Abstract.WHO IS GOING WITH YOU TO THE PARTY? MANAGING CONFLICT BETWEEN PARENTS AND ADOLESCENTSFamily life may be may be in risk when parents and adolescent face conflicts from closed positions. The processes of conflict demand perspectivism competences as an essential resource to facilitate the achievement of satisfactory arrangements for all through adequate argumentation. The purpose of this paper has been to analyze the skills of parents and adolescents to adopt other perspectives when discussing a conflict by means of observational methodology. The study was carried out with 29 families (constituted by father, mother and an adolescent son or daughter) who were recorded while they argued about a real conflict. Frequency of five levels of perspective-taking were registered (Myself; Reasoned myself; The other like an obstacle; The other adding to me; and Us) in the discourse of the family, and also in the different members of the triad, considering their interrelations. The results were showing a moderated level of perspective-taking in family discussions, predominating the levels Reasoned myself, focused on explaining own perspective, and The other like an obstacle, focused on reasons to contest the perspective of the other. In general parents showed more perspective-taking. Particularly the mothers exhibited more sensitivity with her adolescent son or daughter, providing higher levels of perspective-taking and argumentation.Keywords: Family conflicts, parents-adolescents, oral argumentation, perspective-taking, negotiation.Resumen.La convivencia familiar puede ponerse en peligro cuando los padres e hijos adolescentes afrontan los conflictos desde posturas cerradas. Los procesos de conflicto, en un contexto de convivencia, requieren poner en marcha el perspectivismo como recurso imprescindible para facilitar el logro de acuerdos satisfactorios para todos a través de una adecuada argumentación. Mediante la metodología observacional, analizamos la capacidad de adoptar otras perspectivas durante los conflictos familiares. La muestra está compuesta por 87 participantes, organizados en 29 tríadas familiares (constituidas por el padre, la madre y un/a hijo/a adolescente) que fueron grabadas mientras discutían acerca de un conflicto real. Se analizan la frecuencia de cinco niveles perspectivistas (Yo simple; Yo Razonado; el Otro como Obstáculo; el Otro Añadido; y Nosotros) en el discurso familiar, en función de cada uno de los miembros de la tríada, así como las relaciones que se establecen entre sí. Los resultados muestran el predominio de los niveles «Yo Razonado» con explicaciones sobre la propia posición, y «el Otro como Obstáculo» con razones para rebatir las posiciones contrarias. Los padres, en general, conceden mayor oportunidad al perspectivismo que los adolescentes, especialmente las madres, quienes muestran más sensibilidad con los hijos/as al emplear niveles perspectivistas y de argumentación más elevados.Palabras clave: Conflictos familiares, padres-adolescentes, argumentación oral, perspectivismo, negociación.

The article systematizes the results of the study of adolescent health in conflict with the law in East Kazakhstan region. Adolescent mental health is considered a basic condition for development and well-being. It takes into account international practice of working with children in conflict with the law, which updates the needs of children for special work and special assistance. Mental health as a basic basis for assessment is given a significant place. In order to reduce the risks of repeated conflicts with the law and to plan recovery programs, it is necessary to understand the basis of well-being - the state of mental health of children. The study was conducted on a sample of 511 people using the methods MAYSI-2 and STAB. On the basis of the study, activities can be planned that will help adolescents to receive assistance in the field of mental health.

ABSTRACT Objective: To understand the meaning of being institutionalized and in conflict with the law for the institutionalized adolescent. Method: A qualitative, phenomenological-comprehensive study carried out in a Socio-educational Service Foundation in the northern region of Brazil, with 05 institutionalized adolescents. The analysis was carried out under the understanding of the content suggested by Heidgger, thus allowing the construction of analytical categories for a hermeneutical interpretation. Results: Conflicting with the law means something negative and bad for the institutionalized adolescents, in which they understand that although there is deprivation of liberty, the period of hospitalization is an important moment for the reflection on the need to start over. Conclusion: The meaning of conflicting with the law goes far beyond a simple word, act or behaviour, it is something that only those who experience the phenomenon are able to unveil, arouse deep feelings and provide reflection to the adolescent about the damages caused by the infraction.

