Este artigo apresenta o conceito de "justiça administrativa", que ultimamente tem se tornado cada vez mais popular no mundo anglófono da common law. Dessa forma, explora o que tal conceito pode significar quando aplicado aos tribunais administrativos (administrative tribunals). Nos sistemas jurídicos inglês e australiano, os tribunais oferecem alternativas às cortes (courts) para a revisão das decisões administrativas. O artigo centra-se particularmente na Austrália, que tem um sistema altamente desenvolvido de tribunais administrativos, e onde as cortes podem rever as decisões administrativas no que concerne à sua "legalidade", enquanto que os tribunais revisam o mérito dessas decisões. Tal distinção entre legalidade e mérito tem várias implicações para a compreensão de como os tribunais prestam "justiça" e que espécie de justiça é oferecida. Na Austrália, os tribunais são valorizados porque propiciam uma versão particular de justiça administrativa diversa daquela oferecida pelas cortes, o que se reflete em parte na forma pela qual operam os tribunais.

La actual investigación, titulada “Control difuso administrativo y las dificultades interpretativasdel Tribunal Constitucional”, tiene como objetivo analizar si el control difuso administrativoes o no una atribución constitucional que pueden ejercer los órganos administrativos colegiadoscon competencia nacional. Es una investigación descriptiva documental, basada en aspectosconceptuales y recogidas en algunas resoluciones administrativas en el ejercicio del control difuso.Durante su desarrollo se esbozarán las precisiones vinculadas a los distintos enfoques que seadopta en mérito a la doctrina jurisprudencial sobre la eficacia del ejercicio del control difusopor parte de los órganos administrativos con competencia nacional. A tal fin se recorrerá por losconceptos básicos de la competencia administrativa, el procedimiento administrativo, el procesocontencioso administrativo y sobre la existencia o inexistencia de una justicia administrativa.Asimismo, se abordará el control de constitucionalidad y legalidad y sus efectos en el tiempo enque estuvo vigente dicha atribución (control difuso) por parte de los órganos administrativos concompetencia nacional, y finalmente se desarrollará un análisis crítico sobre el cambio de posiciónque ha adoptado el Tribunal Constitucional respecto a estos aspectos en su condición de máximointérprete de la Constitución.

<p>Appreciative activity of public administration: a new vision about public discretion</p><p> </p><p>O trabalho intitulado Atividade apreciativa da administração pública: uma nova visão sobre a discricionariedade administrativa busca demonstrar a existência de quatro, e não apenas três, formas de subjetividade ou autonomia pública. Além da liberdade de conformação ou configuração, a discricionariedade administrativa em sentido técnico-jurídico e a margem de livre apreciação dos conceitos jurídicos indeterminados, existe, também, o que se pretende chamar de apreciatividade administrativa. O trabalho expressa que a teoria das distintas margens de liberdade/autonomia/volição administrativa não aborda de maneira correta a existência de todas as condutas administrativas, ou seja, deixa de tratar da subjetividade ou da autonomia pública administrativa habilitada por fontes não voluntárias do direito, derivada do conteúdo do direito, dos defeitos do sistema jurídico e do exercício da função, reportando-se normalmente a ações não deônticas, realizadas por agentes públicos que atuam em contato direto com o cidadão, com algum caráter imediato ou urgente, e que são realizadas de maneira rotineira, regular e cotidiana. A proposta, portanto, é teorizar a apreciatividade administrativa.</p><p> </p><p>The work entitled Appreciative activity of Public Administration: a new vision about public discretion seeks to demonstrate the existence of four, and not just three forms of subjectivity or public autonomy. In addition to the freedom of conformation or configuration, administrative discretion in technical legal sense and the margin of free appreciativity of indeterminate legal concepts, there is also what you want to call administrative appreciativity. The work expresses the theory of the different margins of freedom / autonomy / administrative volition does not address properly the existence of all administrative conduct, that is, fails to deal with subjectivity or public administrative autonomy enabled by non-voluntary sources of law, derived from the content of law, the shortcomings of the legal system and the role of exercise, reporting often to non deontic actions held by public agents who work in direct contact with citizens, with some immediate or urgent, and they’ve done routine, regular, everyday way. The proposal is therefore theorize administrative appreciativity.</p>

