Abstract:
Reinventing the government was big in the early 1980s; post media presentation that echoed how inefficient the government has been. Ever since, the government went through different reorganization processes through the application of different modern management theories, endorsed by the politicians, such as the Hawthorne theory, the Gantt Theory, Mintzberg Management Theory, Theory X and Y, and the Agency Theory – all promise efficient government. They were implemented as a trial and error – one fails try another. This management system separates the top management and bottom level management, known also as an operational management. This system was introduced in a fanfare but it represents a hollow system. Overtime, all these modern management theories, which Ghoshal argued as bad theories, have destroyed good management practice of a public institution. Its management and administrative system are broken, the institution becomes very dysfunctional, and it causes a badly divided government. This damaged system makes it easy for theft, fraud, corruption, bribery, grafts, sabotage, espionage, and all kinds of illegal practices. At the same time, the change causes the used to be a professional public institution to become an amateur corporation that is individually managed, personally ruled, and undemocratic governance.Leadership does not exist in this system, neither does the middle level management, and it also suffers from severe democratic deficits. This paper discusses the theoretical foundation of the bureaucracy and its analysis, andusing holistic and phenomenological approaches, this theory can be applied in the management administrative system of government, and this dysfunctionality and the broken system can be remedied practically.

AbstractIn the United States, an important literature shows that legislators use interest groups, courts, and budgets to assert political control over bureaucrats. Similar theories can be applied to study the scores of new democracies that have emerged in recent decades. In Argentina, politicians in the first administration of Carlos Menem (1989-95) rewrote administrative procedures and relied on both “police patrol” and “fire alarm” oversight to realign the behavior of tax bureaucrats in conformance with their own policy preferences. Whereas U.S. legislators generally prefer complex administrative procedures, different electoral incentives led their Argentine counterparts to support reforms that significantly streamlined those procedures. This finding challenges theories that attribute legislators' bureaucratic preferences to the separation or fusion of powers between the executive and legislative branches.

Embedded in the epoch of globalization, initiatives of governmental reforms among countries are intertwined, especially when these countries seek to gain wider experience from their counterparts’ suggestible pathways. However, scholars are inclined to oversimplify their analytical frameworks when conducting comparative research on administrative reforms. This paper intends to interpret and analyze such simplification of comparative studies which might result in the continuing promotion of a failing approach or the aimless transplantation of other countries’ reform experience and theories, the phenomenon not uncommon in studies of China’s administrative practices. This paper reveals an overlooked context, namely, that the adaptation of international theories of institutional reform has not achieved the intended goals in China’s case. Through our analysis, we aim to use China’s example to highlight the need to consider its social and cultural context in adapting Western administrative theories, and to suggest how scholars can better advise the government in the process of administrative reforms.

AbstractA novel form of international order was developed in the nineteenth century by international administrative unions such as the International Telegraph Union and the Universal Postal Union. This administrative internationalism posed a striking alternative to the international society of great powers, sovereignty, and forms of imperial domination, for the members of administrative unions included not only sovereign states but also semi-sovereigns, vassals, and colonies. Members were equal and bound identically to the union treaty and its international administrative law. This article examines the structure of unions and their politics of membership in the nineteenth century, and engages theories of global governance to argue that early administrative unions present a mode of international order different from theories of both global networks and the international system of neorealism.

This Article examines the relationship between the developing European Union (EU) system of banking supervision and the theories of constitutional pluralism. It questions the remaining epistemic, explanatory, and normative value of these theories with regard to the EU system of banking supervision. The argument is broken down into three parts. First, the Article briefly describes the system of banking supervision in the European Union and the pluralist challenges that it spurs. Second, it schematically maps out the leading theories of constitutional pluralism to test, by way of their application to the field of EU banking supervision, their epistemic, explanatory, and normative value. Finally, to the extent that this value has diminished, the Article offers another pluralist theory, not a constitutional one, which could supplement the identified epistemic, explanatory, and normative gaps. This is a theory of administrative pluralism.