Abstract Students strongly bonded to the educational institution are more motivated to study and less likely to present behavioral problems and/or juvenile delinquency. This study's objective was to verify the existence of variations in school bonding among different groups of adolescents and identify the most problematic aspects among adolescents in conflict with the law from the perspective of Marc LeBlanc's Social and Personal Control Theory of Deviant Behavior. The 60 adolescents participating in the study responded to the Portuguese version of the School Scale, part of the Measuring Adolescent Social and Personal Adaptation Scale. The results reveal that the level of school bonding differentiated the groups, showing that offenders who dropped out of school obtained the worst indicators of school bonding when considering investment and commitment levels, as well as attachment to teachers.

O presente estudo é resultado de uma pesquisa documental realizada nos autos dos processos das Varas Especiais da Infância e da Juventude da Comarca de São Paulo que continham decisões judiciais determinando o encaminhamento de crianças e adolescentes usuários de substâncias psicoativas para tratamento no campo da saúde mental, com o objetivo de conhecer, compreender e analisar os discursos que sustentam as decisões do Judiciário no campo da saúde mental quanto ao modelo assistencial adotado no caso concreto, respondendo à questão: as decisões do Poder Judiciário no campo da saúde mental estão orientadas para o modelo de assistência psiquiátrica tradicional ou para o modelo de assistência proposto pela reforma psiquiátrica? A análise documental se valeu da técnica de Análise do Discurso, cujos resultados foram discutidos à luz do referencial teórico do materialismo histórico-dialético, tendo a ideologia como categoria de análise. A partir da constatação da contradição estabelecida entre o tratamento em saúde mental de atenção psicossocial e as medidas socioeducativas de internação e semiliberdade, referente à precarização da territorialidade dos adolescentes, o estudo revelou duas condições essenciais para a determinação do respectivo paradigma teórico-assistencial do campo da saúde mental adotado pelo Judiciário, quais sejam, a avaliação da esfera territorial dos adolescentes e o conhecimento do específico dispositivo de saúde mental indicado para o tratamento dos jovens, condições que propiciaram a identificação de que uma das amostras encontra abrigo no referencial da reforma psiquiátrica.<br>This study is the result of documental research performed on the proceedings of the Special Courts for Children and Youth of the district of São Paulo containing judiciary decisions on the forwarding of children and adolescent users of psychoactive substances for treatment in the mental health field with the objective of knowing, comprehending, and analyzing the discourses that support the courts decisions in the mental health field relative to care model chosen, answering the following question: are the courts decisions in the mental health field oriented by the model of traditional psychiatric care or by the model proposed by the psychiatric reform? The documentary analysis was made using the technique of discourse analysis, whose results were based on the theoretical-methodological system of Historical and Dialectical Materialism, having ideology as its category of analysis. From the contradiction between mental health treatment and the institutionalization measures of the Special Courts for Children and Youth concerning the territorial precariousness of adolescents, the study revealed two essential conditions to determine which theoretical paradigm is chosen by the judiciary: the evaluation of territorial sphere of adolescents and the knowledge of the particular mental health service for the treatment of adolescents; conditions that helped identify among the samples, one that belongs to psychiatric reform.

