In Antonio da Sangallo the Younger's Reactions to the Pantheon: An Early Modern Case of Operative Criticism, Francesco Benelli looks at three annotated drawings by Antonio in which he analyzed features of the Roman Pantheon. The architect's analysis of this ancient monument drew on both his close, methodical, and pragmatic investigations of the building and his deep knowledge of Vitruvian theory. Together, the drawings and text represent an unprecedented critique of a building then almost universally admired. Yet Antonio's dependence on Vitruvius, who belonged to a different period of Roman history than did the Pantheon, led to certain discrepancies within his conclusions. Nonetheless, Antonio's study marks a new level of professional confidence, objectivity, and critical detachment among Renaissance architects, as ancient monuments were no longer seen as perfect and unquestionable, but as sources to be praised, criticized, utilized, adapted, or ignored according to the specific needs of modern architectural practice.

Commodus has been considered as a profligate emperor who threw over all the Golden Age achievements during the Antonine dinasty. In this article we will try to analyze one of the first decisions that the young emperor had to make, whether to continue or quit the campaigns commanded by Marcus Aurelius. Throughout this work we shall support the idea that strategic and military decisions of Commodus were rational regarding the Roman military thought of the Second Century, so we will contribute to Historiographical debate with a new vision of Commodus and of how Roman emperors made their decisions.

Marcus Aurelius reigned from 161 A.D. to 180 A.D., and he ranks among the most successful emperors of the antonine dynasty. The success of his administration may be attributed to his philosopher personality and, more than that, to his stoic character. Meditations presents thoughts of a stoicism devotee, which reflects in moments of intimacy on the challenges that he faced throughout his life as an emperor. It is in the practice of the ethical precepts of stoicism that he finds his refuge. The text consists of a series of spiritual exercises which reaffirm the indifference to pleasures, contempt for fame, detachment from riches and abnegation for political power. This paper is a study of Meditations, and its main purpose is to elucidate how the stoic way of life is incorporated in the figure of the philosopher emperor; this, as a military function, as he was a commander of the Roman army in the war against the Nordics, where political virtue was tested. Amid the chaos of an insane struggle for the survival of Rome, he found in stoicism a precious source of inspiration. Marcus Aurelius was not dazzled by the cult of the emperor's personality; he acted for the natural right to freedom and guided his political actions for the common good. His stoic perseverance reveals itself in a harmonious conduct with the city, the rational and cosmic organism from which the emperor is a simple part.

Abstract Alexander of Cotiaeum, the cultivated sophistes and one among the teachers of Aelius Aristides and Marcus Aurelius, distinguished himself in linguistic and literary studies, teaching, and cultural communication. Though without achieving brilliant results, he also engaged in some of the questions previously discussed by the most learned scholars. This cultural figure displays some typicality with respect to the average educated personalities (grammatikoi) of the Antonine renaissance. However, current studies are revealing a possible specificity of Alexander’s role: his influence, by way of educational approach, on the making of literary trends and models (canons) of the concurrent high culture, between New Sophistic and Atticism. This paper focuses on the very philological side (diorthosis, or textual criticism) of the composite and complex intellectual profile of Alexander.

Kiobel v. Royal Dutch Petroleum Co. marks the second time in nine years that the Supreme Court has ruled unanimously that the Alien Tort Statute (ATS) does not provide jurisdiction in a high-profile human rights case, a sequence that might suggest an end to the gilded age of human rights litigation that began with Filártiga v. Peña-Irala. On closer analysis, however, Kiobel, like Sosa v. Alvarez-Machain before it, adopts a rhetoric of caution without foreclosing litigation that fits the Filártiga model. To the contrary, Sosa and Kiobel invite considerably more ATS litigation than they resolve or bar and therefore confirm Justice Antonin Scalia’s memorable encapsulation of the Court’s “Never Say Never Jurisprudence.” All four of the opinions in Kiobel confirm that multiple significant issues remain for future resolution, but it is unrealistic to expect answers on the basis of the Court’s decision because what is law in Kiobel isnt clear and what is clear in Kiobel isn’t law.

ABSTRACTIn contrast to what its title suggests, Niccolò Jommelli's Cajo Mario (Rome, 1746) has little to do with the consul Caius Marius (157–86 BC). Instead, the opera transposes the myth of Iphigenia in Aulis to the Roman Republic, having Marius, his daughter, her lover and her villainous suitor assume the roles of Agamemnon, Iphigenia, Achilles and Ajax respectively. Thus configured, Jommelli's opera held the stage until 1772, enjoying fifteen revivals with most of the original music intact – a record in the composer's oeuvre. This essay seeks to clarify the reasons for that remarkable success. By juxtaposing Jommelli's score and Gaetano Roccaforte's libretto with a set of six paintings by the contemporary artist Antonio Joli (c1700–1777), it aims to show how Cajo Mario shares compositional strategies with a connoisseur's genre in the fine arts: the capriccio. In keeping with Joli's capricci, which all deploy the same structural motif, Cajo Mario incorporates a narrative structure through which the ‘parallel universe’ of related works imposes itself on the opera's setting and action, making spectators wonder – as a character does in the course of the opera – whether they are gazing at an event from republican Rome or reliving a legend from ancient Greece.

The recent Spanish translation of Cyprian’s complete works by Juan Antonio Gil-Tamayo obviously has a problem with the passage in Letter 39 describing the persecution-induced scars that qualify the confessor Celerinus for the clergy . The Cyprianic passage in question reads thus: lucent in corpore glorioso clara vulnerum signa, eminent et apparent in nervis hominis ac membris longa tabe consumptis expressa vestigia (Epist. 39, 2, 3). Here eminent et apparent… expressa vestigia is rendered by Gil-Tamayo as “se advierten y sobresalen las señales” . Significantly Gil-Tamayo has inverted the order of the verbs (eminent et apparent), while omitting expressa altogether. The Iter 34 (Antonine Itinerary XXXIV) is the name of the Roman road that crosses the province of Álava from west to east. Since no specific path was officially recognized before our study, the remains of the road did not benefit from heritage protection. In 2017, we made a project to determine the course of the road through rural Álava. In addition to traditional archaeological excavation and prospecting techniques, we used UAVs (unmanned aerial vehicle) to produce NDVI (normalized difference vegetation index) orthomosaic plans of ten cultivated areas through which the road is conjectured to pass. NDVI orthomosaics let us see crop marks better than with conventional photography, allowing us to detect the crop marks during times of the year and in places where conventional photography would fail to show them. Thanks to the NDVI orthomosaics, remains of the road were identified not only in places where we knew it existed, but also in previously unknown locations. Furthermore, other archaeological features were identified close to the roadway. This technique heralds a great advance in non-invasive methods of archaeological surveying. By using precision farming techniques we have identified the course of the Roman road Iter 34 in several locations in a short period of time and with few resources.

