Abstract:
In response to the public outcry for mandatory testing for AIDS, this Article explores the major issues concerning the identification of persons with AIDS in society. The Article first studies testing procedures and the purposes behind them to determine if a call for mandatory testing of the general populace would better achieve society's objectives for identifying individuals with AIDS. Concluding that testing should not be required of the population as a whole, the Article then explores whether testing should be required of certain subpopulations which society perceives as likely to have or to spread the disease. In this context, too, the Article concludes that mandatory testing would be unwarranted, and that funds proposed for mandatory testing would be put to better use in education and universal precautions to prevent the further spread of AIDS.

Abstract:
As we have become experienced in dealing with AIDS, we have learned that early concern over employees who refuse to care for patients with AIDS was merely the tip of the iceberg from the infection control standpoint. During the past 5 years, additional questions and concerns have been raised regarding employee health and AIDS. An interesting body of literature has emerged recently that discusses many of these current employee health issues. Some of these questions have been answered in major communications in The New England Journal of Medicine, the Journal of the American Medical Association, and The Lancet. Many other topics have been covered in short communications in letters to the editor in these same journals and in the CDC's Morbidity and Mortality Weekly Report (MMWR). When taken together, this writing presents a very clear picture of what is happening with AIDS in the health care arena. It is obvious that most of the concerns regarding AIDS in health care settings can be answered by taking a close look at the available epidemiologic data. It is important to remember that the decision-making process related to AIDS is easier if we try to separate the emotional issues surrounding the disease from the scientific data available.

A survey of 341 persons, 82% of whom were university students whose median age was 27.0 yr., was conducted to investigate the relationship between their attitudes regarding mandatory AIDS testing for various groups, attitudes toward the disease, sexual orientation and behavior, and attitudes toward homosexuals. Homosexual and bisexual respondents were less supportive of mandatory testing for anyone than were heterosexual respondents. Greater homophobia and attitudes in favor of legal sanctions against persons with AIDS were correlated for heterosexual respondents, with attitudes supporting mandatory testing for everyone and homosexuals in particular. However, concern about contracting AIDS was unrelated to heterosexual attitudes favoring mandatory testing. Social and political considerations in an era of growing and potentially militant public health concern are discussed.

Currently the number of AIDS-related deaths in the United States has reached 311,000 and at least one million more Americans are infected with HIV. Of those one million or more infected, many spread the virus unknowingly as approximately forty percent of those infected have never been tested. More than eighty-five percent of the U.S. population has never been tested for HIV. No cure or vaccine for HIV currently exists.The federal and state governments have set up a patchwork of free and confidential HIV testing at local clinics. States have enacted a variety of legislation concerning HIV testing and test results. Most states have enacted statutes that require informed consent for an HIV test to be conducted. All states require the reporting of AIDS cases, and many also require the reporting of HIV-positive status to state public health departments. Furthermore, many states mandate certain requirements for HIV counseling.
