Faasen, Cornelia. "Theatre as alternative historical narrative : a study of three plays : "Ubu and the Truth Commission", "Copenhagen" and "Ghetto"." Thesis, Stellenbosch : University of Stellenbosch, 2009. http://hdl.handle.net/10019.1/3006.

Abstract:
Thesis (MDram (Drama))--University of Stellenbosch, 2009.
In this thesis I examine the way in which fictionalised and dramatised narratives in theatre have the potential to create significant alternative narratives that can potentially be regarded as a crucial part of history writing. This is done through a critical analysis of three historically orientated dramatic texts, Ubu and the Truth Commission by Jane Taylor (1998), Copenhagen by Michael Frayn (1998) and Ghetto by Joshua Sobol (1984). I investigate how these playwrights narrativised history by fictionalising and dramatising events and people of historical importance, and how each of these plays individually contributes to the debate on narrative in historiographical discourse. Drawing on Hayden White’s theory on the poetic and narrative nature of history writing, as represented by his definitive work, Metahistory, I explore different theories and works on the philosophy of history to determine the precise nature of narrative itself as well as the historical work. Chapter Two is therefore an exploration of White’s philosophy on the ‘historical imagination’ as he describes his theory on the narrative and poetic nature of the historical document. In addition, this chapter provides an introduction to narrative in a theatrical text. This is done in order to examine how we can apply White’s theory to investigate narrative in theatre that focuses on historical events for the purpose of possibly including the dramatic narrative in the broader discourse on narrative in history writing. In this I highlight the theatrical narrative as a specific practice of language beginning with an interlude on representation in theatre. This is applied as the basis for examining the three texts in subsequent chapters. There are both general and more specific advantages in pursuing these arguments. Firstly, it may generate an understanding of some of the broad claims and problems bearing on the impact that literary theory is said to have on a subject which is not normally considered to fall within its domain, namely history writing. The work of Hayden White has been singled out to represent these claims, as he challenges the traditional distinction between history and literature. As a result, we are made aware of those arguments which set out to show that there are aspects of historical writing which are often ignored or which we generally overlook. An example of such an aspect that serve as the focus of this study is the narrative in historical explanation, representing the “ineluctably poetic nature of the historical work” (White 1983:xi). As such theatre can be an important tool in the process of constructing memory and alternative narratives, arguing that these narrativised histories could provide a “countermemory to the dominant narrative of the official histories” (Hutchison 1999:3). The theatrical texts singled out demonstrate that these alternative narratives in the theatrical texts function as a discourse of multi-levelled stories that engage with the complexities of the society and the complexities present in the context of the plays, making a contribution to the practice of historiography itself.

Melchers, Alma Louise Sophia. "Cinema plays history : National Socialism and the Holocaust in counterfactual historical films of the twenty-first century." Thesis, University of St Andrews, 2018. http://hdl.handle.net/10023/14340.

Full text
Abstract:
Inspired by 2009 pastiche Inglourious Basterds (US/DE), my research presents counterfactual historical film, firstly, as a marginalised type of film: the 2000s and 2010s have seen an abundance of overtly fictional films which do not intend to represent the past but nonetheless playfully refer to imageries of National Socialist and Holocaust history. These films have so far been neglected by historical film studies which, despite a consensus not to judge films according to their factual accuracy, tend to focus on genres close to historiography. My research considers as historical films the counterfactual parodies Churchill: The Hollywood Years (GB 2004) and Mein Führer: Die wirklich wahrste Wahrheit über Adolf Hitler (DE 2007), as well as Inglourious Basterds and, in a brief conclusion, Nazi zombie films. In this sense, counterfactual historical film is, secondly, a research approach which suggests reconfiguring academic definitions of the field of history and film and historical film. Assuming that historical film never visualises past reality but engages with a history that is always already medialised, I propose that the above films despite their counterfactual plots embark on a visual historical discourse, and what is more reflect upon cinema and history in their own enlightening ways. My analyses show how twenty-first century counterfactual historical films revise Nazi and Holocaust visual history, and how they describe National Socialist history as visually constructed and historical Nazism as an eclectic amalgamation drawing on fictional as well as factual media sources. In regard to the present, they explore tensions between popular and academic culture through the dissolving binaries of fiction film and historiographical fact, and propose to recognise the reciprocity of media representation and actual past as an object of research in its own right. My research demonstrates the value of cinema's playful engagement with history as a potential contribution to the theory and practise of historical film studies.

