Abstract:
This thesis is particularly concerned with everyday creativity as a social practice that is taking place within the digital environment. Web 2.0 made it much easier for laypersons to produce and publish digital content and to participate in online communities. Through participation community members can acquire domain-relevant knowledge as well as develop their digital competency. In some areas, online communities of highly motivated amateurs (Pro-Ams) work to professional standards and even achieve better results than their professional colleagues. Open Source software projects or Wikis are among areas that rely on committed amateurs and the strength of a community. The empirical stage of the research comprises two studies that aim to investigate the role of ICT and the Internet in everyday creative activities and how the use of digital tools for creativity can be facilitated and improved. An exploratory online survey revealed that the majority of participants are involved in everyday creative activities many of which are performed with the use of digital tools. However, the lack of digital competency and skills has been proved to be among the main barriers to using software tools for everyday creativity and participation in the digital environment. Taking into account the survey data that revealed digital photo-editing and manipulation to be the most popular creative activity among participants, a powerful, free, image-editing program - the GIMP - was chosen for the experiment. A group of people with no professional knowledge of using image editing programs participated in a single-day workshop where they learned how to do basic image processing with a free software editor, the GIMP. Data collection methods involved questionnaires, observation and follow-up telephone interviews. The GIMP tutorial and practice session proved to be successful in engaging non-professionals in image manipulation with the GIMP and facilitating further use and learning through individual effort.

Abstract:
This thesis constitutes a critical intervention in contemporary research on terrorism. It seeks to address the problems resulting from a reductive understanding of terrorism and from a predominant concern with terrorism after 9/11. For this purpose, this thesis charts and critically engages certain watershed moments in the history of terrorism since its emergence in the French Revolution. The aim is to show that terrorism is not a historically constant and readily identifiable form of violence but a variable element in a wider context of power relations. The discourses of terrorism examined in this thesis show that conceptions of terrorism are tied to and function within a wider context of changing political interests and an evolving modern economy of power. I show that there are reasons for the different meanings and roles of terrorism across time and between societies, and that these reasons shed light on larger social, political, cultural or economic developments. It is in this context that particular discourses of terrorism help to legitimate political and legal regimes and allow for the selective exclusion of individuals, groups and ideologies from the political realm. I argue that a historically grounded and theoretically thorough analysis of terrorism can provide important insights into how the state has been able to sustain itself by incorporating and mobilizing different types of power. By way of a genealogical study of terrorism, my project attempts to map these forms of power as well as their dependence on various frameworks that are used to legitimize violence, to dismantle legal norms, and to expand power in the name of freedom and democracy. This thesis thus not only responds to the epistemological, methodological and temporal limitations of contemporary terrorism scholarship but is also of practical political relevance.

In doing so, the dissertation demonstrates the central concerns of hacker stories—concerns about digital security, privacy, and the value of information—have become the concerns of digital culture as a whole, hackers laying bare collective hopes and fears regarding digital networks.

This study brings together science and technology studies, political anthropology, and Latin American studies, by studying the practices and political reasoning of neoliberal networks in Peru. It analyses the extension of such networks by studying the relationships and subjectivities cultivated under two contemporary state-led projects: an initiative promoting intellectual property rights among traditional artisans as tools for rural development, and a national effort to encourage the uptake of free/libre and open source software based resources. Promising to modernize government and prepare citizens for the global, information-based economy, these projects frame their reforms as new, contemporary models for economic development. This work demonstrate how key to the success of such projects is the remaking of rural and urban citizens into "free" and modern individuals who are able to independently self- realize using the tools and logics of information networks. It argues that such plans rely on the ability to bring diverse actors - including state planners, transnational corporations, traditional artisans, rural communities, urban technology experts, and transnational activists -- into strategic alliance, or what can become coded as relations of promiscuity. What brings these partnerships together and seduces such disparate actors into alliance isn't so much the promise of increased technology access. It is instead the promise of "freedom" and the opportunity for diversely situated subjects to realize themselves as "modern individuals."

