Abstract:

ZusammenfassungDer vorliegende Text leg die rechtspolitische Kompromissfindung im Rahmen der Kodifikation der Reichsstrafprozessordnung von 1879 dar. Die Reichsstrafprozessordnung bildete den Abschluss eines Reformjahrhunderts und den Beginn des modernen Strafprozesses in Deutschland. Traditionellglt sie als Kongromiss zwischen dem „Inquisitions-“ und dem ,Anklageprinzip “. Der Text argumentiert jedoch, dass sich hier gesellschaftspolitisch ein Konflikt um die Ralle der Bürgerrechte bzw. die Machtverteilung im Staat manifestierte, der sich im Zielkonflikt fischen der materiellen Wahrheitssuche