Khan, Amir. "Counterfactual Thinking and Shakespearean Tragedy: Imagining Alternatives in the Plays." Thèse, Université d'Ottawa / University of Ottawa, 2013. http://hdl.handle.net/10393/24310.

Full text
Abstract:
This dissertation is the application of counterfactual criticism to Shakespearean tragedy—supposing we are to ask, for example, “what if” Hamlet had done the deed, or, “what if” we could somehow disinherit our knowledge of Lear’s madness before reading King Lear. Such readings, mirroring critical practices in history, will loosely be called “counterfactual” readings. The key question to ask is not why tragedies are no longer being written (by writers), but why tragedies are no longer being felt (by readers). Tragedy entails a certain urgency in wanting to imagine an outcome different from the one we are given. Since we cannot change events as they stand, we feel a critical helplessness in dealing with feelings of tragic loss; the critical imperative that follows usually accounts for how the tragedy unfolded. Fleshing out a cause is one way to deal with the trauma of tragedy. But such explanation, in a sense, merely explains tragedy away. The fact that everything turns out so poorly in tragedy suggests that the tragic protagonist was somehow doomed, that he (in the case of Shakespearean tragedy) was the victim of some “tragic flaw,” as though tragedy and necessity go hand in hand. Only by allowing ourselves to imagine other possibilities can we regain the tragic effect, which is to remind ourselves that other outcomes are indeed possible. Tragedy, then, is more readily understood, or felt, as the playing out of contingency. It takes some effort to convince others, even ourselves, that the tragic effect resonates best when accompanied by an understanding that the characters on the page are free individuals. No amount of foreknowledge, on our part or theirs, can save us (or them) from tragedy’s horror.

Abstract:
My D-essay has the working title “Alternative Identities and Foreign Language Learning”. I have chosen this area because I have noticed a certain reluctance among Swedish students to use the foreign language English in English classes. They often seem embarrassed to express themselves in a language which is not their mother tongue, but they seem less embarrassed when they are allowed to act somebody else. These two observations converge into a focus of discussion on the matter, which will be supported by a minor study of my own, by extracts from other people’s essays on the matter, and by an overview of current litterature on language, identity and drama. The aim of my essay is to compare Swedish students’ willingness to use the foreign language English when acting minor plays in school, as themselves and as a chosen character, and to investigate the possibility of improving students’ willingness to use a foreign language, when given the opportunity to do so through acting somebody else.

Karthikeyan, Arul Pragash. "Detection of bottlenecks for multiple products and mitigation using alternative process plans." Thesis, Wichita State University, 2010. http://hdl.handle.net/10057/3727.

Full text
Abstract:
In a manufacturing environment, productivity and quality of the system can be improved by focusing on production constraints (bottlenecks). As a result, the bottleneck detection methods have gained more importance in enhancing the performance of the system. There are several short-term and long-term bottleneck detection methods. This research focuses on inactive state duration bottleneck detection for multiple product flow as high complexity arises in material flow due to several products and different processing sequences. The efficiency of the proposed methodology is validated by case studies using discrete event simulation models. The integration of simulation tool to detect bottlenecks in the manufacturing system has been useful in real-time case studies. An automatic bottleneck detection method was proposed to identify the bottleneck time and bottleneck machines in an easier manner. Previous research focuses on additional capacity and buffers to machines to mitigate the bottleneck. This approach spotlights the selection of alternative process plan in the presence of bottlenecks with a objective of minimized bottleneck time and minimized machining cost of the products in the given process plan. A mathematical model was presented with these objectives. Case studies were conducted for initially selected process plan and alternative process plan to show the improvements in system performance.

Manning, Isaac Hall. "Cary Cortona: an alternative development model for the Research Triangle Area." Thesis, Virginia Polytechnic Institute and State University, 1985. http://hdl.handle.net/10919/53084.

Full text
Abstract:
Cary-Cortona is a city that lies on the periphery of two realities; the reality of pragmatism and the reality of abstraction. It was conceived as a response to the pragmatic questions posed by an uncertain, yet impending future. It was nurtured by the correlation of vaguely related information until the facts and figures themselves became an abyss of abstraction. From the cavernous depths of information came a night of dreams when Cary-Cortona first emerged as walls and columns that began to form a city of arcades and courtyards. On that night the inhabitants walked the streets and alleys and the fragments of a dream became the very real elements of a living town. The subconscious residue of that dream flowed together as expressions of order, hierarchy, and form, drawn into existence through the media of models, drawings and sketches. Those formal expressions have taken on a reality of their own even when seen as abstractions through pragmatic eyes because they represent aspirations not yet realized. Cary-Cortona is very much alive in the realm of ideas, and as an idea it can emote a different series of images from each viewer who sees it. Just as there are limitless images of the future each tied to the individual, Cary-Cortona represents only one aspiration for a small corner of a vast future. In its present form Cary-Cortona is an adolescent in a purgatory between the two realities of abstraction and pragmatism, belonging to neither world completely, yet existing to be judged and scrutinized by both.