As infrações cometidas por adolescentes despertam interesse e preocupação. A maioria dos estudos realizados sobre o tema direciona-se a aspectos relacionados à família. Em termos de proporção, outras instituições de socialização dos adolescentes, tais como a escola e os pares, são menos investigadas. Nesse sentido, interessa a este trabalho investigar os aspectos escolares atinentes à problemática no contexto nacional, uma vez que investigações internacionais recentes demonstram que a conduta delituosa apresenta forte associação com a desadaptação às exigências e às expectativas do meio escolar, sendo essa relação, na adolescência, mais forte que a existente com os problemas na família. Os objetivos da pesquisa foram: 1) identificar quais variáveis encontram-se associadas ao comportamento infracional em adolescentes, e 2) verificar de que modo as variáveis associadas contribuem para o aparecimento/manutenção do comportamento infracional, no quadro da Teoria da Regulação Social e Pessoal da Conduta Divergente de Marc LeBlanc. Para a coleta de dados, procedeu-se à aplicação da Escala Escola do Inventário MASPAQ (Measuring Adolescent Social and Personal Adaptation) e de um questionário de caracterização socioeconômica. Participaram da presente pesquisa 60 adolescentes, divididos em dois grupos, constituídos, respectivamente, por 30 adolescentes infratores (GI) e 30 não infratores (GNI). Estes grupos foram subdivididos também em outros dois, compostos cada um por 15 participantes: adolescentes infratores evadidos da escola (GI-Evadidos); adolescentes infratores estudantes (GI-Estudantes); adolescentes não infratores evadidos (GNI-Evadidos); e adolescentes não infratores estudantes (GNI-Estudantes). Para LeBlanc, a Regulação Escolar se ancora sobre três mecanismos complementares: Desempenho, Vínculo com a escola e Constrangimentos escolares. Cada uma dessas condições é explorada pelo instrumento empregado, o que possibilita avaliar o nível de adaptação do aluno e como se dá a regulação da conduta pela escola. Em síntese, os resultados possibilitaram tanto uma compreensão geral do sistema que regula o comportamento dos adolescentes na escola, quanto específica, concernindo a cada aspecto avaliado nas diferentes dimensões postuladas no quadro da Teoria. As experiências escolares se mostraram nitidamente distintas entre os grupos e foi possível identificar as fragilidades ou pontos fortes de cada um. A quase totalidade das diferenças estatisticamente significativas incidiu nas comparações entre os grupos GI-Evadidos e GI-Estudantes, bem como entre os Grupos GI-Evadidos e GNI-Estudantes. Denotou-se que os adolescentes infratores evadidos (GI-Evadidos) possuem mais problemas escolares em comparação aos outros três grupos investigados; ao passo que os adolescentes não infratores estudantes (GNIEstudantes) demonstraram os melhores resultados, de modo a evidenciar que uma experiência educacional mais positiva concorre para a boa vinculação escolar e ausência de conduta contrária à lei. A presente investigação também lançou pistas para o desenvolvimento de intervenções dirigidas a fatores escolares, na medida em que as evidências indicaram quão fundamental é a experiência educacional, no sentido de funcionar como risco ou como proteção à conduta infracional na adolescência.<br>The infractions committed by teenagers have caused interest and concern.Most studies on the subject focus only on issues related to the family. Thus, other institutions of socialization of adolescents, such as school and peers, are not much investigated. In that sense, this work is interested to study the aspects related to school in the national context, since international recent research has shown that juvenile delinquency is strongly associated with maladjustment to the demands and expectations of the school environment, being this relation stronger than the relation with family problems. This research objectives were: 1) identify which variables are associated to the criminal teenagers behavior, and 2) verify in which way the associated variables contribute for the criminal behavior emersion/maintenance, under de perspective of Personal and Social Control Behavior Theory by Marc LeBlanc. The School Scale of MASPAQ Inventory (Measuring Adolescent Social and Personal Adaptation) and a questionnaire of socioeconomic characterization were used of the data collection. 60 adolescents participated in this research and they were divided in two groups, that were formed, respectively, by 30 adjudicated adolescents (GI) and 30 non-adjudicated adolescents (GNI). These groups were also subdivided in other two groups, each one was formed by 15 participants: adjudicated adolescents who were evaded from school (GI-Evaded); adjudicated adolescents students (GI-Students); non-adjudicated evaded adolescents (GNI-Evaded); and non-adjudicated adolescents students (GNI-Students). For Le Blanc, the School Control is based on three complementary mechanisms: academic performance, school bonding and constraints. Each of these conditions is analyzed in its various aspects by MASPAQ, which enables to evaluate the student\'s level of adaptation and how the control of conduct is made by the school. In short, the results enabled as far as a general comprehension about the system that adjust the adolescents behavior in school, and a specific comprehension, regarding each aspect evaluated in different dimensions claimed in the Theory frame. The scholar experiences show themselves clearly distinct among the groups and it was possible to identify the weaknesses or strong points of each one of them. The nearly totality of the statistically significant differences fell on the comparisons between the GI-Evaded and GI-Students groups, as well as those between GI-Evaded and GNI-Students groups, denoting that the evaded infriging teenagers (GI-Evaded) showed most problems in comparison on others groups; while non-adjudicated adolescents students (GNI-Students) showed the best results, in order to show that a more positive educational experience contributes to the good school and no binding of conduct contrary to the law. Moreover, the current investigation threw clues for the development of intervention towards scholar factors, insofar as the evidences pointed how elemental the educational experience is, in the sense of working as a risk or as a criminal behavior protection in adolescence.

