Abstract:
Ontario’s Farming and Food Production Protection Act, 1998, protects farmers from nuisance actions arising from agricultural methods that are considered “normal farm practices”. Similar “right-to-farm” legislation exists in all Canadian provinces. It demonstrates the government’s desire to protect the agricultural industry, likely for food security and economic reasons, and a willingness to prioritize its needs before those of nearby landowners with possible nuisance complaints. This legislation shifts the definition of “reasonable” used in nuisance complaints from farm neighbours to the farmer. It also transfers power from the courts to government agencies. The processes undertaken by agencies such as Ontario’s Normal Farm Practices Protection Board may be less lengthy, expensive and adversarial than court litigation.

Abstract:
The article provides an overview and analysis of the case law of courts in the field of execution concerning agricultural real estate. In the first part shows a statutory definition of real property. Thereafter, the main part of the article presents in detail an execution concerning immovable property after entering into force on amendment act. The article points out the conditions which have to be fulfilled in order to exceptionally obtain the ownership of agricultural real estate in accordance with law. Regulation were analysed in view fact, that pursuant to the Polish legislation, the right of pre-emption is granted only to coowners of agricultural real estate.

Agricultural land pawning is not a new phenomenon to the traditional communities (Masyarakat Adat) in Indonesia, especially the matrilineal Minangkabau people who rely on their agricultural land for economic transactions. Based on the national law, customary law (referred to as Adat Law hereafter) is to prevail over agrarian issues in Indonesia. But even so, agrarian issues remain under the influence of national law. This study discusses the management of agricultural land pawning in the matrilineal Minangkabau society according to national, Adat, and Islamic laws. Despite its popularity, the Adat law approach in dealing with land issues, especially agricultural land pawning, has not been well accommodated under National Law. This paper investigates how agricultural land pawning is regulated in Indonesia, with a focus on the Minangkabau society in West Sumatra. This paper does not seek to promote one legal system over another, but instead, it intends to promote legal certainty in agricultural land pawning in West Sumatra. To show how the lack of legal certainty can lead to confusion and conflict, this study relies on the contradicting verdicts of an agrarian conflict case from lower courts to the Supreme Court. The study reveals that the contradiction between national agrarian laws, Minangkabau Adat law and West Sumatra local Regulation No. 16/2008 on Communal Land Tenure causes confusion within the community and the judiciary. Legal certainty is crucial to strengthening the rule of law and democracy in Indonesia, and the conflicting interpretations of agrarian laws belittle this concept. This study suggests that one way to deal with legal uncertainty regarding agrarian law in West Sumatra, and throughout Indonesia, is to promote a stronger and more just decentralization, which is increasingly important as the country faces the question of legal unification. The suggested decentralization effort would leave local issues to the authority of local legislations.

The author would like to briefly describe the historical background of the application of the principle of proportionality and by analysing the case law follow the evolvement of the application of the principle. The study should bring the answer on question whether the rule of law (in this case principle of proportionality) is safeguarded enough by the courts review of the decisions imposing fines.

This article provides a historical overview of the development of U.S. government-mandated commodity promotion. This form of promotion, known colloquially as the “checkoff,” is responsible for such memorable slogans as “Beef: It's What's for Dinner,” as well as research intended to boost consumption of agricultural products. The article argues that checkoffs represent an associational form of governance in which private organizations achieve public aims. Though they have been frequently challenged in courts and have garnered scrutiny from public health activists, checkoffs have been a durable form of agricultural regulation because they hide the heavy hand of government with the rhetoric of markets and self-help.

Abstract:
In the Brazilian agricultural space, numerous cases of large farmers have declared themselves in severe financial distress and filed for Judicial Financial Recovery (JFR) in the past few years. Our statistical analysis, although preliminary and based on limited available data, indicates that these operations have shown financial indices at levels that, in general, did not significantly differ from a sample of other larger farmers’. Only ‘liquidity’ presented a more persistent relationship with the cases of Judicial Recovery. Therefore, it seems that farmers may be resorting to the JFR route prematurely. Within a limited subsample of cases of farmers who filed for JFR, data also shows a pattern with indications that farmers may tend to time their filing to coincide with having their main crops ready for commercialization immediately preceding or after harvesting. This suggests that these farmers might be seeking to free their most recent crop from previous financial and commercial commitments by pursuing a favorable court decision to their JFR. Some factors may be driving this behavior: (1) most farmers in Brazil do not produce a complete set of financial statements on accrual bases, which may lead to errors and incomplete information; (2) not all farmers’ debt is registered at the Central Bank, making debt consolidation a challenging discovery process to lenders, who may overleverage clients; (3) farm revenues are concentrated in only a few weeks of the year, allowing farmers that file for Judicial Recovery to carry on with their business, if the courts halt service of previous debt; (4) courts have also allowed these farmers to release assets from collateralized loans. In sum, there may be inaccurate interpretation of the farmers’ financial condition due to incomplete information, and a component of moral hazard motivating large farmers filing prematurely for JFR in Brazil. The number and magnitude of these cases may generate negative consequences to agricultural credit costs and availability in the future.

