A socialização humana é um processo que acaba por distinguir os membros de um grupo (“nós”) daqueles que lhe são externos (“eles”). Faze-o por meio da criação de fronteiras que não se amparam em elementos naturais ou imutáveis, mas em constructos artificiais para os quais se inventa uma história e uma significação. Para esse processo de construção colaboram os olhares dos membros (“nós”) e dos não membros (“eles”). O Brasil é um país profundamente marcado por tais separações, cuja exposição permite ver que o “mito” da democracia racial como marca da brasilidade é um falseamento das relações desiguais que se estabelecem com base em distinções de raça, gênero, sexualidade, religião e procedência regional. Uma dessas distinções é a de foro regional, que dotou de história as regiões e permitiu o surgimento do Nordeste como o conhecemos hoje, num processo de invenção que atendeu, de uma forma ou outra, aos interesses e apelos políticos das elites regionais, com a contribuição tanto de teóricos tradicionalistas, quanto dos críticos. Na base dessa invenção estão imagens e argumentos que sedimentaram representações que até hoje povoam o imaginário nacional e estão na base das formas de preconceito de que são vítimas o Nordeste e o nordestino, estereotipados por meio das ferramentas de um discurso colonial estigmatizante que lhes atribui inferioridade social. No atual período de acirramento de manifestações xenófobas e discriminatórias nas sociedades hipercomplexas da modernidade líquida, em que o Estado não é mais porto seguro para as inseguranças sociais, o preconceito de cunho regional apresenta-se recorrente no Brasil, explodindo as manifestações discriminatórias sempre que o nordestino apresenta- se como obstáculo aos interesses de habitantes de outras regiões do país. Assim, tornase importante estudar a tematização que o direito faz a respeito destas formas de discriminação, especialmente porque o ordenamento constitucional brasileiro devota grande preocupação ao trato do tema, prevendo o combate ao preconceito principalmente pelos meios jurídicos do direito penal e do direito civil, mediante o estabelecimento de normas jurídicas que preveem comportamentos desejados ou proibidos e cominam de sanções para punir e/ou evitar a infringência de suas prescrições. Entretanto, o exame da jurisprudência a respeito da discriminação contra os nordestinos permite ver que o direito, além de reproduzir imagens e estereótipos, possui um limitado alcance para reagir contra formas de veiculação de preconceito, uma vez que apenas pode tematizar aquelas expressões dotadas de exterioridade e passíveis de comprovação em processos judiciais. Desse modo, o direito tem uma limitação estrutural para lidar com espécies mais sutis e cotidianas de discriminação, havendo que se complementar a sua atuação pela ênfase noutros mecanismos sociais que permitam questionar os estereótipos e abrir oportunidade para lutas por reconhecimento. A teoria das formas de reconhecimento de Axel Honneth foca a solidariedade que excede a mera tolerância. Sua teoria permite enxergar as limitações estruturais do direito e avançar em direção a outras formas de interação social (na política, na educação, na cultura, etc.) que produzam uma modificação discursiva estrutural que detenha os processos de estigmatização que vitimam as populações do Nordeste. _________________________________________________________________________________ ABSTRACT
Human socialization is a process that divides people, separating members (“we”) from non-members (“they”) of specific groups. This is done through the creation of boundaries that are not founded on natural or immutable elements, but based in artificial constructions for which a history and a meaning is produced in which both members’ and non-members’ views are included. Brazil is a country profoundly divided by these separations, which shows that the racial democracy “myth” is featured as a special character of our nationality that overshadows the unequal relations based on race, gender, sexuality, religion and regional origins. One of those boundaries is based upon the idea of “region”, whose history was artificially built. This naturalized history allowed the appearance of the Northeast region as it is known nowadays, in a process that, in one way or another, served the political interests of the regional elite and counted with the support of both theories of traditional and critical intellectuals. The construction of the region is rooted in a set of images and arguments that cemented the stereotypes that constitute the core of misrepresentation located on the basis of multiple forms of prejudice against the Northeast and its population. These stereotypes are articulated via colonial discourse that stigmatizes its victims and assigns them a lower social value. In a moment when highly complex societies of the liquid modernity are facing intense xenophobia and discrimination, the State no longer offers a safe place against social insecurities. In Brazil, this fact gives opportunity to the recurrence of prejudice based upon regional origin in a special dangerous way, emerging every time a Northeastern person shows himself up as a potential obstacle to the interests of people from other areas of the country. For this reason, it seems important to study how Law addresses this form of discrimination, particularly because the Brazilian Constitutional Law is highly devoted to that matter, enforcing the fight against discrimination mostly through civil and criminal law measures. These tools are very often legal norms that prescribe desirable or prohibited behaviours and impose legal sanctions to punish or avoid Law’s infringement. Nevertheless, a review of the Brazilian Courts jurisprudence on discrimination against Northeastern persons shows that Law reproduces stereotypes and also has a limited scope to fully react against expressions of prejudice, since it is able to address only external manifestations that must be proved in lawsuits. Therefore, Law has a structural limitation that diminishes its ability to deal with subtle and daily forms of discrimination, which requires a complementation of its capacity through other social mechanisms that can question those stereotypes and open possibilities for struggles for recognition. Axel Honneth’s theory about distinct forms of recognition stresses the importance of solidarity beyond mere tolerance. His theory makes possible to envision the structural limits of Law and moves towards other ways of social interaction (in politics, in education, in culture, etc.) in order to produce a structural modification which deters stigmatization discourses that victimize Northeastern populations.

