Full textThis dissertation discusses the intermediate sentences in Angolan legal order. We start from the study of the supremacy of the Constitution and the inspection of the constitutionality of norms as a mechanism to guarantee the integrity of the Constitution. We did a study of the different models of norms inspection. We also analyze the evolution of the constitutional system in Angola, and we conclude that Angola has adopted a mixed judicial system for the review of constitutionality of the rules. The doctrinal and jurisprudential study carried out revealed the existence in the Angolan legal system of sentences of an intermediate type. These types of sentences, as proposed by the doctrine, appear as an alternative to simple sentences (of dismissal or dismissal of the request for unconstitutionality). With this type of sentence opens the possibility for Constitutional Judges to modulate the effects of their decisions made in the control of constitutionality, exercising normative powers, competing with the legislator. The existence of these sentences is justified as a possible solution to deal with situations of legal certainty that were undermined by the effects of simple sentences of unconstitutionality. We have identified some of these types of sentences in the Angolan legal system, namely interpretative sentences, sentences that modulate temporal and repressive efficacy, and manipulative sentences (additive and substitutive). The most important question that we propose to answer is whether or not the actions of the Constitutional Judges, pronouncing these sentences is compatible with the Angolan legal system, in the light of the principle of the separation of powers, from then on have devoted itself in the last part of the work to the study the principle of separation of powers, its evolution and the possible redefinition of the limits of the separation of powers, supported by the Constitution itself.
