелляционного производства в Украине. Анализируются формы и методы административно-правового обеспечения апелляционного производства в Украине. Исследуется правовой статус субъектов административно-правового обеспечения апелляционного производства в Украине, под которыми понимается отдельная группа органов государственной власти и должностных лиц последних, которые в соответствии с комплексом предоставляемых им нормативно-правовыми актами Украины полномочий реализуют организационные, управленческие, контрольные, надзорные и другие административные функции для упорядочения общественных отношений, возникающих в сфере апелляционного производства. Изучается зарубежный опыт правового обеспечения апелляционного производства, устанавливаются возможности его использования в Украине. Предлагаются пути совершенствования административного законодательства, регламентирующего апелляционное производство в Украине. Определяются способы оптимизации организационных основ апелляционного производства в Украине.
The author of the dissertation has provided theoretical generalization and a new solution to the scientific problem, which consists in determining the essence and peculiarities of administrative and legal guaranteeing of the appeal proceedings in Ukraine and outlining the directions for its improvement. The essence and peculiarities of the appeal proceedings as an object of administrative and legal provision have been clarified. The legal principles of the appeal proceedings in Ukraine have been characterized and the place of administrative and legal regulation among them has been established. The principles and types of administrative and legal guaranteeing of the appeal proceedings in Ukraine have been systematized. The essence and structure of the mechanism of administrative and legal guaranteeing of the appeal proceedings in Ukraine have been revealed. The author has established the directions and subject matter of administrative and legal guaranteeing of the appeal proceedings in Ukraine, its forms and methods. The range of subjects of administrative and legal guaranteeing of the appeal proceedings in Ukraine has been outlined. International experience of legal guaranteeing of the appeal proceedings has been characterized and the possibilities of its application in Ukraine have been determined. The author has offered directions of improving administrative legislation, which regulates the appeal proceedings in Ukraine.

Taking into consideration that the Constitutional principles are applicable to the tax administrative proceeding, such principles, as well as the federal legal tax system, are studied so as to present an overview of the tax administrative proceeding and to point out its peculiarities. Therefore, the questions related to the assessment of taxes and the federal tax proceeding's postulates are examined under the rules foreseen in Decree 70,235/72 and Law 9,784/99, as well as under the Acts issued by Brazilian Internal Revenue Service, General Attorney Office and Federal Treasury Ministry. As a result, the aspects of the decision rendered in the federal tax administrative proceeding, the appeals provided by law and also other means of revision of the final administrative decision are studied. Finally, the conclusions achieved by means of all the research and investigation referred above are briefly presented
O objeto deste trabalho consiste na análise de aspectos relevantes da decisão proferida no processo administrativo tributário federal que trata da exigência dos créditos da União. Tendo em vista que ao processo administrativo aplicam-se os princípios constitucionais vigentes, percorremos o sistema constitucional, com ênfase no subsistema constitucional tributário e no subsistema processual tributário, quando apresentamos um panorama do regime jurídico e das peculiaridades do processo tributário. Partindo dessas considerações são analisadas as questões relacionadas ao lançamento tributário e os postulados fundamentais do processo administrativo tributário federal, à luz do que dispõem o Decreto 70.235/72, a Lei 9.784/99 e os principais atos normativos expedidos pelo Ministério da Fazenda, Secretaria da Receita Federal do Brasil e Procuradoria Geral da Fazenda Nacional. Full textO presente trabalho tem por objetivo aprofundar o regime jurídico disciplinar do servidor público temporário. Analisam-se as características principais dessa espécie de agente público que o diferenciam dos demais servidores e que justificam um regime disciplinar próprio. Em uma breve investigação sobre as prováveis origens do temporário, constata-se a presença desse servidor na Administração Pública brasileira desde 1823. No direito estrangeiro (particularmente, no direito francês e no direito português), verifica-se a existência de figuras assemelhadas ao servidor público temporário brasileiro, que é uma espécie de “servidor público” do gênero “agente público”, exercendo uma função pública, mas não ocupando nem cargo, nem emprego públicos, sendo contratado por tempo determinado para atender a necessidade temporária de excepcional interesse público. A Constituição Federal, em seu artigo 37, IX, indica que a lei estabelecerá os casos de contratação por tempo determinado, mas não há uma uniformidade entre os entes da federação sobre o regime jurídico adotado para o servidor temporário. Esta análise concentra-se na Lei Federal n.