Abstract:
A call for design proposals for three features for the National Garden was held in October, 1992 by the National Fund for the U.S. Botanic Garden. The competition called for refinement of an existing master plan developed by EDAW, a landscape architectural firm, or the design of a new concept for the National Garden. This creative project chose to develop a new master and to document the research, process, and assumptions that lead to the final design. The research will focus on the examination of the site and it's history (Washington, D.C.) and examination into the history, evolution, and relevance of botanic gardens. The underlying thesis is that the changing roles that botanic gardens have played in society have had an effect on their built form. The current role of botanic garden as a pleasure garden aswell as an educational experiences is the result of hundreds of years of evolution. By the examination of the history and changing roles of botanic gardens, this creative project will design a space that not only meets the needs of the competition, but will meet the needs of the generation at hand.

Abstract:
With the recent innovations in technology, sports betting became more accessible to any bettor, professional or not. An analysis of tennis and models applicable on the estimation of the result of men’s tennis matches in Grand Slam tournaments allowed us to identify a model with the capacity to predict the result with a 76,02% accuracy. The selected model was applied on a case study, using Betfair as an example of an ‘exchange’ platform. This approach allows us to compare the estimated odds and the odds present at the betting market in such a way that the predictive ability of the model is assessed.

Knapp, Sandra V. "Does GRID Alternatives Impact Greenhouse Gas Emissions Reduction Targets in Central Coast Climate Action Plans?" DigitalCommons@CalPoly, 2016. https://digitalcommons.calpoly.edu/theses/1613.

Full text
Abstract:
As of March 2016, GRID Alternatives’ 179 solar electric system installations on low-income housing contributed 103 metric tons of carbon (MT CO2e) emissions reduction for the climate action plans’ Energy or Renewable Energy climate action measures that pertain to solar electric installations in the cities of: Arroyo Grande, Atascadero, Paso Robles, and San Luis Obispo and San Luis Obispo County. In 2007, the San Luis Obispo County Air Pollution Control District (APCD) created a team of government agencies to design climate action plans (CAP) that met the emission reduction goals set out by AB 32 and the 2008 Climate Change Scoping Plan (Rincon Consultants, 2014, p. 1-2). Each CAP outlines its greenhouse gas (GHG) baseline emissions and GHG emissions reduction targets in metric tons of carbon (MT CO2e) and identifies climate action measures to reach GHG emissions reduction targets. The climate action measure that pertains to Energy or Renewable Energy, specifically solar electric system installations, is examined in this study. GRID Alternatives, a non-profit solar installer that implements its Solar Affordable Housing Program, was selected by the California Public Utilities Commission (CPUC) in 2008, to serve as the statewide program manager for the California Solar Initiative’s $108 million incentive program called the Single-family Affordable Solar Homes (SASH) program, which is the country's first dedicated solar rebate program for low-income families (GRID, 2016a, p. 2). In 2010, GRID Alternatives opened its Central Coast office in Atascadero to serve five central coast counties and tracks CO2 emission reductions for each installation. My objective is to determine the impact that GRID Alternatives’ solar electric installations in the cities of Arroyo Grande, Atascadero, Paso Robles, and San Luis Obispo and in San Luis Obispo County have on their respective CAPs’ GHG emissions reduction targets for the Energy or Renewable Energy climate action measure that pertains to solar electric installations.

Johnston, Brian. "Constructing Alternative Christian Identity: An Ethnography of Jesus People USA's Cornerstone Festival." Scholar Commons, 2011. http://scholarcommons.usf.edu/etd/3172.