Polskie tłumaczenie skróconej wersji artykułu w tekście. Jaký je obsah (českého) pojmu ČLOVĚK? A v čem se shoduje a v čem liší konceptualizace člověka v perspektivě mluveně-psaného jazyka (jakým je čeština) a v perspektivě jazyka znakového (jakým je český znakový jazyk)? V novějších českých slovnících bývá význam lexému člověk vymezován na základě rysů, jimž se člověk odlišuje od zvířat (dvě nohy, schopnost práce, řeč), v těch starších je vztahován k nadpřirozeným bytostem, resp. k Bohu (tělesnost, smrtelnost, nedokonalost). V jazyce i v textech je však fixována řada dalších aspektů, které se do významu lexému člověk promítají; mnohé lze uchopit v podobě opozic (člověk vs. neživá věc, např. loutka, robot; člověk vs. číslo, administrativní položka aj.). V češtině se systematicky realizuje i řada metonymií exponujících za člověka jednu část jeho těla v daném kontextu relevantní (tvář, hlavu, nohu, ruku). V mnohém podobná i v mnohém odlišná konceptualizace člověka se promítá do znaků českého znakového jazyka, ovšem za pomoci prostředků vizuálně-motorických, často s velkou mírou ikoničnosti. Studie se věnuje zejména znakům a klasifikátorům vztaženým k člověku (s pokusem o výklad jejich motivace) a krátce poukazuje i k tomu, jak se významový prvek člověk (uvedenými klasifikátory nesený) promítá do znaků dalších, sémanticky blízkých. Šíře pak je porovnána konceptualizaci člověka v obou zkoumaných jazycích, zejm. s ohledem na odlišný modus jejich realizace.

RESUMOO objetivo do artigo é testar a fidelidade do regulador administrativo às normas legais que deveriam limitá-lo, em situação de divergência entre a visão do regulador e o conteúdo das leis. Para a análise jurídica da extensão da competência regulamentar administrativa, o artigo afasta a discussão circunscrita à interpretação do princípio constitucional da legalidade e empreende o exame dos dispositivos legais que conferem atribuições normativas administrativas. O caso escolhido foi a resolução da Agência Nacional de Cinema - ANCINE que estendeu a empresas estrangeiras restrição que a lei fizera incidir apenas sobre empresas com sede no Brasil. A constatação do artigo é de infidelidade consciente do regulador. PALAVRAS-CHAVE: Regulação. Poder Normativo. TV por Assinatura. Serviço de Acesso Condicionado. Empresa estrangeira. ABSTRACTThis article tests the administrative regulator’s fidelity to the legal limits for his actions when there is discrepancy between what he wants to do and what a legal norm allows him to. For the legal analysis of this regulatory competence´s extent, the article moves away from uptakes on the constitutional principle of legality and exams legal dispositions that attributes normative competence to public administration. The case studied is an administrative resolution edited by the National Film Regulatory Agency – ANCINE, in which the agency extended to foreign companies a restriction legally intended only for companies with head offices in Brazil. The article’s finding is the administrative regulator’s conscious infidelity to legality.

Abstract:
Subject of this diploma thesis is building documentation of an office building. Designed object is located in the city of Olomouc. Primary purpose of the building will be offices with rentable space, whose layout will be designed as open space offices with option to divide space according to requirements of a tenant. Office spaces will serve for example as headquarters of design offices, IT consulting and services, business companies, technical consulting or managerial services. The building will contain except of office premises also a space for café, retail and underground garage primarily designed for parking of office employees´ cars. Office building is designed as cast-in-place reinforced concrete frame with shear walls, consisting of 4 floors and basement. Object is shaped as two buildings connected with common walking space. Facade will predominantly be designed as glass curtain walling and also as a ventilated facade with cladding from exposed cement-fiber board. Also there is designed a system of steel curtain wall with docked trellis ropes for planting of climbing plants to decrease overheating of the building in summer and to meet the city requirements of as much greening of buildings and their surroundings as possible.

Abstract:
This master thesis elaborates the project documentation for the construction of an office building in Krnov city, located in the Moravian-Silesian region. The office building has four utility above-ground floors and one underground floors serving as underground garages. There is a cafe, stationery, showrooms and office space with sanitary facilities. The construction system is designed as a monolithic reinforced concrete skeleton. Vertical infill constructions are made of brick technology from Porotherm ceramic blocks. The ceiling structures are made of filigree panels with hidden steel girders, which are embedded with concrete layer. The basement and the basic structure of the house is designed as a white tub. The building is covered with vegetation roof. The design emphasized increased comfort in use and the overall modern concept of an office building. Overall, the building is designed to the required values for a near zero energy building.