The Franciscan Antonio Daza, a native of Valladolid, published his Historia de las llagas de nuestro seráfico padre San Francesco in 1617. He intended to demonstrate that the stigmata of Francis of Assisi were miraculous and unique. Daza referred to Juana de la Cruz (d. 1534), a Poor Clare, whom he identified as providing evidence of the veracity of Francis's stigmata in her sermons, which had been collected by one of the nuns in her convent in a manuscript known as El Conhorte. Juana's sermons were defended as divinely inspired and thus her defence of the miracle of Francis's stigmata was regarded as based on information received directly from God. Yet Juana herself had, according to another work by Daza, the Historia, vida y milagros, éxtasis y revelaciones de la bienaventurada virgen Santa Iuana de la Cruz (first published in 1610) received painful marks on her hands and feet in 1524. This paper will consider the tensions evidenced in Daza's work and his tactics in attempting to demonstrate the unique nature of the stigmata of Francis of Assisi whilst at the same time apparently acknowledging a similar miracle experienced by Juana de la Cruz.

La Dirección Nacional de Derechos de Autor (dnda) condenó al Colegio Montessori por la violación del derecho moral de divulgación del señor Loerbroks. Esta decisión es importante ya que es una de las pocas sentencias en las que se han protegido los derechos morales de los autores en Colombia. La decisión deja entrever la línea jurisprudencial que la dnda poco a poco ha trazado para la protección de los derechos de autor, y en especial de los derechos morales de que goza el autor de la obra. Ello obedece a que, a diferencia de los derechos patrimoniales, estos son perpetuos, inalienables e irrenunciables. Así se evidencia en el caso del artista Gabriel Antonio Calle contra el centro comercial San Diego y en el expuesto en esta reseña.

Between 1947 and 1958, thousands of Austrian children were hosted by Portuguese fami‑ lies and institutions as part of an action promoted by Caritas. Thus escaping, for some time, the misery of a country devastated by war, these “Caritas children” found in Portugal, under Antonio de Oliveira Salazar’s Estado Novo, shelter and, in most cases, affection: an experience that, besides having repercussions in their memories and journeys, also left marks that, although less visible, conti‑ nue to make themselves felt in Portugal. In this article we present a general outline of the research «The “Caritas Children”, between Austria and Portugal (1947-1958)», which was aimed to understand the way the Action took place, its repercussions on those involved, the way it was dealt with by government agencies and displayed by the press at its service and perceived by the population.

The ideas originating in Antonio Gramsci’s politico-theoretical work, in a multifaceted itinerary departing from a purely ethical matrix, have developed in Latin America into a sophisticated theoretical formulation focused on the theory of hegemony. The emergence of this formulation marks the beginning of a complex process of reformulation of the classic paradigms of the left, producing a drastic change in thinking about the logic of social transformation in Latin America. With this shift the issues of strategic design and the transformational process began to undergo thorough debate. The theoretical tasks presented by the current development of Gramscian thought toward the construction of a comprehensive theory of hegemony include the classical political and cultural dimension and the productive dimension of hegemonic actions. Las ideas oriundas en la elaboración teórico-política de Antonio Gramsci, en un itinerario multifacético a partir de una matriz puramente ética, desenvuelven su contenido hasta ser expuestas en la forma de una formulación teórica sofisticada centrada en la teoría de la hegemonía. La emergencia de este momento marca el inicio de un complejo proceso de reelaboración de los paradigmas clásicos de la izquierda, constituyendo un cambio severo en el modo de pensar la lógica de la transformación social en América Latina. En este viraje las cuestiones del diseño estratégico y del sujeto del proceso transformador serán puestos en discusión radical. Las tareas teóricas planteadas por el desarrollo actual del pensamiento gramsciano hacia la construcción de una teoría integral incluyen las clásicas dimensiones política y cultural y la dimensión productiva de acciones hegemónicas.

Abstract The Vita Heliogabali in the Historia Augusta consists of a political-biographical first section (1.4––18.3), generally considered to be historically useful, followed by a fantastic catalogue of the emperor's legendary excesses (18.4––33.8), generally dismissed as pure fiction. While most of these eccentricities are probably inventions of the ““rogue scholar,”” it is argued that the grand recital of imperial antics, more than just a detachable appendix, serves a demonstrable ideological purpose and is informed by a unifying rationale, which in turn helps explain the ““Lampridian”” Elagabalus as historiographical construct. Within the sequence of Antonine biographies Elagabalus, ultimus Antinonorum, marks the climax in a progressive tendency towards tyranny and is accordingly styled as transcendental despot; multiple topoi from the literary tradition provide the generic coordinates for this larger-than-life portrait. Food and sex in particular, both typical elements in this context, are inflated in Heliog. into major thematic systems to signal the emperor's tyrant status, to bring out his distinctive attention to aesthetics, and to enhance the Life's literary cohesion.

A setting of texts by female prisoners and factory workers, it marks a sharp stylistic departure from Nono's political music of the 1960s by virtue of its audible quotations of revolutionary songs, its readily intelligible text setting, and especially its retention of the diatonic structure of the song on which the piece is based, the communist “Internationale.” Nono's decision, following the premiere, to withdraw the work from his catalogue suggests that he came to regard it as transgressing an important boundary in his engagement with “current reality.” I examine the work and its withdrawal in the context of discourses within the Italian left in the 1960s that accused the intellectuals of the Partito Comunista Italiano of unhelpfully mediating the class struggle. Nono's contentious reading of Antonio Gramsci, offered as justification for his avant-garde compositional style, certainly provided fuel for this critique. But Voci destroying muros suggests receptivity on the part of the composer—albeit only momentary—to achieving a more direct representation of the voices of the dispossessed.

Leone Leoni's house in Milan, the Casa degli Omenoni, is one of the city's most distinctive architectural landmarks. It has long earned the attention and admiration of visitors, particularly for its unusual façade decorated with six over-life-sized barbarian prisoners and two half-length caryatids flanking the central portal. Figures of this kind had never been seen on a house or palace façade before they appeared here. This article analyzes the sculptural and architectural sources of these figures as well as the architectural sources of the façade in general. The Casa degli Omenoni is placed within the context of the three major façade types at mid-century, in order to further clarify its innovative qualities. Finally, the iconology is discussed, with Leoni's dedication of the house to Marcus Aurelius seen in relation to the popularity of two books on the ancient emperor by the court historian of Charles V, Fray Antonio de Guevara. The prisoner motif is linked to the Persian Portico, and the famous frieze relief showing lions attacking a satyr is related to a similar device in Filarete's palace for the pseudonymous architect Onitoan Noliaver. It will be seen that Leoni presented himself to the public less as an artist than as a gentleman in the social camp of the Hapsburgs.

From Republican times Romans, unlike any other people known to them, had three names, praenomen, nomen (gentilicium) and cognomen. In the first and second centuries A.D. Roman writers assumed that the possession of tria nomina distinguished the civis Romanus from the peregrinus.Roman practice in the late Republican period was not always in accordance with the above. Cognomina were not adopted in official inscriptions by the Roman state as a constituent of the nomenclature of a senator or an eques until the end of the second century B.C. even though the use of cognomina by patrician families dates from the second half of the fourth century B.C. Despite this official recognition some families such as those of Marius and the Antonii never used cognomina. There were also many individuals who used an additional cognomen (or agnomen) which resulted from a military honour, adoption or the need to mark separate identity from other branches of a family. The practice of employing tria nomina, therefore, was never universal among the upper classes during the late Republic. The aim of this paper is to present a statistical analysis of the nomenclature patterns by which all individuals who can confidently be considered of senatorial or equestrian status are known to us. In the case of women, the study is restricted to those from the senatorial class.