Adolescents, therefore, are connected to their parents and siblings, and need consistent interaction in their quest to feel valued and accepted, and to have warm and supportive relationships. In South Africa, particularly the Drakenstein area, adolescents are constantly in conflict with the law, which influences family connectedness. Limited research has been done in the South African context on this phenomenon. For this reason, the researcher sought to address this gap in the literature by means of this study. The purpose of the study was to explore and describe the perceived link between family connectedness and families dealing with adolescents in conflict with the law.

Problematizam-se conceitos do campo das ciências humanas ? integralidade, inserção social, ato infracional, família ? entendendo-os como relevantes para a análise da saúde do adolescente. A perspectiva teórico-metodológica do self dialógico fundamenta-se na concepção da interdependência entre subjetividade e cultura, segundo a qual a pessoa constrói significações no encontro com o outro. Neste processo, a memória narrativa atualiza vozes que, nos seus múltiplos posicionamentos, realizam trocas dialógicas análogas à assimetria das relações sociais. Enquanto gênero discursivo, o modelo de proteção integral incorpora concepções sobre o adolescente, fundadas no reconhecimento da igualdade e defesa da dignidade humana, o que sinaliza ruptura com a doutrina da situação irregular. Para o adolescente autor de ato infracional estão previstas medidas de caráter protecional e pedagógico, aplicadas ?erga omnes?, no curso do devido processo legal, no qual operadores judiciais dialogam com a família em reconhecimento de suas funções sociais e simbólicas. Com o objetivo de investigar o diálogo entre atores da família, sociedade e poder público em um âmbito de construção discursiva acerca da integralidade à saúde, foram selecionadas setenta e oito peças processuais que registram narrativas sobre vínculo familiar de adolescentes da instância judicial de responsabilidade juvenil por ato infracional em Salvador, entre 1996 e 2002. Propõe-se, como unidade de análise, o encontro entre atores judiciais e familiares, em face do objetivo específico de analisar a construção de significações em torno do eixo relacional pertencimento-desterro considerando a continuidade, a ruptura dos vínculos familiares e a construção de significados acerca do pertencimento. No primeiro artigo, as significações maternas acerca de vias de sociabilidade, risco e prática infracional de adolescentes, revelam a busca por minimizar as conseqüências da infração, mediante trocas significativas entre pessoas e contextos, a fim de restituir, em algum sentido, a ruptura gerada pela infração. Sobressai a busca, junto ao poder público, de contextos que ofereçam proteção ao adolescente. A fim de alcançar ainda o objetivo mais amplo, a análise do segundo artigo tem como objeto a construção da cultura pessoal e trata de trajetórias de adolescentes em conflito com a lei, discutindo processos que implicam em continuidade e na desistência da prática infracional. A partir da abordagem do self dialógico, os atores posicionam-se frente à participação do jovem em 8 contextos de sociabilidade que, na sua perspectiva, os aproximam da prática infracional. O terceiro artigo tem como objeto as tensões e paradoxos suscitados no encontro entre adolescente e genitor no contexto da justiça de responsabilidade juvenil. As narrativas paternas remetem à construção de sentidos relativos aos seguintes eixos: a. prática infracional; b. intervenções na medida socioeducativa; c. conflitos intergeracionais. As demandas do adolescente ultrapassam as condições familiares de resposta, o que requer ação planejada em nível de políticas públicas para oferta de suporte sistemático das relações familiares na constituição de sentidos subjetivos para a convivência social. A investigação aponta posicionamentos e vozes parentais diversas em relação à integralidade e família, bem como do lugar social da família e do adolescente em face da prática infracional que evoca limites da continuidade de vínculos. Os posicionamentos de figuras de cuidado demarcam padrões de trajetórias e propiciam demandas para o sistema de garantias. Nas conclusões, discutem-se relações dialógicas entre várias idéias ou vozes em conflito acerca da prática infracional, da trajetória do adolescente e dos recursos da família para inserção social. Caso isso aconteça, sua condição passa a ser adolescente em conflito com a lei. Dessa forma, o Estatuto da Criança e do Adolescente (ECA) prevê