Full textThe notion of employment insecurity is hard to define, despite being frequently referenced in political speeches, in various legislations, such as the law n° 2001-2 from the 3rd January 2001, regarding resorption of job insecurity or the modernisation of the public services and the law n° 2012-347 from the 12th March 2012. If employment insecurity is one aspect of poverty, it can also occur elsewhere, via the employees sentiment of not being in a capacity to foresee his professional future, in comparison to other jobs that provide more security.This sector of society is divided into « secure » « possibly insecure » and « insecure » jobs and can be applied to the public service in a French manner, opposing the those with a permanent contract and public officials on a fixed term contract. As Marcel Pochard described in an article in 2002, contracted agents should not be assimilated with permanent employees, who don’t benefit « from any advantages and feel left left out ». Contractual staff don’t have access to the same rights or security given to public officials, and are subsequently excluded from any potential career development as well as any stability that this could lead to. Despite the changes made in improving job tenure, and the desire from the Government to tighten recrutement conditions for contractual workers and contract renewals exclusive to the public sector, the number of employees is growing inexorably. With in mind, the public service isn’t good example, with the highest percentage of contractual workforces - up 5% in ten years, with hospitals being particularly concerned. This sector has a prevailing ambiguity in the political sphere, that lists « contradictory injunctions » shared between respecting the status and the primordial continuation of care. Thus, the social vulnerability of contractual staff must be studied alongside the general public service workers status, with regards to the specific conjuncture in which they evolve. The overall structural or statuary idea is that the evolution is « one of the more enticing features of civil service » with the creation of a « semi » status for hospital contract workers. If the rights and the security for the contractors and permanent employees converge, and their obligations become identical, the professional careers of the contract workers will remain marked by a strong disparity. By opposing the situations, that are threatened by insecurity depending on the nature or need of the contractual job, temporary or permanent, short term contract (CDD) and permanent contract (CDI). The question of knowing whether the agents in possession of a permanent contract are unstable is will no longer be under debate. The agents that are employed will resemble more so public service agents and their progression will threaten more and more the coherence of the statuary structure. The conjuncture lies particularly in financial difficulties and demographics, something public and health establishments are very familiar with, but this aggravates the situation, between contracts imposed or accepted. The same goes for a contract that offers some flexibility and negotiation, which is vital to the establishments. In a more competitive and deficient context of some jobs, a contract is an enticing aspect to attract rare competencies. Be it via work time management or provisional management of jobs and competences (GPMC) contractual agents integrate perfectly into the staff, despite the reglementary restraints and is a humaine source totally substitutable to the tenures of a permanent contract. Furthermore, these contractual agents are more budget than management variables, essential in the reduction of spending by the Assurance-Maladie (Health Care) or in the case of establishments merging