Under the reform of article 1 of the Federal Constitution (June 10, 2011), all government authorities have the obligation to respect human rights. The main inquiry of this essay is whether the Executive can, ex officio, revoke administrative acts for violations of human rights or stop enforcing a law it deems unconstitutional. Following this line of inquiry, for the purposes of this essay, the hypothesis is affirmative. The first part of this work analyzes several techniques and their comprehensive interpretation. Doctrine and comparative law are used to frame the issue. The second part consists of a constitutional analysis of article one under several legal interpretation theories to obtain preliminary results. The third part focuses particularly on revocation in the Administrative Procedure Act and the Mexican Federal Tax Code, in addition to relevant case law. Lastly, it is concluded that, in certain cases involving legal certainty, revocation can apply; however, refusal to enforce a law deemed unconstitutional cannot.

A definition of regulation is offered and the relevance of regulatory theory to understanding change in financial markets is explained. The nature of financial change is sketched. Four major sets of regulatory theories are outlined—teleological, cultural, instrumental and administrative. The adequacy of each in explaining recent changes in securities markets in Britain and the United States is assessed. The article concludes that some cultural and administrative theories perform best, and argues that in the United Kingdom and the United States there is a convergence of regulatory styles.

These schools relied on the use of various hypotheses or theories that sought to develop a knowledge structure of management that could contribute to solving administrative problems, especially at the end of the nineteenth century, which witnessed the development of management science through scientists and eggheads.Moreover there was an odd experience at the level of administration and governance, revealing the unique mentality of Ali in management, in the legal, comprehensive and humanitarian ones, which printed the terms of his reign to Malik - decibel and companion of Ali - some related to economic matters political, social issues deal with the duties and functions of the ruler and relations between the ruler and the parish.We concluded that the management materials provided by all known administrative schools testify unequivocally to the thought of Ali, addressing the administration from the perspective of building the land on the basis of justice, efficiency and equity. Therefore, we consider that venerable scholars, whatever their religion, creed or race, are just witnesses to the correctness, validity and comprehensiveness of Ali's thought, not only in the twenty-first century, but we can say objectively as a testimony to all ages.

Purpose The purpose of this paper is to examine three substantial trends in public administration research from a Norwegian perspective with a special focus on administrative reform that addresses organizational arrangements rather than changes of policy by focusing on government capacity and good government. Design/methodology/approach The paper is synthesizing trends in Norwegian public administration research over the past 30 years by using existing publications and also by contrasting it to development in other countries. Findings The paper describes, first, the theoretical development toward meso-level theories and an institutional turn in public administration research. Second, it focuses on the methodological development toward more time series analysis and comparative and objective data. Third, it addresses the trend from processes and administrative behavior to performance and effects. Originality/value The paper addresses the increasing internalization of public administration research, the strengthened focus on empirical studies of “living” organizations, the need to address the big issues and large forces in public administration and also the transformative periods and unsettled situations going beyond settled stable situations.

Currently, our understandings of the dynamics behind the effects of politicization on values and on administrative decision-making remain largely muddled and far from complete. The richness of theoretical accounts, amassed over the past eight decades, has yielded only a limited number of empirical examinations. This failure to develop a coherent collection of empirical works can be for the most part attributed to the complexity associated with studying values, particularly to the lack of clear and testable theories and models. This article attempts to address this deficit and to add to our understandings of the association between values and administrative decision-making at the individual level by explicitly testing the Broker-Purist (BP) model (within a sample of public procurement specialists). It is found that the BP model fits the data well, which suggest the framework as a valid and useful perspective for conceptualizing the effects of environmental politicization on administrative decision-making in public procurement specifically, and in public administration in general.

This study aims to describe the effect of administrative personnel services on students’ satisfaction. This was descriptive quantitative research that involved 110 students of state junior high schools in Solok as the sample. Data were collected using a questionnaire that was constructed based on related theories. The data analysis included testing validity, testing reliability, descriptive analysis, and simple linear regression. The findings described that there was no significant relationship between the quality of administrative services and students’ satisfaction. It indicates that administrative services should pay attention to several aspects including tangibles, reliability, responsibility, assurance, and empathy to achieve students’ satisfaction.