The North Caribou terrane of the western Superior Province attained continental thickness (~35 km) by 2997 Ma. It records a subsequent 300 million years history of continental fragmentation, arc magmatism, and terrane accretion. At Lake Winnipeg the ~2978 Ma Lewis–Storey quartzite–komatiite–iron formation assemblage marks Mesoarchean breakup. Unlike the relatively continuous 2980–2735 Ma stratigraphic record of the Red Lake and Birch–Uchi greenstone belts to the east, little of this interval is recorded at Lake Winnipeg. Rather, two belts of younger, juvenile rocks are tectonically juxtaposed: the Black Island assemblage of isotopically depleted, 2723 Ma basalt, and calc-alkaline andesite; and Rice Lake greenstone belt of basalt, calc-alkaline andesite, and dacite (2731–2729 Ma). Collectively these terranes represent a short-lived island-arc–back-arc system that docked with the southwestern North Caribou margin along a northwest-trending, dextral, transpressive, D1 suture. This zone is marked by the highly deformed coarse clastic Guano Island sequence (<2728 Ma) that contains detritus of North Caribou affinity and is interpreted as a strike-slip basin deposit. Younger clastic sequences, including the Hole River (<2708 Ma), San Antonio (<2705 Ma), and English River (<2704 Ma) assemblages, occur in east–west belts that may have been deposited during the terminal collision (D2, D3) between the North Caribou terrane and continental crust of the Winnipeg River terrane to the south. Several terrane docking events within a framework of north-dipping subduction and continental arc magmatism appear necessary to explain structural and stratigraphic relationships in the 2735–2700 Ma interval.

In 2017 the International Court of Justice (ICJ or Court) made only procedural decisions, one on preliminary objections, one on counterclaims, and two on provisional measures. Three other new applications were made to the Court, all linked to earlier cases: Malaysia applied for the revision, and interpretation, of the judgment in the Pedra Branca/Pulau Batu Puteh case; and Costa Rica brought a case against Nicaragua concerning their land boundary in the area of Los Portillos, the latest in a long line of cases between the two states. Judges Ronny Abraham (France), Dalveer Bhandari (India), Antonio Cançado Trindade (Brazil), and Abdulqawi Yusuf (Somalia) were reelected to the Court, and one new judge, Nawaf Salam (Lebanon) was elected. The UK failed to secure the reelection of its judge, Christopher Greenwood. For the first time since the establishment of the ICJ, the UK will have no judge on the Court. This failure may be taken as an indication of its declining influence in international relations, arguably attributable in part to Brexit, and it marks the end of the convention that each permanent member of the Security Council will have a judge of its nationality on the Court. Nor was the UK able to prevent a request by the UN General Assembly (passed by ninety-four in favor to fifteen against, with sixty-five abstentions) for an Advisory Opinion on the legal consequences of the separation of the Chagos Archipelago from Mauritius in 1965—a sensitive issue for the UK, and one that has already been the subject of much litigation.

AbstractWritten between 1990 and 2009, my seven works for string quartet: Poems for string Quartet and 6 numbered Quartets approach different modal languages, from prepentatonic or pentatonic structures to heptachordic or dodecaphonic configurations, sometimes overlapping musical languages, generating those polymorphous languages, with moments of overlapping or juxtaposing of syntaxes, with a motivic cycling determinant of a conceptual unit of works linked to synthetic, elaborate thinking. Esta forma de oposición más violenta es la que predomina en el relato de las fuentes clásicas, que recogen importantes datos para conocer las relaciones entre el Senado y el princeps. Sin embargo, de entre ellas, hay un hecho particular que llama la atención, ya que se trata de un caso de oposición no violenta y que llega a ser ensalzado en las fuentes (Tac., Ann., 3, 75), representado por el jurista Marco Antistio Labeón. En primer lugar, para abordar el tema recopilaremos los casos anteriores a Antistio Labeón que se opusieron a Augusto y haremos un breve perfil biográfico del personaje. Finalmente, indagaremos en los casos en los que Labeón mostró su oposición a la figura de Augusto.AbstractIn the Senate there were always individuals who opposed Octavius and several of them came to conspire against him. On Sunday 3 July 2011 the Research Committee of the IUCN Academy of Environmental Law, the IUCN Environmental Law Centre, Bonn and the IUCN Commission on Environmental Law organised a pre-conference workshop entitled “Towards the legal recognition and governance of ecosystem services” at Mpekweni, Eastern Cape, South Africa. At this workshop, papers were delivered on various aspects of ecosystem services. These included an introduction to ecosystem services from a legal perspective by Alejandro Iza of the IUCN Environmental Law Centre, and an introduction from a scientific perspective, by Christo Marais of the South African Department of Water Affairs. Justice Antonio Benjamin from the High Court of Brazil gave a presentation on Jurisprudential experiences in Brasilia and the importance of the legal recognition of ecosystem services; Alistair Rieu Clarke (University of Dundee) spoke on “The 1997 UN Watercourses Convention and Ecosystem Services: Can a Combined Reading Ensure that International Watercourses are Utilised in an Equitable and Reasonable Manner?”; Jamie Benidickson (University of Ottawa) presented the new IUCN “Guidelines for Protected Areas Legislation” and David Hodas (Widener University) gave a presentation entitled “Seeing into Law's Blindspot: Ecosystem Energy Services”. The discussions during the workshop enabled participants to realise that there were numerous angles to the topic of ecosystem services and that the discussion had not been fully explored, in particular concerning the human livelihoods aspect and the intricate relationship between ecosystem services and rights. It was therefore decided that there would be an open call for papers for publication on these issues, which would contribute to furthering this important discussion in the light of the major world conferences that would have taken place from 2012 onwards.

Przedmiotem artykułu jest dwuchórowy motet na dziewięć głosów o incipicie tekstu Sancte Simon magno mundi, zachowany w postaci intawolacji organowej w rozpoczętej w roku 1619 tabulaturze braniewsko-oliwskiej (Wilno, Biblioteka im. Wróblewskich Litewskiej Akademii Nauk, F 15-284, k. 45v–46r) z atrybucją „Joannis Baptistæ”. Podobnie skrótowe atrybucje w tym źródle oraz w innych, pochodzących z północnych terenów Rzeczpospolitej, odnosiły się wyłącznie do dobrze znanych kompozytorów lokalnych, a w dwóch z tych rękopisów imionami „Joannes Baptista” określano Giovanniego Battistę Cocciolę, twórcę działającego na Warmii i w Wielkim Księstwie Litewskim (potwierdzone źródłowo lata działalności 1606–1625). Autor podsumowuje i uzupełnia informacje na temat dorobku twórczego tego kompozytora, podając do wiadomości niezauważoną dotychczas wzmiankę o istnieniu jeszcze jednego jego druku autorskiego, który nie zachował się do naszych czasów (Motetti a cinque, wyd. przed 1621). Tekstu motetu Sancte Simon magno mundi nie udało się odnaleźć. Odnosi się on z pewnością do św. Szymona Apostoła, który wprawdzie nie cieszył się rozwiniętym indywidualnym kultem, ale był patronem Szymona Rudnickiego, biskupa warmińskiego w latach 1605–1621. Rudnicki utrzymywał ścisłe kontakty z kolegium jezuickim w Braniewie, gdzie powstało znane dziś źródło omawianego motetu, a Cocciola został w roku 1606 odnotowany jako muzyk tego biskupa. Ten szczególny splot okoliczności pozwala z dużym prawdopodobieństwem przypisać autorstwo motetu Sancte Simon magno mundi Coccioli, który przypuszczalnie dedykował go swojemu patronowi. Motet ten należy do niewielkiej ilościowo grupy utworów, w których jako ostinato wykorzystano melodię wezwania z litanii do Wszystkich Świętych. Zdradza on bardzo duże pokrewieństwo z przeznaczonym na taką samą obsadę motetem Beatissimus Marcus Antonia Gualtieriego, wydanym w jego druku autorskim z roku 1604. W obydwu utworach umieszczone w najwyższym głosie ostinato pojawia się siedem razy w niezmiennej postaci i w równych odstępach. Motet Gualtieriego również odnosi się do świętego, którego imię nosił patron kompozytora, biskup Marco II Cornaro, będący adresatem dedykacji zbioru. Wydaje się bardzo prawdopodobne, iż Cocciola świadomie wzorował się na utworze Gualtieriego, jednocześnie stosując w swojej kompozycji bardziej kunsztowne środki: prezentację ostinata na trzech różnych stopniach skali, imitacyjne rozpoczęcie, większe zróżnicowanie rytmiczne, rezygnację z powtórzeń materiału muzycznego i efektowniej zaplanowaną końcową kulminację.