A pesquisa Diversidade Cultural Religiosa na Cultura da Escola tem por objetivo compreender como acontecem as interações e relações entre as diferentes identidades religiosas na cultura de uma escola pública da cidade de Florianópolis/SC. Entende Diversidade Cultural como os conjuntos de símbolos e significados peculiares construídos por cada sujeito/grupo social, através do tempo e do espaço, que servem de referência para a configuração de identidades pessoais e coletivas. Concebe o humano como um ser sócio-histórico-cultural, que constrói sua(s) identidade(s) a partir das relações de poder e estratégias de resistência, num processo de apropriação/produção das culturas. Compreende cultura da escola como amálgama dos imperativos da cultura escolar, da influência da conjuntura histórica, geográfica, social e cultural do contexto na qual a escola está situada e da teia de significados tecidos no cotidiano pela trama das relações entre seus sujeitos. Utilizando a etnografia como metodologia, esta investigação possibilita entrever as dificuldades da cultura da escola em respeitar e acolher positivamente as diversas identidades religiosas, com seus muitos olhares, rostos, nomes, textos, ritos e símbolos. O não reconhecimento da diversidade cultural religiosa e a naturalização de preconceitos que legitimam processos de exclusão e desigualdade evidenciam a necessidade da escola se desprender da perspectiva monocultural, integrando a diversidade de culturas e os diferentes sujeitos sócio-histórico-culturais presentes em seu contexto. A escola está sendo desafiada a abrir espaços para a alteridade, modificando os ritos, ritmos e processos que colaboram para a manutenção dos rótulos e estereótipos perante as crenças afro-brasileiras e pentecostais. O desafio é buscar outra forma de relacionamento com a diversidade cultural que permita compreendê-las em suas bases lógicas e epistemológicas. Um pensamento que afirme a existência de diversas racionalidades, todas legítimas e constituídas por sujeitos no seio de suas culturas, abrindo possibilidades para diálogos e interações positivas entre elas. The research Religious Cultural Diversity in the Culture of the School has the goal to understand the way happen the interactions and relations between the different religious identities in the culture of a public school from Florianópolis, Santa Catarina. It understands Diversity Cultural as the sets of symbols and peculiar meanings constructed by each citizen/social group, through the time and the space that serve as a reference for the configuration of personal and collective identities. The human being is conceived as a social, historical and cultural being that constructs his/her identity from the relations of power and strategies of resistance in an appropriation process/production of cultures. It understands the culture of the school as amalgam of the imperatives of the school culture, of the influence of historical, geographic, social and cultural from the context in which the school is situated and the relations among the citizens. Using the ethnography as methodology, this investigation allows seeing indistinctly the difficulties of the culture of the school in respecting and receiving the diverse religious identities positively, with its many looks, faces, names, texts, rites and symbols. The non recognition of the religious cultural diversity and the naturalization of preconceptions that legitimize processes of exclusion and inequality evidence the necessity of the school disconnect itself from the monoculture perspective, integrating the diversity of cultures and the different social, historical and cultural citizens present in its context. The school is being defied to open spaces for changing's, modifying the rites, rhythms and processes that collaborate for the maintenance of the labels and stereotypes facing the afro-Brazilians and Pentecostals beliefs. The challenge is to search another form of relationship with the cultural diversity that allows understanding them in its logical and epistemological bases. A thought that affirms the existence of diverse rationalities, all legitimated and constituted by citizens in their cultures, opening positive possibilities for dialogs and interactions among them.