Administrative reform in the developing countries becomes a necessity and focus ofgovernments. The term administrative reform contains meanings, varied in functions,but also brings debate that has never been completed among practitioners, societiesand theorists. Administrative reform aims to improve the performance of individuals,groups and institutions. One of the administrative reform agendas is to improve thesalary of state apparatuses. However, the government does not have yet any payrollregulation of state apparatuses that relate their workload and proper reward.Consequently, its long-term impact is to bring down the spirit, work ethic and workdiscipline among the state apparatuses which are supposed to have high productivityand discipline. This article aims to explain the concept of administration reform fromthe perspective of human resources, as well as the change strategy for the developmentof Indonesia. It applied major theories of administrative reform and bureaucracy aswell as human resource management. The method used is qualitative descriptive, withresearchers as a tool based on literature studies. The results of this study show thatadministrative reform in the context of bureaucracy reform is not a new issue. Manyministries and institutions have implemented administrative reform, but not yetoptimally gave positive results. The implications of this study is that bureaucracyreform should involve stakeholders in formulating performance indicators as well asthe institutionalization of values and bureaucratic culture oriented towards the publicinterest.

RESUMO O presente artigo discorre sobre a evolução do controle sobre os atos administrativos discricionários, em especial a sindicabilidade do “mérito” destes, perpassando as diferentes teorias surgidas, desde a consolidação da ideia de Estado de Direito. Logo após, discorre-se sobre a admissão do controle judicial quanto aos elementos vinculados do ato, e, em seguida, sobre esse controle a partir de parâmetros implícitos da lei. Posteriormente, discorre-se sobre a teoria da vinculação direta aos princípios e dos atos “vinculados” por conceitos jurídicos indeterminados. Por último, aborda-se a teoria do enfoque jurídico-funconal, para, então, concluir pela possibilidade de se verificar uma tendência de sistematização, no sentido de apontar alguns parâmetros para o controle jurisdicional da discricionariedade administrativa. É utilizado o método dedutivo, por meio de pesquisa realizada em legislação, doutrina e jurisprudência das Cortes Superiores. ABSTRACTThis article discusses the evolution of the judicial control over discretionary administrative acts, especially the syndicability of the "merit" of these acts, crossing the different theories that have emerged since the consolidation of the idea of the rule of law. After discussing this judicial control in face of the rule of law, the admission of judicial control on the elements of the act is analyzed, and then, this control from implicit parameters of the law. Subsequently, there is a discussion of the theory of direct linkage to principles and "bound" acts by indeterminate legal concepts. Finally, it is discussed the theory of the legal-functional approach, and then, conclude that there is a tendency to systematize, in order to point out some parameters for the jurisdictional control of administrative discretion. The deductive method is used, through research conducted in legislation, doctrine and jurisprudence of the Superior Courts. Purpose – The purpose of this paper is to address the core concept of docility in Simon’s learning theories and elaborate docility as a missing link in organizational performance structures. In his book, Administrative Behavior, first published in 1947 with three subsequent editions, Herbert A. Simon introduced a new concept to the emerging field of organizational theory, docility. Design/methodology/approach – In Administrative Behavior, Herbert A. Simon introduced to management and organization theorists the concept of docility. Simon adopted the concept and meaning from E.C. Tolman’s (1932) classic work, Purposive Behavior in Animals and Men, and his novel views on learning processes and key concepts like purpose (goals), thought processes (cognitive psychology) and cognitive maps. This paper elaborates on docility mechanisms and the implications for social learning in organizations. Findings – This paper addresses this lacuna in the organizational literature, and the implications for current theories of organizations and organizational learning. Practical implications – Docility is a tool to link individual learning with organizational learning in complex environments and changing technologies. Originality/value – The paper traces origins of Simon’s docility and learning theories.