Abstract:
The nineteenth of June 2011 marks a century and fifty years since the birth of José Protasio Rizal in 1861.1 The ninth of November 2011 also marks the Golden Jubilee of the foundation of the Departments of Ophthalmology and Otorhinolaryngology of the Philippine General Hospital (PGH) in 1961, dividing the original Department of Eye, Ear, Nose and Throat that was established a century ago in May 1911. The national hero of the Philippines and Pride of the Malay Race2 is immortalized in countless ways, reflecting his multiple accomplishments that mark a true renaissance individual. The two departments of the national University of the Philippines (UP) have likewise made their mark in pace with the many achievements of their alumni. Rizal was a polyglot and polymath poet, painter, sculptor, sportsman, scientist and patriot, whose writings led to his execution and sparked the Philippine Revolution of 1898.1,3 He was also a physician and an ophthalmologist who insightfully dissected the ills of his patients and society.4 What have the departments and their hospital contributed to health and to humankind? If precedence were the measure of significance, the pioneering “firsts” would have to include the first laryngo-fissure operation by founding department head Dr. Reinhard Rembe in 1913, the first intracapsular cataract lens extraction in the country using a suction erisophake after the technique of Barraquer by the next chair (and nephew of the national hero) Dr. Aristeo Rizal Ubaldo in 1920, the first laryngectomy by Drs. Ubaldo and founding president of the Philippine Academy of Ophthalmology Antonio S. Fernando in 1923 and the first labyrinthectomy by Drs. Ubaldo and Vicencio C. Alcantara in 1927.5 There was a time when the chairs and senior consultants of most departments of otorhinolaryngology - head and neck surgery in the Philippines were alumni of the UP-PGH, as was the leadership of the Philippine Society of Otolaryngology and Bronchoesophagology (later Philippine Society of Otolaryngology Head and Neck Surgery) which separated from the Philippine Ophthalmological and Otolaryngological Society (subsequently Philippine Academy of Ophthalmology and Otolaryngology) in 1956. But those are bygone days, and the folly of resting on one’s laurels becomes all too apparent, as these are quickly eclipsed by the capabilities of newer, better-equipped health care facilities that are manned by experts trained in their respective institutions. Thus the race to super-specialize and sub-specialize, perhaps to regain lost ground and primacy at the expense of tertiary general health care has become the battle cry for some, led by the present administration of the PGH. And yet, the majority of Filipinos still do not have access to primary health care.6 They who do not even have the services of a basic physician much less can avail of special care of their sight, hearing and balance, smell and taste, breathing, swallowing or speaking, nor of the face with which they face the world. Witness the number of adults with unrepaired cleft lips and untreated head and neck tumors roaming the streets of the city. The UP College of Medicine (UPCM) founded in 1905 aims “towards leadership and excellence in community-oriented medical education, research and service directed particularly to the underserved.”5 As the teaching hospital of the UPCM, with whom it shares such academic and clinical departments as Ophthalmology and Otorhinolaryngology, the hundred-year-old Philippine General Hospital and its leadership cannot and must not turn a blind eye or deaf ear to the underserved it is mandated to serve. Its true strength lies in relevance, which is quickly lost if it succumbs to the delusionary glitter of super specialization beyond the reach of most people. Of what benefit is it to be the “first,” if it does not redound to the good of the “many?” Of Rizal, it has been said “to his patients he gave sight; and to his country he gave vision.”7 As the Departments of Ophthalmology and Otorhinolaryngology pursue the arts and sciences of vision, hearing and balance, olfaction and gustation, respiration and deglutition, phonation and facial expression, may they sharpen the sensitivity of health providers in PGH and other loco-regional general hospitals to the real issues of health and humankind in the developing world and embolden us to overcome the apathy to “hear no evil, see no evil, speak no evil.”

