Esta pesquisa teve como objeto de estudo o professor enquanto agente da prática do abuso sexual de crianças e adolescentes. Os objetivos consistem em Analisar as contribuições da Genealogia de Michael Foucault para o entendimento do abuso sexual de crianças e adolescentes quando cometidos pelo sujeito professor; Discutir as formas de saber e poder adotadas pela produção científica a fim de objetivar as práticas do abuso sexual contra crianças e adolescentes cometido pelo professor; Refletir sobre as políticas (poderes) de enfrentamento que entram em jogo a esse acontecimento no âmbito dos programas e ações governamentais instituídos e como são acionados sobre os corpos de crianças e adolescentes; Identificar e discutir a forma com que o Poder Judiciário vem produzindo suas jurisprudências nos casos trazidos à sua apreciação e as relações de poder e processo de subjetivação que esses documentos produzem. Como problemas de pesquisa destacam-se: Qual a importância da Genealogia de Michael Foucault na problematização do acontecimento analisador abuso sexual contra crianças e adolescentes praticados pelo professor? Como as práticas de saber e poder são acionadas para a produção científica objetivadora desse tipo de abuso sexual? De que forma tais práticas entram em jogo e como são acionadas sobre os corpos de crianças e adolescentes abusados sexualmente pelo professor? Como o poder Judiciário vem produzindo sua Jurisprudência nos casos trazidos à sua apreciação em relação ao professor? O referencial teórico metodológico adotado baseia-se em uma análise histórico-genealógica, proposta por Michael Foucault. Pesquisa de caráter bibliográfico e documental abrangendo o período de 1998 a 2016. As evidências teóricas e documentais evidenciaram que o acontecimento abuso sexual vem se constituindo objeto de estudo em diferentes pesquisas realizadas nas diversas áreas do conhecimento, transformando-se em campo de investimento epistemológico, particularmente nas dissertações e teses produzidas e defendidas nos Programas de Pós- Graduação no Brasil. Contudo, são raros os trabalhos que abordam esse fenômeno tendo como principal agente o sujeito professor. Além disso, na área de educação tal temática ainda é revestida pelo tabu, mas no âmbito das jurisprudências do Tribunal de Justiça do Estado do Pará, as decisões evidenciam que, a pesar de todo o sistema de garantias e das políticas públicas protetivas existentes no Brasil, o professor investido de saber e poder pastoral, ao invés de se constituir um sujeito promotor da cidadania e da dignidade humana por meio do processo de formação escolar, torna-se um delinquente que faz de sua profissão um meio de aliciar crianças e adolescentes a fim de perpetrar o abuso sexual.
This research aims to study the teacher as an agent of the practice of sexual abuse of children and adolescents. The objectives are to analyze the contributions of Michael Foucault's Genealogy to the understanding of sexual abuse of children and adolescents when committed by the subject teacher; To discuss the forms of knowledge and power adopted by scientific production in order to objectify the practices of sexual abuse against children and adolescents committed by the teacher; Reflect on the coping policies (powers) that come into play to this event within the established programs and governmental actions and how they are applied on the bodies of children and adolescents; Identify and discuss the manner in which the Judiciary has been producing its jurisprudence in cases brought to its appreciation and the relations of power and process of subjectivation that these documents produce. How are research problems highlighted What is the importance of Michael Foucault's Genealogy in the problematization of the analyzer sexual abuse event against children and adolescents practiced by the teacher? How are the practices of knowledge and power triggered for the objective scientific production of this type of sexual abuse? How do such practices come into play and how are they triggered on the bodies of sexually abused children and adolescents by the teacher? How has the judiciary been producing its Jurisprudence in cases brought to its appreciation in relation to the delinquent professor? The methodological theoretical framework adopted is based on a historical-genealogical analysis proposed by Michael Foucault. Bibliographical and documentary research covering the period from 1998 to 2016. The theoretical and documental evidences showed that the sexual abuse event has become the object of study in different researches carried out in the various areas of knowledge, transforming itself into an epistemological investment field, Particularly in the dissertations and theses produced and defended in the Graduate Programs in Brazil. However, there are few works that approach this phenomenon having as principal agent the subject teacher. Moreover, in the area of education, this subject is still covered by taboo, but within the jurisprudence of the Court of Justice of the State of Pará, the decisions show that, despite the entire system of guarantees and public policies in Brazil , The teacher who is invested with knowledge and pastoral power, instead of being a subject that promotes citizenship and human dignity through the school education process, becomes a delinquent who makes his profession a means of enticing children and adolescents to perpetrate sexual abuse.
Cette recherche a pour objet l'étude du professeur tout agent de l'abus sexuel des enfants et des adolescents à pratiquer. Les objectifs sont d'analyser les contributions de la généalogie de Michel Foucault pour comprendre l'abus sexuel des enfants et des adolescents lorsqu'ils ont été commis par le sujet enseignant; Discutez des types de connaissances et de puissance adoptée par la production scientifique afin d'objectiver les pratiques d'abus sexuels contre des enfants commis par l'enseignant; La réflexion sur la politique (le pouvoir) d'adaptation qui entrent en jeu à cet événement dans le cadre des programmes et mis en place les actions du gouvernement et de la façon dont ils sont déclenchés sur les corps des enfants et des adolescents; Identifier et discuter de la façon dont le système judiciaire a produit sa jurisprudence dans les cas portés à ses relations d'attention et d'énergie et processus subjectif qui produisent ces documents. Comment telles pratiques entrent en jeu et la façon dont ils sont conduits sur les corps des enfants et des adolescents abusés sexuellement par l'enseignant? Comme le pouvoir judiciaire a été la production de sa jurisprudence dans les affaires portées devant elle contre le professeur délinquant? Le cadre théorique méthodologique adoptée est basée sur une analyse historique et généalogique, proposé par Michel Foucault. Étude bibliographique et documentaire couvrant la période de 1998 à 2016. La preuve théorique et documentaire a montré que l'abus sexuel d'événement est en train de devenir un objet d'étude dans diverses recherches sur les différents domaines de la connaissance, se transformant en domaine de l'investissement épistémologique, en particulier dans les mémoires et les thèses produites et défendue dans les programmes d'études supérieures au Brésil. Cependant, peu d'études ont étudié ce phénomène avec l'agent principal du sujet des enseignants. En outre, dans l'éducation ce thème est toujours couvert par le tabou, mais en vertu de la jurisprudence de la Cour de Pará de cas, les décisions montrent que, en dépit de l'ensemble du système des garanties et des politiques publiques de protection existantes au Brésil l'enseignant investi dans la connaissance et le ministère de l'alimentation, au lieu de constituer un sujet promoteur de la citoyenneté et de la dignité humaine à travers le processus de scolarisation, devient un délinquant qui fait leur profession un moyen pour inciter les enfants et les adolescents ordonner à commettre des abus sexuels.