Painted in 1937 as part of the centenary celebration of the death of Alexander Pushkin, Nikolai Ulyanov's A. S. Pushkin and his Wife, N. N. Pushkina at the Imperial Ball has been lauded as the quintessential example of Soviet history painting. Modern scholars have followed the lead of Soviet critics, who praised the painting for its insight into the psychology of the brilliant poet repressed by the tyrannical tsarist regime. According to this interpretation, Soviet viewers in the 1930s were to ponder on the tragedy of Pushkin's demise and rejoice that the victory of Socialism had freed them from such repression. However, this thesis suggests that Ulyanov embedded a secondary, subversive message in his masterpiece. Through careful manipulation of Pushkin's complex semiotic significance, Socialist Realist dialectics, and the Aesopian method, Ulyanov crafted an image that could be celebrated for its adherence to Soviet ideology, while simultaneously suggesting to those who detected his clues that artistic repression had not ended with the revolution. In this subversive reading, Ulyanov's masterwork becomes a psychological self-portrait of an artist living under Stalinist oppression during the Great Terror.

Sociala medier har fått en allt större roll i det svenska samhället och användarantalet ökar ständigt. I takt med att internetuppkopplingen blivit mer lättillgänglig genom exempelvis smarta telefoner har sättet som kommunikation idag sker på fått nya dimensioner. Privatlivet har således börjat gå in i arbetslivet och tvärtom, vilket har lett till att gränsen blivit otydlig och svårdefinierad. Vad arbetstagare får uttrycka i sociala medier är omdiskuterat och åsikter mellan arbetsgivare, Arbetsdomstolen och andra aktörer går isär. Den grundläggande Yttrandefrihetsgrundlagen inskränks i den privata sektorn av lojalitetsplikten och även rätten att kritisera arbetsgivaren begränsas. Hur långtgående arbetsgivares bestämmanderätt är i fråga om reglering av sociala medier är en annan problematik. Arbetsgivare har möjlighet att skapa olika typer av riktlinjer och policies och är relativt obegränsade i utformningen av dessa genom arbetsledningsrätten. Lagstiftningen har i vissa fall fått svårigheter med att följa den snabbt växande teknikutvecklingen, vilket därför har lett till att ändringar i exempelvis Yttrandefrihetsgrundlagen och Tryckfrihetsförordningen ofta måste göras. Sociala medier domineras av den yngre generationen och det har skapat klyftor mellan olika ålderskategorier. Hur dessa klyftor påverkas av att sociala medier får en större roll i arbetslivet studeras i uppsatsen genom ett åldersdiskriminerande perspektiv. Frågeställningarna baseras på arbetstagares skyldigheter, arbetsgivares bestämmanderätt, åldersaspekten samt vilka effekter regleringar av sociala medier har i samhället.
Social media has been receiving an increasingly important role in Swedish society and the number of users is constantly increasing. As the internet connection has become more accessible for an example by the smart phones, the way of communication has acquired the situation new dimensions. Personal life has now begun to go into work and vice versa, which has led to that the border has become unclear and difficult to define. What employees may express in social media is controversial and opinions between employers, the Labour Court and other stakeholders diverge. The basic Freedom of Speech is restricted in the private sector by the duty of loyalty and the right to criticize the employer is limited. How far-reaching employer's discretion goes in regulation of social media is another problem. Employers have the opportunity to create different types of policies and guidelines and are relatively unrestricted in the design of these through the labor management law. The legal regulation has in some cases had difficult to follow the rapidly growing technology development, which therefore has led to a lot of changes in for example, Freedom of Speech and Freedom of the Press. Social media is dominated by the younger generation and it has created a rift between different age categories. In which way this gap is affected by the fact that social media has received a larger role in work life is studied in this paper by an age-discriminatory perspective. The questions are based on employee’s obligations and employer discretion in social media. Age aspect constitutes an issue in the essay and the effects of regulations in social media in society are the final issue.

