Abstract:

<p>According to the national legislation concerning discrimination within labour law, it is prohibited to discriminate on the grounds of sex, ethnic belonging, religion or other religious belief, functional disability, sexual nature and part-time work or time-limited employment. The EC-law goes further and also prohibits discrimination on the ground of age. Since several rules of law have a consideration of age, the Swedish labor law collides in many ways with the prohibition of age discrimination. The employment directives of EU were implemented in the member countries after the shift of the millennium. Sweden was the last member to introduce age as a ground of discrimination in its legislation. <p>This paper examines the prevalence and character of age discrimination by conducting and experiment with 200 students at Växjö University. The participants were first asked to read a description of a job of either youthful or age neutral character. Afterwards they got to evaluate one out of two job applicants. The applicants were made identical in every way with the exception of age, in order to isolate the age discrimination. The results for the different jobs and applicants were then compared in order to investigate the prevalence of discrimination. The results support the hypothesis that

Med en åldrande befolkning i Sverige, stannar allt fler äldre arbetstagare på arbetsmarknaden för att få ut samma pensionsinkomst som tidigare generationer. Fler äldre vill och kan fortsätta arbeta, men då behövs arbetsgivare som är villiga att anställa dem. Den här studiens syfte var att undersöka om det förkom åldersdiskriminering i rekryteringsprocessen och om rekryterare kan bedöma lämplighet och kompetens hos en arbetstagare oavsett ålder. Abstract:

Diskrimineringslagstiftningens karaktär av intervenerande normer gör att det finns en tydlig konfliktyta mot den svenska arbetsmarknadsmodellen. Åldrsdiskrimineringslagstiftningen är här mest intressant, med sin uppbyggnad som en avvägningsnorm. Mitt syfte med detta arbete är att studera skyddet mot diskriminering av unga, ur framförallt EU-rättsliga utgångspunkter. Mot detta ställer jag några av de befintliga regleringarna i kollektivavtal som finns på arbetsmarknaden.