Full text
Abstract:
This dissertation examines processes through which alternative Christian identities are constructed, maintained, and performed at the annual Cornerstone Festival in Bushnell, Illinois. Organized and managed by Jesus People USA (JPUSA), an urban commune in Chicago, Illinois, the festival includes non-traditional methods of religious expression including rock music, making camp, play, and community-building. Cornerstone Festival attracts and includes members of the Christian faith who would not otherwise be included in traditionally organized Christian groups and fosters interaction between these less enfranchised members and more traditionally minded and socialized Christian practitioners. JPUSA appropriates the festival format as a method of religious expression and practice that successfully includes marginal or fringe Christians by offering a site of "play," and thus avoids the more traditional frames of recruitment and membership of orthodox religious services. In order to better understand Cornerstone Festival's complicated place in the American religious experience, a theoretical framework is developed from research in social constructionism, rhetoric and cultural studies. This framework is used to extrapolate the festival's significance as a site for socialization, its role in the cultivation of alternative Christian identities, and the purposes for which attendees use the festival as a site for community-building. The primary source of data for this study is drawn from ethnographic fieldnotes and interviews gathered at the 2008 Cornerstone Festival. I conclude that Cornerstone Festival is a coproduced, ephemeral site buttressed by a symbiotic relationship between structure and communitas. Evangelical faith and practice receive a new treatment at Cornerstone Festival where rock music, rather than a point of contention, is in fact a unifying aesthetic experience.

Abstract:

Abstract:
These research works concern the development of an approach anticipating the possible human behaviours when they do not respect safety rules. The failure in complying with safety rules, considered human error, is the major source of incidents/accidents in agricultural equipment field. The proposed approach consists in defining a tool for generation of human action plans. An action plan is a sequence of actions allowing the achievement goal. The identification of these plans is done through the implementation of algorithms of planning methods based on hirerachical methods. These allow the decomposition of tasks into sub-tasks according to the chose specification of the generator. This specification consists in defining the parameters of the generator in order to simulate the failure in complying with safety rule. It concerns the following input parameters; task to achieve, safety preconditions, action effects, actions, list. Work then focus on the defining of a strategy based on the expert judgements to assess the human action plans, produced by the generator, in terms of credibility. The developed approach is a part of an improvement human factors consideration in risk analysis of agricultural equipment. Finally, this approach is demonstrated by its application to the riding lawn mower

Abstract:

Abstract:
Cultural diversity in a global community demands our tolerant understanding of one another. Participatory art projects can be instrumental in facilitating equal-footing encounters and creative communication between people from different cultures that transcend language barriers. Used as a methodology for synergistic exchange and exploration, they represent a useful tool for the study and advancement of alternative solutions to development-related themes, particularly where non-verbal communication is either essential or advantageous. This report considers an independent arts-based project, “How to Talk to Dragons”, which was carried out in Phnom Penh, Cambodia by cultural workers from Berlin. The inter-cultural project chose the art form of shadow puppetry to explore the country’s culture and the experiences of its people, and to exchange ideas and perspectives in an engaging and socially just forum. The question guiding this cultural voyage of discovery was how the symbolic dragon, a mythical creature with a global resonance but subject to different perceptions in Europe and Asia, might be used as an agent for opening the way to revealing insights into human nature. The report also explores the links between How to Talk to Dragons and ComDev practices and, by incorporating an auto-ethnographic approach, considers how this method can serve to provide a better understanding of practice and add value to project analysis from a practitioner's perspective. It finds that open concept projects offer an exceptional flexibility to adapt to local and cultural conditions and makes the case for the Cambodian shadow theatre known as Sbek Touch (literal meaning: small leather) as a valuable emancipatory tool for promoting communication across social, economic and cultural borders. It recommends further studies into its potential for raising and identifying sometimes controversial issues in a humorous manner and for uncovering collective solutions, particularly among marginalized communities and classes. Ultimately, the report points to Hooks’ “Practice of Love” as an overarching concept that can inform and transform activities designed to engage with and embrace diversity.