Abstract:
The purpose of this paper is to chart the relationship between supplicants and the Knightship and the nobility (K.a.N) during the age of freedom and the identities created in these meetings. The result of this study is based on the parliamentary protocols of 1731, 1746-1757 and 1771-1772. To answer the purpose of this study, three questions have been constructed. First, who were the supplicants and the supplications? Supplicants came from all over Sweden and its provinces. It was mainly nobleman who spoke to K.a.N, but also women, farmers, bourgeois, craftsmen, theologians, academics, officials and cultural workers. The supplications, could be performed by a single supplicant or a larger group, both for personal reasons or for someone else's. The supplications could both, written down short and concise or long and nuanced. Service, economy, benefit, legal goals and permissions are the five different types of supplications that have been categorized. There is a change in the content of supplications over time, which was due to changes in external frameworks such as laws and taxes. Secondly, what strategies and identities were used by the supplicant to try to influence the outcome of the supplication? In total, sixteen different strategies and identities have been indetified. The legal right, Employment, Succession, For king and country, Suffering, Gods will, By the nature, Like so many before, Honors and status, Encouragement, Flattering, The family, Health and mind, Loss, Modesty, and Poverty. Thirdly, how did the K.a.N motivate their decisions? Of the total 182 supplications 147 were appeals. In 1731 a practice was developed where widows were granted half of the amount they sought. In total there were 12 supplications that did not get a decision or were left resting and nine supplications were rejected. The supplications that were rejected were mainly requests regarding succession and recommendations. It has shown that the supplication could create reproach for the K.a.N, partly by showing decisions later regarded as incorrect. Supplications about recommendations often raised discussions within the K.a.N and many advocated that they should not interfere with private matters. K.a.N did not treat the supplications with consistency - but with what was considered appropriate for the individual, even if it was against the law/practice. It was also found that the supplicant's identity was fortified by K.a.N or created, in order to justify approvals. The approval could be written even more nuanced and flattering by K.a.N than the supplication itself.

Abstract:
In Tinker v. Des Moines Independent School District, the Supreme Court ruled that students have speech rights in the school environment unless the speech causes or is likely to cause 1) a substantial disruption, or 2) interferes with the rights of others. The Supreme Court has yet to hear a case involving school officials' authority to regulate electronically-delivered derogatory student speech, and no uniform standard currently exists for determining when school authorities can discipline students for such speech when it occurs off campus without violating students' First Amendment rights. The purpose of this dissertation is to examine 19 federal and state court decisions in which school authorities were sued for disciplining students for electronically delivered, derogatory speech. Eighteen of these cases involved student speech that demeaned or defamed school teachers or administrators. Only one involved speech that demeaned another student. Each case was analyzed to identify significant factors in court holdings to provide a basis for the construction of a uniform legal standard for determining when school authorities can discipline students for this type of speech. The full application of Tinker's first and second prongs will provide school officials the authority needed to address this growing problem while still protecting legitimate off-campus student cyber expression. Predictions of future court holdings and policy recommendations are included.

Abstract:
It is commonly contended by the political right that freedom and equality are mutually incompatible values. This ‘incompatibility argument’ can be characterized as positing a trade-off between freedom and equality, such that the more a society realizes of one, the less it is able to realize of the other. Talk of trade-offs between values implies the possibility that they can be subjected to quantitative analysis, and in order to make sense of the trade-off interpretation of the incompatibility argument I identify quantifiable conceptions of freedom and equality. The incompatibility argument invokes negative freedom and equality of outcome. Consequently it is often resisted by endorsement of alternative conceptions of these values like positive freedom or equality of opportunity. Refraining from this strategy, I aim to show that for those committed to both negative freedom and equality of outcome the outlook is not as bleak as the incompatibility argument would seem to suggest. This is because the traditional picture ignores the context in which the trade-off between freedom and equality takes place, namely, the widespread privatization of resources. I argue that in addition to the advertised trade-off between freedom and equality, each of these values also trades off against the extent to which private property rights are enshrined. As above, for trade-offs to take place between private property and other social goals it must be possible to quantify private property, and I seek to show that such quantification can be achieved. If my analysis is successful we will then be faced with three trade-offs: freedom vs. equality, freedom vs. private property, and equality vs. private property. By integrating these three trade-offs into a single three-dimensional model I aim to present a more informative account of the relationships between the three goals. The extent to which freedom and equality trade-off against one another is itself determined in part by the extent to which a society realizes private property. As a result, by curbing or abolishing private property rights more freedom can be secured alongside greater equality.