O uso de sistemas automatizados adequadamente projetados e validados para a execução de ensaios é conveniente, pois assegura maior estabilidade das condições de ensaio, otimização do tempo de operação, redução das falhas ou imperfeições humanas, consequentemente conduzindo a melhor qualidade dos resultados de ensaio. Deste modo, o presente trabalho propôs projetar, instalar e validar uma bancada automatizada para condução de ensaios de perda localizada de carga. Desenvolveu-se o circuito eletrônico microcontrolado que dispõe de funcionalidades para aquisição e condicionamento de sinais de sensores; controle de inversor de frequência e válvula proporcional; controle Proporcional-Integral-Derivativo (PID); e, comunicação Modbus RTU com outros dispositivos através de rede RS-485. O firmware implementado no microcontrolador foi desenvolvido na linguagem C, enquanto que a interface gráfica do usuário (GUI) foi desenvolvida em C#. A validação da bancada foi efetuada a partir de ensaios de estabilidade, que permitem afirmar o adequado funcionamento da bancada de ensaios. FRIZZONEDESIGN AND EVALUATION OF A TEST BENCH FOR DETERMINING MINOR PRESSURE LOSSES 2 ABSTRACT The minor pressure losses are fundamental in the development of subunits for micro-irrigation systems. The use of well-designed and validated automated systems in order to perform tests is convenient because it ensures a greater stability of test conditions, and also improves the use of operating time, reducing the risk of faults or human error, consequently, thus having better quality in the test results. Thereby, this paper aims to develop, install and validate an automated bench to conduct minor pressure loss tests. The previously developed micro-controlled electronic circuit has features to input and store signals from sensors; Frequency inverter controller and proportional valve; Proportional-Integral-Derivative Controller (PID); and a Modbus RTU communication protocol to interact with other devices via RS-485 network. The firmware implemented in the microcontroller was developed using the C programming language, whereas the graphical user interface (GUI) was programmed in C #. ResumoNão há dúvidas de que a pirataria digital contemporânea é produzida coletivamente por “peers”, no entanto, o título deste artigo não diz respeito apenas às características da pirataria em si – embora elas devam ser retomadas em algum ponto. A escolha de “Peer Piracy” como título denota uma intenção de tratar dos atributos particulares dessas duas formas de apropriação cultural à luz da filosofia política, especialmente os trabalhos de Michel Foucault, Gilles Deleuze, Antonio Negri e Michael Hardt. Entendendo que essas são práticas opostas, ou pelo menos contraditórias entre si, do ponto de vista econômico/legal (e talvez ético), esse artigo não pretende juntá-las ou realizar um estudo sobre seu entrelaçamento histórico e político. Pelo contrário, busca-se apontar como essas práticas marcam uma fase de transição do capitalismo global, e, acredita-se, estariam contribuindo, em suas singularidades e oposições, para construção de uma nova constituição econômica, política, social e cultural do presente.Abstract Amidst the many political themes surrounding our contemporary age, one that draws more attention concerns the philosophical and legal discussion about property, especially (but not restricted to) intellectual property and copyright. Actually, it would be no exaggeration to say that the notion of private property as a whole is changing and that this transformations leads also to socio-economical, political and cultural consequences. In Digital Culture – one of the main poles of this scenario in dispute – the hacker and peer-to-peer (P2P) movements can be highlighted as two preponderant elements in the conceptual and quite physical taken of property. Nevertheless, it is necessary to inform that this paper does not intend to advocate in favor of this or that cause, but to show how this is a contemporary situation that must be an object of study in academia. In this sense, the Occupy movements, open software, collaborative economies and hacker groups (such as Anonymous) can be used as examples of the penetration of this thematic in our days. However, they must not be considered isolated cases of insurgency against the capitalist system and its means of production, but as manifestations of a structural change, a status quo modification, in the actual idea of property and its usage. Regarding hacker culture, the reference to our investigation will be a set of works commonly related with the so called cognitive capitalism and its respective influences, largely the French political philosophy. In the case of peer production, beyond the already mentioned bibliography, some authors such as Bauwens et al. were chosen in an attempt to establish a more integrative counterpoint to this cultural and consumption logics. Contemporary digital piracy is obviously peer-based yet the title of this short essay does not regard the characteristics of piracy in itself – although they will be addressed at some point. The choice for “peer piracy” as the title marks our intention to speak about the particular attributes of these two kinds of cultural appropriation. Understanding that these are opposed or at least contradictory practices in an economical/legal point of view, this paper intends not to mingle them together or study how they would be intertwined historically or politically. On the contrary, we seek to indicate how each one of them, in their own singularities, may be used to build a new economical, political and social constitution of the present. Thus, as a way to situate the debate inside this theoretical background, first it is necessary a short summary about what this essay understands for cognitive capitalism and how this conceptual operative fits in the socio-economical transitions of the last 30/40 years.