The final thesis deals with design of new administrative object. The administrative object is located in edge part of Znojmo city. The building is situated in built-up area, which is used for housing and services. The building is accessible as a detached house on a slightly sloping territory. It is a four-storey house with a cellar, terminated by a warm flat roof, which has three-storey and basement. On the above ground floors are located offices and their associated spaces, staff facilities and toilets. On the third floor there is a terrace for employees’ stay in the summer months. On the third floor there is a collective garage with twenty parking spaces too. The individual floors are accessed via the main staircase and elevator. The building is designed as reinforced precast concreate frame and is based on prefabricated reinforced concrete foundation pads. The infill and internal wall are designed from the Porotherm building system.

Abstract:
The subject of the master's thesis is elaboration of the complete project design documentation of a administrative building, ready for implementation in the construction phase. The object is divided into four above-ground floors and one underground floor. It is divided into three blocks A, B, K and into three independent functional units. The prevailing part of building is administrative part, which is located in blocks A and B. In the basement there is a compound garage. Part of the building comprises of a service, a café, located and operated on the first floor above ground in block K. The individual blocks have separate entries and are without any mutal limitation to their independent operations. The building has a carrier system designed as a monolithic, reinforced concrete skeleton with two reinforced cores, placed on reinforced concrete feet. Ceramic fittings are slated for filling . The roof structure designed as a single-shell flat roof area, eventually vegetative. The facade is designed as ventilated with cement-bonded particle boards. Within the specialization is the solution of technical equipment, forced ventilation by means of air-conditioning system.

The building is designed as a detached building with five floors and one underground floor. The ground plan of the building is rectangular, set in a slightly sloping terrain. The underground floor is located underground garage and technical facilities. On the first floor there is a café and counters. On the second and third floors there are counter halls and on the fourth floor there are office spaces of a private company. The last fifth floor serves as a flat roof exit. The construction system is two-way wall. The building is insulated with thermal insulation and covered with a flat roof.

The skeleton of construction is designed from reinforced concrete, walls are from brick-walled POROTHERM. Roofing is designed from reinforced concrete board. The building will be roofed with arched trusses with metal roofing. In 2nd and 3rd floor are situated offices, meeting rooms, conference halls and social background. The work includes the study of building and heat considerations.

My thesis solveses the office building. The building will be located in Šumperk. It will be located near the center. The building has two floors and a partial basement floor. Ceilings are beams with ceramic inserts and reinforced concrete slabs. Vertical structure consists of a ceramic blocks in the aboveground parts and concrete blocks in the underground section. The roof is walked on vegetation. The staircase is reinforced concrete, monolithic. The entire building is insulated with mineral wool. Basement is insulated with polystyrene foam.

AbstractIn the system of German federalism, the administrations of the 16 federal states (Länder) have central responsibility for the enforcement of both federal and state law. Despite all the heterogeneity in terms of size, administrative tradition and culture, their administrative structures are relatively uniform. Everywhere, the municipalities, which are part of the state executive under state law, play a significant and, above all, independent role as bodies of the public administration. There are some differences, but administration seems in some respects relatively homogeneous, not least due to the largely similar staffing structures, career patterns and administrative cultures. Structural reforms of very different scopes have been a long-term phenomenon since the 1990s.

Studies on the German administrative system should focus especially on key institutional features of public administration; changing relationships between public administration, society and the private sector; administrative reforms at different levels of the federal system; and new challenges and modernisation approaches, such as digitalisation, open government and better regulation. The publication is following this structure in four parts with 22 chapters.

This is true, not only of those areas in which the Member States have transferred to the EU the authority to make laws, but increasingly also of those areas in which the Member States have retained such authority. At the same time, however, there is no systematic codification of the law on administrative procedures at European level and no system of legal remedy for Union citizens equivalent to those at national level.

AbstractA process-oriented approach sees public administration as an interconnection of information, communications, interactions and decisions. It establishes the process organisation that shows the state ‘in action’ and complements the administrative and personnel side of public administration. While the term administrative processes can be understood as a generic term for this procedural side of the administration, according to the German understanding, procedures are processes with which the administration works towards citizens and companies and in which these face the administration with their own rights. Characteristic of these procedures vis-à-vis persons outside the administration is a high degree of juridification by administrative procedure law. The legal status of the citizen vis-à-vis the administration is very strong in Germany. In recent years, also influenced by New Public Management thought, great efforts have been made to optimise the procedural side of public administration. The chapter presents significant tools and approaches of this process thinking.

AbstractThe control of the administration by administrative courts follows very particular rules. Two elements of the German system stand out: first, the intensive type of control which makes the scope for independent administrative decision-making an exception. Second, the quite strict restrictions on locus standi. The development of administrative law by the courts and its application by the administration are an elementary part of the German legalistic tradition. The courts of audit at all levels of government also play an independent role. They can control the proper as well as the efficient use of funds from the respective budgets. While there is no enforcement mechanism, the publication of the findings certainly leads to pressure to comply.