º 8.745/93, que disciplina o assunto. No âmbito federal, o servidor público temporário é dotado de um regime jurídico com características mais próximas do regime jurídico administrativo, sendo recrutado por meio de contrato administrativo assemelhado ao regime estatutário. Tal contratação deve pautar-se pela observância dos princípios da continuidade do serviço público, da moralidade, da impessoalidade, da razoabilidade, da proporcionalidade e da motivação. Focaliza-se a responsabilidade do servidor público temporário no âmbito administrativo, procurando-se demonstrar que tal servidor, por um princípio de equiparação, submete-se a um processo administrativo disciplinar para apuração de suas faltas, o qual cumpre prazos especiais e condições específicas em razão do vínculo temporário com a Administração Pública, em tudo sendo respeitado o devido processo legal, a ampla defesa e o contraditório. Analisam-se as diferenças entre o processo disciplinar do servidor temporário (sindicância) e o processo do servidor público em geral, os ritos adotados, os prazos, as penalidades e os recursos, constatando-se que o servidor público temporário responde pelos atos ilícitos em todas as esferas: penal, civil, administrativa e por atos de improbidade. A transitoriedade na função não o exime de responsabilidades, por isso, com as devidas adaptações, está sujeito aos ônus e bônus do serviço público. Daí a necessidade de construir, com base nas características próprias dessa espécie de servidor público, um regime adaptado às especificações do vínculo especial a que se submete o servidor público temporário. Propõe-se aqui um miniprocesso disciplinar ou um processo disciplinar especial, ou uma minissindicância ou uma sindicância especial, sui generis.

Full textSport disputes resolution has shown an extraordinary strength over the past twenty-five years through the interaction between the three main forms of justice as component of the "sport justices", i.e. the internal justice of the sport organisations (disciplinary and administrative justice), the alternative justice (ADR, arbitration and independent authorities) and the state justice (French and European justice).Through the dialogue between the various sport judges, we will also analyze how these three justices, despite their differences, enlighten each other, stand each other, respect and complete each other. This research also aims at highlighting the very existence of the dialogue between the different sport judges. This dialogue plays a part in the improving of sport disputes resolution and more generally of the sport rules.Through the dialogue of judges, the internal justice of the sport organisations has significantly changes to the benefit of the members of sport organsisations whose rights are more guaranteed. Alongside, thanks to the dialogue between judges, the development of the alternative justice is considerable, showing its significant efficiency in sport disputes resolution. Nonetheless, these two justices cannot pretend covering the whole sport litigation and handing down final and binding decisions. Despite the positive evolution of the internal justice of sport organisations and the development of the alternative justice, the involvement of the state justice remains indispensable in the good resolution of sport litigation

Выясняются основные этапы становления и развития правовых основ реализации мер принудительного исполнения судебных решений в Украине. Раскрывается понятие и определяются виды мер принудительного исполнения судебных решений в Украине. Обобщаются принципы реализации мер принудительного исполнения судебных решений в Украине. Механизм административно-правового обеспечения реализации мер принудительного исполнения судебных решений в Украине определен как система организационно-управленческих и правовых средств, мероприятий, инструментов, благодаря которым обеспечивается надлежащий порядок, а также другие важные условия, необходимые для эффективной и качественной реализации процесса принудительного исполнения судебных решений. Устанавливаются роль и значение начальной стадии исполнительного производства. Выделяются особенности правового регулирования проведения исполнительных действий по принудительному исполнению судебных решений в зависимости от вида мер принудительного исполнения судебных решений. Выявляются основания и порядок приостановления совершения исполнительных действий по принудительному исполнению судебных решений. Определяются основания и порядок окончания исполнительного производства по принудительному исполнению судебных решений. Приводятся особенности принудительного исполнения судебных решений отдельных судов. Разрабатываются рекомендации по совершенствованию административно-правового статуса субъектов реализации мер принудительного исполнения судебных решений в Украине. В целях совершенствования взаимодействия между участниками реализации мер принудительного исполнения судебных решений предложено разработать Инструкцию «О порядке взаимодействия между участниками реализации мер принудительного исполнения судебных решений», в которой четко очертить права и обязанности субъектов такого взаимодействия, границы их полномочий и компетенции. Даются рекомендации по развитию административно-правовых форм и методов реализации мер принудительного исполнения судебных решений в Украине. Обобщается зарубежный опыт правового обеспечения реализации мер принудительного исполнения судебных решений и определяются возможности его использования в Украине.