Encerrando as publicações de 2019, o 3º número da Motricidades: Revista da SPQMH traz 6 textos, sendo 1 artigo de pesquisa, 3 artigos de revisão e 2 ensaios.No Artigo de Pesquisa “Arte popular na região fronteiriça Brasil-Paraguai”, Paulo César Antonini de Souza (Universidade Federal do Mato Grosso do Sul, UFMS, Campo Grande-MS, Brasil) e Maria Carolina Rodrigues (Universidade Federal do Mato Grosso do Sul, UFMS, Campo Grande-MS, Brasil) apresentam os resultados de uma investigação desenvolvida durante o biênio 2016-2017 a fim de identificar manifestações da arte popular na região fronteiriça de Mato Grosso do Sul com o Paraguai, especificamente, a partir das relações entre Ponta Porã (Brasil) e Pedro Juan Caballero (Paraguai).Wagner Wey Moreira (Universidade Federal do Triângulo Mineiro, UFTM, Uberaba-MG, Brasil), Marcus Vinicius Simões de Campos (Universidade Estadual de Campinas, UNICAMP, Campinas-SP, Brasil) e Regina Simões (Universidade Federal do Triângulo Mineiro, UFTM, Uberaba-MG, Brasil), no artigo de revisão intitulado “Motricidade, Corporeidade e Complexidade: diálogos a partir do hemisfério sul” enfatizam a Motricidade como possível meta-ciência ocupada em reconhecer o ser humano que se movimenta intencionalmente na direção de transcender, a Corporeidade como uma atitude a exigir valores diferentes do trato com o corpo mecânico, ainda estudado e ensinado de forma hegemônica na atualidade e a Complexidade como nova forma de perspectivar a vida e os pressupostos axiológicos nela contidos.Em “A proposta da Base Nacional Comum Curricular para o ensino de Arte”, Denise Andrade de Freitas Martins (Universidade Estadual de Minas Gerais, UEMG, Ituiutaba-MG, Brasil) e Maria Aparecida Augusto Satto Vilela (Universidade Federal de Uberlândia, UFU, Pontal-MG, Brasil) discutem a Base Nacional Comum Curricular (BNCC) brasileira, tendo como foco o ensino de arte na Educação Infantil e nos anos iniciais do Ensino Fundamental. A intenção das autoras é suscitar reflexões que contribuam para o exercício crítico e cidadão de ser professor e professora no Brasil.No terceiro artigo de revisão, “Physical activities, sports and sustainability: a reflection on the role of the world surf league”, Tiago Brant de Carvalho Falcão (Universidade de São Paulo, USP, São Paulo-SP) e Ricardo Ricci Uvinha (Universidade de São Paulo, USP, São Paulo-SP), a partir da exposição de iniciativas sustentáveis como: Sustainable Surf, Earth Technologies, The Plastic Pickup, Counter Current Art e The Cigarette Surfboard, apresentam reflexões sobre o papel da liga mundial de surfe na preservação da natureza. Para os autores, a sustentabilidade e a preservação da natureza, que fazem parte do estilo de vida do surfista, podem influenciar as novas gerações de forma a reverter a atual crise climática e ambiental pela qual passa o planeta.“Em busca de movimentos ausentes para motricidades emergentes: a relação entre Epistemologias do Sul e Motricidade Humana”, de autoria de Carlos Nolasco (Universidade de Coimbra, UC, Coimbra, Portugal), parte das Epistemologias do Sul, enquanto proposta de resgate de dimensões epistêmicas e humanas ausentes do espaço hegemônico, e apresentadas como alternativas ao esgotamento da modernidade, para propor uma análise crítica das dinâmicas sociais do desporto, através da operacionalização dos conceitos de sociologia das ausências e de sociologia das emergências, sugerindo a emergência de outro desporto que vá ao encontro da perspectiva da motricidade humana na assunção da complexidade e da transcendência do gesto desportivo.Pensar como o Profissional da área de Motricidade Humana se insere na era da simulação e se apropria dos recursos digitais para atualizar e dinamizar sua prática, representou a motivação para o ensaio “Motricidade (pós)humana e a abordagem sobre o corpo na era da simulação”, de Gisele Maria Schwartz (Universidade Estadual Paulista “Júlio de Mesquita Filho”, UNESP, Rio Claro-SP, Brasil). Caros Leitores,Inicia-se com este primeiro número da Revista CAFI – Contabilidade, Atuária, Finanças & Informação mais uma contribuição da PUC-SP à comunidade acadêmica, no cumprimento de sua missão de assegurar a liberdade de investigação, de ensino e de manifestação de pensamento, objetivando sempre a realização de sua função social, considerada a natureza e o interesse público de suas atividades.Vinculada ao Programa de Estudos Pós-Graduados em Ciências Contábeis e Atuariais da FEA/PUC-SP, que este ano comemora 40 anos de atividades ininterruptas, a CAFI é uma publicação semestral e propõe-se publicar artigos científicos e ensaios de professores, pesquisadores e alunos brasileiros e do exterior, em português, inglês ou espanhol, de caráter multidisciplinar na área de ciências sociais aplicadas, servindo como espaço para o debate de ideias de reconhecido rigor teórico, relevância intelectual e científica para comunidade acadêmica e sociedade, tanto nacional como internacional. A CAFI é editada em parceria com a Corporación Universitaria Remington da Colômbia.Este primeiro número da CAFI traz oito artigos, sendo cinco do Brasil e três da Colômbia, iniciando com isto a abertura para a internacionalização. Segue uma breve apresentação dos artigos.O primeiro artigo, de Kátila Oliveira Silva e Antonio Robles Júnior, intitulado Provisão para crédito de liquidação duvidosa (PCLD) calculada conforme as normas do BACEN e IFRS: comparação, buscou expor conceitos relacionados à inadimplência e PCLD, bem como as diferenças existentes entre as metodologias de cálculo da PCLD pelos métodos BRGAAP e IFRS. Para tanto, analisou o comportamento da PCLD dos quatro maiores bancos presentes no Brasil: Banco do Brasil, Bradesco, Itaú e Santander. Apesar de serem identificadas diferenças já esperadas no cálculo da PCLD realizado pelos dois métodos, concluiu que o método IFRS favorece as Instituições financeiras.O segundo artigo, intitula-se Relación entre el desempeño financeiro y las practicas de sostenibilidad de las empresas del sector cosmético y beleza de Colombia, de Lina María Maya Toro, apresenta o grau de correlação entre o desempenho financeiro das empresas envolvidas na indústria de cosméticos e beleza na Colômbia, com o desenho e implementação de políticas de sustentabilidade. Por meio de técnicas estatísticas, foi comprovada a hipótese de que uma boa prática na concepção e implementação de políticas de sustentabilidade em empresas desta natureza, melhora significativamente o seu desempenho financeiro.O terceiro artigo, de Amanda Torres de Azevedo Araújo e Marcus Vinicius Moreira Zittei, intitulado Impactos na convergência das normas internacionais de contabilidade de leasing para arrendatários, demonstrou os impactos na convergência à regra IFRS 16 com foco na contabilidade do arrendatário nas operações de leasing e o resultado das modificações propostas, bem como as mudanças nos indicadores financeiros, tais como: lucro antes dos impostos, EBITDA e nível de alavancagem financeira. Concluiu que a convergência é um caminho importante, dado à sua transparência, porém, certamente, continuará como pauta de futuras adequações entre os reguladores.O quarto artigo, intitula-se Caso: disenõ e implementación de la estrategia de intervención social en una instituición micro financiera en la Ciudad de Cali-Colombia, con un modelo institucional orientado en temas de protección y capacitación de los servicios no financeiros, de Victor Manuel Escobar Zuñiga, apresenta a experiência de uma instituição financeira da cidade de Cali, especializada em microcrédito, a qual foi base para a pesquisa. A política pública de bancarização da Colômbia estimula o fortalecimento do microfinanciamento e requer o desenvolvimento da educação financeira em prol de uma maior e melhor utilização dos recursos. Com base nesses princípios, a instituição analisada implementou a educação financeira como uma questão institucional dentro de seus programas estratégicos, gerando um impacto significativo entre seus clientes, uma vez que estes estão localizados em setores da cidade com menor receita econômica.O quinto artigo, intitula-se Caraterizacion de las prácticas de sostenibilidad en las empresas colombianas "caso sector financiero", de Maria Fanny Castro Arbeláez, analisou as boas práticas de desenvolvimento sustentável contido nos relatórios de sustentabilidade emitidos por empresas no setor financeiro colombiano, declaradas como casos de sucesso de sustentabilidade durante os períodos de 2011-2014. Concluiu que o setor financeiro colombiano tem praticado políticas de desenvolvimento sustentável com grande impacto na população, garantindo assim uma melhor geração de valor tanto econômico como social e ambiental para os grupos de interesse, que trabalham pela inclusão social para reduzir a pobreza e gerar melhores condições de vida para todos.O sexto artigo, intitula-se A