sua inserção em uma das medidas socioeducativas, entre elas a de internação. Diversos fatores de risco e de proteção encontrados na literatura associam-se ao adolescente em conflito com a lei e suas famílias e estão relacionados ao engajamento ou não desses adolescentes à prática de atos infracionais. O estudo desses fatores contribui para entender o envolvimento deles no mundo criminal. Diante desse contexto, o presente estudo se propôs a caracterizar 30 adolescentes em conflito com a lei e suas famílias, de acordo com o modelo bioecológico de Bronfenbrenner (1996). A abordagem bioecológica adotada focaliza os diferentes níveis de fatores que influenciam a vida desses adolescentes de forma negativa, e das possibilidades de se criar e fortalecer os fatores protetivos, também em diferentes níveis. Os resultados revelam que esses adolescentes apresentam idade média de 17 anos, baixa escolaridade e que coabitavam com suas famílias, antes da internação. A maioria usava maconha, cocaína e crack e começaram a praticar atos infracionais entre sete e dezessete anos. O ato infracional encontrado com maior percentual foi o tráfico, seguido de roubo, furto e homicídio. Observou-se estreita relação entre prática infracional e o uso de drogas pelos adolescentes e a necessidade de aquisição de bens materiais. This way, the Statute of the Child and Adolescent presumes his insertion into one of the socio educative measures, among them the internment. Several risk and protection factors found in the literature associate to the adolescent in conflict with the law and the families, and are related to the commitment or not of these adolescents to the practice of infractional acts. The study of these factors helps to understand their involvement in the criminal world. In front of this context, the present study is proposed to characterize 30 adolescents in conflict with the law and their families, searching for a wider regard, according to the bioecological model of Bronfenbrenner (1996). The adopted bioecological approach focuses on the different levels of factors that influence the lives of these adolescents in a negative way, and the possibilities to create and strengthen the protective factors, also in different levels. The results reveal that these adolescents are around 17 years old, low schooling and cohabited with their families before the internment. Este estudo investigou as percepções de adolescentes autores de ato infracional sobre sua própria família, o ato infracional cometido e a medida socioeducativa. Foram realizados estudos de caso com três adolescentes, do sexo masculino, com idades entre 15 e 18 anos, que cumpriam medidas socioeducativas em meio aberto. Os instrumentos utilizados foram uma entrevista semiestruturada, o genograma e o Family System Test (FAST). Foram feitas análises individuais de cada caso e uma discussão integrada, enfocando os contextos de desenvolvimento e a infração juvenil. Foram identificados os fatores de proteção e de risco presentes nos contextos nos quais os jovens estavam inseridos, sendo que as práticas educativas parentais foram percebidas como fator de risco no desenvolvimento destes jovens, enquanto que a medida socioeducativa foi percebida como um importante fator de proteção. Destaca-se a importância de estudos que investiguem os fatores individuais e ambientais envolvidos na problemática da infração juvenil, para que possam ser propostos programas de prevenção e intervenção adequados.<br>This study investigated the perceptions of adolescents who were authors of infraction acts on their own families, the committed infraction act and the socio-educational measure. Case studies were conducted with three adolescents, male, aged between 15 and 18 years old who were in freedom, but followed by a supervised socioeducative measure. The instruments utilized were a semi-structured interview, a genogram and the Family System Test (FAST). In addition, individual analyses from each case and an integrated discussion were carried out, focusing on contexts of development and youth infraction. Risk and protection factors were identified in the contexts in which the young individuals lived and the parent educational practices were perceived as a risk factor in the development of these young individuals, while the socio-educational measure was perceived as an important protection factor. Finally, the importance of studies that investigate individual and environmental factors involved in the issue of youth infraction were highlighted which allows that adequate programs of prevention and intervention are proposed.