The dissertation is focused on the analysis of administrative and legal provision for the implementation of measures of compulsory execution of judgments in Ukraine. The main stages of the formation and development of legal principles of implementing the measures of compulsory execution of judgments in Ukraine have been clarified. The concept of the measures of compulsory execution of judgments in Ukraine has been revealed; and the types of such measures, features of their realization have been outlined. The principles of implementing the measures of compulsory execution of judgments in Ukraine have been generalized. The essence of the mechanism of administrative and legal provision for the implementation of the measures of compulsory execution of judgments in Ukraine has been clarified. The author has formulated propositions on improving administrative and legal status of the subjects of implementing the measures of compulsory execution of judgments in Ukraine. Directions of improving the interaction between participants of implementing the measures of compulsory execution of judgments in Ukraine have been suggested. Recommendations on the development of administrative and legal forms and methods of implementing the measures of compulsory execution of judgments in Ukraine have been provided. International experience of legal provision for implementing the measures of compulsory execution of judgments has been generalized; and the possibilities of its application in Ukraine have been outlined.

Full textThe purpose of this paper is to analyze the disciplinary processes judged by the Federal University of Tocantins in 2015 and 2016. Consideration was given to those processes in which there was the possibility of applying penalties to those involved. Therefore, it were included in the data collection the Disciplinary Administrative Procedures of the Ordinary Rite, which involves the investigation of more serious faults; those of Summary Rite, which involve the possible occurrence of illegal acts of illegal accumulation of positions, abandonment of office or habitual inassiduity; the Accusatory Syndication, which corrects minor offenses; and also the disciplinary process that has as accused students of UFT. The study of the subject is current and has relevance not only to know the state of the disciplinary processes by the academic community of the UFT, technical-administrative servants, teachers and students, but for the whole society that has the desire to know if the processes are regularly judged. The research was based on information provided by the Coordinating of Disciplinary Processes (CPAD) of the UFT and then, after the receipt of digital copies of the processes, data were collected from the main pieces of the them, such as introduction order, conclusive reports of the commissions , opinions of the Federal Attorney's Office and decisions of the established authority to verify the occurrence or not of due process, as established by Law nº. 8.112 / 1990, as well as whether the defendants had their human rights protected, in particular the right contradictory and ample defense. Thus, the research sought to answer if the processes comply are efficient and fulfill their social function. The study, in its first part, brings the evolution of the punitive process of Public Administration from the redemocratization of Brazil with the Constitution of 1998. The procedures of the disciplinary processes under analysis, the principles applicable thereto, and the role of the Federal Attorney's Office in its outcome. Next, the data collected by the survey are presented based on the analysis of the case files. Subsequently, the results were exposed, demonstrating the lack of efficiency in the resolution of the UFT's disciplinary conflicts, thus failing to fulfill its social function, even with an infringement of fundamental rights. In the end, the research indicates some possible solutions for the improvement of the process of disciplinary processes and the development of the members involved in the commissions, especially with recommendation for the creation of Permanent Chambers of Disciplinary Administrative Procedures.

Full textThis dissertation aims at examining the exercise of the Police Power by the Public Administration, taking the discretionary competence as a reference, by confronting such Police Power with the legally posed limits and the qualification that is invested to it by the administrative doctrine. That is so because, even though the Public Administration is acknowledged to be liable of using a certain margin of subjectivism in its manifestations, where the law grants it, through the use of convenience and opportunity criteria, it should never be placed at the edge of the legal system. Thence, its actions will be always subjected to the rules and principles that guide the administrative activity and establish the State limits regarding the citizen. After generically analyzing the correlate issues to the main point, the work particularizes the approach, by centering it in the Police Power that is intrinsic to the Brazilian Central Bank and the Federal Securities Commission, in the leading of sanctioning administrative proceedings, either established by one or another, out of those public entities, in their respective legal environment, as well as in the enactment of special systems by the foremost, facing institutions under its supervision. At a first instance, the study offers a theoretical view in relation to the subject, and then it brings an illustrative panel of the practical aspect of those entities regulating activity in the financial and capital markets. Accordingly. grounded on the Brazilian Law and on the national and foreign doctrines, the study can lead to the conclusion that there is no wavelength on what the legal actions on the subject should determine and on what the respective doctrine and the attitude taken by public administrators should rule, when acting under alleged exercise of discretionary competence. In other occasions of such situations, the Public Administration understands it has a broader power than the legally entitled power and uses subjective assessments that are not comprised by legal authorization. Such an absence of correspondence or lack of synchronicity becomes evident in connection with the general principles, either those that are inherent to the generically considered exercise of Law, or even those other ones that are pertaining to the juridical and administrative system