Abstract:
With the opening of the Internet to the public, in 1994, a new alternative journalistic offer emerged around the world. On the initiative of experienced and recognized professionals, these news websites are part of a common ideological and democratic project: the Internet Media Dreamin'. It represents the dream of rehabilitating a journalism committed to democratic interests and citizens, which has been perverted over the years by the economic logic of the market. To achieve this, these dreamers' adhere to the public cyberspace, as well as to its promises of citizen empowerment, deinstitutionalization of the public debate, and freedom of information sharing. For them, the Internet is more than a technology: it is a solution that would allow them to circumvent a hegemonic information environment. Focusing on the process of reconfiguration of the journalistic landscape, this PhD thesis questions the ability of the online alternative offer to break with the institutional hierarchies of information, by proposing media spaces that promote a polyphonic citizen expression. This initial questioning is developed from three perspectives: 1) the individual and their citizen and media action; 2) the media and their communication positioning in the public debate; and 3) media structures and journalistic practices. Our study panel is composed of 50 news pure plays from Brazil and from France: a global one with editions in each of the two countries, and 48 alternative national projects. For its treatment, we implemented a thematic content analysis based on data collected through information monitoring conducted between 2016 and 2019, and 31 semi-structured interviews with content producers involved in the projects studied. Inspired by the method of media information gender analysis established by Patrick Charaudeau (1997, 2006, 2011), we analyzed the discourse of two "event-theme" articles (Soulages, 2002): women's condition and presidential elections of 2017 in France and 2018 in Brazil. To carry out this study, 3,147 texts were collected using manual and automatic methods, then processed according to the positions and the engagement levels of the speakers, according to two axes: enunciative postures and discursive points of view. To structure our discussions, this thesis is organized in two parts, which refer to the temporal evolution of the ideological and media development of alternative online journalistic projects. The first part, entitled "In Dreams", reveals a theoretical and empirical problematization of three ideological and democratic projects, that we call Internet Dreamin', Media Dreamin' and Internet Media Dreamin '. Then "In flesh and blood" aims to ponder about the incarnation process of the Internet Media Dreamin' in and by the social body. For this, we develop three chapters based on the tensions established by alternative journalism producers regarding the dominant journalistic models: 1) bourgeois and citizen voice; 2) homogeneous and heterogeneous information; 3) dependent and independent media. In addition to these theoretical and empirical contributions, this thesis aims to propose a methodology for the constitution of discursive cartography, eliciting the degree of commitment of the media offer

Abstract:
The objective of the cellular manufacturing is to simplify the management of the

manufacturing industries. In regrouping the production of different parts into clusters,

the management of the manufacturing is reduced to manage different small

entities. One of the most important problems in the cellular manufacturing is the

design of these entities called cells. These cells represent a cluster of machines that

can be dedicated to the production of one or several parts. The ideal design of a

cellular manufacturing is to make these cells totally independent from one another,

i.e. that each part is dedicated to only one cell (i.e. if it can be achieved completely

inside this cell). The reality is a little more complex. Once the cells are created,

there exists still some traffic between them. This traffic corresponds to a transfer of

a part between two machines belonging to different cells. The final objective is to

reduce this traffic between the cells (called inter-cellular traffic).

Different methods exist to produce these cells and dedicated them to parts. To

create independent cells, the choice can be done between different ways to produce

each part. Two interdependent problems must be solved:

• the allocation of each operation on a machine: each part is defined by one or

several sequences of operations and each of them can be achieved by a set of

machines. A final sequence of machines must be chosen to produce each part.

• the grouping of each machine in cells producing traffic inside and outside the

cells.

In function of the solution to the first problem, different clusters will be created to

minimise the inter-cellular traffic.

In this thesis, an original method based on the grouping genetic algorithm (Gga)

is proposed to solve simultaneously these two interdependent problems. The efficiency

of the method is highlighted compared to the methods based on two integrated algorithms

or heuristics. Indeed, to form these cells of machines with the allocation

of operations on the machines, the used methods permitting to solve large scale

problems are generally composed by two nested algorithms. The main one calls the

secondary one to complete the first part of the solution. The application domain goes

beyond the manufacturing industry and can for example be applied to the design of

the electronic systems as explained in the future research.

Abstract:
The thesis is intending to answer the question: Do tools and objects have the ability to support capacities for imagining alternative ways of living the present and through that also the future? How do we imagine our future? What is necessary for us and how do we want to live our everyday? It is important to rest for a moment and have a conversation about this questions in order to adapt old concepts of the world towards drastically changing conditions. Most of us, mainly in the modern western society, know that we can no longer maintain this lifestyle in the future. We know that we have to react as soon as possible and find alternative ways of living together. Yet it seems that we are paralysed to initiate action towards new ways of thinking. Where does this inactivity come from? It is hard to find new ways of thinking, especially when conventional norms, rules and structures of the current system do not provide any room for new forms of development. Is it possible that we are trapped in this system and the web of stories that hold it together? Is it possible that we are so used to the structures of the everyday, that we see them as set truths and do not question them anymore? The work investigates where these conditions come from and how non-human stakeholders in form of our everyday objects impact human culture and core beliefs. Through designing a disobedient tool that supports the capacity for alternative thinking towards more playful, imaginative presents and futures I want to try to questioning established systems embedded in our everyday tools, tools which embody our relations to each other and to the living and non-living inhabitants of our surroundings.