As my work has argued previously, European integration enjoys an “administrative, not constitutional” legitimacy. This view is in obvious tension with the deeply-rooted conceptual framework—what we might call the “constitutional, not international” perspective—that has dominated the public-law scholarship of European integration over many decades. Although the alternative presented in my work breaks from that traditional perspective, we should not view it as an all-or-nothing rejection of everything that has come before it. The administrative alternative can be seen, rather, as providing legal-historical micro-foundations for certain theories that also emerged out of the traditional perspective even as they too are in tension with it. I am referring in particular to Joseph Weiler's classic notion of European “equilibrium”—now updated as “constitutional tolerance”—as well as Kalypso Nicolaïdis's more recently developed theory of European “demoi-cracy” on which this article focuses in particular. The central idea behind the “administrative, not constitutional” interpretation—the historical-constructivist principal-agent framework rooted in delegation, as well as the balance demanded between supranational regulatory power and national democratic and constitutional legitimacy— directly complements both theories. The administrative alternative suggests how the relationship between national principals and supranational agents is one of “mediated legitimacy” rather than direct control. It has its origins in the evolution of administrative governance in relation to representative government over the course of the twentieth century (indeed before). By drawing on the normative lessons of that history—notably the need for some form of national oversight as well as enforcement of outer constraints on supranational delegation in order to preserve national democratic and constitutional legitimacy in a recognizable sense—this article serves an additional purpose. It suggests how theories of European equilibrium and demoi-cracy might be translated into concrete legal proposals for a more sustainable form of integration over time—a pressing challenge in the context of the continuing crisis of European integration.

There are several important justifications for autonomous units of local government, derived from the writings of J. S. Mill and later theories concerning the value of pluralism. These arguments fail to show that local government is a morally necessary, as opposed to expedient, adjunct to liberal-democratic government. The paper develops from J. S. Mill's ideas on liberty a more substantive justification for local government based on the principle that local government can be a means for ensuring that the determination of collective decisions are made solely by those people affected by the decision.

The purpose of this paper is to analyze two significant treatises concerning the constitutional structure of the 16th century French monarchy, namely Jean Bodin’s Les Six livres de la République and Vindiciae, contra tyrannos written under the pseudonym of Brutus. The texts were answers to an ongoing institutional crisis of the monarchy, especially in light of the strictly connected issues of decentralization and the weakness of the royal administrative apparatus. The paper portrays how the tension between the royal administration and the complicated structure of the local networks of power not only rendered it impossible for both Bodin and Brutus not to take a stance on the matter but also how it influenced the shape of their theories. An analysis of how Brutus and Bodin tried to incorporate the complex institutional realities of the French kingdom into their own theories sheds some light on the authors’ attitude towards the functioning of the local centres of power, their theoretical disabling or using them on purpose; it also points to how much the actual decentralization of the state influenced the shape of the theories of both authors.

Design/methodology/approach This paper draws on economic as well as political theories regarding decentralization and describes historical development of the local autonomy system in Korea. Findings This paper discusses the current discrepancies among the progress of political, administrative and fiscal independence in the local autonomy system in Korea and concludes that the lack of fiscal independence in the local level significantly undermines the efficacy of political and administrative decentralization in Korea. Originality/value Decentralization has three distinct perspectives. This paper examines decentralization in Korea from all three perspectives.

Purpose The purpose of this paper is to examine whether deeply rooted ethnic values persist in public administration in spite of strong foreign influence in education and administrative culture. Design/methodology/approach This paper presents the theories and concepts on ethnic values, in particular Chinese and Canadian administrative values in order to examine their differences. Victoria of Canada and Hong Kong of China, both former British colonies, have been selected as the study sites due to their similarity in British education and administrative culture. Comparable samples of human subjects were drawn from the public sectors of Hong Kong and Victoria, who were either students or graduates of a master of public administration program. A questionnaire containing questions on program evaluation and staff promotion was administered to participants. Findings The survey results show that, while organizations may have similar administrative systems and cultures, employees revert to their ethnic values for matters concerning their immediate well-being – staff promotion in this case. The findings also suggest that employees endorse good practices and reject bad ones more often than they believe their organizations do. Research limitations/implications The purpose of this study is to examine whether lengthy foreign influence can change deeply rooted ethnic culture. The research results are not aimed at and may not be relevant to explaining a current situation. Practical implications The research findings may help improve public administration, in particular regarding issues of human resources management. Social implications The research findings may provide a better understanding of social behavior in the work place. Originality/value This paper contains original data for a comparative analysis that appears to have never been done before. It provides empirical proof that deeply rooted ethnics values are very difficult to change in spite of a long history of foreign influence.