Abstract:
The aim of the paper is to answer the question whether the legislator provides protection of agricultural and forest land in the process of localization of technical infrastructure. The technical infrastructure has not reached the universal legal definition, but in many different legal acts there is a reference to this notion. According to the final conclusions, the protection of agricultural and forest land includes the need for localization of technical infrastructure when the technical infrastructure is the part of the composition of the normative notion of agricultural and forest land regulated by the Act on the Protection of Agricultural and Forest Land and according to the Forest Act. Technical infrastructure are an integral part of these legal concepts, although their normative borders are different. For incomprehensible reasons, the legislature does not explicitly recognize land under power lines as agricultural land, but they fall within the scope of the legal concept of the forest. However, in practice, the administrative courts in the cases of certain investments of the technical infrastructure, especially power lines, consider these facilities as not infringing the nature of agricultural land or for forestry purposes.

Abstract:
Climatic conditions (precipitation, evapotranspiration, available soil moisture, and temperature) are important variables when considering cumulative storm streamflow for a watershed. The objective of this study was to determine what climatic conditions, if any, could be used to mathematically model cumulative storm streamflow for an extensively-drained small agricultural watershed in northwest Delaware County, Indiana. A water-level recorder was installed in Killbuck Creek during autumn 2002, spring, summer, and autumn 2003 and 2004. To determine discharge, velocity measurements were collected following US Geological Survey (USGS) methods and two rating curves (high and low flow) were constructed. Simple linear regressions were performed using cumulative streamflow as the dependent variable and precipitation, evapotranspiration, available soil moisture, temperature, and runoff as independent variables. Multiple linear regressions were used to examine combinations of the independent variables. Cumulative streamflow was most related to precipitation (r2 = 0.23 and p < 0.001) and least related to temperature (r2 = 0.03 and p < 0.5). The multiple linear regression from the combination of precipitation, runoff, and temperature provided the most accurate cumulative streamflow simulation (R2 = 0.53 and p < 0.001). Multiple linear regressions using climatic variables can be used to estimate cumulative streamflow for an agricultural watershed.

The purpose of this study was to determine the county extension agents' perceptions of institutional constraints to the performance of their duties within the Arizona Cooperative Extension System. Study population was 66 county extension agents in the state of Arizona. They were surveyed by mailed questionnaire. Study results indicated, on the average, most of the institutional constraints affect slightly on the county extension agents' work performance. Considerable variation observed among respondents in their perceptions of severity of the constraints. Some of the other important findings include; (1) 4-H agents perceived constraints more severe than Agriculture or Home Economic Agents. (2) County agents perceived more constraints in salary and promotion more severe than county directors. (3) County agents with more than 5 years of service perceived more of the constraints in the area of Personnel Evaluation more severe than agents with 5 years or less service.

En s'appuyant sur une démarche historique et empirique, et en mobilisant le cadre conceptuel de l'écologie territoriale, cette thèse analyse les relations entre la ville et l'agriculture au cours d'une période de profondes mutations agricole urbaines, et de globalisation, qui aurait dessaisi la ville de la question agricole. Pourtant, la ville continue depuis 1945 d'entretenir avec l'agriculture une relation forte quoique changeante. Dans l'après-guerre, la ville est un relais de l'Etat pour la modernisation des filières agricoles et des outils de transformation, contribuant à l'insertion des productions locales dans le système alimentaire, et développant par ce biais son économie agro-industrielle. Elle tente de maintenir sa fonction centrale de commerce agricole par la rénovation des infrastructures de marché. Celles-ci deviennent progressivement alternatives aux circuits dominants, permettant l'insertion au marché des produits artisanaux, aujourd'hui valorisés pour leur lien au terroir. Dès les années 1950 la ville construit son image territoriale en développant les contenus immatériels de l'agriculture, promouvant les produits et savoir-faire locaux. Ce faisant, elle contribue à maintenir jusqu'en 2012 une rente liée à l'ancrage territorial qui assure la pérennité des outils et opérateurs locaux. Plus récemment elle engage l'approvisionnement local de sa restauration scolaire et appuie son projet d'agglomération sur les produits et paysages locaux. Brive révèle le rôle des villes d'expédition dans la recomposition territoriale du système alimentaire, et le rôle d'intermédiation des villes moyennes entre l'agriculture locale et le système alimentaire.