presença da sustentabilidade na formação do administrador em universidades públicas, de Leonardo Fabris Lugoboni, Karen Rodrigues de Souza e Bárbara Stefáne Ferreira dos Santos, analisou as grades curriculares dos cursos superiores de administração de 12 faculdades de universidades públicas, visando compreender como as questões relacionadas à sustentabilidade são contempladas. Verificou-se que na maioria dos casos o tema é adicionado à grade tradicional dos cursos e não de forma transversal, de maneira integrada com outras disciplinas ao longo do curso, como deve ser desejável e possível.O sétimo artigo, de Luiz Fernando de Barros Scholz e Fernando de Almeida Santos, intitulado Estudo de caso: análise financeira da rentabilidade no transporte aéreo baseado em informações públicas e sua relação com o custo do petróleo no resultado operacional das cias. aéreas, apresenta uma visão crítica das cias. aéreas nacionais, demonstrando a forte concentração de receitas na operação das linhas domésticas (98%), bem como o impacto do custo do querosene de aviação, denominado de QAV1, na rentabilidade das mesmas.Por fim, o oitavo artigo, intitula-se Relação entre o relatório de auditoria com modificação e a troca de auditor independente em companhias listadas, de Marcos Reinaldo Severino Peters, Leda Honorato da Silva Reis e Lincoln de Jesus Peres, analisou todas as companhias listadas na CVM na data-base de 31/12/2016, totalizando 619 companhias. Foram identificadas 41 companhias com relatório de auditoria com modificação e concluiu-se que 26,83%, ou seja, 11 companhias trocaram seu auditor independente subsequentemente ao recebimento de um relatório de auditoria com modificação. El Instituto de Investigaciones en Educación de la Universidad Veracruzana se precia de tener una añeja tradición editorial, a la cual se buscó dar a un giro innovador en 2005, transformando la Colección Pedagógica Universitaria, con 30 años de trayectoria, en una nueva publicación cien por ciento electrónica, la CPU-e, Revista de Investigación Educativa.Con el fin de consolidar la CPU-e, desde sus primeros números se decidió apegarse a criterios editoriales que le otorgaran un sello de calidad y le permitieran tener acceso a índices, bases de datos y directorios que contribuyeran a su visibilidad. La meta original fue cumplir con los lineamientos de Latindex, pues a nuestro juicio, la claridad y los alcances de sus normas eran la guía idónea para cubrir los estándares indispensables en la presentación de los artículos académicos por publicar. De esta forma integramos a la revista elementos que ahora nos parecen evidentes pero que, en su momento, ignorábamos. Mediante esta dinámica de explorar los requisitos de inclusión de diversos índices y bases de datos, fuimos enriqueciendo el perfil de la CPU-e, al hacerlos propios mediante su adaptación a nuestras necesidades institucionales. Por lo que sucesivamente postulamos la revista y fue aceptada en: Latindex (catálogo y directorio), DOAJ, Redalyc, IRESIE y Dialnet.El avance más reciente fue la inclusión de la CPU-e en SciElo. Así como en el momento de su fundación fue la primera revista digital de la UV, ahora es la primera en ingresar a este índice, el de mayor fortaleza a nivel iberoamericano.La relevancia de SciELO radica en que, más allá de ofrecer a los lectores revistas a texto completo, recopila y proporciona datos bibliométricos que permiten medir el impacto de los artículos publicados en la región. El sistema SciElo ha ido evolucionando con el objeto de optimizar la recuperación de la información de cada uno de los elementos que integran un documento.En 2014, SciELO dio inicio a la adopción del estándar XML-JATS como esquema para las publicaciones que alberga. Tras un periodo de transición, en el que se abandonó el anterior esquema basado en HTML, el equipo de Scielo-México está llevando a cabo una extensa capacitación para editores, con el fin de descentralizar las tareas que conlleva implementar el nuevo modelo. En nuestro caso, asumir la responsabilidad de preparar los artículos y llevar a cabo su marcación bajo el nuevo estándar era una condición sine qua non para que la CPU-e fuera aceptada en este índice, una vez que ya se contaba con los requisitos académicos y editoriales que establecen sus normas.La riqueza del XML (eXtensible Markup Language) consiste en que se trata de un metalenguaje de marcación con el cual se asignan etiquetas para identificar los datos de un documento; a diferencia del HTML, cuyas etiquetas están enfocadas en la presentación de los datos, el XML está enfocado en el contenido. Por ejemplo, en HTML el título de un artículo estaría etiquetado así:<H1>Discapacidad y educación superior</H1>lo que indicaría que este texto debe desplegarse centrado, con un puntaje mayor y en negritas, pero sin dar información sobre el tipo de contenido de que se trata. En cambio, en el XML se marcaría como:<doctitle>Discapacidad y educación superior</doctitle>de tal suerte que los sistemas que lleguen a recabar la información de este archivo identificarán el fragmento como el título principal del artículo. La norma JATS (Journal Article Tag Suite) es la que define la estructura de un artículo en XML y los componentes que lo integran. De esta forma se pueden marcar todos y cada uno de los elementos bibliográficos que contiene un documento, haciendo posible su identificación inmediata y sin ambigüedades.Esta capacidad del XML es la que lo hace sumamente valioso para preservar y difundir artículos académicos, pues se suma a otra característica no menos importante, la interoperabilidad, que permite que este tipo de archivos sean leídos por una amplia variedad de dispositivos y sistemas operativos. A partir del XML también se pueden generar distintos formatos de archivo: PDF, ePUB y el mismo HTML, ahora enriquecido con nuevos metadatos.El nivel de detalle con que se realiza la marcación de cada uno de los elementos del artículo alcanza su punto más elaborado con la lista de referencias, como puede observarse a continuación:[ref id="r6" reftype="book"][authors role="nd"][pauthor][surname]Browne[/surname], [fname]M. Aunque recién en mayo de 2017 se puso en línea el primer número de la CPU-e en el portal de este índice, el proceso comenzó en noviembre de 2014. El Dr. Antonio Sánchez Pereyra, coordinador de SciELO-México, aprobó el ingreso de la revista en aquel entonces, y nos puso bajo la tutela de la Lic. Patricia Garrido Villegas, quien nos impartió los conocimientos pertinentes y nos proporcionó el software necesario para concretar la tarea. Debido a que llegamos justo en el momento de la transición, primero fuimos instruidos en el marcaje de archivos HTML y luego, en el de XML, lo que de forma inevitable dilató el proceso. El apoyo del Dr. Sánchez y la Lic. Garrido ha sido constante y muy cercano, mostrando un interés entusiasta por ver incluida nuestra revista en su plataforma, en tanto representamos, de alguna manera, esta nueva vertiente de editores autónomos que buscan forjar.Estamos conscientes de que apenas hemos dado los primeros pasos y que la tarea por venir es ardua, pues además de los números recientes que ya están en preparación, quedan por marcar los de los primeros 10 años. Pese a que la UV ha atravesado por momentos sumamente complejos en los años recientes, lo que ha dificultado que se destinen los insumos que se requieren para desempeñar de manera óptima las múltiples tareas académicas que se desarrollan en nuestra casa de estudios, el ánimo no disminuye. Abstract:
A 4ª Edição da Revista do CNMP tem por objetivo precípuo divulgar artigos jurídicos relacionados com as atribuições do Ministério Público brasileiro, com ênfase nas seguintes áreas: a) 20 anos de vigência da Lei nº 8.625/93, que instituiu a Lei Orgânica Nacional do Ministério Público e da Lei Complementar 75/93, que dispõe sobre a organização, as atribuições e o estatuto do Ministério Público da União; b) a atuação do Ministério Público na copa do mundo da FIFA-2014; c) a PEC nº 37, de 2011; e d) a atuação do Ministério Público na defesa dos direito fundamentais. O artigo “A atuação do Ministério Público no combate à corrupção na Lei 12.846/2013”, de Eduardo Cambi, Promotor de Justiça do Paraná, aborda a inserção da nova Lei no ordenamento jurídico, bem como os possíveis conflitos com as normas vigentes e reforça o papel do Ministério Público como instituição responsável pela proteção do patrimônio público. O artigo de Thiago André Pierobom de Ávila, Promotor de Justiça do Distrito Federal, intitulado “A atuação do Ministério Público na concretização do direito fundamental à segurança pública”, afirma a existência de um direito fundamental à segurança pública, pela análise da estrutura normativa desse direito e pelo reconhecimento das áreas nas quais o Ministério Público age para assegurar sua realização. Essas áreas