Abstract:
Defining religion for the purposes of constitutional or human rights protection is a challenge shared by UK and Canadian courts in this era after the enactment of the Human Rights Act 1988 and the Canadian Charter of Rights and Freedoms 1985, respectively: neither defines what is to be protected. Canadian courts have been impressed with this task since 1982 and, unsurprisingly, the Supreme Court of Canada (SCC) has considered the content and scope of section 2(a), the fundamental right to freedom of conscience and religion, on a number of occasions, most recently in Syndicat Northcrest v Amselem. The outcome in Amselem is a salutary reminder that, for post-modern courts, religion can be whatever they want it to be, and, indeed, be nothing in particular, which merits protection or not at the whim of these courts. In Amselem, a 5–4 majority of the SCC reduced religion for Charter purposes to any beliefs which the complainant calls religion and persuades a court to be sincerely held. A court then has the discretion to decide whether to extend legal protection to those beliefs (and their allegedly offensive practice) without giving credible reasons beyond the complainant's sincere belief in them. Amselem may, therefore, be of considerable interest to British lawyers regarding the potential lurking within ostensibly generous constitutional protections for religion ultimately to reduce religion to nonsense undeserving of legal protection.

Abstract:
In Alberta v. Hutterian Brethren of Wilson Colony, the Supreme Court of Canada reconfigured its approach to section 1 of the Canadian Charter of Human Rights and Freedoms by holding that the final step of the R. v. Oakes test—the requirement of proportionality between a measure’s salutary and deleterious effects—provided the critical framework for its analysis. The author suggests that the Court’s emphasis on the last step of the Oakes test was not the most appropriate response to the specific minimal impairment argument Alberta presented. Alberta argued that the reason it could not safely offer an exemption from its licence photo requirement to Hutterites who objected to photos on religious grounds was because Syndicat Northcrest v. Amselem restricted government inquiries into the sincerity of religious beliefs. Ontario intervened in support of Alberta’s concerns. Although the Court did not address this minimal impairment argument, the author argues that it reflects an unnecessarily strict reading of how Amselem’s guidelines would apply in this context. In support, the author presents an exemption that would have cohered with Amselem and achieved Alberta’s safety objectives. The author then argues more broadly that the provinces’ concerns in Hutterian Brethren demonstrate the critical role the minimal impairment step of the Oakes test plays in generating solutions to clashes between laws of general application and minority religious practices. The Court’s new emphasis on the proportionate effects test, in contrast, may unfortunately discourage both parties from formulating potentially innovative alternatives.

Abstract:
“Arbiter of religious dogma,” first expressed by the Supreme Court of Canada in Syndicat Northcrest v. Amselem ([2004] 2 SCR 551), has had a lasting and pervasive effect on the Canadian lawscape. Developed in an effort to remove the State (and therefore Court apparatus) from a decision-making capacity in questions related to religious doctrine, this expression has become an inevitable mantra when discussing issues related to religion in Canada. This article argues, however, that the presence of this expression should not be understood as the end of a conversation, but rather, the beginning of a novel one on the legitimacy of religion in law. Through discourse analysis, this article will endeavor to suggest that this “marriage march” between law and religion is inevitable in the Canadian context.

ISSN 0804–4643 Activating mutations of G proteins, which are membrane signal transducers, have been associated recently with the development of various endocrine neoplasms. Mutations of two highly conserved codons, Arg201 and Gin227, in the α-subunit of the Gs protein, the adenylyl cyclase-stimulating protein, were first described in growth hormone-producing pituitary tumours. They resulted in constitutive activation of the αs-subunit by decreasing intrinsic GTPase activity. A similar mutation, affecting codon Arg179 (exon 5) in the α-subunit of the Gi2 protein, the adenylyl cyclase-inhibiting protein, has been described by a single group in ovarian and adrenocortical tumours. We evaluated the frequency of activating mutations in the α-subunit of the Gi2 protein in 18 human adrenocortical tumours. We screened exons 5 (codon Arg179) and 6 (codon Gln205) for mutations by denaturing gradient gel electrophoresis analysis of leucocyte and tumoural DNA. No abnormal migration pattern was found in either exon. The absence of mutation in exon 5, which includes the Arg179 codon, was confirmed in all tumoural DNA by direct sequencing. In conclusion, we did not find any oncogenic mutations in the GTPase domain of the α-subunit of the Gi2 protein in adrenocortical tumours. Thus, the previously oncogenic gip2 mutations do not appear to be determinant for adrenocortical tumourigenesis. Objective:The purpose of this study was to examine the characteristics of Gram stain versus Pap smear in diagnosis of bacterial vaginosis (BV).Methods:One-thousand and sixty women were enrolled in this study. All cases with symptoms of BV were determined by Amsel's criteria, which were accepted as the gold standard for diagnosis of BV. Pap smear and Gram stain evaluations were compared according to Amsel's criteria, without viewing the clinical results of the patients. Gram stain and Pap smear results were determined as negative or positive according to Amsel’s criteria. Sensitivity, specifity and positive predictive values were calculated.Results:After accepting the cases that were diagnosed as BV according to Amsel's criteria as reference cases, the sensitivity of the Gram stain method was calculated as 97% and the sensitivity of the Pap smear method as 93%. Similar specificity rates were obtained with both methods in diagnosis of BV related to the clinical results. There were no statistically significant differences in diagnosis of BV between these two groups.Conclusion:If Amsel's criteria are accepted as the gold standard for diagnosis of BV, Gram stain and Pap smear methods will give similar results in diagnosis.