Abstract:
The aim of this study is to describe interaction between mothers/ caregivers and their profoundly mentally retarded and multiply handicapped children, and to describe the function of play in communicative interaction. In the study I describe the communicative interaction of six children aged 1:3 to 10 years. The children have been studied in their homes and preschools or schools. Each child had five or six handicaps in addition to their profound retardation. The study is based on interviews with parents, information from naturally-occurring conversations and videoobservations. Meals and play were selected for video-recording. The results indicate that the most important function of play is as a means of communication and learning. Play most often involves sensory stimulation and body play. Communicative interaction is non-verbal and described in terms of gaze/eye contact, facial expressions, gestures and body movements. A pattern of interaction has been found. This consists of four phases: an impression-receiving phase with orientation, an expressive phase with motor activity, a pause with processing and preparation of an answer and finally a break or a limited reaction. These children have, however, a communicative competence. The ability of the mothers to interpret the children’s signals is extremely context-dependent. These mothers adjust their communicative behaviour to the child and facilitate the child’s communicative interaction. The ability of the mothers/ caregivers to interpret the signals of these children is often underestimated by professionals. The living conditions of the parents have emerged as an important factor for play, communication and the development of the child.

One of the first activities in preventing pressure ulcers is the early identification of individuals who are susceptible to developing them. If a person is identified as susceptible or 'at risk', it is the health care professional's duty to ensure that preventive measures are implemented. The earliest phases of pressure ulcer development may show no outward visible signs of damage. Therefore it is important that individuals' at risk* are given an immediate prevention plan.

Abstract:
By literature and studentinterviews this work aims to identify which kind of learningpotentials geography simulations hold and try to connect these to relevant pedagogical theories. The work also tries to explore how students perceive simulations as didactic tool and structure these views in different categories. The author concludes that learning through simulations primarily depends on practical work, social interaction and emotional commitment. Also the different character of simulations and the gaming dimension seems to influence learning positively.

Abstract:
Spending almost two decades of experience with one of the largest oil and gas production company in the Middle East namely “Kuwait Oil Company” as a Team Leader and Senior Counsel for the Projects and Claims Team under Legal Affairs Department has undoubtedly inspired me the notion the essence of this thesis alongside with that sort of eagerness to research in quest for the knowledge which man has always and still run after but the least nevertheless only acquired! Before I join the company in late eighties, and on my graduation I found myself in cross roads, become a lecturer and embark on the academic career and satisfy my desire for research or fight my way in the legal profession as practitioner? I walked the second route in the hope of gaining the legal experience with the thought of grapping the research route in a later stage in which I now do enjoy and live. Working with KOC, I have been involved up to teeth in different areas of law since a project documents is governed and regulated not only by contract law but commercial law, companies law, patent law, labour law, construction law and tax law are also incorporated. The dispute resolution methods are addressed as well since local litigation is the main method and international adjudication, mediation and arbitration are exceptional but used and applied in particular on LSTK, EPC, EPF and Technical Service Agreements TSAs. Negotiation rounds which were entered with international oil companies on new projects and contracts gained me skills and exceptional knowledge in applying law and practice as well as sharing expertise not only in law function but in commercial and technical angles of the project bearing in mind the diversified expertise representing all aspects of business and the approaches followed to successfully accomplish a project. In the thesis, I’ve opted to deal with the elements of dispute resolution in the construction industry on the international scale and on the local or national level choosing State of Kuwait’s legal system and enhancing the research with the practical work experience in the Kuwait Oil Company extending seven chapters for this aim. I fully hope with my humble efforts exerted in this thesis that something valuable is added to the endless and depthless ocean of legal knowledge. In addition to the introductory section, the analysis of the thesis subject will be split into and developed through seven parts. Chapter one will define the construction contract, the field of the study subject, which will be followed by the mechanism of formation of the contract subject matter in chapter two. Then, the next four chapters, the means of the most common alternative dispute resolution; namely arbitration, adjudication, expert determination and mediation will be examined respectively. Chapter seven will mainly focus on the evaluation of the Kuwaiti national oil producer (Kuwait Oil Company “KOC”) as a case study and eventually will come up with the recommendations. Then, the mission of the thesis would reach the Conclusion being the final destination of its journey.