Having this institution as background to place the research. These experiences and emotions reveal the everyday life of the adolescents in conflict with the law in fullfilment of socioeducational measures. By telling all this, I tried to overcome the walls and gates of Febem, showing a world not well-known to outsiders. In the second part, the research was dedicated to the study of the everyday life of adolescent in conflict with the law in fullfilment of semi liberty socioeducational measure of internment. This discussion aimed at, by analyzing the adolescent s speech, understanding his experiences and emotions and investigating how the adolescent deals with the measure. This is a qualitative research and it was done in a Febem institution. Three adolescents took part of it. They aged from 16 to 17 and were in conflict with the law in fulfillment of socioeducational measure. The individual interview was the main instrument to collect data. The data analysis have showed that, in spite of the fact that the socioeducational measure allows the adolescents to go out and to visit the family on the weekends, the adolescents keep on living moments of anguish and stress due to the norms and imposed rules. Despite the difficulties, they say that the effective norms are necessary for their re-socialization; besides, they show, during interview, ambiguities and contradictions in relation to their future choices. The consumption culture emerges as the main reason of the juvenile delinquency. They perceive the rules of the measure as a penalty that restrict the freedom and the satisfaction of their desires, and the vulnerability is the source to make them break the law. For the interviewed adolescents the challenge is the future, which is linked to the satisfaction of desires of consumption. However, satisfying these desires is almost impossible for these adolescents due to their social economic status<br>O presente estudo teve como objetivo, num primeiro momento, narrar as experiências e as emoções vivenciadas por mim, enquanto funcionária da Febem/SP, tendo esta como pano de fundo para situar a pesquisa. Nele, apresento um relato do cotidiano e da convivência com os adolescentes em conflito com a lei, em cumprimento de medida socioeducativa de internação, transpondo muros, grades e portões, revelando as facetas de um mundo ainda pouco conhecido. Num segundo momento, o trabalho dedicou-se ao estudo sobre os adolescentes em conflito com a lei, em cumprimento de medida socioeducativa de semiliberdade, caracterizando a vida cotidiana dos adolescentes nela inseridos, buscando compreender e identificar as percepções e experiências vividas, investigando como é para eles conviverem com esta medida: ora liberto, ora sem liberdade. Trata-se de uma pesquisa qualitativa, realizada em uma unidade da Febem, na qual participaram três adolescentes, com idade entre 16 e 17 anos, que estavam inseridos nesta medida. A entrevista individual foi o principal instrumento para a coleta de dados. As análises dos dados mostraram que, embora a medida possibilite saídas externas e convivência familiar nos fins de semanas, os adolescentes vivem momentos de angústia e stress, em função das normas e regras impostas. Apesar das dificuldades, eles adotam o discurso que as normas vigentes são necessárias para a sua ressocialização e deixam entrever ambigüidades e contradições quanto às suas escolhas futuras. O consumismo aparece como principal motivo para delinqüência. Os preceitos da medida são percebidos, por eles, como algo que impede a liberdade e a satisfação dos desejos, e a vulnerabilidade como impulso para seu ingresso no meio infracional. These incidents require that harsh attitudes should be taken on the part of the competent authorities. Then, the authorities decided to quickly respond to it by launching a new proposal that changes the current Brazilian legislation like reducing the come of age of the perpetrators from eighteen years old to sixteen years old, following the same model of the developed countries. This proposal turned the issue into a big controversy debated nationwide.This survey refers to an investigation in what the role of the state schools and high schools of the city of Manaus might be in face of the students with problems with the law, and most importantly, in face of students that belongs to street gangs.It is necessary to understand the interrelations that emerged from the observed context to fully comprehend the reality in which the students live in. This research adopted a qualitative perspective and investigated two county high schools to better understand the relationship between the education and the social reality of the observed students. And it also looked for information in their reports.The analysed context allowed us to conclude that the results pointed to the fact that it is necessary to enhance the scholar environment when it comes to including the adolescents with problems with the law in their society. Despite the fact the several researches pointed out to the necessity of implementing primary preventative measures, especially inside the schools in a way to reduce the adolescents perpetrators, nothing or almost nothing has been done to improve this scenario, either on the part of the schools or the public institutions.