The author gave a definition of administrative responsibility for administrative delicts within banking operations. The author identified specific features of administrative responsibility within banking operations. The article deals with the scientific approaches to the definition of responsibility for administrative delicts within banking operations. The author, with the help of the deductive method, outlines the scientific theories that interpret the responsibility for administrative delicts within banking operations. The author of the article substantiates the theory of responsibility for administrative delicts within banking operations, namely: security, punitive, management, coercion, obligation, conviction. The author considers the features that are inherent for administrative responsibility within banking operations. The author names specific features that are inherent for administrative responsibility within banking operations, namely: small public harm is based on normative, factual and procedural grounds, has negative consequences for delinquency, is accompanied by public condemnation of delicts, does not involve cryptography. It has been concluded that administrative responsibility for delicts within banking operations is the application of enforcement action for a delinquent offender (an individual or a legal entity) for the violation of banking legislation by the National Bank of Ukraine that are stipulated by the relevant administrative and legal norm. Responsibility for administrative delicts within banking operations is an element of state management mechanism, challenged to restore violated legal relations within banking operations that is protected by the relevant administrative and legal norm by imposing administrative fines for a delinquent offender.

In this text, Giorgio Agamben argues that the concept of democracy attests to a political, ontological amphibology: on the one side, democracy describes a constitution of a political order (and in this sense it belongs to public law); on the other side, democracy is a certain form of administration (in which case it belongs to administrative practice). It is argued that this amphibology can be located in the political theories of Aristotle and Jean-Jacques Rousseau who have been instrumental in forming our present conception of politics. Consequently, we misunderstand the fundamental nature of politics, and any hopes of genuine political life must therefore break with this tradition of Western political philosophy.

The prevailing theories of student persistence have been developed in Predominantly White Institutional (PWI) contexts. The extent to which these theories—in whole or in part—apply to Minority Serving Institutions such as Historically Black Colleges and Universities (HBCUs) has not been studied in depth. This study tests a PWI-based theory of student persistence in residential colleges and universities at two residential HBCUs. Four-hundred and fifty-one residential students completed a survey testing the theory, and then administrative data were used to link student persistence data. Findings suggest that theories developed at PWIs—such as the model tested in this study—hold salience for understanding student persistence at Minority Serving Institutions such as HBCUs. However, a complete picture of student persistence at HBCUs may benefit from the addition of HBCU-specific constructs and models.

The authors of theories and models of spatial development considered the development of territories from the point of view of a wide range of factors of influence: geographical, administrative, economic, social, political, innovative, etc., characteristic of different time periods. An effective management of territorial development in modern conditions is becoming relevant in terms of the need not only to solve existing problems, but also to expand opportunities for self-development of territories. The implementation of theoretical provisions of spatial development theories has found a practical reflection in different historical periods of the economy of different countries. Theories of spatial development form the basis of the methodology of public administration, which determines the principles, directions of formation and ways to ensure the functioning of organizational structures and relevant mechanisms, models of development and management, approaches to the use of resources, etc. With the help of spatial theories one explains and anticipates trends, develops models and mechanisms of territorial development, forms instruments for their practical implementation. Architectural historiography is seldom concerned with the antithetical notions of ‘noise’ and ‘silence’. In this case study, I tentatively explore the theme in the context of nineteenth-century administrative buildings. More particularly, I investigate the normative views of British and French authors concerning acoustic perception in one subtype of ‘bureaucratic’ architecture: the ministerial office building. Drawing examples from the work of, among others, ‘panopticon’ theorist Jeremy Bentham and the architect Julien Guadet, I point at the centrality of ‘sound control’ or ‘sound management’ in architectural discourses on office buildings. In the specific domain of ministerial offices, moreover, these discourses were rife with ideological views on the nature and the functioning of government itself.