Abstract:
Dry and wet fine earth spectral measurements were made on the Ap soil surface horizons on the Maricopa Agricultural Center by using a Barnes Modular Multiband Radiometer. Three subsets were used in the analyses 552, 101 and 11. There were three soil series, Casa Grande, Shontik and Trix, four soil mapping units, and three texture classes identified on the farm. The wet soil condition reduced the amplitude of the spectral curves over the entire spectrum range (0.45 to 2.35 μm). The spectral curves were statistically related to the soil mapping units to determine if the soil mapping units and texture classes could be separated. The wet soil condition and the smaller sample size increased the correct classification percentages for soil mapping units and texture classes. LSD tests showed there were significant differences between these groups. Simple- and Multiple-linear regression analysis were used to relate some soil physical (sand, silt and clay contents and color components) and chemical (iron oxide, organic carbon and calcium carbonate contents) to soil spectral responses in the seven bands under dry and wet conditions. There were high correlations levels among the spectral bands showing an overlap of spectral information. Generally, the red (MMR3) and near-infrared (MMR4) bands had the highest correlations with the studied soil properties under dry and wet conditions. Usually, the wet soil condition resulted in higher correlations than that for the dry soil condition over the total spectrum range. The predictive equations for sand, silt and clay and iron oxide contents were satisfactory. For organic carbon and color components, the greatest success was achieved when variation in spectral response within individual samples are smaller than that between soil mapping unit group averages. There was a poor relation between calcium carbonate and spectral response. A comparison of multi-level remotely sensed data collected by SPOT, aircraft, and ground instruments showed a strong agreement among the data sets, which correlated well to fine earth data, except for the SPOT data. Rough soil surfaces showed a reduction in reflectance altitude compared to laser level, and it appears to be directly proportional to the percent shadow in the viewing area measured by SPOT satellite and aircraft.

The purpose of this report is to analyze different aspects of two levelling courses in Chemistry, offered to entry-levels students in the Degree in Geology (Universidad Complutense de Madrid) and in the degree in Agricultural Engineering (Universidad de Almería). We comparatively analyze the motivations for offering the course, its aims and objectives, the course design and finally the methodology ans assessments of the course in both universities. The assessment of the learning process is done through quizzes at the beginning and at the end of the courses. Voluntary and anonymous surveys show that the students are very satisfied with the courses. In the future, the aim is to improve the learning methodology in order to achieve greater student motivation

Abstract:
The aim of the paper is to evaluate the change in the energy efficiency of crop production in the EU during the period 2002–2012. The energy efficiency is an important indicator of sustainability of agricultural processes. The energy-saving agriculture is a priority of the new Rural Development Programme in 2014–2020. Even though the analysis counts with main direct energy inputs into the crop production (fertilizers, fuels and pesticides), the methodology of the energy efficiency for commodities and farms uses all indirect non-renewable energy inputs spent on production of buildings and machinery. The analysis covered 24 EU countries. The change in the energy efficiency in time was calculated through the Malmquist index. Clustering using medoids revealed groups of countries with similar energy efficiency. The Malmquist index identified the United Kingdom, Portugal and Sweden as countries with the most dynamic positive change in energy efficiency of the crop production in time. On the contrary, Baltic States and Poland experienced the most dynamic decline of energy efficiency. However, Lithuania, Latvia and Poland significantly increased the Malmquist index in recent years, partly as a consequence of effective investments from the Rural Development Programme (RDP). The energy efficiency indicator that includes direct and indirect energy inputs is supposed as suitable indicator for RDP’s ex-post evaluation.

The Forestry and Agriculture Sector Optimization Model with Greenhouse Gases (FASOMGHG) has historically relied on regional average costs of land conversion to simulate land use change across cropland, pasture, rangeland, and forestry. This assumption limits the accuracy of the land conversion estimates by not recognizing spatial heterogeneity in land quality and conversion costs. Using data from Nielsen et al. (2014), we obtained the afforestation cost per county, then estimated nonparametric regional marginal cost functions for land converting land to forestry. These afforestation costs were then incorporated into FASOMGHG. Three different assumptions for land moving into the forest sector were run; constant average conversion cost, static rising marginal costs and dynamic rising marginal cost, in order to assess the implications of alternative land conversion cost assumptions on key outcomes, such as projected forest area and cropland use, carbon sequestration, and forest product output.
