Full textAdultery has figured in various forms in the repressive arsenal of successive legislators who, from the 1789 revolution to the current day, have studied fidelity between spouses ; with the current disapperance of adultery as penal offence, the judical evolution of marriage shows the protection which, following successive acquisitions of new-found freedom and equality (sexual freedom, equality of the sexes, has become of less and less concern to law order. The history of adultery as a penal offence, is thus indissociable from the evolution of a socio-religious concept : the indissolubility of marriage. When associated the indissolubility of marriage, this incrimination tends to censure the finality, which is notably to enable christian spouses to remain as one at the centre of the united family. The penal offence thus ensures the defence of marriage, a fundamental social institution. The incrimination on the other hand, tends to disappear during periods of dissolubility of marriage, when it loses its consistence, to leave the institutional field for simple contractual field ; in this case adultery is simply a civil incident. Two important period mark recent history of adultery as a penal offence. From 1816 to 1884 it was the main rampart af the indissoluble marriage (Part I) ; from 1884, the offence, henceforthat the service of dissoluble marriage, lost any reason to exist and became ineffective before completely disappearing (Part II)

Full textThis dissertation aims to confront the two archetypes of the prostitute and the adulterous woman in the XVIth century Venetian society. Taking a multidisciplinary approach, this text examines literary works – well known and unpublished – and the legal sources of the Serenissima. Looking beyond binary oppositions between individual desires for freedom and the repressive control apparatus by the State, this study works to clarify the ways in which the sexual tensions come from the economical, political and social contradictions which governed gender relationships in the republic of Venice. It first analyzes sexual and sentimental norms of the early-modern society. It will then define the ways in which licit and illicit love overlap, especially during the key moment of seduction. This will allow us to elucidate the specificities of female adultery and prostitution as forms of extra-conjugal sexuality. It will then be possible to trace the history of prostitution's management by the Venetian government. The latter recognized thea legal status of venal love, from which the ruling class could benefit. But we will also show how antiputtanesca poetry reflects the concerns of that social class. Adultery may similarly be seen as a contradictory practice, violently condemned by the law but part of young men's socialization before their wedding. Finally, one important aspect of this research stands in the presentation of various unpublished antiputtaneschi poems, often anonymous: we will display their rich intertextuality

Our contemporary society does not infringe upon this rule. Very often, Man appears "loaded" with a secret which inevitably he will not try to discard. Quite the contrary. Secrets seem to show themselves under a protective form with a synchronising function among members of a group. A secret becomes an illusion and renders achievable the modification of a sad or maladjusted reality. It is where the sacred meets the imagination and sometimes even the proscription. A secret, a polysemous and polymorphous object, varies in its sense, its functions, and its forms according to the environment in which it is confronted. This research is presented and is experienced as a voyage, an exploration passing through the abysses of three parallel worlds, those of adultery, illness and freemasonry. To experience such an expedition in such abounding and heterogeneous fields requires the accompaniment of a guide. The companion chosen is the character of the Faust legend. With the help of this guide we have been able to travel into the depths and discover secrecy itself, carrying with us in our luggage, symbolism and imagination…Throughout our voyages, secrecy has become a myth-like narrative entity, drawing its strength from this ability to exist through shadows and opposites, providing us simultaneously with a poisonous charm, potency, power and magic

Full textThe main subject of this study is seduction and it's counterpart love. Seduction is the starting point of the thematic study of each chapter. Through the study of various contemporary french and american novels, we have to draw the map of the new loving landscape and to point out the literary variations of the loving behaviour. This study is not only based on the thematic of the novels but also on their resemblances and their differences. However, it is not only built on the comparison between the literature of the two countries. It is also based on the opposition, in each country, between two forms of seduction and love. The two forms can be summarized as follows : a destructive and dangerous form, and an idyllic one. These two forms are different in each country but we can find resemblances. In french literature, the theme of seduction is simultaneously represented in an evil and a perverse way and in a romantic form, which provides the apology of hapiness and happy couple. In the american literature, seduction is presented in two differents forms. Firstly, there is a cruel seduction, because it happens essentially in extra-marital love affairs. Secondly, there is an ideal seduction. This seduction appearsin a particuliar type of novels. It can be found in sentimental novels, which can be called harlequin romances, and, thus, in love stories written by danielle steel. Hence, we can define two literary worlds privileging the description of love through seduction. The novels studied are novels of society which are the image of a form of throught and of a way of life. But, before beginnning the study of the corpus, we have to look back upon the sources in order to give some definitions but also to remind who were the great tempters in literature