There are many programs and measures in the administrative reform of governments in various countries, where governance related theories are broadly discussed and indeed enhance public administration changing the traditional practice and turn the government into transformation in past years. Government reform in new public management becomes more difficult for governments constructing transparent accountability systems. In this case, it is urgent to establish transparent, accountable, and corruption controlled anti-corruption governance strategies for governments’ reform. In the process of transforming government administrative reform to governance, it is necessary to establish the core concepts of accountability, openness, transparency, zero-corruption, and high-performance standard. Aiming at employees of Ministry of National Defense in Taiwan, as the empirical objects, total 360 copies of questionnaire are distributed for this study, and 273 valid copies are retrieved, with the retrieval rate 76%. According to the results to propose suggestions, it is expected to help the government draw the goal of transparency in government and promote many measures about anti-corruption to achieve the effective utilization of public resources, enhance people’s trust in the government, and reinforce government rule legitimacy.

The purpose of this study is to explore the relationship between perceived organizational support (POS) and work engagement of administrative staff in newly-established universities of China. For this purpose, this article reviewed related literature and theories, proposed a single hypothesis. Primary data was collected by the self-administrated questionnaire which included 2 scales and 33 items. The findings showed that there was a positive relationship between POS and work engagement, and also illustrated that POS was the predictor of work engagement. In view of the low level of POS determined by study survey, it was suggested that newly-established university should improve administrative staff’s work engagement by concerning their POS.

The paper concluded that, leadership qualities are strong determinants of principals’ tasks performance effectiveness in proper delivery of secondary schools education in Nigeria. Principals’ leadership qualities influence effective school administration. Finally recommended that, the principals should be well prepared; knowledgeable, professionally and administratively competent for the challenges involved in the mantle of leadership. Indonesia, Indonesia is a nation of law that uses a rule of law country (rechtstaat) concept. The concept of rule of law Indonesia set forth in its Constitution, the 1945 Constitution, Article 1 paragraph (3). There is an important element of democracy stated on the Constitution, namely the protection of human rights, that every citizen has the right to enjoy it. One of the rights protected in the Constitution is right to access a good and healthy living environment. For this, the environment needs to be preserved and function through administrative law enforcement. The study uses normative juridical approach with descriptive-analytics, which describes the norms and associated with theories, and opinions of legal experts. The development of a democratic nations of law can be seen from the aspect of law enforcement in particular with environmental administration. In Indonesia, it can be reviewed through the theory of organic states and the theory of pluralist states. Based on the theory of an organic state and looking at the aspects of environmental administration law enforcement in Indonesia, the state has regulated the enforcement of environmental administrative sanctions whereby the state can regulate every activity and/or business in the environmental issues. Therefore, the pluralist state theory recognized a variety of diverse interests in society that the state has accommodated all citizens rights to a good and healthy environment through pro-environment government policies.

This article considers the World Bank as a political thinker. This involves an interpretation of the values, methodologies, and theoretical references contained within the Bank's governance documentation. Generally, the Bank steers away from a serious engagement with the nature of states, or the dynamics of reform execution, even in its more detailed policy documents in reform areas such as administrative reform. But, by looking at the World Bank's involvement in African states, we can understand the ways in which the World Bank works with certain expectations concerning how reforms will work. The article critically analyses the Bank's ‘political vision’ by comparing it with prominent theories of African politics. The article concludes that the World Bank's governance agenda misses three pivotal aspects of African politics: the unity of political and economic power, the extreme openness of African states to external pressures, and the salience of historically-embedded cultural and political relations. These three points directly raise important questions about the prospects of good governance reforms in Africa, and the involvement of the Bank therein.