<br>Nos últimos anos tem sido praticamente uma constante, nos noticiários nacionais e locais, por todo o Brasil, manchetes noticiando o envolvimento de adolescentes em atos infracionais. Esses acontecimentos acabaram por impulsionar a população a cobrar alguma atitude das autoridades competentes. Essas autoridades, por sua vez, como em forma de resposta rápida a essa população, e seguindo o modelo aplicado por países ditos do primeiro mundo, lançaram a proposta de mudança na legislação brasileira, reduzindo a idade penal de 18 para 16 anos de Idade. Essa proposta se transformou em uma grande polêmica nacional, envolvendo representantes dos mais diversos setores da sociedade brasileira. Diante desse quadro, esta pesquisa teve, como corte analítico, a investigação de qual o papel desempenhando por escolas públicas da rede municipal de ensino fundamental (6o ao 9o ano) da cidade de Manaus, diante da presença dentro do seu universo, de adolescentes em conflito com a lei, principalmente adolescentes que fazem parte de galeras, ou, gangues de rua. Dessa forma, partindo do princípio de que para a construção do conhecimento de uma determinada realidade, se faz necessário a compreensão das inter-relações que emergem em torno do contexto observado, essa pesquisa adotou uma perspectiva qualitativa, e como instrumento de investigação para uma melhor compreensão da vinculação da educação com a realidade social, delimitou-se o universo das observações ao cotidiano de duas escolas municipais de ensino fundamental da cidade de Manaus, como também consultas à relatórios das referidas escolas. O contexto analisado permite concluir que os resultados apontam para o fato de que a educação, no que se refere as escolas de ensino público municipal da cidade de Manaus, de uma forma geral, necessita fortalecer o clima de convívio escolar no que se refere a inclusão, nessa comunidade, de adolescentes em conflito com a lei. Apesar de vários estudos científicos apontarem para a necessidade da implantação de prevenções primárias, principalmente dentro das escolas, para se trabalhar a redução do número de adolescentes infratores, pouco, ou quase nada vem sendo realizado, tanto nas escolas quanto por demais instituições públicas.

Este trabalho é resultado de um estudo sobre o conceito de estigma e seus efeitos práticos na vida de jovens em cumprimento de medida socioeducativa. Inicialmente, o estigma foi abordado sob a perspectiva teórica de Erving Goffman, de Norbert Elias e John Scotson e de Michel Foucault. Posteriormente, seguindo as orientações de Goffman, foi desenvolvido o estudo do estigma específico “menor infrator”, analisandose a sua construção histórica no Brasil, a delimitação e identificação do grupo afetado e os efeitos que esse estigma produz nesta população. A pesquisa compreendeu um grupo de 96 jovens, todos provenientes dos bairros Partenon e Lomba do Pinheiro, localizados na cidade de Porto Alegre. Com o fim de traçar o perfil desses jovens em cumprimento de medida de Prestação de Serviço à Comunidade (PSC), a pesquisa valeu-se, como material empírico, de documentos do Núcleo de Extensão e Pesquisa Interdepartamental de Práticas com Adolescentes e Jovens em Conflito com a Lei (PIPA), da Universidade Federal do Rio Grande do Sul (UFRGS), que realiza um trabalho interdisciplinar no acompanhamento de jovens em medida socioeducativa, com participação de estudantes, técnicos e professores da pedagogia, psicologia, direito, história, artes, serviço social, enfermagem e ciências sociais. Tais documentos foram obtidos do banco de dados do Programa de Prestação de Serviço à Comunidade (PPSC), Programa este integrante do PIPA, consistindo principalmente de Relatos de Acompanhamento, transcrições de Audiências e relatórios de Plano Individual de Atendimento (PIA). O estudo revelou que estes jovens acabam tendo seus direitos negados, tornando-se meros objetos de técnicas disciplinadoras e normatizadoras do Estado, tudo isto legitimado pelo estigma de “menor infrator”. Esses Jovens são vistos como seres humanos inferiores, perigosos para a sociedade, descartáveis e incapazes (desacreditados). Essa visão perpassa os próprios profissionais de medidas socioeducativas e da rede pública, os quais, por isso, acabam, com frequência, por manter estes jovens à distância, tratando-os de modo paranóico ou perverso, como seres inadequados, excedentes e indesejáveis, sem preocupar-se em conhecer o contexto de vida único de cada um destes jovens e suas potencialidades. O conceito de estigma revelou-se, assim, instrumento útil para estudos sobre jovens em conflito com a lei e em cumprimento de medidas socioeducativas.