estão ligadas à promoção da persecução penal, à impugnação judicial das situações de grave desestrutura e à fiscalização continuada no âmbito do controle externo da atividade policial. O artigo “A implementação e o controle das políticas públicas através do inquérito civil, recomendação, termo de ajustamento e da ação civil pública pelo Ministério Público do futuro”, de Silvio Roberto Matos Euzébio, Promotor de Justiça de Sergipe, traz a consideração de que o sistema normativo é integrado por normas (regras e princípios), procedimentos, e discurso argumentativo, bem como que as normas que prescrevem políticas públicas são dotadas de positividade concretizadora dos direitos metaindividuais. Por conseguinte, as políticas públicas estão sujeitas ao processo de exigibilidade e fiscalização ou controle quanto aos seus aspectos funcionais. Ao final, afirma que o Ministério Público tem papel fundamental na promoção dos instrumentos de defesa dos direitos metaindividuais, sem excluir outros órgãos , posto que dispõe de ampla apresentação e legitimação dos instrumentos de atuação , consoante estratégia inerente à atividade-fim do Parquet. No artigo intitulado “Unidade de julgamento, igualdade de tratamento e o juiz natural: entre ponderações, acomodações e adequações constitucionais”, o Procurador da República de Minas Gerais, Eugênio Pacelli, analisa a Ação Penal 470, focando-se nas definições constitucionais do juiz natural ou de origem. Trata, ainda, da competência originária do Supremo Tribunal Federal, no caso de foro por prerrogativa de função, bem como os critérios constitucionais e legais para o desmembramento ou não do processo. Para tanto, leciona sobre as regras de alteração de competência previstas no Código de Processo Penal, a saber, conexão e continência. O artigo “Derrotabilidade das normas-regras (legal defeseability) no direito das famílias: alvitrando soluções para os extrem cases (casos extremos)”, do Promotor de Justiça da Bahia, Cristiano Farias, examina a propalada bipartição das normas jurídicas entre as regras e os princípios, bem como afirma a inexistência de hierarquia normativa entre elas. Avalia, ainda, os princípios e a ponderação de interesses (balanceamento) aplicada no Direito das Famílias. Por fim, investiga a aplicação das normasregras e a excepcional possibilidade de derrotabilidade (superabilidade ou defeseability) nos extreme cases (casos extremos) caracterizados no âmbito das famílias, especialmente, nos casos de impedimento matrimonial com base no incesto; do direito real de habitação em favor do cônjuge ou companheiro sobrevivente; e da regra que estabelece a irrevogabilidade e irretratabilidade da adoção. O artigo do Promotor de Justiça de Sana Catarina, Onofre José Carvalho Agostini, e dos servidores Marcos Dagoberto Cardoso Delavi e Guilherme Brito Laus Simas, nomeado “Direitos fundamentais e a nova lei de organização criminosa (Lei 12. 850/13)”, delineia e explicita, embrionariamente, as principais inovações trazidas pela Lei n. 12.850/13, dentre elas, a evolução do conceito de organizações criminosas no ordenamento jurídico pátrio, a criação do crime autônomo, os meios de obtenção de provas e o procedimento criminal, fazendo uma leitura voltada aos direitos fundamentais. No artigo “Estupro de vulnerável: uma abordagem à luz da prioridade absoluta da infância e juventude”, os Promotores de Justiça do Rio Grande do Norte, Fausto Faustino de França Júnior e Wilmar Carlos de Paiva Leite Filho, discutem o tema do estupro de vulnerável, como sucessor normativo do chamado estupro por violência presumida, especificamente no ponto em que trata da vulnerabilidade pela idade da vítima, inferior a 14 anos, conforme alterações promovidas pela Lei 12.015/2009, e buscam a fixação de marcos hermenêuticos que partam do princípio constitucional da prioridade absoluta da infância e juventude, da tutela coletiva para a prevenção da pedofilia e da violência sexual. Defendem, ainda, a necessidade de uma visão à luz da doutrina da efetividade das normas constitucionais e da proibição da insuficiência, com o desiderato de transformação do quadro, ainda fortemente presente, de impunidade e de tolerância cultural a esse tipo de violência contra crianças e adolescentes, abordando-se também o tema do erro de tipo. O artigo do Promotor de Justiça de Minas Gerais, Eduardo Machado, denominado “Ministério Público, gestão social e os conselhos gestores de políticas públicas”, procura debater as interfaces entre a atuação do Ministério Público, responsável pela defesa do regime democrático, e os conselhos gestores de políticas públicas, buscando responder de que maneira aquela instituição pode contribuir para a efetividade desta. O autor parte da premissa de que o MP se encontra divido em duas vertentes de atuação, uma demandista – mais tradicional e que busca soluções através de ações ajuizadas perante o Poder Judiciário – e outra resolutiva – que se refere à atuação eminentemente extrajudicial e de aproximação aos conflitos sociais. Sob tal perspectiva, elege-se a vertente resolutiva como a mais adequada ao cumprimento dos objetivos da República Federativa do Brasil e à efetivação dos direitos fundamentais. A partir de então, desenvolve-se uma revisão de literatura sobre o paradigma da gestão social e suas categorias teóricas, notadamente a democracia deliberativa e a esfera pública, e dos próprios conselhos gestores de políticas públicas. Em seguida, é realizada a correlação entre a atuação do MP resolutivo e as faces formal, substancial e institucional do funcionamento dos conselhos gestores, a partir das possibilidades e limites dos referidos entes. No artigo “O novo conceito de democracia e o Ministério Público refundado: o Ministério Público como agente da democracia militante. A PEC 37 e as ameaças ao Parquet refundado. Novas posturas resolutivas do Parquet”, o Promotor de Justiça da Bahia, Pablo Antonio Cordeiro de Almeida, argumenta que o vocábulo “Democracia” é juridicamente polissêmico, o qual, hodiernamente, tem adquirido sentido mais amplo. Consequentemente, ampliando-se o conceito de democracia, avultam-se também as atribuições do Órgão incumbido de sua defesa: o Parquet. Expõe que a democracia substancial ou de três vértices, que somente se realiza com democracia formal e participativa (sem corrupção e com liberdade), com crescimento e desenvolvimento econômico-sustentável e com igualdade social (distribuição da riqueza), pressupõe instrumentos aptos e expeditos, além de agentes que possam induzir e fiscalizar a efetivação destes pilares. Revista do CNMP – n.4, ano 2014 7Apresentação Por fim, conclui que a Democracia é antes de tudo praxe (exercício), razão pela qual o MP, com seu agir, contribui para a consolidação da Democracia Militante. O artigo “Pena e punição no Brasil no século XIX”, do Ministro do Superior Tribunal de Justiça, Rogério Schietti, explora as sanções penais dispostas nas Ordenações Filipinas, no Código Criminal de 1830 e, ainda, no Código Penal de 1890, fazendo, ao final, uma análise comparativa entre esses dois códigos, relativamente a algumas penas em espécie, tais como, a pena de morte, a pena de açoites, a de prisão perpétua e a de galés, dentre outras. No artigo “Portais da transparência e gestão do conhecimento no Ministério Público”, dos Mestres em Engenharia e Gestão do Conhecimento, Hélio Santiago Ramos Júnior, Jane Lúcia Silva Santos e Marcus de Melo Braga, disserta-se sobre as iniciativas do CNMP em relação à regulamentação dos portais de transparência dos Ministérios Públicos, destacando-se a sua evolução histórica e normativa, além de contextualizarem o papel do Ministério Público neste cenário como defensor do regime democrático. Por fim, relatam algumas práticas iniciais de gestão do conhecimento que vêm sendo implantadas no Ministério Público. No artigo “A persecução penal em juízo pelo Ministério Público e seu constante desafio de não fragmentar o in dubio pro reo no processo penal”, o Promotor de Justiça da Bahia, Saulo Murilo de Oliveira Mattos, analisando a doutrina e jurisprudência, verifica que há um permanente desafio a ser vivenciado pelo Ministério Público no sentido de, ao deduzir em juízo sua pretensão acusatória (art. 129, inciso I, da Constituição federal), não esquecer que, no processo penal, é também órgão tutor de direitos e garantias processuais penais fundamentais, estando limitada sua pretensão acusatória aos reflexos práticos impostos pelo princípio da presunção de inocência ou não culpabilidade descrito no inciso LVII do art. 5º da Constituição Federal, especificamente no campo probatório (in dubio pro reo). Finalmente, mais uma vez, agradecemos a todos os membros e servidores do Ministério Público que, atendendo o chamado deste Conselho, enviaram seus artigos jurídicos para apreciação pela Comissão de Acompanhamento Legislativo e Jurisprudência.