Abstract:
This essay reflects a particular method and way of working that I employ when undertaking artistic research. My artworks are rooted and develop from the situation I find myself in as an artist, the very context I exhibit the work within. I do this by trying to understand this position, both on the micro and macro scale. As an artist currently studying at—and subsequently exhibiting in relation to— Konstfack, I base my research with the physical manifestation of the school. An imposing building that was part of a huge headquarters and factory site for the telecommunication company, Ericsson, in south Stockholm. The title of my essay is from the translation of a unique German cipher machine, the Geheimschreiber, made known to me through enquiry into this site. Throughout the Second World War the German army used this machine to send highly encrypted military messages across Swedish telephone cables. Following one of the greatest accomplishments in the history of cryptography, a Swedish mathematician broke this German code and subsequently assisted in designing a deciphering machine on behalf of the Swedish Intelligence branch. This device, known as the App, was secretly developed and manufactured by Ericsson, possibly where I now study. In exploring the theme of secrets, this essay originates from an underpinning desire and subject of my work to reveal what is concealed or overlooked. Through researching and writing this essay I attempt to have a better understanding on the notion of secrets, in both the private and public realms. Introducing the artistic process and situation I am working from, I explore the central role that secrets play within society. In order to understand secrecy today I introduce the intertwined and associated contemporary debates of privacy, (both private and public) and transparency through such subjects as Google’s new privacy policy, mobile phone hacking, WikiLeaks and offshore banking.

Abstract:
In this essay I explore complexity of democratic praxis in compulsory school and after school age-educare. I use reflective writing and set off from a personal story and dilemma with a purpose to gain greater understanding on:  - why I as a teacher seems exclude ore furthermore - perceived as racist -when I set out on praxis democracy and equality. I also aim for a greater understanding in how freedom and upbringing are to be connected in democratic praxis as it seems to be a paradox. The theorizing is based on Michel Foucault and postcolonial theory on power, freedom, racism, and subject positions.  The reflective writing combined with theorizing helps me to gain a greater understanding of the dilemma. I come to realize that I need to take personal responsibility on my actions and create ethical and moral principles against oppression. I also need to be responsive to make changes when needed. By being responsive I will be able to se my shortcomings and therefore make necessary changes when needed. By theorizing I realized that I had not completely knowledge about how to understand racism and therefore I made mistakes.
I denna essä använder jag mig av ett reflekterande skrivande och en tolkande hermeneutisk ansats för att försöka utveckla en förståelse av hur det kommer sig att jag i min praktik som fritidslärare utövar en exkluderande didaktik och ytterligare för att försöka förstå hur fostran och frihet kan tänkas höra samman. Jag utgår från ett dilemma som visar på komplexiteten i att fostra i demokratiska värderingar eftersom det kan upplevas som motsägelsefullt i att fostra i en värdering i relation till en annan. I dilemmat framkommer även att min praktik upplevs som rasistisk trots att jag har intentioner om att förmedla en etik i linje med demokratiska värderingar och allas lika värde.  Min undersökning tog avstamp i ett socialkonstruktivistiskt perspektiv via Foucault och postkolonial diskurs om makt, subjekts positionering och rasism. Där den ”nya förståelsen ” visade på att jag måste ta ett personligt ansvar och vara lyhörd men också att jag hade en dålig förförståelse kring hur rasism manifesteras. Det jag kom fram till var att jag behöver ta ett personligt ansvar för att formulera en etik och moral som motverkar förtryck och jag behöver vara lyhörd för att få hjälp med att se mina egna tillkortakommanden. Genom att vara lyhörd ges jag möjligheten att kunna korrigera min praktik så att den stämmer överens med min praktik.

Cette étude se propose d’analyser la réception médiévale du personnage de Caton d’Utique, philosophe stoïcien et citoyen romain engagé dans la défense des institutions républicaines durant la période de la seconde guerre civile, qui se suicida après la victoire de Jules César (46 av. J.-C.). Concentrant, dans un premier temps, notre intérêt sur le Catone dantesco, et en particulier sur le portier du Purgatorio de la Commedia, il a semblé pertinent de remonter le cours du temps afin d’étudier les potentielles sources de la figure catonienne élaborée par Dante (1265-1321). Ce projet a conduit à réévaluer l’image du Romain dessinée par les auteurs antiques (Ier s. av. J.-C.-VIIe s. ap. J.-C.), puis à découvrir les contours de celle tracée par les auteurs médiévaux (VIIIe s. ap. J.-C.-1320). Cet imposant parcours s’est organisé autour d’une quadruple interrogation concernant la pensée médiévale : quel rôle y joue l’exemplarité ? quelle place revient à Rome et aux Romains ? comment sont traitées les questions de la liberté et du suicide ? comment répond-on au problème du salut des païens antiques ?
The study examines the medieval reception of the character of Cato of Utica, a Stoic philosopher and Roman citizen engaged in defending the institutions of the Roman Republic during the second civil war, who committed suicide after the Julius Caesar's victory (46 B.C.E.). The thesis starts by focusing on the Catone dantesco, and in particular on Cato as the warden of the Purgatorio of the Commedia, and then works backwards in analyzing the potential sources of Dante’s (1265-1321) portrayal. This undertaking leads to a reevaluation of the image of Cato in antique authors (1st century B.C.E.-7th century C.E.), and then to uncovering the outlines of the portrayals of medieval authors (8th century C.E. - 1320). This massive undertaking is organized around four questions concerning medieval thought : what role does the notion of exemplarity play in the discussion? What place is given to Rome and to the Romans? How are the questions of liberty and suicide treated? How do the authors discuss the problem of salvation for pagans of Antiquity?