A dissertação tem por objeto examinar o exercício do poder de polícia por parte da Administração Pública, tendo como referencial o manejo da competência discricionária, confrontado-o com os limites legalmente postos e o entendimento que lhe é conferido pela doutrina administrativa. Isto porque, muito embora se reconheça à Administração Pública, nos casos em que a lei lhe autorize, a possibilidade de se valer de uma certa margem de subjetivismo em suas manifestações, mediante o emprego de critérios de conveniência e oportunidade, jamais pode ela se colocar à margem do ordenamento jurídico. Em vista disso, seus atos sempre estarão sujeitos às regras e princípios que orientam a atividade administrativa e estabelecem os limites do Estado em relação ao cidadão. O trabalho, depois de analisar, de maneira genérica, os temas correlatos à questão central, particulariza a abordagem, centrando-a no poder de polícia próprio do Banco Central do Brasil e da Comissão de Valores Mobiliários, na condução de processos administrativos sancionatórios, instaurados por um ou por outro daqueles entes públicos, nas suas respectivas esferas de competência, bem como na decretação de regimes especiais por aquele primeiro, em face de instituições sob sua supervisão. O estudo, num primeiro momento, oferece uma visão teórica a respeito da matéria e, a seguir, traz um painel ilustrativo do aspecto prático da atividade reguladora daquelas entidades, nos mercados financeiro e de capitais, respectivamente. Com suporte na legislação brasileira e na doutrina nacional e estrangeira, o estudo permite concluir que não existe uma sintonia entre o que estabelecem os comandos legais sobre a matéria ou o que preceitua a respectiva doutrina e as posturas assumidas pelos administradores públicos, quando atuam sob alegado exercício de competência discricionária. No mais das vezes, a Administração Pública, nessas situações, entende ser detentora de poder mais amplo do que o legalmente conferido e faz uso de valorações subjetivas não abrangidas pela autorização legal. This present work aimed to investigate, through the structuring element Fato Administrativo , the way rationality guides the processes of personnel management at the Associa??o Companhia TerrAmar , which operates in the district of Felipe Camar?o in Natal/RN. This paper is characterized by a descriptive study, as it sought to establish the relationship between the materialization of the studied phenomenon - by means of a theoretical framework consisting of the following theories: Fato Administrativo (GUERREIRO RAMOS, 1983), Substantive and Instrumental Rationality (GUERREIRO RAMOS, 1981) and Proceedings of Personnel Management proposed by Joel Dutra (2004). As the main research findings, time as an intrinsic element of the Fato Administrativo - suffers much interference from external factors, especially from the sponsors of the researched organization and also from their bureaucratic control tools; not directly relating to the processes of Personnel Management, though. Among these, it was noticed that there isn‟t a dialogue between the sponsors and the theory, due to incompatibilities regarding the structure and nature of each organization. Both movement and development have stood out. These are processes that are guided by elements of substantive rationality, literally speaking, including personal, emancipatory and solidarity values. Thus, it is stated that for future research a compatible model of Personnel Management should be built and explored (compatible with the nature of nonprofit organizations). Understanding, in depth, the processes separately aiming to understand each work is also advised. Trying to fully understand the ways of overcoming the lack of skilled workers to perform activities in similar organizations needs to be considered as well
A presente disserta??o teve por objetivo averiguar atrav?s do elemento estruturante do Fato Administrativo, a forma com que as racionalidades norteiam os processos de Gest?o de Pessoas da Associa??o Companhia TerrAmar, que atua no bairro de Felipe Camar?o no munic?pio de Natal/RN. Caracterizou-se por ser um estudo descritivo, pois buscou estabelecer as rela??es existentes na materializa??o do fen?meno pesquisado por meio de um aporte te?rico constitu?do das seguintes teorias: Fato Administrativo (GUERREIRO RAMOS, 1983), Racionalidade Instrumental e Racionalidade Substantiva (GUERREIRO RAMOS, 1981) e modelo Gest?o de Pessoas proposto Joel Dutra (2004). Como principais achados da pesquisa, podem-se destacar que o tempo, elemento constituinte do Fato Administrativo, sofre forte interfer?ncia de fatores externos, principalmente, a influ?ncia dos patrocinadores da organiza??o pesquisada e das pe?as de controle burocr?ticas utilizadas por estes financiadores, entretanto sem rela??o direta com os processos de Gest?o de Pessoas.
