Abstract:
For many executives and other participants in the mining industry, litigation or arbitration is an avenue of last resort; the resolution of disputes is a priority. This chapter focuses on the informal resolution of international or domestic disputes, often referred to as alternative dispute resolution (ADR). The various forms of ADR differ from international arbitration in that they provide for a non-binding means to assist the parties in attempting to reach an amicable consensual resolution of the dispute. While mediation and conciliation are the most widely used form of non-arbitration ADR, parties also use other forms of ADR such as expert determinations, mini-trials, and neutral evaluations. One of the incentives for parties to amicably resolve an intentional mining dispute is that it gives them the opportunity to restore or improve the original bargain. The final section of the chapter discusses the timing and procedural steps of ADR.

Abstract:
This chapter analyzes the supervisory function of the court in trust litigation and describes the extent to which that role can be fulfilled by arbitrators. It uses the Rinehart case as an example, in which a family feud over a trust holding assets valued at upwards of AU$9 billion generated a dispute regarding the removal of Gina Rinehart as trustee in which issues arose as to the applicability and validity of an alternative dispute resolution (ADR) clause. It argues that disputes concerning the removal of trustees can be submitted to arbitration whilst preserving the Court’s distinct supervisory jurisdictions over arbitration and trust administration as means to different ends. Whilst a supervisory jurisdiction is attached to arbitration, thereby facilitating the enforcement of arbitral awards, a distinct supervisory jurisdiction over trust administration is preserved that facilitates the ongoing performance of the trust above and beyond arbitration.

Abstract:
Alternative dispute resolution (ADR) refers to a variety of private processes for resolving disputes, independent of trial before a court of law. Economists are interested in ADR for two main reasons. First, from an ex post perspective, the manner in which disputes are resolved or decided in society affects the operation of the legal system and its cost-efficiency. Second, from an ex ante perspective, the manner in which rights are vindicated impacts primary behavior and investments in prospective dispute avoidance. The literature relating to the economic analysis of ADR can be divided into two facets: one facet is dedicated to the interests of litigating parties to make use of ADR mechanisms; the other is directed at the social interest in ADR. This chapter identifies the conditions under which parties will be incentivized to enter into ADR proceedings, and then moves on to examine the social welfare implications of ADR.