One hundred forty-six species of Gelechiidae including 36 new records are reported from Israel. Anarsia balioneura Meyrick, 1921 and Polyhymno chionarcha Meyrick, 1913 are recorded for the first time in the Palaearctic region. Two new species are described: Metzneria freidbergi sp. nov., and Scrobipalpa aravensis sp. nov. Photographs of the type specimens of most taxa described from Israel and Palestine are presented. Abstract:
Background: Bacterial vaginosis is an imbalance in the ecology of the normal vaginal flora which is characterized by depletion of lactobacilli, and proliferation of anaerobic bacteria. It most often manifests clinically as a vaginal pH of > 4.5, presence of thin whitish homogenous vaginal discharge, detection of “clue” cells and presence of an amine odour after the addition of 10 percent potassium hydroxide. These anaerobic bacteria through specific products stimulate the decidual tissue causing an increase of cytokine level, release of phospholipase A2 and prostaglandins leading to preterm labor, premature rupture of membranes, chorioamnionitis and development of PID following abortion. To compare Amsel Criteria and Nugent Criteria for diagnosis of bacterial vaginosis.Methods: A cross sectional study involving 260 patients with preterm and term labour was conducted at a tertiary care hospital in North India. BV was determined to be present or absent on the basis of Amsel’s criteria and Nugent’s criteria. Pearson’s chi-square test was used to demonstrate the difference between both groups with respect to various categorical data.Results: Amsel’s criteria and Nugent’s criteria were reliable diagnostic methods. As compared to Nugent scoring system, Amsel’s criteria had sensitivity of 75%, specificity of 95%, positive predictive value of 90% and negative predictive value of 86%.Conclusions: Although the Amsel’s criteria is a convenient and inexpensive method of diagnosing bacterial vaginosis, it is not always reliable. Nugent’s criteria is considered as a gold standard for the diagnosis of bacterial vaginosis but it requires an experienced slide reader and considerable time and skill. If lab equipment is not available as in many developing countries, the diagnosis of BV can be simplified by using a combination of any two Amsel’s criteria like vaginal pH and whiff test which had highest sensitivity and specificity (90.19% and 97.78%) respectively as seen in present study.

Abstract:
This thesis contends certain contentious court cases can be traced beyond their legal roots to deep, sometimes incommensurable philosophical disagreements. However, the unitary nature of the judicial system effectively forces the court to take sides, putting its institutional weight and moral authority behind one set of principles and not another. Following Cover, I contend that this encourages future litigants to rephrase their claims in the court’s preferred normative language, thus influencing our normative environment. The theories which guide judicial decisions, however, are generally insufficiently attentive to the court’s normative influence. In response, I attempt adapting Dworkin’s Law as Integrity around Cover’s more sociological view. Chapter 1 examines Cover’s view, Chapter 2 explores Syndicat Northcrest v. Amselem and Delmaagukw v. B.C. as case studies, and Chapter 3 adapts Dworkin around Covers view. My conclusions argue that further inspiration can be drawn from EU Coordinate Constitutionalism and Sui Generis aboriginal rights.

Abstract:
This chapter, ‘Bacterial vaginosis (BV) and anaerobic balanitis’, provides an overview of the aetiology, clinical features, diagnosis, and management of these common conditions. It contains discussion of the role of a polymicrobial vaginal biofilm in the aetiology of BV and outlines the associated organisms. Clinical features and complications of BV are discussed, and the chapter then goes on to look at the different diagnostic frameworks used (including Hay-Ison and Amsel’s criteria). The management of BV is discussed with particular attention to strategies for recurrent BV and also pregnancy. The chapter ends with a discussion of anaerobic balanitis in men and the role that Gardnerella vaginalis plays.

Abstract:
By itself, cognitive variability would be an interesting curio, but no more. What makes it important is the potential it offers for adapting to task and situational demands. Realizing this potential, however, requires wise choices among the available alternatives. If children know two strategies—one faster, the other more accurate—they will benefit only if they choose the faster strategy when speed is most important and choose the more accurate when accuracy is. Choosing randomly will yield worse performance than always using the approach that on average yields the best outcome. Thus, the higher the quality of choices among alternative approaches, the greater the benefits of cognitive variability. How well do children choose? The conclusions of developmental psychologists have tended to emphasize the negative. Those interested in metacognition have focused on findings that children who have been taught new strategies often do not use them when they later are free to choose (e.g, Ghatala, Levin, Pressley, & Goodwin, 1986; Keeney, Cannizo, & Flavell, 1967; Paris & Lindauer, 1982; Williams & Goulet, 1975). Those interested in decision making have focused on situations in which children choose alternatives with lower expected values over ones with higher values (Byrnes & McClenny, 1994; Klayman, 1985). Those interested in planning have focused on situations in which children who have heard the virtues of planning extolled nonetheless fail to plan (Friedman, Scholnick, & Cocking, 1987). Those interested in scientific reasoning have emphasized cases in which children who have discovered advanced experimentation strategies nonetheless continue to choose less advanced ones (Kuhn, Amsel, & O’Laughlin 1988). These and related findings have led to generally negative conclusions about children’s ability to choose wisely among alternative ways of thinking. To cite two examples: . . . Children do not monitor well and often fail to make appropriate executive decisions.