Šiuo klausimu suformuotos teisminės praktikos Lietuvoje kol kas nėra, juridinio asmens baudžiamosios atsakomybės galimumas svarstomas teoriniame lygmenyje, įvairiais aspektais nagrinėjamas mokslinėse publikacijose. Pradėjus taikyti juridinio asmens baudžiamąją atsakomybę ekonominiuose, aplinkosauginiuose santykiuose, ilgainiui sąrašas veikų už kurias juridinis asmuo gali būti traukiamas baudžiamojon atsakomybėn ilgėja. Įgyvendinant Europos Sąjungos teisės aktus 2006 m. Lietuvos Respublikos BK įtvirtinta juridinio asmens baudžiamoji atsakomybė už tokias nusikalstamas veikas kaip išžaginimas, seksualinis prievartavimas ir kitas, numatytas Lietuvos Respublikos BK XXI skyriuje „Nusikaltimai ir baudžiamieji nusižengimai žmogaus seksualinio apsisprendimo laisvei ir neliečiamumui“. Pažymėtina, kad juridinio asmens baudžiamoji atsakomybė už šias veikas kyla tik tuomet, jei nukentėjusysis yra nepilnametis ar mažametis asmuo. One of the latest tendencies in international criminal law is legitimation of corporate criminal liability. Validation of corporate criminal liability in Lithuanian criminal code is one of the essential aspects of criminal law reform. According to new Lithuanian Criminal Code by volition of legislation legal person can be held liable for many crimes. Legitimation of corporate criminal liability is associated with international covenants and eurointegration. While implementing the Acts of European Union in 2006 under Lithuanian Criminal Code juridical person can be held liable for such criminal acts as rape, sexual abuse and other criminal acts in section XXI of Lithuanian criminal code (Crimes and misdemeanors against freedom of human sexual self-determination and inviolability). Legal person can be held liable for these crimes only in cases when the victim is a person under aged. The object of this work is liability of legal person for criminal acts against freedom of human sexual self-determination and inviolability The aim of this work is to evaluate the possibility of legal person to be the principal of criminal acts against freedom of human sexual self-determination and inviolability, considering particularities of these criminal acts and peculiarities of corporate criminal liability in Republic of Lithuania. Cette étude porte sur un corpus de chroniques du XIVe siècle qui comprend les trois principaux textes historiographiques florentins en langue vulgaire de cette période – Cronica delle cose occorrenti ne’ tempi suoi de Dino Compagni, Nuova Cronica de Giovanni Villani et Cronaca fiorentina de Marchionne di Coppo Stefani – et se fixe pour objet l’analyse des principaux concepts employés pour décrire le fonctionnement de la cité et ses enjeux, ainsi que l’identification des sources présentes dans les chroniques. L’analyse prend en compte à la fois l’écriture du fait politique et la valeur de celui-ci dans l’élaboration du discours de la cité.Pour mettre en évidence ce qui transparaît des principaux rouages politiques de la cité, les textes du corpus sont abordés selon les trois axes suivants : les rapports entre cité et citoyens dans le contexte de l’affirmation de la souveraineté du Comune et en regard des notions d’unité et de division ; la question de la liberté à Florence, ses principes fondamentaux, ses formes et ses représentations, par opposition à la tyrannie ; les liens entre cité céleste et cité des hommes à partir de l’analyse de la réception des signes célestes et des notions de providence, fortune et libre arbitre. This study focuses on a corpus of chronicles of the Fourteenth century consisting in three main historiographical Florentine texts written in vernacular in this period, namely Cronica delle cose occorrenti ne’ tempi suoi by Dino Compagni, Nuova Cronica by Giovanni Villani and Cronaca fiorentina by Marchionne di Coppo Stefani. It aims at analyzing the principal concepts describing the running of the city and its stakes, as well as identifying the sources present in these chronicles. The analysis takes in account both the operation of writing the political experience and its value in elaborating the discourse on the city.To highlight what can be seen from the main aspects of political machinery in the city, the approach to the texts is threefold : the connections between city and citizens both in the context of the Comune’s increasing sovereignty and in the light of the concepts of unity and division ; the question of freedom in Florence, its fundamental principles, its forms and representations, in opposition to tyranny ; the links between the celestial city and the city of men based on the analysis of the reading of celestial omens and the concepts of Providence, Fortune and Free Will. The approach chosen concentrates on the stakes and representations peculiar to each of those subjects.From this conceptual analysis it emerges that the three main sources to the discourse on the city are the authors of Classical Antiquity, Christian Theology and Law. Advances in Computer Science continue to provide more tools, each time more efficient, to aid us in our everyday lives with everything from work to entertainment, from health to management of natural resources. Technology has made our lives better and continues to facilitate progress. But just as it can benefit us, it is only a tool. That tool itself is not ’good’ or ’evil’; it is only useful to achieve the ends of those who utilize it. And just as it has been used for benefit, there have been cases where its use had a detrimental impact to us. Given the benefits, who is to deny that a government can keep track of its citizens in the same way a business keeps track of all its assets? The discussion here will centre on this question, where we suspect that, given technological advances, governments are tempted to achieve this goal. The purpose is to present some of the policies that governments in North America and Europe have proposed and/or adopted with respect to technology and national security, and point out flaws that could allow the undue erosion of privacy and free speech in the electronic world as a consequence. We reflect upon those measures that seem unjustified and unnecessary even in the face of terrorism, and argue that none of them include adequate safeguards to minimize the risk of abuse. We hope the reader will realize that none of the measures discussed admit that technology can accommodate the protection of civil liberties as well as security. We also argue that at least in Canada’s case, not counting academia and civil rights groups, policies and laws introduced as a consequence of the events of 9/11 seem to receive little attention from the public at large. Citizens would appear to be unaware of what is being done to mitigate the terrorist threat. Indeed, amidst such legislative actions, we may be getting used to living in a permanent state of war. We hope our conclusions give an insight into the current landscape of privacy protection in North America and, to some extent, Europe.