<br>This research resulted from a study about the concept of stigma and its practical effects in the life of adolescents under socio-educational measures. Initially, the stigma was approached from the theoretical perspective of Erving Goffman, Norbert Elias and John Scotson and Michel Foucault. Later, following the guidelines of Goffman, the study of the specific stigma of "menor infrator" was developed by analyzing its historical construction in Brazil, the delimitation and identification of the affected group and the effects that this stigma produces in this population. The research comprised a group of 96 adolescents, all from the neighborhood areas Parthenon and Lomba do Pinheiro, located in the city of Porto Alegre. In order to profile these adolescents that were in Prestação de Serviço à Comunidade (PSC), the research employed, as empirical material, documents of the Núcleo de Extensão e Pesquisa Interdepartamental de Práticas com Adolescentes e Jovens em Conflito com a Lei (PIPA), from the Universidade Federal do Rio Grande do Sul (UFRGS), which conducts an interdisciplinary work monitoring teenagers accomplishing socio-educational measures, with the participation of students, technician and professors of pedagogy, psychology, law, history, arts , social work, nursing and social sciences. These documents were obtained from the database of the Programa de Prestação de Serviço à Comunidade (PPSC), which integrates the PIPA, and are mainly Accompanying Reports, transcripts of audiences and reports of Plano Individual de Atendimento (PIA). The study revealed that these adolescents have their rights denied, becoming objects submitted to disciplinary and regulatory techniques of the State, all legitimized by the stigma of "menores infratores". These adolescents are seen as dangerous to society, disposable,unable (discredited) and inferior human beings. This view pervades the professionals that work in thepublic service, which therefore keep these adolescents in distance, treating them in a paranoid or perverse way, considering them as being inadequate and undesirable, without focusing on their unique life contexts and potentialities. The concept of stigma proved itself as a useful tool for studies on youth in conflict with the law and in socio-educational measures.

Abstract:
The analytical and practical field of restorative justice is linked to the debates on the new social conflict management that challenge the institutional design of criminal justice and the Brazilian legal system. When starting from the problematization of the Brazilian criminal justice, we assume that the penalty under neoliberalism presents itself as a societal project that is sustained by the paradox of the potentiation of the police and penitentiary State and the minimization of the economic and social areas of action of the State. Thus, restorative justice emerges as an efficient conflict resolution mechanism, mainly because its criminal approach is based on equating relationships and repairing the damage caused to individuals and communities. In this context, this research aims at analyzing the impact of the implementation of the Restorative Justice Program of the General Department of Social and Education Actions (DEGASE, abbreviation in Portuguese) established by Ordinance 441 of September 13, 2017, within the scope of the social and education units, as well as the challenges presented to those responsible for implementing the law in the state of Rio de Janeiro, Brazil (judges, public defenders, members of the Public Prosecution Service and the DEGASE System) inthe management of restorative practices directed at juvenile offenders deprived of freedom. This problematization raises questions about the limits of the definition of crime and punishment; the relationship between criminal law; and the protection of human rights. The research is structured in three stages: systematic review of the academic field of restorative justice and the Brazilian criminal justice system; elaboration of a framework of the experiences of policies developed in the field of restorativejustice in the state of Rio de Janeiro; and the elaboration of the sociodemographic profile of adolescents and their family structure –analyzing the variables:gender, infraction, age group, monthly family income, education, family structure, and territoriality. It is expected to obtain a critical view of the state of the art of literature on restorative justice in the Brazilian criminal justice system and the debate in the field of conflict resolution criminalized by juvenile offenders served by the Restorative Justice Program of the General Department of Social and Education Actions (DEGASE).

All this sets the task of teachers and psychologists to help the teenager, to teach him a rational way out of the conflict, as well as to carry out preventive measures, to create programs to reduce the level of negative manifestations.

Abstract:
This article raises and discusses the main issues related to the technologies of working in conflict situations in the adolescent environment. Speaking about the conflict in adolescence, it is worth noting that scientists agree that it is communication with peers that is most significant for a teenager and largely determines all other aspects of his behavior and activity, personal development. Consequently, disagreements in the peer group, the struggle for status leads to a conflict of the parties. In this regard, we decided to develop technologies of psychological and pedagogical influence in working with conflict adolescents. We have developed a model of consistent work of actions, which will be aimed at preventing conflicts in the adolescent environment, as well as the formation of their stress resistance, self-control and self-control.