Abstract:
The modern state administration and its bodies and special organizations should act in the field of the rule of law. It is a term that originates from the Anglo-Saxon legal world, but it is also a category and a principle of the Constitution of Serbia from 2006. The paper points out the different understandings of the rule of law and briefly looks at the position of the administration or the phase in its historical course until its subsumption under the principle of legality. In Serbia, state administration bodies consist of ministries, administrative bodies within the ministry and special organizations. Administrative or special organizations are formed by the state in order to perform professional and related administrative tasks. In order to permanently and unhinderedly perform the professional work of these organizations, they can act authoritatively. Special organizations have numerous and diverse administrative powers. The paper points out both the similarities and differences of special organizations in relation to administrative bodies. A review of the activities and organizational structure of all special organizations (secretariats, institutes, directorates and one center) established by the Law on Ministries from 2020 was performed. It was also pointed out that all institutes: the Republic Institute of Statistics, the Republic Hydrometeorological Institute, the Republic Geodetic Institute and the Intellectual Property Institute are special organizations that provide services to interested parties. In one part of the final considerations, the author states that for special organizations (as part of the state administration) it could be concluded that they really operate in the field of rule of law as an order with positive properties as characterized by the Constitution, it is necessary to strictly respect the principles organization of state administration prescribed by the Law on State Administration: independence and legality; expertise, impartiality and political neutrality, effectiveness in exercising the rights of the parties, proportionality and respect for the parties; publicity of work.

"The administration performs a great task in the life of modern societies, through its intervention to satisfy public needs through the establishment and management of public utilities that aim to achieve the public interest and respond to the requirements and necessities of daily life, as well as protecting public order, and regulating the relationship between them and individuals with constitutional and legal texts, as well as The organizational rules that lay down the general framework for public liberties and individual rights, all to prevent them from practicing any activity outside the framework of legality. Originally, the administration is not obligated to issue its decisions in a specific form, as it is free to choose the external form of these decisions, unless the law requires it otherwise. This requires that the decision be embodied in an external form in order for individuals to know the will of the administration and to adjust their behavior according to its requirements. However, the implementation of this rule on its launch, may negatively affect the rights of individuals, because the administration may sometimes deliberately remain silent about deciding the requests submitted to it, or it may neglect at other times to respond to these requests. Accordingly, the request submitted to any party starts from the legal period available to the administration to meet the requests of individuals and in its absence the implicit administrative decision of rejection or acceptance arises. Accordingly, we will study the jurisprudence of the French, Lebanese, Egyptian and Iraqi judiciary in this study. The importance of the study lies in the implications of the subject of requests submitted to the administration, the delay in their completion, the silence of the administration, and the consequent effects and exposure to the rights of individuals. And that it will show how to confront this silence, neglect and intransigence of the administration. The idea of ​​implicit administrative decisions, resulting from the administration’s silence on the requests submitted to it, is an effective means, which makes the administration more positive and enables individuals to confront the administration’s silence, and prevents its intransigence, arbitrariness or neglect. The problem of the research is that can silence be an expression of the will? How do individuals protect themselves from the actions of the administration, and who guarantees its non-bias, arbitrariness and deviation? Does submitting the application to a non-competent body protect the rights of individuals? ? And the extent of judicial oversight on the authority of the administration.? And the extent of the compatibility and divergence of the positions of the administrative judiciary in France, Lebanon, Egypt and Iraq regarding this.? From the above in explaining the importance of the study and its problem, we can deduce the scope of the study, which is the study of judicial control over the requests submitted to the administration by taking an overview of the nature of the requests, their types and distinguishing them from others, and the position of each of the legislation, the judiciary and jurisprudence from it. Report considers the field of governance first at the level of constitutional institutions and tradition, addressing the development of Turkey’s constitutional politics and contemporary debates as its subject matter. Secondly, the report includes the primary institutional structures relevant to establishing constitutional institutions into its subject matter. In this context, the political party regimes, electoral system, and public administration must be handled with their current structures and problems. Whether at the level of the constitution or the primary institutional structures, analyses are debated in terms of the socio-administrative dynamics that are determinant in shaping these structures, the effects these dynamics have on the formation of institutional structures and administrative traditions, and finally their impact on the functioning of Turkish politics. When creating the vision document, the report will identify Turkey’s stance within global debates through both its similarities, as well as its peculiarities to other nations. In this context, concrete and practicable recommendations are made to improve the functionality of the Presidential System, which was introduced with the 2017 Constitutional Referendum.