The current regulation on communication in Taiwan adopts the “ the regulation based on the category of the communication media ” principle. In other words, the current regulation system on communication is enacting professional law in accordance with the category of communication media and the distinction of the communication content. As time goes by, the phenomenon of “ digital convergence” occurs on account of the development of digital compress technologies and the progress of the communication technologies. Digital convergence means that different carriers can carry the same content and service. Hence, there is a problem about whether “ the regulation based on the category of the communication media ” principle can be adopted? Moreover, the condition of cross-ownership taking by digital convergence also cause the crux concerning the maintenance of the cultural diversity and the fair and competitive market order. For instance, Significant Market Power will make use of their dominant position to destroy fair and square competition. The Judicial Yuan’s Interpretation No. 613 has mentioned that the freedom of communication is protected by Constitution. However, the concrete content of the freedom of communication is vague. This paper will build up the content of the freedom of communication through the functional construction of the freedom of communication. And by way of content, the article indicates some aspect to cope with the problem caused by digital convergence. In addition, this paper will introduce the regulative methods of telecommunications sector. For example, asymmetric regulation, essential facilities doctrine, structure regulation, behavior regulation, and interconnection will be introduced in this paper.

Abstract:
The increasing importance of religious and moral issues in American politics makes salient once again the question of the relationship between religion and democracy. The United States is in the midst of a debate pitting secularists and those who adapt their faith to progressive outlooks against conservatives who see a need to ground liberal-democracy in something Biblical. Taking up this debate, I argue that the viewpoints of both secular progressives and religious conservatives suffer from key oversights. While the former fail to notice that their commitment to toleration rests on certain absolute claims, the latter overlook the extent to which religion has been transformed and liberalized. Seeking a more nuanced version of this debate, I compare the Enlightenment’s case for toleration to Tocqueville’s claim that democracy requires religion for moral support. Examining Locke and Spinoza, I argue that the Enlightenment sought to achieve freedom, prosperity, and a rich cultural and intellectual life through the weakening or liberalization of religious belief. I then turn to Tocqueville’s friendly critique of the Enlightenment and try to elucidate his solution for preserving, in times of liberalism and equality, the great human devotions which he saw as inextricably linked to religion. I conclude that that by describing a civil religion capacious enough to permit tolerance but substantive enough to encourage real devotion, Tocqueville gives us a kind of moderate politics seldom found in today’s debates.

Due to the development of the Internet, getting information has become faster and more convenient. And because of the rapid development of digital technology, the storage of information has also become very cheap. Although the technological innovations made information easily available, personal data is disclosed to the public unreservedly at the same time. People stop forgetting any information because everything is available on the internet. Thus, the concept of “the right to be forgotten” has been raised, and the issue soon attracted global attention. In particular, The Court of Justice of the European Union pointed out in the judgment of Google v. AEPD that Directive 95/46/EC has implied the concept of “ the right to be forgotten”. The EU has also passed General Data Protection Regulation to protect people’ right to be forgotten. This essay will first focus on the concept and background of the right to be forgotten, then, will explore and clarify the status of it in domestic law and the possibility of it for being a fundamental right. Besides, we try to figure out the resolution of conflict between the right to be forgotten and freedom of speech. In particular, data subject versus personal data controller, search engine operators and the Internet users. We hope to draw the boundary and find a balance between the right to be forgotten and freedom of speech in this essay. At last, by observing the court's opinions, we can understand the difficulties of applying rules of the right to be forgotten in Taiwan, and try to provide some advice to the legislator.

