Abstract:
On May 30, 2019, the Agreement Establishing the African Continental Free Trade Area (AfCFTA) entered into force for the twenty-four countries that had deposited their instruments of ratification. When the remaining thirty-one member states of the African Union ratify it, the AfCFTA will cover a market of 1.2 billion people and a gross domestic product (GDP) of $2.5 trillion. That would make it the world's largest trade agreement since the World Trade Organization (WTO).

The European Community (EC) has recently announced its decision to begin dispute-resolution procedures in the World Trade Organization (WTO) against the United States (US) because of the latter's passage of the so-called ‘Helms-Burton’ law, which tightens the sanctions against Cuba by means of extraterritorial application. Two high-levels commissions, as well as some scholars, have identified several areas of concerns with respect to the WTO rulemaking processes. Some of them have put forth proposals for their reform. However, the WTO has not proceeded with or even reflected upon any major reforms affecting the functioning of its rulemaking processes.