A Unidade Letiva do sexto ano, “A Pessoa Humana” foi lecionada na Prática de Ensino Supervisionada e aprofundada neste trabalho. No meu entender, ao abordar todas as dimensões da pessoa, esta unidade letiva tem a preocupação de proporcionar uma formação integral do aluno. No primeiro capítulo, foi referida a prática pedagógica realizada na Escola Salesiana de Manique. Deste capítulo, fazem parte os seguintes pontos: a caracterização da escola, destacando alguns elementos do seu projeto educativo, inspirado na pedagogia de São João Bosco; a caracterização da turma que acompanhei ao longo do ano letivo; a experiência letiva e as dificuldades que os alunos apresentaram na compreensão dos conteúdos. No segundo capítulo, foi feito o levantamento da categoria “Pessoa” na unidade letiva em estudo e o cruzamento com outras unidades letivas do primeiro, segundo e terceiro ciclos. Chegando à conclusão de que a temática desta unidade é de tal maneira significativa que aparece referida no percurso proposto pelo programa de EMRC do ensino básico. Ao lecionar a unidade letiva, verifiquei que a 1 Jo 4, 7-21 era pouco explorada, quer pelo programa quer pelo manual. No terceiro capítulo, o núcleo central do trabalho, a exploração da 1 Jo 4, 7-21, é realizada em dois momentos. No primeiro momento hermenêutico, estudei o contexto em que o autor viveu. Verifiquei nele que as seitas gnósticas queriam conhecer Deus, mas não viam em Jesus o Cristo encarnado. Para o autor da carta, o conhecimento de Deus dado pela fé só faz sentido se existir amor pelo próximo. No segundo momento hermenêutico, fiz a atualização do texto bíblico. O autor da carta apela para o leitor promover a dignidade humana através da prática do amor. Apela também para o perigo de viver uma religiosidade fechada no “eu”, ignorando os outros. Segundo a 1 Jo 4, 7-21, a “Pessoa” como ser uno só desenvolve as suas dimensões através da abertura a Deus e aos outros. No quarto capítulo, tentei demonstrar a pertinência da EMRC como uma disciplina promotora da dignidade humana. Seguidamente, fiz uma proposta de duas aulas para realizar a exegese da 1 Jo 4, 7-21 de um modo mais aprofundado, com dois momentos hermêuticos, dando destaque à atualização do texto para a vida dos alunos.
The sixth grade Teaching Unit one, “The Human Person”, was taught in the Supervisioned Teaching Practice in this project. The way I see it, when we try to approach a person’s several dimensions, this unit tends to provide the student’s global training. In the first chapter, it was mentioned the teaching practise used in Salesiana de Manique School. In this chapter, these are the aspects to consider: the school’s description, where I mention some of its educational project aspects, inspired by São João Bosco’s pedagogy; the description of the class I followed during the year; the teaching experience and the students’dificulties mentioned by the students. In the second chapter, I approached the “Person” cathegory in the respective teaching unit, which I was studying, and also the crossing between this unit and some of the first, second and third chapter units. I came to the conclusion that this unit’s subject has such an importance that it is studied in the proposed EMRC (Religious Education) curriculum. When I taught this unit, I realized that 1 Jo 4, 7-21 wasn’t really explored, neither by the subjet’s curriculum nor by its book. In the third chapter, there is the main object of study, which is the exploration of 1 Jo 4, 7-21, done in two different moments. In the first hermeneutic moment, I studied the environment in which the author lived. I have realized that the gnostic sects wanted to know God, however they didn’t see Jesus as the incarnated Christ. For the letter’s author, God’s aknowledgement by faith only makes sense if there is love for others. In the second hermeneutic moment, I have done the biblical text update. The letter’s author appeals the reader to promote the human dignity through love. He also appeals for the danger of living in a closed religiosity, ignoring others. According to 1 Jo 4, 7-21, the “Person” as a whole being, only develops oneself by letting in God and others. In the fourth chapter, I tried to show the importante of EMRC (Religious Education) as a subject where we can promote human dignity. Then, I proposed two lessons in order to do the 1 Jo 4, 7-21 explanation in a more profound way, with two hermeneutical moments, emphasizing the text update for the students’ life.

O tipo legal do art.171º-1 e 2 do CP está tipicamente estruturado como um crime de perigo abstrato, na base da dupla presunção legal de que os menores de 14 anos não têm capacidade de autodeterminação sexual e de que, por força dessa incapacidade, a sua participação em práticas sexuais, ainda quando não forçadas, prejudica o livre desenvolvimento da sua personalidade, em particular na esfera sexual. Se a validade da presunção relativa a este prejuízo deve ter-se por adquirida (ainda que nesse juízo de validade possam também interceder fatores não estritamente “técnico-científicos”), mais problemática se afigura a validade da presunção referente àquela incapacidade em faixas etárias próximas da idade-limite fixada na incriminação. The legal type of art.171-1 and 2 of CP is typically structured as a crime of abstract danger, on the basis of the double legal presumption that children under the age of 14 years do not have the capacity for sexual self-determination and that due to this incapacity their participation in sexual practices, even when not forced, is harmful to free development of their personality, particularly in the sexual sphere. If the validity of the presumption concerning this loss must be acquired (even if in that judgment of validity may intercede factors not strictly “technical-scientific”), the more problematic is the validity of the presumption regarding that incapacity in age groups close to the age limit set in the incrimination. Punk rock provided not only a watershed of creativity, innovation and a do-it-yourself spirit to a culture saturated in the mainstream, it physically brought like-minded people together in a community, or rather extended family, which in today’s hyper-d.i.y. culture, is progressively declining. As early as the 1940s, theorists such as Adorno and Horkheimer warned us about alienation in a society increasingly dependent on technology. By looking to punk, and other resilient and robust counter-cultures, perhaps we can find solutions to the pitfalls of the ‘culture industry’ (Adorno, Horkheimer, 1944). My thesis, consisting of a feature-length documentary film and textual analysis, is a culmination of: ethnographic research into the punk scene in my own community; theoretical research into the sociology, ethnography and subculture theory; and my own subjectivity. My personal findings are presented to offer insight into punk philosophy and to spur discourse, rather than deliver an objective account or didactic reproach.

Abstract:
Community hospitals are an important component of the post-acute care pathway for older people. The objective of this study was to describe and contrast patients' and carers' experiences of community and general hospitals. Interviews with patients and carers revealed similarities in the perceptions of care between the two settings. These included appreciation of staff sensitivity, a sense of security, encouragement of independence and lack of activity. The community hospital was appreciated for its location, atmosphere, accommodation, greater sense of freedom, quality of food and staff attitudes. UK health policy promotes the development of community hospitals. This should be progressed in a way that retains key strengths of the specific service they offer.
